It is thought to be one of the most fatal cases of migrant deaths near the southern border in recent years.In a <a href="https://twitter.com/POTUS/status/1541858758820864000">tweet</a>, President Joe Biden said that his "administration will continue to do everything possible to stop criminal smugglers from exploiting migrants."However, immigration advocates told Insider that they are frustrated that the Biden administration has not done more to end Title 42, an emergency <a href="https://www.cdc.gov/coronavirus/2019-ncov/downloads/CDC-Order-Suspending-Right-to-Introduce-_Final_8-2-21.pdf">public health order</a> that allows the government to turn away migrants seeking asylum because of the COVID-19 pandemic. Experts believe that Title 42 has caused more cases of human smuggling across the border, resulting in injuries and fatalities like the incident in San Antonio."Allowing Title 42 to continue and other egregious policies for migrants is racist, hypocritic[al], and deadly," Patrice Lawrence, executive director of UndocuBlack Network wrote in a statement to Insider. "The migrants who perished in the truck in San Antonio, Texas should have been met with compassionate policies. They were not. They should be alive today and together with their loved ones. They are not."<h2>Title 42 was set to end in May.</h2>In April, the Biden administration announced that it would be terminating Title 42, a public health order under the Public Health Service Act enacted by the Centers for Disease Control and Prevention that allows the federal government to turn away migrants seeking asylum in the event of a pandemic or epidemic.However, after 24 state attorney generals <a href="https://www.politico.com/news/2022/05/20/judge-blocks-biden-administration-from-lifting-title-42-border-policy-00034195">sued</a> the administration, a Federal judge in Louisiana issued a ruling blocking the CDC from ending Title 42. The extension was supposed to be lifted on May 23, 2022; however, Title 42 still remains in place."I would say for Black migrants, that is a place of dignified rage, is the best way to put it. I think disappointment is putting it too mildly," Haddy Gassama, National Director of Policy and Advocacy at UndocuBlack Network, told Insider. "Frustration is, I think, a little too polite."April 2022 saw the highest amount of border encounters on record at the U.S. southern border, according to <a href="https://www.cbp.gov/newsroom/stats/southwest-land-border-encounters?language_content_entity=en">US Customs and Border Protection</a>. The Biden administration has also expelled migrants under Title 42 at <a href="https://www.pewresearch.org/fact-tank/2022/04/27/key-facts-about-title-42-the-pandemic-policy-that-has-reshaped-immigration-enforcement-at-u-s-mexico-border/">twice the rate</a> of the Trump administration.As far as Biden's overall grade on immigration, advocates said there has been an increase in legalization for people who are already in the country. However, they believe Biden has not lived up to what he promised. After the murder of George Floyd by Minneapolis police, President Biden affirmed that his administration would prioritize <a href="https://www.whitehouse.gov/equity/">racial justice</a> in all of his policies, <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2022/06/19/fact-sheet-the-biden-harris-administration-advances-equity-and-opportunity-for-black-americans-and-communities-across-the-country/">including immigration</a>. Immigration advocates say that has not been the case."I think what's disheartening for us is that Biden very much ran on a platform around racial equity. And, for us, our tagline is that immigration is a Black issue. And we feel that oftentimes his policies don't reflect some of those sentiments," Gassama said.<h2>Advocates say the Biden administration can do more, even after the extension of Title 42.</h2>Louisiana US District Court Judge, Robert Summerhays, a Trump appointee, <a href="https://www.washingtonpost.com/national-security/2022/05/20/title-42-asylum-border/">sided</a> with the 24 states, stating the Biden administration must launch a <a href="https://www.federalregister.gov/uploads/2011/01/the_rulemaking_process.pdf">notice-and-comment process</a> in order to remove the policy in what's called the Administrative Procedure Act.Muzaffar Chishti, a senior fellow at the Migration Policy Institute, said the administration can issue a stay of the injunction, pass an executive order and wait for it to be challenged in court or follow the procedural grounds stated by Judge Summerhays under the Administrative Procedure Act since removing the policy still has merit. The Biden administration has filed an appeal to Judge Summerhays' ruling. "I think initially it might have been defensible just because they have a lot of restrictions placed on travel to the United States by air, by road, in any case, but I think the more after we got the vaccination and after the travel restrictions on airfare and travel, particularly, were loosened, it became less and less defensible," Chishti told Insider. <h2>Advocate said the Biden administration has extended protective status to those already in the US.</h2>While immigration advocates are frustrated with the Biden administration's immigration policies, particularly with regards to people seeking asylum, Christi said the administration has been responsive to accepting Afghan refugees and extending Temporary Protected Status to Haitians and <a href="https://www.uscis.gov/newsroom/news-releases/secretary-mayorkas-designates-cameroon-for-temporary-protected-status-for-18-months">Cameroonians</a> who are living in the US.For people already in the country, the administration has reeled back on deportations and is accepting <a href="https://apnews.com/article/immigration-joe-biden-donald-trump-alejandro-mayorkas-4fd76fd10ffe5e1ee96b665c3cbb7be4">more</a> green card applications than the Trump administration. "With the exception of Title 42, it's hard to see a more pro-immigration administration," Chishti told Insider. "Immigration advocates are focused on two things that the Biden administration was expected to improve. One is the situation on the border, and the other was sort of trying to get legalization for 11 million unauthorized people in the country."<h2>Looking ahead to midterms.</h2>As far as what is next for immigration advocates, Gassama said they are looking ahead to the midterms this year and the general election in 2024."What's disheartening for us is that Biden very much ran on a platform around racial equity," Gassama told Insider. "I think, on the one hand, the injunction is terrible that, you know, these sort of Republican states and attorneys general are using their power, and these Trump-appointed federal judges are using their power to effectively ban asylums at the border. But on the other hand, I think the slowness of [the Biden] administration to even respond when these things happen, again, is an example of their apathy."

<ul class="summary-list"><li>Second generation Americans, or the children of immigrants, are a growing part of the US population.</li><li>Not all children of <keyword id="11657604" type="UNKNOWN" weightage="60" keywordseo="black-immigrants">Black immigrants</keyword> assimilate or accept labels like 'African American.'</li><li>Activists say combating racism is sidetracked by debates about country of origin.</li></ul>Alex Love is a born and raised New Yorker. She's lived in that city for the past 34 years she's been on this earth. But unlike many Americans, she doesn't like McDonald's, favors a chicken patty over takeout, and says "good morning" to strangers she passes on the street."I grew up knowing that I was American, but not a 'regular American,'" the consultant told Insider.Both Love's parents are from Barbados. So how she shows up in American society and views her Blackness was first shaped by that Black immigrant experience. "If you have a parent born in another country, even though you're born here, your upbringing is still predominantly led and shaped by where your parents came from and their own <keyword id="24504" type="ORGANIZATION" weightage="60" keywordseo="culture">culture</keyword>," said Haitian-American journalist, Edvige Jean-François who speaks extensively on the Black immigrant experience. Straddling the line of an African American and Black immigrant identity can even make it difficult to feel connected to historical milestones and celebrations unique to the US, including recent Juneteenth commemorations."I think that it's great that people are celebrating, but I don't feel connected to it," she said. "For me, I can trace my history within Barbados so that's where I feel rooted." Black, second-generation immigrants spoke with Insider about that intersectionality, and how they internalize American Blackness through a different lens than their African American counterparts whose existence dates back to US slavery. <h2>Children of Black immigrants are growing part of the population</h2>Second-generation immigrants - people born in the US with at least one immigrant parent - make up <a href="https://www.pewresearch.org/hispanic/chart/first-and-second-generation-share-of-the-population/">12%</a> of the American population, according to a 2017 Pew report. But the term can also be applied to those born abroad and raised in the US. Black immigrants with parents from the Caribbean, <a href="https://www.migrationpolicy.org/pubs/AfricanMigrationUS.pdf">Northern and sub-Saharan Africa</a>, and a smaller group from Canada and Europe are included in that makeup."Unfortunately, people do look at [all] Black people here as being black when it comes to these things and don't recognize our individual cultures and ethnicities," Jean-François said.<div type="image" title="Pew Research graph of first and second generation demographics change in US" height="1132" width="1400" msid="84487309" hostid="261"></div>Vice President Kamala Harris has had her own Blackness <a href="https://www.washingtonpost.com/nation/2019/03/15/black-like-kamala-harris-an-identity-dilemma-second-generation-black-immigrants/">called into question</a> on account of her Jamaican heritage. And former President Barack Obama faced lingering attacks on a racial identity, and US citizenship from the far-right who pinpoint his Kenyan father.With parents or guardians from countries where Black people are usually the dominant majority race, some second-generation immigrants like Love hold a different view of their place in the US in comparison to African Americans with longstanding history here. Sociology professor Nancy Foner noted pressure to reject the dominant culture "is usually found in first-generation immigrants," but with second-generation immigrants often "a small minority" still favor their ancestral home and cultural practices.For those that do, their reasons can be as rooted in societal anti-Blackness in the US that positions African Americans as inferior, as it is cultural pride. As a result, some second-generation Americans, even those who migrated to the US as a child <a href="https://www.nbcnews.com/news/nbcblk/solidarity-when-caribbean-immigrants-become-black-n308686">attempt to distance themselves from African Americans</a>. "My upbringing is very heavy on manners. I kind of had a different standard," Love said. "So I kind of grew up believing that Americans didn't have as good manners as Caribbean kids."One of the things that she found most challenging was navigating between being identified as Caribbean and being identified as African American, especially being born and raised in the US. <h2>Black immigrants don't always accept with the term 'African American'</h2><div type="image" title="harris.capitol" height="2000" width="2666" msid="84487311" hostid="261"></div>Foner said there is often a struggle second-generation Black immigrants face to define their Blackness, often most closely associating with their parents' homelands."They think of themselves in many cases as African Americans, but they also think of themselves in many cases as Jamaicans or Nigerians," she told Insider. "And because of how other Americans view race, they have a problem establishing their ethnic identity."Some research suggests most children of immigrants <a href="https://www.sciencedirect.com/science/article/pii/S1229545014000217">eventually assimilate</a>, taking on the cultural norms of where they reside to better fit in with the world outside of their homes. But that's not always the case - especially for Black second-generation Americans whose parents themselves may be unaware of the societal nuances that dictates what it means to be Black in America. Those who lean heavily towards becoming more Americanized may do so with the intent of being part of the African American culture. Jean-François told Insider she was keen to learn about Blackness in America and determined to understand the African American experience beyond what she learned in her Haitian home. Her parents, who migrated to the US in their 30s and 40s, didn't necessarily understand the systemic racism, redlining, economic disenfranchisement, or just being treated differently primarily because of the color of their skin. Their idea of navigating American society and becoming successful hitched on the cornerstone of attaining proper education and avoiding political or social activism and groups - something they didn't associate with their African American counterparts. Jean-François' own experience proved that to be untrue having moved to Canada, then the US. She was first made aware of her racial difference when, at eight years old, a white girl asked Jean-François whether her parents had left her in the toaster for too long. Love, too, came to the realization that what she learned in the home sometimes did not translate to when she was out in the world as a Black person, especially in the corporate world. At home, she was taught to be humble, keep her head down, and that with a good education and hard work she would be successful. But "that has not been true, in my experience, in the [American] workforce," she said. There are times, she said, when she had to be bold and make herself seen in a way she was told African Americans behaved to get ahead. But as part of the African diaspora overall, Love told Insider African Americans and Black immigrants are connected through shared traumas of slavery and segregation.<h2>Institutional racism impacts Black Americans no matter country of origin</h2><div type="image" title="solidarity protests " height="1335" width="2000" msid="84487312" hostid="261"></div>Black immigrants are part of the larger Black community in America and have similarly been treated institutional racism. As recent as 2018 the killings of St. Lucian American <a href="https://www.cnn.com/2018/09/07/us/dallas-police-shooting-botham-shem-jean/index.html">Botham Shem Jean</a> and Jamaican American <a href="https://www.nytimes.com/2018/04/04/nyregion/police-shooting-brooklyn-crown-heights.html">Saheed Vassell</a> made national and international <keyword id="6355005" type="UNKNOWN" weightage="100" keywordseo="news">news</keyword> as two Black immigrants who were victims of police brutality. Differences like Jamaican, Ghanaian, or Panamanian may be important at home - not within American institutions that devalue Black skin regardless of whether it carries a blue or red passport. "Being Black in America, the rest of the world doesn't care what my name is," Ephiphane Yohou, a Maryland-based global marketing strategist said, adding non-Black people seldom say 'let me go and find out where her last name comes from.'" "If you're Black, you're Black," she told Insider.Yohou, whose parents migrated from the Ivory Coast in West Africa, is often subject to the same stereotypes as all Black Americans - including the over-policing of her dress, hair, and mannerism in the workplace.She says the complexity of being Black in America, with various ethnic backgrounds, is all rooted in the desire to be accepted and free in the US - regardless of if a Black person is born in America or makes a home here for themselves. The diaspora has been uniting to fight against racial injustice, including <a href="https://www.usatoday.com/story/opinion/2020/09/10/why-haitian-americans-brooklyn-have-aligned-black-lives-matter-column/5757831002/">marches</a> in solidarity with the <keyword id="2771111" type="PERSON" weightage="60" keywordseo="black-lives-matter">Black Lives Matter</keyword> movement. Second generation Americans' lived experience also uniquely position them to fight against anti-Black racism while amplifying imm migrant issues.Black immigrants are detained and deported at <a href="https://www.insider.com/how-trump-tps-immigration-policy-could-affect-black-immigrants-2020-1">disproportionate rates relative to their population</a>, and many young migrants from Africa and the Caribbean are <keyword id="2382465" type="PERSON" weightage="60" keywordseo="DACA">DACA</keyword> recipients."We have to recognize African American cultures in the fight that they have waged historically, for African Americans, but all Black people who come here have benefited and are benefiting from it," Jean-François said.Even though their upbringing resulted in two different views of where they stand on being Black in America, both Love and Jean-François agree on one thing: being a Black person in America means dealing with racism. With that experience nearly universal across the diaspora, Jean-François says country-of-origin debates detract from liberation for all Black people, no matter where they're born."Whether or not we celebrate our individual cultures, when it comes to America and how they view Black people, we face the same challenges," she said.

For some children of immigrants, 'African American' doesn't fit their unique, Black experiences in the US

Pawar emphasized that the decision to cut short the legislature session is not out of any panic over <keyword id="1754604" type="PERSON" weightage="20" keywordseo="coronavirus">coronavirus</keyword>, but to enable the state government to marshall all its efforts towards the disease, and allow MLAs to return to their constituencies and oversee the precautionary measures being taken. Thackeray assured that though the 10 patients have tested positive, they are not 'serious' and they are undergoing treatment at various hospitals. Health officials have described the two found affected in Mumbai and the others in Pune as close to some of the afflicted who had returned from a Dubai trip last along with a 40-member tour. The two Mumbai patients are currently undergoing treatment in an isolation ward in Kasturba Hospital after their test reports were received on Thursday, an official of Communicable Diseases Control Programme said. The tour members hailed from different parts of Maharashtra and now warlike efforts are underway to trace them and implement the necessary measures. Thackeray and Pawar assured the people that the state government is fully geared towards tackling any crisis arising out of the coronavirus spread and appealed to all not to panic. "Those who have travelled and come from abroad are advised to stay indoors at home for 14 days. All others should avoid crowding in public places and exercise all other precautions as prescribed by the health authorities," Thackeray said. To a question, he said there appears to be no immediate need to shut down schools and colleges in the state and the situation would be monitored before taking the final decision. In a significant announcement, Thackeray said that there is a proposal to restrict people from entering the upcoming Indian Premier League (IPL) tourney matches in various stadia, as a precautionary measure. Health Minister Rajesh Tope said that sufficient number of beds in government and private hospitals - numbering around 650 in Mumbai - have been readied to tackle any emergency. "A central team of experts will visit the state soon and train our medical staff on handling Covid-19 patients. We have sufficient number of masks, medicines, beds and isolation wards, medical and para-medical staff to handle the situation," he added. While the state government has appealed to the people not to panic, as many as 138,968 passengers have been screened till Wednesday (March 11) at the three international airports in Mumbai, Pune and Nagpur. Besides, as per revised rules of the Centre, all passengers arriving from Iran, South Korea and Italy are being notified to the Bureau of Immigation. From February 29 till date, a total of 635 passengers from these affected countries have landed in Maharashtra. Since January 18, 349 people with suspected coronavirus symptoms were admitted to various hospitals in the state of which 312 have tested negative so far and discharged after completing their 14-day quarantine. Presently, 18 suspected Covind-19 patients are still in Pune hospitals and 15 in Mumbai hospitals whose test reports are awaited besides Coronavirus suspects in government hospitals in Nagpur and Pimpri-Chinchwad.

H1-B denial rates for initial petitions have increased four times between 2015 to 2018, from 6% to 24%. The denial rates have spiked further to 32% in the first quarter of 2019 . An analysis by the National Foundation for American Policy (NFAP) <a href="https://nfap.com/wp-content/uploads/2019/04/H-1B-Denial-Rates-Past-and-Present.NFAP-Policy-Brief.April-2019.pdf">states</a> that, in contrast, denial rates have never exceeded 8% in the years between 2010 and 2015.

NFAP noted that only 20% of full-time computer science and electrical engineering students in US universities are actually citizens of the US.
