TRAI has issued new guidelines based on suggestions from the <keyword id="19912439" type="General" weightage="20" keywordseo="department-of-telecommunications" source="keywords">Department of Telecommunications</keyword> (DoT) to curb fraudsters from porting out mobile connections using the SIM swap scam. The new guidelines will come into effect from July 1, 2024. What is MNP? Mobile Number Portability or MNP is a facility that enables users to easily switch from one telecom operator to another, without having to change their mobile number. This allows the user to port out of an operator and move to another if they are not happy with the services offered. MNP was initially introduced in Haryana in November 2010 and a national rollout began in January 2011. Changes to MNP As per the latest amendment, users will not be able to request for allocation of a Unique Porting Code (UPC) that is needed to transfer the mobile connection from one operator to another if there has been a SIM swap or replacement in the last seven days. This is essentially a cooldown you will have to complete before you can port to a different network provider after getting a new physical SIM. Additionally, once you have ported your SIM, you will have to wait for 90 days before you can port again. While the regulatory body has not revealed any information about how the SIM swap scam is happening, it reportedly usually happens when users get a new SIM or place a request to port their SIM. TRAI is also considering DoT’s recommendation to include demographic details matching before allowing the user to port to a new telecom operator. What is a SIM Swap scam? As the name suggests, SIM swap scam involves the scammer getting access to your SIM, either with the help of someone at the mobile service provider or through other means. The scammer often convinces the network operator to activate a SIM card they possess, gaining control of the victim’s mobile number. This allows them to gain access to all calls and text messages that the victim may receive, which is important in this day and age where all accounts are linked to your phone number. Once the scammer gets access to the victim’s mobile number, they use it to gain access to their bank account and steal money. Mobile Number Portability revamped to reduce SIM swap frauds – Here are the new rules

New Delhi, <keyword id="175577" type="General" weightage="20" keywordseo="commercial-pilot-license" source="Orion">Commercial pilot license</keyword>s will now be valid for ten years, with the government amending rules as part of efforts to further improve ease of doing business in the aviation sector. Till now, the validity of Commercial Pilot License (CPL) was for five years and after completion of that period, it had to be renewed. The civil aviation ministry amended the Aircraft Rules, 1937. Among various changes made, the validity of licenses in relation to Airline Transport Pilot License (ATPL) and CPL holders has been increased from five years to ten years. "This change is expected to reduce administrative burden on pilots and aviation authorities like DGCA, promoting a more streamlined and efficient licensing process," the ministry said in a statement on Monday. Besides, rules have been amended to address concerns related to the display of lights in the vicinity of an aerodrome. It has also been clarified that the term 'light' encompasses lantern lights, wish kites, and laser lights. Also, the government's jurisdiction over those exhibiting such lights has been extended from 5 kilometres to 5 nautical miles around an aerodrome. "It is made explicit that the government possesses the authority to take action against individuals displaying lights that disrupt the safe operation of aircraft or pose hazards to the operating crew. "Should such lights remain unattended for 24 hours, the government is empowered to enter the location and extinguish them," the ministry said. Simultaneously, the matter should be reported to the relevant police station for legal action under the Indian Penal Code (IPC). When the source of the observed light is unidentifiable or if it shifts locations, the airport or airline operator is obligated to promptly report the incident to the local police station, initiating potential criminal proceedings. Another amendment is that the requirement for validation of foreign licenses has been removed. "This change signifies aligning the regulations with the evolving needs of the aviation sector," the ministry said. Further, the requirements related to continued competence for <keyword id="6414849" type="General" weightage="80" keywordseo="air-traffic-controller" source="Orion">Air Traffic Controller</keyword> (ATC) license holders have been liberalised. According to the ministry, this change offers increased flexibility to accommodate situations with limited movements or watch hours. ATC license holders must complete a minimum of ten hours of simulated exercises, including emergencies. Subsequently, they must undergo a skill assessment for their respective rating within ten consecutive days of commencing these exercises, it said. The ministry said the amendments to the Aircraft Rules, 1937, notified on October 10, mark a crucial shift in promoting ease of doing business and ensuring safety and security within the aviation sector. India is one of the fastest growing aviation markets in the world. Airlines are expanding their aircraft fleet and will be hiring more pilots to cater to rising air traffic demand.

Govt amends aircraft rules; commercial pilot licenses to be valid for 10 years

The grievance officer will be required to acknowledge a complaint filed by a user within 24 hours and dispose of the complaint within 15 days from the receipt of the complaint. The grievance officer will also be required to acknowledge and perform directions given by the central government, the courts or any competent authority. The Indian government may soon have more control over how social media companies moderate content and block users

The government has approved the production-linked incentive (PLI) scheme for <keyword id="94769" type="General" weightage="20" keywordseo="drones" source="Orion">drones</keyword> and drone components for implementation during the current year (2022-23) till 2024-25 with an outlay of Rs 120 crore. Based on the consultations/meetings with the stakeholders, including the industry representatives and the concerned departments, the operational guidelines of the PLI scheme for drones and drone components have been finalised. A statement from the <keyword id="149609" type="General" weightage="100" keywordseo="ministry-of-civil-aviation" source="Orion">ministry of civil aviation</keyword> (MoCA) said that the objective behind this scheme is to incentivise the manufacturing of drones so as to make them self-sustaining and globally competitive. The statement said in order to make the country a global hub for the research and development, testing, manufacturing and operation of drones under the Atmanirbhar Bharat Abhiyan, the liberalised <keyword id="2730972" type="General" weightage="20" keywordseo="drone-rules" source="Orion">Drone Rules</keyword>, 2021, was released to create a growth-oriented regulatory framework for drones. To facilitate further growth, the government said it approved the PLI scheme for drones and drone components in <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword>. Some of the operational guidelines which were notified for the stakeholders and the public were based on the definitions of the companies; eligibility; application and online portal; project management agency (PMA), empowered group of secretaries (EGoS) and the Competent Authority; approval under PLI and determination of baseline and calculation and disbursement of incentives. These applicants for the scheme are the companies registered in India that are manufacturing -- drones and drone components. The manufacturing can be carried out at one or more locations in India. According to the statement, the target segment covers drones and drone components. Drone components include airframe, propulsion systems (engine and electric), power systems, batteries and associated components, launch and recovery systems, communication systems, cameras, sensors, detect-and-avoid system, and software for drone and drone components, among others. In terms of applications, the statement said it should be with supporting documents and an application fee. Application acknowledgement date is the date on which it is acknowledged by the ministry after carrying out initial scrutiny. The application approval date is the date on which, based on an application, approval under the scheme is issued by the PMA. According to the guidelines, the scheme will be implemented through a nodal agency. Such nodal agency shall act as a PMA and will be responsible for providing secretarial, managerial and implementation support and carrying out responsibilities as assigned by the ministry from time to time. The PMA would be responsible for the appraisal of applications and verification of eligibility, examination of claims, a compilation of data, regarding the progress and performance of the scheme and to keep a check on any diversions arising out of any change in accounting policy or duplication of benefits on account of the same activity under different PLI schemes. The scheme shall have a provision for audit by an external auditor (chartered accountant or cost accountant). The EGoS will conduct periodic reviews of eligible companies with respect to their investments, employment generation, production and value addition under the scheme. It may revise incentivise rates, ceilings, and eligibility criteria as deemed appropriate during the scheme's tenure. The statement from the ministry said claim for disbursement of incentive shall be filed on an annual basis by the applicant within 12 months from the end of the financial year for the claims pertaining to FY22 (2021-22) and within six months from the end of the financial year to which the claim pertains for remaining tenure of the scheme. Applicants will be required to submit claims for disbursement of incentives to the PMA for claiming incentives under the scheme. Applicants must ensure that the claims are complete in all respects and accompanied by all the documents required as per the format prescribed. PMA will have to examine the disbursement claims as submitted by an applicant. The statement also said the PMA shall process claims for the disbursement of incentives and make appropriate recommendations to the Competent Authority. It also said the disbursement of incentives may be in the form of Direct Bank Transfer or through any other mechanism of adjustment in the name of the applicant only. In case of excess claims disbursed, the applicant shall reimburse MoCA for any incentive amount refundable along with interest calculated at three years. The PMA will submit budgetary requirements to MoCA as a consolidated amount on a quarterly basis. The statement also said that all approved applicants shall be required to furnish self-certified quarterly review reports within 30 days from the end of each quarter. The ministry also said these guidelines may be amended or modified at any time during the continuance of the scheme. Any dispute arising out of any conditions stipulated in the norms, selection of proposals and issues during the implementation under the scheme will be subject to courts/tribunals having jurisdiction under Delhi. Citing third-party data, the survey said that the e-commerce industry in India is expected to cross USD 350 billion by 2030 and called for the need to educate users on the safe use of e-commerce platforms. "The rise of e-commerce is constrained by inadequate skills required for online selling, such as cataloguing. <keyword id="22505774" type="General" weightage="20" keywordseo="data-privacy-issues" source="keywords">Data privacy issues</keyword> and increasing online fraud have turned out to be the most significant hurdle in the growth of e-commerce in India. It becomes imperative to educate users on the safe use of e-commerce platforms," the survey said. The survey mentioned that India's e-commerce market has gained significant momentum during the past few years, owing to technological advancements, evolving new-age business models coupled with government initiatives like the Digital India program, UPI, One District - One Product (ODOP), Open Network for Digital Commerce (ONDC), new foreign trade policy, easing of FDI limits and Consumer Protection (E-Commerce) (Amendment) Rules 2021. It has identified data privacy and <keyword id="19906883" type="General" weightage="20" keywordseo="cybersecurity" source="keywords">cybersecurity</keyword> as critical concerns in the <keyword id="22505776" type="General" weightage="20" keywordseo="digitisation-of-services" source="keywords">digitisation of services</keyword> in the country and called for adopting strong security measures, compliance with privacy regulations, and innovation, among others. However, the government has given Twitter one last opportunity to comply with the new Information Technology (IT) rules. According to a <a href="https://economictimes.indiatimes.com/tech/technology/twitter-india-given-last-chance-to-follow-it-rules/articleshow/92532677.cms">report</a> by Economic Times, the government has warned Twitter that it will lose its intermediary status if it does not comply with the country’s IT rules. The Ministry of Electronics and Information Technology (MeitY) has taken this step as Twitter has repeatedly failed to comply with content take-down notices issued under the IT Act. This is due to “repeated failures to act on the content take-down notices sent under Section 69 A of the IT Act,” an official familiar with the matter told ET. The government, in its notice, has mentioned that Twitter failed to comply with notices sent on June 6 and 9. “Despite repeated notices and chances being given to them to act, Twitter remains in violation. Therefore, appropriate action is being taken. All intermediaries that operate in India must follow the IT Rules in letter and spirit,” a senior official added. MeitY has also warned Twitter that if it continues to violate the IT Rules, it will have to face significant consequences under the IT Act, including the loss of immunity available to intermediaries. “If Twitter Inc. continues to be in violation of these Directions and therefore the IT Act, significant consequences under the IT Act shall prevail.” Consequences may include “loss of immunity as available (to) an intermediary under subsection (1) of section 79 of the IT Act and (will be) liable to punishment to offenses as prescribed in the IT Act 2000.” <cmsannotation type="cmsannotation" annotationid="What is an intermediary?" comment="subhead" text="What is an intermediary?">What is an intermediary?</cmsannotation> The amended IT Rules have granted social media platforms the tag of intermediaries. If the company loses its intermediary status, it will be equally responsible for unlawful content posted on its platform as the person who has posted it. Do note that this is not the first time the Indian government has threatened Twitter about it losing its intermediary status. Chennai, Tamil Nadu's ruling <keyword id="19897149" type="General" weightage="20" keywordseo="dmk" source="keywords">DMK</keyword>, a key constituent of the INDIA bloc, in its manifesto released on Wednesday promised to repeal the Citizenship Amendment Act, 2019 if the opposition alliance wins the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> polls. Restoration of statehood to Jammu and Kashmir and holding polls there, scrapping the New Education Policy 2020, slashing fuel prices, annulling Article 361 of the Constitution that provides protection to governors from legal action and appointment of Governors following consultation with Chief Ministers, were among the key promises made by the DMK. The recommendations of the M S Swaminathan committee will be adopted to ensure that MSP for agricultural products "is set at total production cost plus 50 per cent," the DMK said. Also, it announced that if voted to power, the INDIA bloc will withdraw the Agnipath scheme and reintroduce "permanent recruitment service" in the Indian Armed forces. "From now on, population census, including caste-wise census and census concerning people below the poverty line, will be conducted by the Union government once every five years simultaneously." The DMK will firmly insist on the removal of Article 356, which allows the dismissal of duly elected state governments and imposition of President's rule. The Congress party's ally in Tamil Nadu said that "new constraints" on States' borrowing capacity, imposed by the union government beyond the limits in each state's FRBM-equivalent Act will be eliminated. "A recommendation to share cess revenues with states will be made. It will be proposed that the Finance Commission increase the horizontal devolution of tax revenue (to all States together) from 42 per cent to 50 per cent." The Union government's financial contributions to states will be based on the income tax and GST collected in those states. Thus, financial contributions will be assured based on the taxes collected within each state. The finance provided to states will be permanently determined based on the 1971 population. A 33 per cent reservation for women in Parliament and legislative assemblies will be implemented immediately. "DMK will insist that the Union government enact a law providing menstrual leave to women, emphasizing the journey towards gender equality." Petrol and diesel prices "will be set at Rs 75, Rs 65 (per litre)" and cooking gas cylinders shall be made available at Rs 500 (per cylinder). "The introduction of the Uniform Civil Code will be strictly prevented" to preserve India's secular nature as stated in the Constitution's preamble. "The 2019 CAA law will be repealed, and all minorities will be treated equally without any discrimination. The recommendations of the Sachar Committee for the improvement of the lives of Muslims and other minority communities will be implemented." Facilitation will be provided for <keyword id="21027983" type="General" weightage="20" keywordseo="sri-lankan-tamil" source="keywords">Sri Lankan Tamil</keyword> refugees to get Indian citizenship. Assistance will be provided to those who wish to return to Sri Lanka. Also, the manifesto said efforts will be made to implement reservation for minorities at the all-India level, similar to Tamil Nadu. "The financial assistance previously provided to minority educational institutions has now been stopped. Action will be taken to resume this assistance." For "political" reasons, funding from foreign countries to non-governmental organisations (NGOs) has currently been stopped. "The Foreign Exchange Regulation Act will be properly amended, and measures will be taken to ensure these financial aids continue to reach NGOs without any problems." The proposal of 'One Nation, One Election' will be abandoned, and for the allocation of Lok Sabha seats to states, the current practice, based on the 1971 census will continue. All "people-unfriendly" laws introduced by the BJP government over the last 10 years will be reviewed immediately by the INDIA alliance government. The "labour-hostile laws" introduced by the BJP government will be "reformed." Through the Employees' Provident Fund (EPF), the Union government will ensure a minimum pension of Rs 5,000 per month. The number of working days under the Mahatma Gandhi National Rural Employment Guarantee Act will be increased from 100 to 150 days. "A wage of Rs 400 will be provided across states/ union territories nationwide." Disbanding the current NITI Aayog, set up by the BJP regime and establishing again the Planning Commission to draft plans based on the requests of state governments is another assurance the DMK has made. "Measures will be taken to reclaim Kachchatheevu to ensure India's security and to protect the welfare of the fishermen." A mandatory "cooling-off period" of 2 years will be introduced for retired judges and secretaries before they could join private companies or political parties, the manifesto said. Waiving loans and interests for farmers in nationalised and scheduled banks, waiver of educational loans for students, monthly entitlement of Rs 1,000 for all women in every state and formation of <keyword id="21027984" type="General" weightage="20" keywordseo="state-development-council" source="keywords">State Development Council</keyword> by including Chief Ministers were among the promises made by the DMK. Exemption for Tamil Nadu from the NEET exam and complete removal of toll booths on national highways, forms part of poll promises of the Dravidian party. Further, the DMK said amendments will be made to relevant laws to ensure that state governments, elected by the people, appoint Vice-Chancellors to state-run universities, rather than Governors. Stopping government's divestment from public sector enterprises, implementing the Sethusamudram project, law to ban online gambling, setting up a <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> branch in Chennai, providing statehood for <keyword id="19901639" type="General" weightage="20" keywordseo="puducherry" source="keywords">Puducherry</keyword>, equal funding for all state languages including Tamil, were among the host of other promises made by the DMK. Establishment of Tamil departments in varsities and stopping construction of <keyword id="19950851" type="General" weightage="20" keywordseo="mekedatu" source="keywords">Mekedatu</keyword> dam were also promised by the DMK. "The <keyword id="19996334" type="General" weightage="20" keywordseo="vishwakarma-scheme" source="keywords">Vishwakarma Scheme</keyword>, introduced by the BJP government to encourage caste-based occupations, will be restructured on the basis of social justice."

DMK vows to repeal CAA if INDIA bloc is voted to power

An industry group called Asia Internet Coalition (AIC) representing US-based <keyword id="1781932" type="General" weightage="100" keywordseo="big-tech" source="Orion">Big Tech</keyword> firms have urged <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword>'s <keyword id="3428254" type="General" weightage="50" keywordseo="ministry-of-electronics-and-information-technology" source="Orion">Ministry of Electronics and Information Technology</keyword> (MeitY) to make changes in the proposed amendments to the country's new IT Rules, 2021 which would "negate the government's commitment to ease of doing business". In a letter to the <keyword id="296566" type="General" weightage="80" keywordseo="it-ministry" source="Orion">IT Ministry</keyword>, the coalition that represents <keyword id="6354427" type="General" weightage="50" keywordseo="apple" source="Orion">Apple</keyword>, Meta, Google, Amazon, Twitter, and Spotify, among others, said that the proposed changes in the new IT Rules 2021 would affect continuity in business operations for all intermediaries that have made significant investments in the country in regard to technology, workforce, and other resources. The coalition said that intermediaries, as conceived under Section 79 of the IT Act, only provide a technology platform or a computer resource as a service to the user. "It is ultimately the user who determines the nature of content to be communicated or transmitted on the platforms/computer resources operated by the intermediaries. Given this, it may be more beneficial to impose mandates prohibiting the dissemination of certain types of content on the user itself," it argued. The republished draft by the IT Ministry has revealed a plan to form an appeals panel that can reverse content moderation decisions by Big Tech companies. The new IT rules also require big social media platforms to help the government trace the originator of messages in special cases. The coalition said that the MeitY should allow industry to adopt a self-regulatory grievance redressal mechanism as an alternative to the Grievance Advisory Committee (GAC). "An industry-led self-regulatory mechanism will enable businesses to adopt best practices and ensure long term solutions by identifying trends and gaps. In this regard, we request MeitY for a period of at least six months to implement such a self-regulatory mechanism," the group said. The letter to the IT Ministry came as Indonesia, a country with nearly 28 crore population, forced Meta Platforms and Google to abide by new rules for Big Tech which gives authorities the power to block social media applications and online sites. Facebook, Instagram, and WhatsApp signed up for new rules before the Wednesday deadline. The AIC said that it further recommend these new requirements - deadlines of 24 hours to acknowledge requests to block or suspend a user, or remove information relating to Rule 3(1)(b), and would shorten complaint redress periods to 72 hours for certain content - be limited to intermediary services that have a demonstrated propensity for virality. "These obligations should only attach to services or parts of services that enable sharing of material to all end users, and where the intermediary reasonably knows, based on past experience, that there is a propensity for material to be amplified or accessed virally on the service," the letter argued. The coalition aimed to draw the IT Ministry's attention to the fact that a single instance of non-compliance by the intermediary can lead to loss of safe harbour protections under the IT Act. "We request MeitY to consider providing clarity on the manner in which 'due diligence, privacy and transparency' expectations of users must be met over and above existing compliances already present in Indian law," it added.
