While the exact causes of asthma remain complex and varied, this new study underlines that PM2.5 pollution is a significant risk factor. The study brings together insights from 68 epidemiological studies conducted across 22 countries, spanning regions from North America to South Asia. Children are disproportionately affected; a 2019 report indicated that approximately 6% of children aged 1 to 5 in India show asthma symptoms. Air Quality Alert: Nearly 30% of asthma cases tied to fine particulate matter exposure from bad air

The upcoming Digital Personal Data Protection <keyword id="19032" type="General" weightage="100" keywordseo="bill" source="Orion">Bill</keyword> will drive "deep behavioural changes" among those platforms in <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword> that have for long exploited or misused personal data, <keyword id="6357801" type="General" weightage="50" keywordseo="union" source="Orion">Union</keyword> minister <keyword id="205969" type="General" weightage="50" keywordseo="rajeev-chandrasekhar" source="Orion">Rajeev Chandrasekhar</keyword> has asserted. In an interview to PTI, the minister of state for IT and electronics also sought to allay concerns around the issue of government-appointed fact check body, saying the move is not about censorship at all, rather it gives the Centre an opportunity to clarify and respond to any <keyword id="535763" type="General" weightage="80" keywordseo="misinformation" source="Orion">misinformation</keyword> related to it, something that is critical in a democracy. Misinformation, he said, is not to be confused with right to free speech. The minister noted that misinformation tends to travel 10-15 times faster, and reaches an audience 20-50 times more, than truth. He emphasised that it is absolutely critical that in a democracy if someone says something false about the government, to create hatred, to incite violence, or to just create mistrust, "the government must have an opportunity to say no, this is not true". "So there is no censorship, there no restriction on free speech. This is simply about saying what is patently false, is patently false. And that is certainly not to be confused or deliberately distorted to imply that this is a crackdown on free speech," Chandrasekhar said. The minister's comment assumes significance as the decision to notify an entity that will flag false information posted online pertaining to the government has raised concerns in some quarters on whether it gives government absolute powers. "I think there is some misunderstanding about what it is we are trying to do," the minister said when asked about the issue. "Misinformation is expressly an area that has already been prescribed in the rules as an area that platforms have to do significant work in moderating misinformation if they are to enjoy Section 79 protection. It is already mandated in the rules of October 2022," he said. Rather, the fact check unit aims to help platforms in identifying false content posted about the government. "It is not an opinion. It is not about saying that we will create another narrative about the government," Chandrasekhar added. On the digital personal data protection (DPDP) bill, which will be introduced in the coming session of <keyword id="6354721" type="General" weightage="50" keywordseo="parliament" source="Orion">Parliament</keyword>, the minister said the draft legislation has undergone a lot of consultation and is designed as "a truly world class piece of legislation". "I have absolutely no doubt that the DPDP Bill will create deep behavioural changes among platforms in India who have for long exploited and misused personal data," the minister said. At the same time, those who have played fair will not get affected, and will continue to do the right thing, he observed. "Those who have done it (misused data), tracked consumers, used cookies they certainly will have to go though deep behavioural change... Those who are already doing it right, have nothing to fear. But those who have, in a sense, lived off this model of exploitation will certainly have to reconsider," minister said. He expressed hope that the bill will come up in the Monsoon session of Parliament. The draft bill - which has seen an overhaul after its withdrawal in August last year - details the citizen's rights on personal data, with provisions that makes entities handling personal data accountable for managing it with safety and security in a responsible manner. "The purpose of this bill is to provide for the processing of digital personal data in a manner that recognises the right of individuals to protect their personal data, the need to process personal data for lawful purposes and for other incidental purposes," an explanatory note of the draft bill said. The proposed data protection legislation allows the transfer and storage of personal data in some countries while raising the penalty for violations. The proposed legislation stipulates consent before collecting personal data and provides for stiff penalties of as much as Rs 500 crore on persons and companies that fail to prevent data breaches including accidental disclosures, sharing, altering or destroying personal data. On being asked about Meta being fined a record-breaking USD 1.3 billion recently by European Union regulators for violating EU privacy laws, and whether India too can look at large financial deterrants for Big Tech for non-compliance of laws, the Minister said idea is not about competing with the EU on size of penalties. "I don't think we are in the business of competing with the EU in terms of the size of the penalty, but the formulation of penalties in this Bill is sufficient to incentivise every data fiduciary or any platform to behave correctly, to follow the law, and do the right thing," he said. The days when platform could exploit the data of consumers is fast coming to an end, he said, adding there are many powers under the bill that have been given to the Indian consumer to interrogate, search, check what data the platforms have. "...and I think certainly it's a balance of protecting the consumer rights, as well as continuing to allow innovation and investments," the minister said. On WhatsApp spam call issue, Chandrasekhar said that the government has called out to WhatsApp and other messenger companies about the problem and emphasised that it is unacceptable. "They have responded with alacrity and responded very quickly. They are searching out many solutions. We have also asked them to give to us what are the overseas telecom carriers from where these originate, so that we can talk to BSNL, and to our own <keyword id="150664" type="General" weightage="50" keywordseo="telecom-department" source="Orion">Telecom Department</keyword> to make sure that these carriers are also warned that there is unlawful activities originating from their networks, and that if that continues, we may have to look at some kind of a discussion of whether those networks will be allowed to terminate in India as well," he said. The government and players are not adversaries, rather they work in partnership, he said, adding that a safe and trusted internet for 1.2 billion consumers "is good for business, government, and for citizens". Data protection bill to drive deep behavioural changes for platforms exploiting data: Chandrasekhar

A bill seeking to provide for four nominees by a bank account holder was introduced in the <keyword id="19895394" type="General" weightage="20" keywordseo="Lok-Sabha" source="keywords" meta.keywordsubtype="org" meta.entityname="Lok Sabha" meta.hostid="153" meta.entityid="Lok Sabha">Lok Sabha</keyword> on Friday to ensure better protection of depositors and enhance customer convenience. Introduced by Minister of State for Finance Pankaj Chaudhary in the Lower House, the Banking Laws (Amendment) Bill, 2024, has a provision for simultaneous and successive nominations to bank accounts, lockers, etc. As per the provision of the bill, a bank account holder can nominate up to four persons. The bill also seeks to transfer of unclaimed dividends, shares, and interest or redemption of bonds to the Investor Education and Protection Fund (IEPF), allowing individuals to claim transfers or refunds from the fund, and thus safeguarding investors' interests. As the banking sector has evolved over the years, and with a view to improving bank governance and investor protection, it has become necessary to make certain amendments to five Acts, according to Statement of Objects and Reasons of the Bill. The Bill, which was approved by the <keyword id="19916620" type="General" weightage="20" keywordseo="Union-Cabinet" source="keywords" meta.keywordsubtype="org" meta.entityname="Union Cabinet" meta.hostid="153" meta.entityid="Union Cabinet">Union Cabinet</keyword> last week, proposes to amend the <keyword id="20824389" type="General" weightage="20" keywordseo="Reserve-Bank-of-India-Act" source="keywords">Reserve Bank of India Act</keyword>, 1934, the Banking Regulation Act, 1949, the State Bank of India Act, 1955, the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970, and the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1980. The proposed bill seeks to improve governance standards, provide consistency in reporting by banks to the Reserve Bank of India, ensure better protection for depositors and investors, improve audit quality in public sector banks, bring customer convenience in respect of nominations, and to provide for increase in the tenure of the directors in co-operative banks. Another proposed change relates to redefining 'substantial interest' for directorships, which could increase to Rs 2 crore instead of the current limit of Rs 5 lakh, which was fixed almost six decades ago. Congress member Manish Tewari opposed the introduction of the bill, saying the power to legislate with regard to cooperatives vests with state governments. RSP member N K Premachandran opposed amending five legislations through one bill, while TMC member Saugata Roy termed the bill "superfluous", saying the the amendments proposed in the bill could have been done through administrative decisions. Responding to opposition's remarks, <keyword id="19956758" type="General" weightage="20" keywordseo="Finance-Minister" source="keywords">Finance Minister</keyword> Nirmala Sitharaman said the various amendments done in Banking Regulations Act with respect to <keyword id="20814377" type="General" weightage="20" keywordseo="cooperative-banks" source="keywords">cooperative banks</keyword> are not just one or two but several. "Simple understanding is we are not touching any aspect of the cooperatives other than that which claims under the name of banking...the sections which have been brought in for amendments, as also the court verdicts, have repeatedly reinforced the point that Banking Regulation Act and the Cooperative Banks do have this relationship and therefore it has to be taken through this route," she said. Otherwise, there is no attempt to undermine the cooperatives, particularly cooperatives dealing with everything other than banks, she said defending the Bill. The bill proposes to increase the tenure of directors (excluding the chairman and whole-time director) in cooperative banks from 8 years to 10 years, so as to align with the Constitution (Ninety-Seventh Amendment) Act, 2011. Once passed, the bill would allow a director of a Central Cooperative Bank to serve on the board of a State Cooperative Bank. The bill also seeks to give greater freedom to banks in deciding the remuneration to be paid to statutory auditors. It also seeks to redefine the reporting dates for banks for regulatory compliance to the 15th and last day of every month, instead of the second and fourth Fridays. "What's the rationale behind it? The current reporting Friday system has several limitations that impact the accuracy and effectiveness of the reporting of data. "These limitations are incomplete coverage of monthly data, seasonal fluctuations in banking activity which lead to inconsistent reporting, and the need for adjustment every 11th year which introduces complications and inconsistencies. That is why, in order to address the issue, it is proposed to amend the legislation," she said. The announcement about amendments to the Banking Regulation Act was made by the Finance Minister in the 2023-24 Budget speech. "To improve bank governance and enhance <keyword id="22728161" type="General" weightage="20" keywordseo="investors-protection" source="keywords">investors' protection</keyword>, certain amendments to the Banking Regulation Act, the Banking Companies Act and the Reserve Bank of India Act are proposed," she had said.

We urge the government to undertake further consultation before they introduce it into the parliament,” Venkatesh Krishnamoorthy, the Country Manager for <keyword id="1681687" type="ORGANIZATION" weightage="20" keywordseo="BSA-India">BSA India</keyword> told Business Insider India. BSA, the software alliance that includes companies like Microsoft, Amazon Web Services (AWS), Intel, Adobe, Akamai, Oracle, IBM and Apple, feel that since the policy that will now be tabled is considerably different from what was originally presented for discussion — another round of inputs would help the companies as well as the Indian government. Rushing to parliament Ravi Shankar Prasad, India’s IT and telecom minister, told the press that taking the Personal Data Protection Bill to parliament will be one of his top priorities during the first 100 days of Prime Minister Narendra Modi’s second term. “In IT, we will try to quickly get the data protection bill to the Parliament and also, notifying the intermediary guidelines,” he said. Before India started out on its journey to address data privacy concerns, the debate had already been ongoing in the US for nearly 20 years and in the EU for over 10 years. The original draft of the Personal Data Protection Bill that was shared in 2018 draws its inspiration from the European Union’s General Data Protection Regulation (GDPR) as well as other legislations around the world. And, given that GDPR has just completed its first year of implementation, Krishnamoorthy feels that there’s a lot that India can learn from the EU’s experience, “It would be beneficial for the government given that GDPR has gone through its anniversary and there were learnings from that. And generally, also there’s been a lot of activity as well, like the G20 Summit in Japan. ” It’s not just that India needs to look at the experience of other countries. The new draft that will be tabled at parliament is considerably different from what was originally presented. “The next version be more robust than what it is currently,” Krishnamoorthy explains. He adds, “It’s a step in the right direction because the time of privacy legislation has come. Apple, Amazon, and Microsoft want one more shot at convincing India before data protection bill reaches Parliament

<ul><li>Being compliant with the European Union’s General Data Protection Regulations (<keyword id="2556126" type="PERSON" weightage="20" keywordseo="GDPR">GDPR</keyword>) won’t necessarily mean that companies are compliant with India’s upcoming <keyword id="431014" type="ORGANIZATION" weightage="20" keywordseo="Personal-Data-Protection">Personal Data Protection</keyword> Bill (PDP).</li><li>The scope of the PDP is broader and will require companies to make changes to their data management policies in order to operate in India.</li><li>Once PDP comes into effect, GDPR compliant companies may only have to make a few changes but new laws will be a sea-change for companies who were only compliant to the existing Indian data protection laws.</li></ul>India is ready to take a stab at formulating its first laws to govern data and it is using the European Union’s General Data Protection Regulations (GDPR) as the template. And, for companies operating in India, this could end up being a stick in the mud. While GDPR and India’s <keyword id="458689" type="PERSON" weightage="20" keywordseo="personal-data">Personal Data</keyword> Protection Bill (PDP) are similar in many ways, the differences between them mean that a company which is compliant in Europe may not necessarily be compliant under the PDP. “The PDP scope of application is broader than that of the GDPR as an entity will fall within scope merely by processing personal data in India when compared to that of GDPR,” Neeraj Dubey, a partner of corporate law at Singh &amp; Associates told Business Insider. <div type="Article" hostid="261" msid="81422687" title="India’s new data protection bill makes a good show of user rights — but can it deliver on its promises?" mstype="2" mssubtype="0"></div> A broader definition of <keyword id="8418566" type="UNKNOWN" weightage="20" keywordseo="sensitive-personal-data">sensitive personal data</keyword> Unlike the GDPR, the PDP has divided data into three categories — personal data, sensitive personal data, and <keyword id="10928418" type="UNKNOWN" weightage="20" keywordseo="critical-personal-data">critical personal data</keyword>. The latter is particularly important since there is no parallel for it in Europe’s laws and it comes with its own unique set of terms and conditions, like being obligated to data localisation. Moreover, India has thrown a wider net over what constitutes sensitive personal data as compared to the GDPR. A company may have to comply even if it merely processes personal data in India, and doesn’t collect the data locally, according to law firm <a href="https://www.privacysecurityacademy.com/wp-content/uploads/2020/05/Comparison-Chart-GDPR-vs.-India-PDPB-2019-Jan.-16-2020.pdf">Covington and Burling.</a> For instance, financial data has been categorised under sensitive personal data. “This is an area of concern as processing of sensitive personal data involves greater compliance requirements. Consequently, the large innovations in fintech space, which is currently being observed in India, may get affected,” points out Supratim Chakraborty, a partner specialising in data privacy and protection at Khaitan &amp; Co. This means even if companies are GDPR compliant, they will have more sorting and more rules to abide by. Government stronghold on critical personal data Not only is critical personal data a new category altogether, companies have to make sure that it is exclusively stored and processed in India. In order to transfer any data that falls into that category outside of India, firms will need additional approval from the Data Protection Authority (DPA) and the Supervisory Authority. “Therefore, compliance with the GDPR may not result in compliance with the PDP, since transfer outside India will depend on approvals and permissions, either by the DPA or the central government,” noted <a href="https://www.mondaq.com/india/privacy/903076/comparative-analysis-general-data-protection-regulation-2016-and-the-personal-data-protection-bill-2019">Ikigai Law</a>. Government intervention doesn’t stop there. The GDPR doesn’t lay out any terms and conditions to monitor anonymised data. The PDP, however, allows the central government to access non-personal data as long as it’s to frame policies in the interest of the ‘digital economy’. For users, <a href="https://www.businessinsider.in/tech/news/indias-new-data-protection-bill-makes-a-good-show-of-user-rights-but-can-it-deliver-on-its-promises/articleshow/81422687.cms">this a bigger question of privacy</a>. Meanwhile, for companies, it implies that anonymisation standards may differ between the two frameworks. “Given the current ambiguity in several key provisions of the PDP, the overreaching powers given to the executive, and the exemptions granted to it under the PDP, adequate safeguards and checks and balance are required to be built into the legislation to prevent any misuse of its provisions” said Namita Viswanath, a partner at IndusLaw. The question of consent While one can understand the requirement of having terms and conditions available to users in multiple languages, especially in a country as diverse as India — it means a lot more work for companies collecting data. While firms only need to cough up consent in English under the GDPR, they will have to arrange for multiple languages under the PDP. India’s data protection framework also proposes setting up ‘consent managers’ — a new type of entity of channelling consent. “Data principal [user] may give or withdraw consent through a “consent manager” whereas no such provision exists under GDPR,” explained Dubey. The PDP, on the other hand, proposes that data can be retained for longer stretches of time if the user consents or if required in compliance with any obligation under the law. India’s bill also allows companies to process data for ‘reasonable purposes’. However, unlike the GDPR’s ‘legitimate interests’ — which are clearly outlayed — a purpose will be deemed ‘reasonable’ only by the overarching authority, the DPA. To tell or not to tell — who has the power? Under the GDPR, all breaches are to be reported to supervisory authority and to the users as well. India, however, won’t require users to be informed by law. In the case of a data breach, a data company will only have to inform the end users if the DPA deems it so. “Many provisions under the PDP have been left open-ended and for the Central Government or the Data Protection Authority to notify subsequently, leaving a huge scope for potential misuse and room for ongoing regulatory uncertainty,” said Viswanath. Being GDPR compliant doesn't necessarily make companies ready for India's upcoming data protection laws

<ul><li>India’s three main surveillance projects — <keyword id="109740" type="ORGANIZATION" weightage="20" keywordseo="NATGRID">NATGRID</keyword>, <keyword id="15615" type="CITY" weightage="20" keywordseo="cms">CMS</keyword>, and <keyword id="26425" type="CITY" weightage="20" keywordseo="Netra">NETRA</keyword> — have been directed to stop collecting data by the Delhi High Court. </li><li>The order comes as public interest litigation (PLI) filed by lawyer Prashant Bhushan on behalf of the CPLI cited that there is ‘insufficient oversight’ allowing the mass surveillance of Indian citizens and breaking their <keyword id="515140" type="PERSON" weightage="20" keywordseo="right-to-privacy">right to privacy</keyword>. </li><li>NATGRID has access to 12 categories of data, CMS can listen in on your phone conversations, and NETRA can track everything you do online. </li></ul>The Delhi High Court has issued a notice today asking India’s central government to stop collecting data through their three main surveillance systems — National Intelligence Grid (NATGRID), Central Monitoring System (CMS) and Network Traffic Analysis (NETRA). The notice is in response to public interest litigation (PLI) filed by lawyer and activist Prashant Bhushan on behalf of the NGO called the Center for Public Interest Litigation (CPIL). In the appeal, Bhushan argues that the three systems create a net of 360-degree surveillance on Indian citizens. What are NATGRID, NETRA and CMS? NATGRID, NETRA and CMS are surveillance systems. This means they collect data in order to keep an eye out for anything that could threaten national security. NATGRID allows investigation and law enforcement agencies to access real-time information from data stored within agencies like the Income Tax Department, banks, insurance companies, the Indian Railways, and other offices. There are a total of 21 categories of data that NATGRID has access to. Where the NATGRID has access to real-time data, CMS is centralised telephone interception provisioning system. And, it’s exactly what it sounds like. It can bypass the middleman — the telecom companies — to directly monitor text messages, social media posts and phone calls. NETRA is the third leg of India’s security infrastructure. While the CMS is tapping into your phone’s network, NETRA is watching everything you do online — not just on social media. It can monitor any text-based messages containing direct messages on Facebook, within your personal emails or online blogs. Using filters and keywords, it can identify words even in encrypted messages. How does NATGRID undermine the right to privacy? NATGRID was established through governmental notifications rather than through legislation passed in the Parliament. Even though it helps the project come to fruition faster, it also undermines the system of checks and balances essential to a democracy, according to <a href="https://www.prsindia.org/theprsblog/natgrid-should-parliament-have-role">PRS India</a>. Considering that NATGRID can access information of private individuals, it also has a bearing on their fundamental rights — like the right to privacy, as cited by Bhushan. Unlike India, countries like the US and the European Union (EU) have comprehensive privacy laws. They include the conditions under which access to databases would be allowed and limitations on how such data can be used. UIDAI, like NATGRID, was formed using governmental notifications. It was established as an executive authority, and still functions without a statutory mandate. What roles to CMS and NETRA play? The underlying logic for developing CMS and NETRA was to monitor terrorist activities mainly after the terrorist bomb attack in Mumbai on November 26, 2008. With both of them, the problem again boils down to a lack of transparency in the absence of data protection laws. The general public has no way of knowing if and when a person’s data has been intercepted or how data is being used. CMS and NETRA allow for mass surveillance with the potential to target large groups of people without a valid reason. To solve for the lack of transparency, the PLI filed by Bhushan seeks the creation of a permanent independent oversight body — either judicial or parliamentary — for issuing and reviewing lawful interception and monitoring warrants under the enabling provisions of the Indian Telegraph Act, 1885 and the Information Technology Act, 2000. A new draft of the Personal Data Protection Bill speaks of more restrictions and surveillance.  The first steps towards mass surveillance A day before Christmas, the Russian’s Ministry of Communications announced that the country has successfully unplugged the internet according to a <a href="https://www.bbc.com/news/technology-50902496">BBC</a> report. It marks the implementation of Russia’s ‘sovereign internet’ law, which allows the government to block content in an ‘emergency situation’. <a href="https://www.hrw.org/news/2019/10/31/russia-new-law-expands-government-control-online#">Experts</a>’ main critique of the law is that it’s the first step towards dismantling the internet. The definition of an ‘emergency situation’ is vague but the government insists that the main purpose is to prevent cyberattacks. <a href="https://www.cpomagazine.com/data-protection/new-india-data-protection-bill-may-give-government-unlimited-access-to-citizen-data/">Critics</a> in India find similar faults with the Personal Data Protection Bill. Though the government won’t have the power to remove online content, it will be able to track and monitor accounts that it <a href="https://www.businessinsider.in/business/news/iamai-flags-ambiguities-in-draft-data-protection-bill-seeks-clarity-on-classification-consent/articleshow/72282044.cms">deems to be a ‘threat’</a> — essentially creating a backdoor that can be opened at any time without having to lift a finger. Another way to think about it that the new data privacy laws will apply to everyone, <a href="https://www.businessinsider.in/business/news/centres-exemption-powers-in-draft-data-protection-bill-stir-up-industry-worries/articleshow/72461296.cms">except for the government</a>. The trend of data protection through localisation India is already following in China’s footsteps with its data localisation laws, according to a report by the Eurasia Group and Vontobel. They say it’s partly a way to protect domestic technology companies from foreign competition. And while that may be true, multiple studies show that India companies don’t have the adequate cybersecurity infrastructure in place to protect against data theft.  The level of a vulnerability is worryingly high when one takes into considering that the country has already made data localisation mandatory for financial transactions of its citizens. As experts point out, <a href="https://www.businessinsider.in/tech/news/data-localisation-wont-help-local-firms-or-improve-privacy-but-it-could-cost-india-43-billion/articleshow/72251167.cms">data localisation may keep the data from foreign firms</a> — but it also creates a single point of attack. It won’t be cheap either. According to a report by ICRIER and IAMAI, the restrictions would hamper cross-border data flows costing India up to $43 billion in trade. The lingering question The Personal Data Protection Bill 2019 is still under discussion leaving the possibility open for the proposed laws to be changed before they’re official. "Effective data privacy and personal information protection are critical pillars for driving consumer trust in the rapidly growing digital economy," said the country manager for BSA India, Venkatesh Krishnamoorthy. And he rightly points out, maintaining trust is critical as cybersecurity threats are only set to increase in 2020 as technology continues to evolve and legislation struggles to keep up. The combination of data localisation and tracking of users online activity makes a for a dangerous mixture that could have India becoming the next country to splinter the internet along with China, Iran, Russia and Saudi Arabia. Indian data laws have an uncanny resemblance to Russia’s 'new' internet and China’s 'Great Firewall'

The draft <keyword id="2617070" type="PERSON" weightage="20" keywordseo="Personal-Data-Protection-Bill">personal data protection bill</keyword> that seeks to empower the Centre to exempt any government agency from the provisions of the proposed legislation has the industry worried, as they warn that such exemptions represent "new, significant threats" to the privacy of Indians. The proposed bill also provides for voluntary verification of social media users and transfer of non-personal data. The outcry from industry watchers, analysts and civil society comes amid the draft bill suggesting that the Centre will be empowered to exempt any government agency from the application of the Act and verify social media users.
 One of the provisions of the draft bill states that the Centre can - in the interest of sovereignty, the security of the state, and public order - "direct that all or any of the provisions of this Act shall not apply to any agency of the Government in respect of processing of such personal data..."
 The bill, which was cleared by the Cabinet last week, is likely to be introduced in the Lok Sabha in the next couple of days.
 Mozilla's Policy Advisor Udbhav Tiwari said that if Indians are to be truly protected, it is urgent that Parliament reviews and addresses "these dangerous provisions before they become law".
 "Indians have been waiting for a strong data protection law for years now, and this latest bill delivers real privacy in regards to processing by companies and is a dramatic step backwards in terms of processing and surveillance by the government. Exceptions for government use of data, the verification of social media users, and the forced transfer of non-personal data all represent new, significant threats to Indians' privacy," said Tiwari.
 Mozilla is the not for profit entity behind the web browser Firefox.
 While the bill seeks to protect personal and sensitive data of individuals, it proposes to allow processing of private data without explicit consent in case of security, credit scores, debt recovery, operation of search engines and whistle blowing.
 The draft bill also states that the central government can frame policy for the digital economy with respect to non-personal data. In particular, it can direct any data processor to "provide any personal data anonymised or other non-personal data to enable better targeting of delivery of services or formulation of evidence-based policies by the Central Government".
 Further, social media entities with user base above a certain threshold and whose "actions have, or are likely to have a significant impact on electoral democracy, security of the State, public order or the sovereignty and integrity of India," will be notified as 'significant data fiduciary'.
 Every social media intermediary classified as a 'significant data fiduciary' will enable the users in India to voluntarily verify their accounts. Any user undergoing such voluntarily verification will have to be provided with a mark of verification that is visible to all users of the service. Such entities will also have to get their policies and conduct (of data processing) audited by an independent data auditor.
 Jaspreet Singh, Cyber Security Leader, EY India said termed the Bill a "double-sided sword".
 Singh said that while it protects the personal data of Indians by empowering them with data principal rights, "it bestows the central government with exemptions which are against principles of processing".
 "The State can process even sensitive personal data when required, without an explicit consent from the data principals. However, the government will need to show that any processing of personal data is necessary and processing of sensitive personal data is strictly necessary for the exercise of any function of the State authorised by law for the provision of service or benefit," Singh said.
 These broadly-worded carve-outs "can be misused and hence need to be carefully examined", he cautioned.
 Arun Prabhu, Partner at Cyril Amarchand Mangaldas noted that portions of the bill have been pared down, and some changes such as the lack of a clear implementation timeline, requirement to share non personal data, obligations for social media verification "may be a potential source of concern."
 He, however, said that certain changes made to the Draft Bill are business friendly, providing for increased certainty, a regulatory sandbox for Artificial Intelligence/Machine Learning and other innovative technology, limiting localisation to non-sensitive data and a potential carve out for non-Indian data processed under contract.
 Gartner said that the primary concern will be the execution of the bill across which will include advisory from regulatory bodies such as RBI, IRDAI, SEBI.
 "There must to very clear guidelines which the enterprises can easily follow without relying completely on consulting service providers. Very clear deadlines must be mentioned and clarity on the fines in case of violation must be clearly mentioned and should be available on public website," Rajpreet Kaur, Principal Analyst of Gartner said. If it passes, the government can fine companies up to ₹15 crore ($2 million) or 4% of their global annual turnover — whichever is higher — for major violations. But, in comparison to the General Data Protection Regulation (GDPR), India’s attempt to <a href="https://www.businessinsider.in/groups-of-foreign-companies-are-lobbying-against-indias-personal-data-protection-bill/articleshow/66070718.cms">ensure compliance</a> might not pack the punch required. The European Union (EU) imposes much tougher punishments for those who fail to comply with its regulations. Higher fines give GDPR its teeth — and it’s not afraid to bite EU can level fines of at least 10 million Euros (₹79 crore) or 2% of a company’s annual global turnover for minor infringements under GDPR. In the case of a major violation, a company can even be fined up to 20 million Euros (₹ 158 crore) or 4% of their global annual turnover. “The heft of the fine requires companies to be more responsible,” said a report by <a href="https://www.consumersinternational.org/media/155133/gdpr-briefing.pdf">Consumers International</a>. The higher potential for fines is also what gives GDPR its teeth — and they have already proven that they’re not afraid to bite. Within a year of its inception, over 200,000 GDPR cases were reported and a total of 55 million fines were issued, according to the European Data Protection Board (EDPB). Some of the big cases include the $5 million fine against Google and $125 million against Marriot International. Overall, penalities over 350 million Euros ($387 million) were doled out. And, the recorded cases are only the tip of the iceberg. The number of people with access to the internet is growing and so are the devices that come along with them. As a result, the amount of data that is being generated online has increased substantially over the last couple of years. And, that data is a valuable resource for businesses. Sivan said that the space agency was planning to have 25 launches. </li><li>All was going well for ISRO after the crashlanding of India's moon lander Vikram on the lunar surface in 2019.</li><li>The first setback of the year for ISRO came on March 4, when it had to call off the launch of GISAT-1, a day before its actual launch, owing to technical reasons. </li></ul>What would have been an insipid first half of the calendar year 2020 for the Indian space agency turned a bit interesting towards the end, with the government announcing its decision to open up the sector to private participation. At the start of 2020, Indian Space Research Organisation (ISRO) Chairman and Secretary Department of Space K. Sivan said that the space agency was planning to have 25 launches -- including Aditya-L1 satellite, <keyword id="1512353" type="COMPANY" weightage="20" keywordseo="Geo-Imaging-Satellite">Geo Imaging Satellite</keyword> (GISAT-1), realisation of Small Satellite Launch Vehicle (SSLV) or small rocket (carrying capacity 500 kg), navigation satellite with indigenous atomic clocks and <keyword id="9550825" type="COMPANY" weightage="20" keywordseo="indian-data-relay-satellite-system">Indian Data Relay Satellite System</keyword> (IDRSS), and GSAT-20 satellite with electric propulsion. Sivan also said India will embark on its third moon mission 'Chandrayaan-3' and attempt to land a lander on the lunar surface sometime in 2020-21. All was going well for ISRO after the crashlanding of India's moon lander Vikram on the lunar surface in 2019. The year began well ISRO with the launch of the 3,357 kg communication satellite GSAT-30 by the European space agency Arianespace rocket Ariane 5 on January 17. The ISRO also showcased its robot/half-humanoid -- Vyommitra - which was part of its human space mission programme 'Gaganyaan'. The first setback of the year for ISRO came on March 4, when it had to call off the launch of GISAT-1, a day before its actual launch, owing to technical reasons. The ISRO did not share any detail about the technical reasons, or the glitch, and its rectification since then. It is also not known when the satellite with a very good camera would be launched. Then came the Covid-19 lockdown within and outside India that had its cascading impact on ISRO's core plans like the realisation of SSLV, launch of GISAT-1, delay in the first test-flight of the rocket as part of Gaganyaan mission. "During the lockdown, industries that were supplying components were not working. Our own officials were not able to attend office. Further travel to Sriharikota in Andhra Pradesh for satellite launch by the officials were not possible due to the lockdown," Sivan told IANS. It is also not known when ISRO will be able to restart its satellite launch operations. With coronavirus infection spreading fast in the county, ISRO also started work on developing a low-cost ventilator and sanitiser. Meanwhile, two positive developments happened for ISRO -- securing an Indian patent for its liquid cooling and heating garment (LCHG) suitable for space applications and for its method of manufacturing highland lunar soil simulant or simply lunar/moon soil. On May 16, Union Finance Minister Nirmala Sitharaman announced that Indian private sector will be a co-traveller in India's space-sector journey and a level-playing field will be provided for them in satellites, launches, and space-based services. She also said that a predictable policy and regulatory environment will be provided to private players. The future projects for planetary exploration, outer space travel and others are to be opened up for the private sector, adding there will be a liberal geo-spatial data policy for providing remote-sensing data to tech-entrepreneurs subject to various checks. Welcoming the announcement, sectoral experts suggested various models for restructuring of ISRO and also urged the government to set up an independent regulator and also enact necessary legislation. On June 24, the Union Cabinet decided to set up Indian National Space Promotion and Authorisation Centre (IN-SPACe), making ISRO to focus on research and development (R&amp;D) of new technologies, exploration missions, and human spaceflight programme. Singh said the Union Cabinet led by Prime Minister Narendra Modi decided to set up IN-SPACe to provide a level playing field for private companies to use Indian space infrastructure. He also said the New Space India Limited (NSIL) will endeavour to re-orient space activities from a 'supply driven' model to 'demand driven' model, thereby ensuring optimum utilisation of the country's space assets. Former ISRO Chairman <keyword id="52158" type="PERSON" weightage="20" keywordseo="madhavan-nair">Madhavan Nair</keyword> said there should be a national space law to define responsibilities and liabilities. Pointing out the role envisaged for IN-SPACe and the demand for a sectoral regulator, when queried whether the proposed body could be converted into the space sector regulator, Sivan told IANS: "IN-SPACe could be turned into a regulatory body when the necessary laws and regulations are in place." "We are on the job of getting ready the Space Activities Bill. It will define the space activities, liabilities and other aspects," he added. As part of the reform process, new navigation policy is also being proposed. Suitable changes in the remote sensing data policy as well as SATCOM policy are on the anvil to align them to an open and inclusive space sector, said Sivan. "The best is to establish an independent regulator -- <keyword id="9550824" type="COMPANY" weightage="20" keywordseo="space-regulatory-authority-of-india">Space Regulatory Authority of India</keyword> (SRAI) -- which will create a level-playing field for many of the emerging players," Narayan Prasad, Chief Operating Officer, satsearch, told IANS. Establishing an independent regulator could allow a systematic review and reforms on a continuous basis rather than one-off announcements, Prasad said. As per current scheme of things, IN-SPACe will have its own directorates for technical, legal, safety and security, monitoring as well as activities promotion for assessing the private sector's needs and coordination of the activities. IN-SPACe would have a board and representatives from industry, academia and the government, Sivan said. "Initially, IN-SPACe will be manned by people from the existing space setup. Later, people from outside will be taken in. It will have its funds from the budgetary allocations for the DoS. The new body may not need big financial allocations," Sivan remarked. Stressing that the ISRO's importance will not diminish with the entry of IN-SPACe, Sivan said all the existing centres - manufacturing, services, rocket launch centres - would continue to be with the ISRO. "The ISRO will be involved in research and development in advanced technologies, human space missions. It will also share its technological expertise with the private parties. The proposed new body will not disturb the existing ones. It will be another autonomous body," Sivan said. Industry officials are hoping to see further steps being taken by the government regarding the space sector during the second half of 2020. But as regards the satellite launches - domestic as well as foreign for a fee - by ISRO during the year depends on the spread or control of coronavirus and the resultant lockdown. ISRO doesn't know when it will be ready to restart space launches

Securiti.ai creates tools to help businesses automatically comply with data privacy laws, which are meant to give consumers rights over their own data.The company announced that it raised $50 million in Series B funding earlier this week, in a round led by General Catalyst along with Mayfield. This comes just a few months after the company's Series A round, and a year and a half after the company started in late 2018. Jalil said the reason it's raising another round so soon is because the company is seeing huge demand."As soon as we launched in August last year, it was an absolutely clear realization that the timing of what we've built, this privacy ops platform, couldn't really be better," Jalil told Business Insider. "We started heading up a lot of traction with customers and now we're getting even more of that."<h2>Stricter laws are good for business</h2>Privacy laws like the California Consumer Protection Act (CCPA) and Europe's General Data Protection Requirement (GDPR) allow consumers to request a copy of all the data a company has collected about them - and, furthermore, requires that data be deleted upon request.That's not something many companies are equipped to do. Often, customer data is scattered in many different places within a company's computer systems and finding it and then deleting it is an expensive and labor-intensive process. The state of California estimated that companies will spend up to <a href="https://www.businessinsider.com/california-ccpa-data-privacy-startups-compliance-55-billion-2020-1">$55 billion this year to get in compliance with CCPA</a>.Jalil expects that this is only the beginning. In the wake of GDPR and CCPA, Jalil sees a growing international movement taking shape, with countries like Brazil, India, and Australia seemingly slated to pass their own data privacy laws.As a result, Jalil said his business is growing exponentially, as companies need to find effective ways to comply with the laws. He's even coined a term for the market that's emerging around these tools: "privacy ops."<h2>What is 'privacy ops?'</h2>Jalil defines privacy ops as tools that can help companies automatically keep pace with the fast-moving world of privacy legislation. Securiti.ai has built tools that use bots to help companies go through the steps of collecting, verifying, and compiling the data and then showing it to the consumer and deleting it upon request. Jalil and his co-founders have experience working in security, having worked together at Symantec's cloud security business. Jalil says that privacy ops represents a different kind of security from what companies needed in the past. "It's a whole new era of privacy, because 10, 20 years back, this kind of data did not exist. Any small company now can have so much data compiled, it gets sold, it gets changed, so that is definitely a new era of lack of privacy," Jalil said. He adds that companies like Facebook now have entire teams doing what he'd qualify as privacy ops, and many more are actively hiring for those types of roles. Securiti.ai now has 190 employees. Jalil declined to share metrics around the number of customers the company has, given how new the company is and how fast its growing, but said since launching their platform has processed "data for over 100 million identities, with customers across all major verticals."Recently, the company began offering a free version of its service, giving companies a basic product to help with their data privacy and security, before shelling out for the premium version.
