The Delhi <keyword id="19900812" type="General" weightage="20" keywordseo="high-court" source="keywords">High Court</keyword> has refused to set aside the Central government's order blocking open-source messaging application '<keyword id="22332861" type="General" weightage="100" keywordseo="Briar" source="keywords">Briar</keyword>' in <keyword id="19900657" type="General" weightage="20" keywordseo="Jammu-and-Kashmir" source="keywords">Jammu and Kashmir</keyword> as it is suspected to be used by <keyword id="19900658" type="General" weightage="20" keywordseo="terrorists" source="keywords">terrorists</keyword> and could be a potential <keyword id="19968363" type="General" weightage="20" keywordseo="threat" source="keywords">threat</keyword> to <keyword id="19896999" type="General" weightage="20" keywordseo="national-security" source="keywords">national security</keyword>. The high court observed that in the matters of national security, principles of natural justice can be given a go-by. "The interim order has been reviewed by the committee constituted under Section 7 of the Blocking Rules and as stated earlier, the committee consists of top officials of the Government of India. The blocking orders have been passed for 14 applications/ softwares, including the software/ application of the petitioner herein as it was being used by the terrorists and their supporters to disturb the security and sovereignty of the country. "The application of the petitioner has been blocked only in Jammu and <keyword id="19896255" type="General" weightage="20" keywordseo="kashmir" source="keywords">Kashmir</keyword> and the same can be used in all other parts of the country. In view of the above, this court is not inclined to entertain the present writ petition. Accordingly, the writ petition is dismissed," Justice Subramonium Prasad said. Sublime Software Ltd, the petitioner, sought direction to the Centre to produce and publish the order passed by it under Section 69A of the Information <keyword id="19901571" type="General" weightage="20" keywordseo="technology" source="keywords">Technology</keyword> Act, blocking its open-source messaging application 'Briar' and also prayed for setting aside that order. It was stated that Briar operates on a technology in which a person can directly send a message to another person even when there is no internet connectivity. It added that the technology is crucial in times of emergency, natural calamities and catastrophic disasters in providing emergency healthcare and disaster management as it enables smooth communication between persons and authorities during times of distress. On the other hand, the Centre's counsel submitted that the software, which can work even when there is no internet connection, is suspected to be used by terrorists in Jammu and Kashmir. The application can be misused and can definitely be a potential threat to the national security, sovereignty and integrity of India, the Centre's counsel said. The high court in its order noted that rule 16 of the Blocking Rules provides that strict confidentiality shall be maintained regarding all the requests and complaints received and actions taken thereof. "This court can take judicial notice of the fact that decisions taken at the highest level and for the benefit of the security and sovereignty of the country can be kept confidential," it said.

Rajasthan, Uttar Pradesh saw most Internet shutdowns after Jammu and Kashmir in the last 10 years

<ul><li><keyword id="382594" type="PERSON" weightage="20" keywordseo="internet-access">Internet access</keyword> in <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword> continues to be throttled at 2G speeds despite demands of better speeds in order to access education and healthcare services during the coronavirus lockdown. </li><li>Lawyers told Business Insider that the issue of internet access in India’s troubled state is not about the ‘right to freedom’, but about the ‘right to life’. </li><li>The argument that 4G speeds in Jammu and Kashmir would facilitate terrorism implies that access to faster internet can’t be restored until terrorism is completely eradicated. </li></ul>Access to 4G internet in Jammu and Kashmir was shot down by the Supreme Court on Monday. Instead, they passed on the responsibility of restoring fast-speed internet access onto a committee that will determine the balance between ‘national security’ and ‘human rights’. <div type="Article" hostid="261" msid="75670549" title="India's Supreme Court won't allow 4G in Jammu and Kashmir⁠— despite petitioners' plea that it's essential for healthcare, education and business during the coronavirus lockdown" mstype="2" mssubtype="0"></div> Jammu and Kashmir had the face the longest internet shutdown in India’s history lasting 7 months — between 4 August 2019 to 4 March 2020 — after the <a href="https://www.businessinsider.in/jammu-and-kashmir-and-ladakh-will-now-be-two-separate-union-territories/articleshow/70531866.cms">Article 370 of the Constitution was abrogated</a> by the Indian government. Internet services have since been restored in a phased manner, however only at 2G speeds. “While the Supreme Court’s judgment appears to be based on the principle that no ‘fundamental freedom’ is absolute, this is a case of ‘right to life’,” Padmaja Kaul, a partner at IndusLaw, told Business Insider. <div type="image" title="kashmir3_edited" msid="75708345" hostid="261" caption="&amp;lt;p&amp;gt;Due to constant blockade of mobile phones and internet, landline or fixed line phones are of great demand. The coronavirus pandemic is only making things worse The petitioners argued that 2G internet services aren’t enough to fulfil the requirements that have now come up due to the coronavirus lockdown. Essential services — like education and medical consultation — now have to be conducted online, and slow internet speeds are subpar to meet those demands. <div type="image" title="kashmir6_edited" msid="75708450" hostid="261" caption="&amp;lt;p&amp;gt;Around 985 Jammu and Kashmir students studying in various colleges across Karnataka were ferried in BMTC buses from Byappanhalli to Chikbanawara railway station&amp;lt;/p&amp;gt;"></div> “The issue, essentially, boils down to whether the denial of access to the most efficient, convenient and potentially cheap mode of accessing healthcare services or education — that is through the use of 4G internet — is violative of the constitution. This, during a pandemic, must be a resounding yes,” Kaul explained. The counter-argument presented was that there is no report of anyone dying of COVID-19 due to internet restrictions, which according to Kaul, is akin to an ostrich hiding its head under the ground. “The Supreme Court, in innumerable decisions, has held that the right to health is a part of the right to life and that there is a constitutional duty on the State to ensure timely healthcare services,” she said. <div type="image" title="kashmir4_edited" msid="75708371" hostid="261" caption="&amp;lt;p&amp;gt;User access social media after authorities lifted ban allowing the people of Jammu and Kashmir to access it on 2G mobile internet till March 17. Petitioners argued that there was “no rational relation” between the two. Senior Advocate Huzefa Ahmadi even pointed out that in most cases of terrorism in the state, they were conducted in areas where there was no internet access, to begin with. “The court has refused to take a view if faster internet can be restored in J&amp;K in view of pandemic and held on to its view that the national security considerations prevail over other fundamental rights in view of the security circumstances of J&amp;K,” said Siddharth Mahajan, a partner at Athena Legal. <div type="image" title="kashmir5_edited" msid="75708402" hostid="261" caption="&amp;lt;p&amp;gt;Many Kashmiris residing in Bengaluru along with activists and volunteers gathered at Town Hall to protest against the shut down in Kashmir following scrapping of Article 370 and demanded that internet and mobile phne connections to be restored immediately in August 2019&amp;lt;/p&amp;gt;"></div> Data from the <a href="https://www.satp.org/datasheet-terrorist-attack/india/Jammu-and-Kashmir-fatalities-1998-2019">South Asia Terrorism Portal</a> shows that the incidence of terrorism was much higher before 2006 when the internet was slower and, even non-existent, in certain areas. “The logical extension of the government’s stand of curtailing 4G while terrorism is prevalent may lead to the absurd result that J&amp;K may never have access to 4G until and unless terrorism is completely eradicated from the valley,” added Kaul. The question of fundamental rights The Freedom on the Net <a href="https://freedomhouse.org/sites/default/files/2019-11/11042019_Report_FH_FOTN_2019_final_Public_Download.pdf">report</a> highlights that India is the second worst violator of internet user rights calling access to internet only ‘partly free’ in the country. “The nature of the fundamental rights in our Constitution is very interesting. Most rights — including the right to life and the freedom of speech, expression, etc. — are couched in negative terminology. That is, the state cannot deprive persons of such rights unless there are constitutionally permitted exceptions,” said Kaul. The opposition in court argued that there are aren’t any restriction on fixed-line connections, so eduction and healthcare services should not be hampered. The internet restrictions in the state have been enacted under the Temporary Suspension of Telecom Services (Public Emergency or Public Safety) Rules, 2017. “The said rules allow the government to regulate the temporary suspension of telecom services due to public emergency or public safety,” Kaul explained. However, the provision is meant to be for “temporary suspension” — not nearly a year. “The issue that needs to be highlighted is the proportionality in restricting access for such a prolonged period,” said Kaul. Internet access in Jammu and Kashmir isn’t about the ‘right to freedom’ — it’s about the ‘right to life’, according to lawyers

<ul><li>Prime Minister Narendra Modi addressed the nation late last evening on the Kashmir issue, but didn’t mention when the curfew would be uplifted. </li><li>Kashmiris continue to live in curfew, with no internet, no calls. </li><li>The UN Secretary General too has expressed his concern about the worsening of human rights in <keyword id="23412" type="CITY" weightage="20" keywordseo="Jammu-Kashmir">Jammu &amp; Kashmir</keyword>.</li></ul>For the last five days, Indians have been arguing, joking and debating the abrogation of Article 370, resulting in endless calls, and social media messages. But those who should have had a say in the matter, Kashmiris, are silent. Because, they have been silenced. The Union Home Minister Amit Shah announced in the Rajya Sabha that Article 370 is scrapped. And Kashmir has been on lockdown a day before the announcement, which is August 4. Since Sunday night, internet services have been suspended in Jammu &amp; Kashmir, with a curfew in place since Monday morning (August 5). And, Prime Minister Narendra Modi made no announcement on lifting it in an address to the nation <a href="https://www.businessinsider.in/narendra-modi-address-to-the-nation-live-updates-and-speech-highlights-on-kashmir-news/articleshow/70589852.cms">yesterday</a>, even as he doled out infrastructure and industry benefits. Modi however did promise that he would facilitate Eid celebration. But he did not say how, as the status quo remains in the valley. He did not speak about the communications blackout and transportation issues in the newly formed union territories. This is the case even as Muslims across the country are gearing up to celebrate Eid on August 12. Kashmiris are still not sure about their fate. Social media is filled with messages and pleas from Kashmiris living outside of Jammu &amp; Kashmir hoping for the safety of their family back home. Screenshots of messages are doing the rounds of students and professionals trying to reach out to their parents, but have no response. But the new found constitutional status is not on top of the minds of Kashmiris. A <a href="https://www.indiatoday.in/mail-today/story/kashmir-article-370-revoked-valley-faces-shortage-essential-items-due-curfew-1578458-2019-08-08">shortage of food</a> and other necessities is beginning to worry them as the curfew prevails. Reports say that people are unable to communicate with their neighbours as well. Over a 100 people have been arrested so far. That includes former chief ministers like Mehbooba Mufti, Omar Abdullah as well as Jammu and Kashmir People's Conference leaders Sajjad Lone and Imran Ansari. There is no word from the government on when they would be released, either. António Guterres, the UN Secretary General expressed his concerns over the plight of Kashmiris. A statement released on Thursday by the UN said, “The Secretary-General is also concerned overreports of restrictions on the Indian-side of Kashmir, which could exacerbate the human rights situation in the region.”

It’s been 5 days since Article 370 was scrapped but Kashmiris continue to live in the dark

<ul><li>India’s central government’s <keyword id="116246" type="ORGANIZATION" weightage="20" keywordseo="Department-of-Telecommunications">Department of Telecommunications</keyword> has issued a notice to the state governments to keep from implementing ‘unwarranted’ <keyword id="6471018" type="UNKNOWN" weightage="20" keywordseo="Internet-Shutdowns-in-India">internet shutdowns in India</keyword>. </li><li><keyword id="3944051" type="PERSON" weightage="20" keywordseo="Internet-Shutdowns">Internet shutdowns</keyword> in India have skyrocketed to being the highest in the world, with 40% of them occurring the volatile state of Jammu and Kashmir. </li><li>The DoT has asked the state governments to thoroughly ensure that they are following the parameters set by the Telegraph Act.</li></ul>The Indian government’s Department of Telecommunications (DoT) has issued a notice to its state governments warning against issuing an ‘internet shutdown’ in situations where ‘public emergency’ or ‘public safety’ are not in question. Those are the two clearly identified rules of the Telegraph Act that allows for the ‘temporary suspension of telecom services’. The parameters for internet shutdowns in India may be broad, but they are clear in their intent. Despite this clarity, internet shutdowns in India are the <a href="https://www.internetshutdowns.in/">highest in the world</a> with 130 shutdowns occuring in 2018 according to the internet shutdown tracker by the Software Freedom Law Center. That’s nearly double the amount from 2017 that stood at 79 internet shutdowns in India. Here’s how states manage to manage to overlook a basic law The Indian government is well aware of the problem and knows that in certain cases this could be treated as a violation of basic human rights. Especially in the a state like Jammu and Kashmir that has cumulatively lost its access to internet for <a href="https://sflc.in/sites/default/files/reports/Living%20in%20Digital%20Darkness%20-%20A%20Handbook%20on%20Internet%20Shutdowns%20in%20India%2c%20May%202018%20-%20by%20SFLCin.pdf">nearly a month</a> over the last four years. Of the total number of shutdowns this year, 40% of them happened in that state. The <a href="https://thewire.in/government/jammu-kashmir-has-lost-18-days-of-mobile-internet-access-over-last-four-years">reasons of revoking</a> citizens’ access to internet ranges from blocking access to social media to blocking off all telecom services in specific localities. But, in most cases it has been a statewide shutdown of the internet under the guise of protests, agitation and ‘precautionary measures’. Internet shutdowns have become a tool in the hands of state government and law enforcement authorities where they need a ‘quick-fix’ solution to ‘potentially’ volatile situation. And, in every scenario, there are arguments to be made on the legitimacy of the reasons by implementing an internet shutdown in India. Especially when you look at the example of the internet shutdown in the western state of Rajasthan, where the state government <a href="https://www.medianama.com/2018/08/223-rajasthan-orders-its-26th-internet-shutdown-in-2018-seconds-jk/">justified</a> it was to ‘prevent cheating during examinations’. Internet shutdowns in India have skyrocketed — but now the Indian government wants that to stop

<ul><li>On August 2, thousands of <keyword id="44352" type="PERSON" weightage="20" keywordseo="Amarnath-Yatra">Amarnath Yatra</keyword> pilgrims were asked to leave <keyword id="6354495" type="LOCATION" weightage="20" keywordseo="kashmir">Kashmir</keyword> immediately. </li><li>Since then, section 144 has been imposed, internet services have been suspended, political leaders like <keyword id="19464" type="PERSON" weightage="20" keywordseo="Omar-Abdullah">Omar Abdullah</keyword> and <keyword id="6375812" type="PERSON" weightage="20" keywordseo="mehbooba-mufti">Mehbooba Mufti</keyword> have been placed under house arrest. </li><li>Union Home Minister Amit Shah reportedly held a meeting to discuss the recent developments in Kashmir.</li></ul>On Friday (August 2) evening, the Indian government asked <a href="https://www.businessinsider.in/the-india-pakistan-border-in-kashmir-is-simmering-again-thousands-of-amarnath-pilgrims-have-been-sent-back/articleshow/70500904.cms">thousands of Amarnath Yatra pilgrims</a> to leave Kashmir immediately citing a terror threat. Since then, the state has been in confusion and chaos. Making matters worse is a series of speculation by both <a href="https://twitter.com/SankarshanT/status/1157987037938511872">news outfits as well as on social media </a>that has led to people fearing the worst and hoarding food and necessities. The radio silence from New Delhi, while building up troops in the valley, in the face of rampant speculation has added to the unease, particularly in the Kashmir valley. The speculations range from the abrogation of <a href="https://www.businessinsider.in/what-is-article-35a-of-the-indian-constitution-all-you-need-to-know/articleshow/69684605.cms">Article 35A</a> and <a href="https://www.businessinsider.in/what-is-article-370-of-the-indian-constitution-all-you-need-to-know/articleshow/69684790.cms">Section 370</a> of the Indian Constitution to the splitting up of the state into 3 parts – Jammu, Kashmir, and Ladakh. However, there has been no clear evidence to suggest any of the above. Let us look at all that has happened over the last three days that have intensified tensions in Kashmir leading to warnings from Pakistan too. Security beefed up The state of <keyword id="23412" type="CITY" weightage="20" keywordseo="Jammu-Kashmir">Jammu &amp; Kashmir</keyword> has been under President’s rule since December 2018 and now, section 144, which prohibits an assembly of more than 4 people in an area, has been imposed. "As per the order, there shall be no movement of public and all educational institutions shall also remain closed. There will be a complete bar on holding any kind of public meetings or rallies during the period of operation of this order. Identity cards of essential services officials will be treated as movement passes wherever required. However, there is no curfew in place as reported in a section of media," an official statement said as reported by IANS. The government had already deployed an additional paramilitary personnel of 10,000 in the state. According to <a href="https://timesofindia.indiatimes.com/india/security-deployment-at-vital-installations-in-kashmir-increased-political-parties-hold-meeting-top-developments/articleshow/70524096.cms">reports</a>, riot control vehicles too have been deployed in the state. <keyword id="7948376" type="UNKNOWN" weightage="20" keywordseo="leaders-under-house-arrest">Leaders under house arrest</keyword> The state’s top political leaders were placed under house arrest late Sunday night. Former Chief Minister Omar Abdullah took to Twitter to write about the imminent house arrest. “I believe I’m being placed under house arrest from midnight tonight &amp; the process has already started for other mainstream leaders. No way of knowing if this is true but if it is then I’ll see all of you on the other side of whatever is in store. Allah save us,” he wrote on Twitter. His rival, and a former Chief Minister, Mehbooba Mufti wrote, “How ironic that elected representatives like us who fought for peace are under house arrest. The world watches as people &amp; their voices are being muzzled in J&amp;K. The same Kashmir that chose a secular democratic India is facing oppression of unimaginable magnitude. Wake up India.” Life comes to a standstill Internet services have been suspended since Sunday night in the state. Meanwhile, education institutions in the state too have been asked to remain shut from today until further orders. Kashmir university exams which were supposed to take place from August 5 to 10 have been postponed, according to IANS. BSNL will be giving satellite phones to media persons at the steep price of ₹1 lakh a piece to file stories from the Valley, said an IANS report. However, according to ANI, schools and colleges will reopen today in Ladakh as restrictions under Section 144 CrPC have not been imposed in the region. Security meeting in Pakistan In Pakistan, Prime Minister Imran Khan called for a <a href="https://www.dawn.com/news/1498058/nsc-meeting-pakistan-to-respond-to-any-misadventure-aggression-by-indian-forces">meeting</a> of the National Security Committee to discuss the developments along the border and reportedly, react to any steps taken by the Indian military. While Pakistan alleged that the Indian army used cluster bombs along the Line Of Control, the Indian army has said it was to foil an attempt by Pakistan’s Border Action Team (BAT) to cross over to the Indian side of the border. "Pakistan army regularly attempts to push terrorists through infiltration and opens up with multitude of weapons to assist them. India, during numerous Directorate of Military Operations-level talks, has maintained the right to respond. Such responses are only against military targets and infiltrating terrorists who are aided by Pakistan Army. IITs and IISERs provide internships to 500 science students from Jammu & Kashmir

<ul><li>The state of <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword> no longer has a ‘special status’ in the Indian constitution.</li><li><keyword id="26604" type="PERSON" weightage="20" keywordseo="ladakh">Ladakh</keyword> will be a <keyword id="6356438" type="ORGANIZATION" weightage="20" keywordseo="Union-territory">Union Territory</keyword> (UT) without an assembly and Jammu and Kashmir will be a second UT with an assembly. </li><li>The state’s former chief minister, Mehbooba Mufti — currently under house arrest — stated that India is ‘terrorising its people’.</li></ul>The state of Jammu and Kashmir will no longer have a ‘special status’ in India with <keyword id="405091" type="PERSON" weightage="20" keywordseo="Article-370">Article 370</keyword> and <keyword id="2945985" type="PERSON" weightage="20" keywordseo="Article-35A">Article 35A</keyword> being scrapped by Presidential Order.  Kashmiri students have boycotted a lunch invite from the central government to express their protest, according to IANS. And, in spite of Modis promise that normalcy will return to the valley during the festival, food and ration shops are open only in certain areas. The same applies to ATMs as well. Nonetheless, the government is trying to ensure that people have round the clock access to basic amenities, like electricity and water, with staff on standby in case there’s a breakdown.
