<ul><li>Yesterday, the central government issued orders for the transfer <keyword id="104347" type="PERSON" weightage="20" keywordseo="justice-S-Muralidhar">Justice S Muralidhar</keyword> from the Delhi High Court to the Punjab and Haryana High Court.</li><li>The timing of the transfer has sparked controversy, which came in mere hours of Muralidhar addressing the issue of FIRs being filed against right-wing leaders for delivering hate speeches.</li><li>He has been practising the law for 36 years, either as a lawyer or a judge, in addition to having a doctorate and publishing a book.</li></ul>Today is the last working day for Justice S Muralidhar as a judge at the Delhi High Court. Last night, the central government sent a notification for his transfer to the Punjab and Haryana High Court despite protests from the Delhi High Court Bar Association. “Your lordship has been an inspiration to the entire young bar. We hope we can live up to your example,” a young lawyer told Justice Muralidhar, according to <a href="https://www.livelaw.in/top-stories/you-are-an-inspiration-young-lawyers-tell-justice-muralidhar-on-his-last-day-as-delhi-hc-judge-153193">LiveLaw.</a> Even though the transfer has been recommended by the Supreme Court on February 12, the timing of the government’s orders has sparked controversy. It came in mere hours after Muralidhar <a href="https://www.businessinsider.in/india/news/indias-second-highest-ranking-law-officer-sees-no-urgency-in-a-case-on-delhi-violence/articleshow/74318695.cms">went up against Solicitor General Tushar Mehta</a> in a plea filed by social activist Harsh Mander.

 “We can’t let another 1984 scenario happen in this city, not under the watch of this court,” he said. Muralidhar also directed the Delhi police to decide on the matter of filing FIRs with respect to hate speeches made by right-wing politicians. Muralidhar also came to the rescue of victims of the <keyword id="4930213" type="PERSON" weightage="20" keywordseo="Delhi-Violence">Delhi violence</keyword>, the night before. During a midnight hearing, he issued directions to the Delhi Police to ensure that all injured people are granted safe passage to medical institutions and hospitals. Over three decades of courtroom drama Muralidhar has been practising law for over three decades. Starting off in September 1984 in Chennai, in three years he started to practice at the Supreme Court and the Delhi High Court. As an advocate, he worked on some notable cases — like addressing victims of the Bhopal Gas tragedy and arguing on behalf of the people displaced by the Narmada Dam project. In time he also served as counsel for the National Human Right Commission and the Election Commission of India. He was also awarded his Ph D by Delhi University in 2003. It was only 2006 that he was appointed as a judge at the Delhi court. Set to change things from the get-go, he refused to be addressed at ‘Your Lordship’ by lawyers. Furthermore, he was a part of the bench that ruled in favour of disclosing how many Supreme Court judges had declared their assets in response to an RTI. Over the years, he delivered a number of impactful judgements. In 2009, he was a part of the bench which initially repealed section 377, legalising homosexuality. He also convicted politician Sajjan Kumar for his involvement in the 1984 anti-Sikh riots and revoked the transit demand of activist Gautam Navlakha in the Bhima Koregaon case. He’s also an author. He wrote the book Law, Poverty and Legal Aid: Access to Criminal Justice which was published in August 2004. Calling it 'deplorable', Congress general secretary <keyword id="97274" type="PERSON" weightage="20" keywordseo="Priyanka-Gandhi-Vadra">Priyanka Gandhi Vadra</keyword> raised the issue of transfer of <keyword id="534893" type="PERSON" weightage="20" keywordseo="Justice-Muralidhar">Justice Muralidhar</keyword> on a day he came down heavily on the centre as his brother and Congress leader <keyword id="5268" type="PERSON" weightage="20" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword> brought in Judge Loya sarcastically whose circumstances of death created a political row. Priyanka tweeted: "The midnight transfer of Justice Muralidhar isn't shocking given the current dispensation, but it is certianly sad &amp; shameful." Making a case for independent judiciary, she went on to allege, "Millions of Indians have faith in a resilient &amp; upright judiciary, the government's attempts to muzzle justice &amp; break their faith are deplorable." Rahul Gandhi joined in as well by tweeting:" Remembering the brave Judge Loya, who wasn't transferred." Judge B.H. Loya was presiding over the Sohrabuddin Sheikh case, when he died in December 2014 at Nagpur under mysterious circumstances. The Ministry of Law and Justice on Wednesday transferred Justice S. Muralidhar of the Delhi High Court to the <keyword id="6363691" type="UNKNOWN" weightage="20" keywordseo="Punjab-and-Haryana-high-court">Punjab and Haryana High Court</keyword>. The transfer came on a day when a High Court bench headed by Justice Muralidhar passed a series of orders with regard to the violence in northeast Delhi and said that "another 1984-like situation cannot be allowed to happen in the city under its watch." As many as 27 people have lost their lives while over 200 have been injured after clashes between pro and anti-CAA protesters turned violent in northeast Delhi. The transfer order is now read in connection with his strong stance against the government. "In exercise of the power conferred by Clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India, is pleased to transfer Justice S. Muralidhar, Judge of the Delhi High Court, as a Judge of the Punjab and Haryana High Court and to direct him to assume charge of his office in the Punjab and Haryana High Court," read a notification of the Law Ministry released on Wednesday. Recently, the Supreme Court Collegium had recommended the transfer of Justice Muralidhar to the Punjab and Haryana High Court. Though the transfer was procedural but the day of the government's issuance of notification has now sparked off a political row.

This week, however, things took a violent turn compromising the peace and security of its citizens.  The issue of urgency When the bench started to discuss the issue of urgency, Mehta claimed ignorance. “I’m not aware of the facts, I need to do that first before making my submissions,” he said. Justice Muralidhar however pointed out that he was only asking Mehta’s opinion as an officer of the law — bearing in mind that thousands of people were exposed to videos of the speeches online and social media. 
 To this Mehta responded, “I haven’t watched the videos,” according to <a href="https://twitter.com/LiveLawIndia/status/1232567358218231808">LiveLaw</a>. Muralidhar cited concern and ordered for the clip of Kapil Mishra’s speech to be played in court so that everyone can watch it. Mehta tried one last Hail Mary claiming that he doesn’t watch television news before making his submissions.“Unfortunately, that's not the privilege that judges have,” quipped Muralidhar and continued to play the video. The police officer present in court was able to identify the Sub Inspector present in the video. As the court adjourned for lunch, reports came in of an intelligence officer found dead in Northeast Delhi. “We can’t let another 1984 scenario happen in this city, not under the watch of this court,” said Muralidhar when the court reconvened. Hate speeches The petition filed by Mander argues that hate speeches added fuel to fire. They flared up people against CAA protestors with communal slogans like, “Goli maaro gadaron ko” (shoot the traitors) and “Jai Sriram” (victory to Lord Ram).  At the time of filing the petition, the 10 people had reportedly died as a result of the violence in the Northeast districts of New Delhi. In less than a day, the death toll has nearly doubled. Over 180 are injured and languishing at hospitals.  When the hearing began at 12:30 pm, Mehta submitted that he had been authorised by the Lieutenant Governor (LG) of Delhi to appear. However, when the petitioner’s lead counsel Rahul Mehra argued that the LG can’t authorise any such action without the advice of the council of ministers, Mehta tried to defer the proceedings to tomorrow. As multiple cases are running across courts, the Supreme Court yesterday believed the situation was ‘urgent’. "This city has seen enough violence," concluded Muralidhar.
