Slamming the Indian raids on Chinese technology brand <keyword id="874458" type="General" weightage="100" keywordseo="xiaomi" source="Orion">Xiaomi</keyword>, Chinese state media outlet <keyword id="107898" type="General" weightage="50" keywordseo="global-times" source="Orion">Global Times</keyword> has said that the impression that Chinese and other foreign companies could be intentionally targeted and suppressed isn't something good or favourable for India. Chinese smartphone maker Xiaomi has come under intense regulatory pressure in the Indian market, which may raise concerns over Chinese companies' development in India. "While it is premature to claim whether India is intentionally targeting Xiaomi now, uncertainty surrounding Xiaomi's regulatory predicament should raise a red flag for India," said the report that came out late on sunday. The Enforcement Directorate (ED) has seized Rs 5,551.27 crore from Xiaomi Technology India Pvt Ltd, initiating action against the company for alleged contravention of provisions of the Foreign Exchange Management Act (FEMA), 1999. Reports also surfaced over the last weekend that Xiaomi's top executives faced threats of "physical violence" and coercion during questioning by the Indian officials. However, the ED issued a statement saying the allegations "are untrue and baseless". The Global Times report said that what has happened to Xiaomi could be seen as another example of India's crackdown on Chinese companies. "No one knows whether such an event of business hostility would lead to more Chinese companies there subject to growing regulatory scrutiny in the Indian market in the future," the publication added, admitting though that judging by the latest media reporting, it is fair to say that Xiaomi hasn't been able to communicate effectively with the Indian regulators. Meanwhile, the Karnataka High Court has stayed the ED's Enforcement Directorate's April 29 order under which it seized Rs 5,551.27 crore from Xiaomi. Justice Hemant Chandangoudar last week stayed the ED order, subject to the condition that the petitioner operates the bank accounts which are seized under the impugned order for the purpose of carrying out the day to day activities of the company. The report mentioned that India still faces the long-term challenge of developing its manufacturing sector, and attracting foreign investment is one of the priorities in moving toward this goal. "In this sense, it is of great importance for India to maintain normal and effective communication and coordination with Chinese investors," said the report. Judging from the global supply chains and the development of global trade relationships over the past years, "the biggest problem facing China and India is to consolidate and enhance their positions in the global industrial chain". "Prioritising competition over cooperation will cause unnecessary distraction and friction for both economies, hurting the growth prospects of the world's two largest emerging market powers," the report said, attacking the US and the West for "aspiring to see more competition and rivalry, rather than cooperation and partnership, between the two largest developing economies in Asia". The Global Times said in an editorial that after failing to gain any advantage by stirring up tension at the border with China, which drew stern responses from Chinese soldiers, "New Delhi has shifted its out-of-control jingoism toward a more vulnerable target - Chinese businesses operating in India". "Over the past several months, Indian authorities have banned dozens of Chinese mobile apps and raided local branches of many Chinese firms in shady 'tax investigations'," the editorial said late on Thursday. Chinese telecom giant <keyword id="110306" type="General" weightage="20" keywordseo="huawei-technologies" source="Orion">Huawei Technologies</keyword> confirmed earlier media reports that Indian tax authorities raided multiple offices of the firm and questioned its local employees. In a major relief to major tech giant <keyword id="2210169" type="General" weightage="50" keywordseo="xiaomi-india" source="Orion">Xiaomi India</keyword>, the <keyword id="6371973" type="General" weightage="20" keywordseo="karnataka-high-court" source="Orion">Karnataka High Court</keyword> has permitted it to take overdrafts from banks and make payments. However, the court has excluded the payment of technology royalty. Vacation Judge Justice S. Sunil Dutt Yadav on Thursday also extended the interim order till May 23 and stated that the matter is now between the banks and the petitioner company. The court had given conditional stay on the order given by the Enforcement Directorate (ED) on April 29 to seize a whopping Rs 5,513.3 crore amount. The ED has taken the step after invoking the <keyword id="88944" type="General" weightage="50" keywordseo="foreign-exchange-management-act" source="Orion">Foreign Exchange Management Act</keyword>, 1999. Senior advocate S. Ganeshan argued that <keyword id="874458" type="General" weightage="100" keywordseo="xiaomi" source="Orion">Xiaomi</keyword> India was being targeted as it is a Chinese company and other companies are allowed to make payments of technology royalty. Nargund said that the authorities have no complaints if Xiaomi is agreeable to keep the seized amount in the bank and use the remaining amount. He brought to the notice of the court that on April 24 and 29, before the ED passed the order to seize Xiaomi's bank accounts, there was a transfer of around Rs 1,500 crore from the company's bank accounts as per the available information. However, Xiaomi is maintaining that royalty payments made to three companies abroad would not violate the FEMA Act. Companies are trying to reduce their dependence on China by identifying other countries to source from.
