Former President Donald Trump has opposed forgiveness altogether and has called for abolishing the Education Department.Despite its inability to provide broad cancellation, Biden's Education Department has issued targeted relief that has given nearly 5 million borrowers debt cancellation to date.Under Secretary of Education James Kvaal has been working on these efforts since 2021, trying to improve a higher education system that heavily relies on<a target="_blank" href="https://www.businessinsider.com/student-loan-repayment-issues-debt-relief-broken-industry-2023-9"> student loans</a>.He told Business Insider that shifting to a new administration's priorities will be "a baton race." He hopes the next president continues his work of thinking beyond just relief."We need to make sure that we run the student loan programs in a way that protects students from being left with unaffordable debts," he said. "But we also need to invest in making those programs affordable on the front end and then making sure that those programs reliably lead to graduation and a job."The issue has hardly been mentioned by the presidential candidates — drowned out by concerns about the <a target="_blank" class="" href="https://www.businessinsider.com/cost-expensive-goods-price-impact-presidential-election-scenarios-trump-harris-2024-10">economy</a>, <a target="_blank" class="" href="https://www.businessinsider.com/trump-harris-immigration-jobs-arizona-economy-mass-deportation-employment-wages-2024-10">immigration</a>, and <a target="_blank" class="" href="https://www.businessinsider.com/tax-cut-tariff-plan-outlook-presidential-election-scenarios-harris-trump-2024-10">taxes</a>. That's likely because polling shows it's not a top issue for voters. Just 18% of respondents said student-debt relief would impact their vote in a May Bankrate<a target="_blank" href="https://www.bankrate.com/loans/student-loans/student-loans-presidential-elections-survey/#struggling"> survey</a>, and a separate May <a target="_blank" href="https://apnews.com/article/student-loan-cancellation-forgiveness-college-debt-e5ad2748058cfd037e0323321f532836">survey</a> by the AP-NORC found just three in 10 adults approved of Biden's actions on the issue.While over 40 million Americans still hold student loan balances of about $38,000 on average, and it's keeping them from buying homes, starting a family, or saving for retirement, any future president has limited motivations — or options — for broad relief.<h2 id="de4b5f8c-f342-470c-b137-e8b952968ece">Without broad cancellation, Biden has been chipping away at relief for targeted groups of borrowers</h2>Despite getting stuck on broad relief, Biden's Education Department has spent the last four years making a slew of changes to relief programs like<a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-pslf-borrowers-getting-debt-cancellation-biden-relief-2024-7"> Public Service Loan Forgiveness</a>,<a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-art-institutes-borrower-defense-debt-cancellation-biden-2024-5"> borrower defense to repayment</a> for defrauded borrowers, and the<a target="_blank" href="https://www.businessinsider.com/what-is-new-gainful-employment-rule-student-loan-debt-relief-2023-9"> gainful employment rule</a>, which ensures a borrower's debt doesn't pile up after they graduate.The department also implemented a new income-driven repayment plan, SAVE, intended to lower monthly payments and provide a shorter timeline for forgiveness. The plan has been blocked in court since July following challenges from GOP-led states, and 8 million enrolled borrowers won't have to make payments for at least six more months as the Education Department works to reprogram its systems and adjust repayment plans for impacted borrowers.Some borrowers have lost hope. Constance, 65, has nearly $200,000 in student debt, an amount that's ballooned since she graduated from law school in 1994. Constance — who requested to go by her first name for privacy — went through periods during which her kids' expenses took up most of her salary. She placed her student loans on deferment, meaning she didn't make payments but interest accrued."It's just out of control at this point, and there's no way I'm going to be able to pay it off," Constance said.She's disappointed because she would likely qualify for Biden's<a target="_blank" href="https://www.businessinsider.com/biden-announces-new-student-loan-forgiveness-plan-who-qualifies-relief-2024-4"> second attempt at broader student-debt relief</a>, which has been blocked in court.Specifically, the plan would cancel up to $20,000 in student debt for borrowers whose balances have grown because of unpaid interest and provide relief for borrowers who first entered repayment at least 20 years ago.On October 25, the Education Department unveiled a separate proposal to provide relief to borrowers<a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-plan-borrowers-facing-financial-hardship-education-department-2024-10"> experiencing long-term financial hardship</a> that prevents them from repaying their loans, including challenges with high childcare or healthcare costs. The department expects to finalize the plan in 2025, and it did not comment on how a future administration could impact the relief.Sara Partridge, associate director for higher education policy at the left-leaning Center for American Progress Action Fund, told BI that it's hard to predict what relief will come for student-loan borrowers as legal challenges remain ongoing."We will likely need to see how the current case against the Plan B rule plays out to have a better understanding of what exactly is possible in the future," Partridge said.Kvaal said that moving forward, he wants to focus on the way the country finances higher education. He also said that borrowers should expect more action on student-loan industry regulation, pointing to the Education Department's restructuring of servicers' contracts over the past year. Those changes have enabled the department to process debt relief applications quicker and implement more safeguards for borrowers to ensure their servicers are fulfilling their contractual obligations.<h2 id="a6faf6f8-07ba-4a7e-9d8c-539861222c09">Harris vs. Trump on student loans</h2>Even though both Harris and Trump provided minimal detail on how they would address student debt, Partridge said it's helpful to look back on their previous actions."I would expect continued improvements and limited expansions of debt relief where legally possible under a Harris-Walz administration," Partridge said.She said the Trump administration "didn't take any major steps" to fix long-standing issues, like backlogs with Public Service Loan Forgiveness and borrower defense applications. Borrowers should not expect expanded relief or reform should Trump win the election. He also lauded the Supreme Court decision striking down Biden's debt relief.The composition of Congress will also impact what's in store for student-loan borrowers — Republican control would mean that <a target="_blank" href="https://www.businessinsider.com/gop-bill-overhaul-student-loan-repayment-stop-debt-relief-foxx-2024-1">previously introduced legislation</a> to prevent relief could be signed into law."Where is the forgiveness for the guy who didn't go to college but is working to pay off the loan on the truck he takes to work? What about the woman who paid off her student loans, but is now struggling to afford her mortgage? Is the administration providing them relief? Of course not," Sen. Bill Cassidy, the top Republican on the Senate Education Committee, said in a recent statement.Regardless of who wins the election, legal challenges to debt relief will keep borrowers in limbo. Kvaal said the fight isn't over, and the Biden administration will work to provide relief under its authority as long as it can."It has gone to the full extent of its authority to offer relief to borrowers," Kvaal said. "We are fighting currently in court to offer more debt relief, but we also are taking dozens of actions that are not contested in court that have helped millions of borrowers."

The 10-year Treasury yield rose to an intra-day peak of 3.77% on Thursday, higher than before the Fed cut the federal funds rate by 50 basis points on Wednesday.The rate on the 10-year bond closed at 3.65% on Tuesday.The divergence in a falling federal funds rate and a rising 10-year Treasury yield highlights the ultimate truth in markets, which is that they're forward-looking, and investors had adjusted their outlook for rates long before the Fed decision. That's evidenced by the fact that the 10-year US Treasury yield had already dropped 125 basis points from its 5% peak in October 2023, when it became clear that the Fed was done hiking rates.According to NYSE senior market strategist Michael Reinking, the slight bump in the 10-year Treasury yield suggests investors are feeling good about a potential soft landing in the US economy, as such a scenario would suggest the Fed doesn't need to cut rates as much as aggressively as the market previously thought."The reaction within Treasury markets was most telling yesterday. Fixed income markets were pricing in a very aggressive rate cutting cycle suggesting some skepticism with the soft-landing narrative. The aggressive action taken yesterday seems to have acquiesced some of those concerns, potentially leading to a less deep cutting cycle," Reinking said.However, it also means the 10-year Treasury is moving higher since the decision. The move highlights the fact that the Fed's short-term lending rate doesn't have the impact on long-term borrowing rates — for instance, the 30-year mortgage rate — that many may have been hoping for, and rate cuts might not end up providing much relief for borrowers. Mortgage rates barely budged on Wednesday, while short-term interest rates on high yield savings accounts and money market funds dropped within 24 hours.The 10-year Treasury yield is a lending benchmark for everything from home loans to corporate debt. While companies and consumers have both seen some relief from lower interest rates since they peaked in October 2023, <a target="_blank" class="" href="https://www.businessinsider.com/interest-rate-cuts-how-will-they-impact-me-lag-inflation-2024-9">it might be a while before they see rates come down further.</a>Freddie Mac data shows the average 30-year fixed mortgage rate is 6.2%. That's well below its peak of nearly 8% but still above the 10-year average of about 4.4%.For rates to fall further and for companies and consumers to get more relief in the form of lower borrowing costs, the 10-year Treasury yield needs to move lower — and that probably won't happen until the Fed turns more dovish and continues cutting rates. "US Treasury yields rebounded to a certain extent after the Fed's rate cut but could remain exposed to the downside... The dollar and Treasury yields may remain capped and could decline as new cuts are expected during the coming months," Exness financial markets strategist Inki Cho said in an email to Business Insider.Fed officials expect to lower rates by an additional 50 basis points by the end of this year, followed by another 100 basis points of interest rate cuts in 2025. However, markets see steeper cuts this year and next, according to the <a target="_blank" class="" href="https://www.cmegroup.com/markets/interest-rates/cme-fedwatch-tool.html?redirect=/trading/interest-rates/countdown-to-fomc.html">CME FedWatch Tool</a>.According to Carson Group global macro strategist Sonu Varghese, much of the move in interest rates has to do with Fed Chairman Jerome Powell's comments on Wednesday, in which he strongly defended the economy and said the Fed would not tolerate a higher unemployment rate."The Fed's essentially putting a cap on the unemployment rate, or a floor under the economy - it's as if the strike price of the Fed put went up. That's positive for the economy, and in that case yields should be higher. If the market didn't buy the Fed's guidance, and thought they were behind the curve, I think long- term yields would head lower (pricing in higher risk of recession)," Varghese told Business Insider.

The idea of going after a wildly successful Netflix show — "Baby Reindeer" was viewed 88.4 million times, according to <a target="_blank" href="https://d18rn0p25nwr6d.cloudfront.net/CIK-0001065280/d9ac401f-6967-4a26-868c-710952e5f3c0.pdf">Netflix's July letter to shareholders</a>, and is credited with helping the company add 8 million subscribers and make $9.5 billion in revenue in Q2 2024 — might seem like a herculean effort, especially when Harvey is suing in California, a state famous for its anti-SLAPP law that protects artistic creators like Netflix from <keyword id="19903650" type="General" weightage="20" keywordseo="defamation" source="keywords">defamation</keyword> claims. But Harvey just might have a case. And the outcome of her suit is about more than just a potentially massive payday for one woman. <a target="_blank" class="" href="https://www.businessinsider.com/baby-reindeer-timeline-fiona-harvey-richard-gadd-piers-morgan-martha-2024-5">The drama over "Baby Reindeer,"</a> which has been both a boon and a threat to the streamer, reflects a larger reckoning for prestige TV's favorite pastime: adapting true stories. <h2>'Baby Reindeer' is far from the first Netflix drama to face a defamation suit, but its marketing was slightly riskier</h2>"Baby Reindeer" features compelling performances from its cast (four of whom are now first-time Emmy nominees) and powerful writing from Gadd. Former New York City prosecutor Linda Fairstein <a target="_blank" class="" href="https://www.latimes.com/entertainment-arts/business/story/2024-06-04/netflix-ava-duvernay-linda-fairstein-when-they-see-us-lawsuit">settled with Netflix</a> and Ava DuVernay in June 2024 after she disputed her portrayal as a "villain" in "When They See Us," DuVernay's award-winning 2019 limited series about the 1989 Central Park jogger case, which Fairstein famously prosecuted (she was portrayed by Felicity Huffman on the show). Two other pending suits involve Netflix's unscripted docuseries. Kelly's former assistant filed a complaint against Netflix and Lifetime in February for painting her in a "sinister and defamatory light" in the docuseries "Surviving R. Kelly," which aired on both the streamer and the network. So what's different here? Harvey's lawyer, Richard Roth, told Business Insider in a phone interview that "Baby Reindeer" is a unique case because Netflix didn't market it as a fictionalized drama or say it was "based on" a <keyword id="20352963" type="General" weightage="20" keywordseo="true-story" source="keywords">true story</keyword>. Instead, the show's title card called it a true story outright from the opening moments of the first episode. While Gadd took pains to emphasize on his press tour that the series was "emotionally true" to his experience and not a line-by-line retelling of events, Netflix's marketing, which highlighted things like <a target="_blank" href="https://x.com/netflix/status/1779162630520729877?lang=en">the show's use of real emails</a> Gadd says his stalker sent him, fed the "true story" intrigue. Ultimately, viewers were compelled to play detective and go searching for the real Martha anyway. <h2>Defamation lawsuits are common – but not all of them get this much press</h2>Hollywood has been dramatizing true stories for as long as it has existed. The difference in the beginning was that most of the subjects were long dead: there are dozens of films about the real Macbeth, for instance, and Joan of Arc, each telling the story in a slightly different way. Things got a little more tangled once writers started dramatizing stories involving people who were still alive. One of the earliest examples of a case filed by an individual against a major media company was Street v. NBC, tried in Tennessee in July 1977. The case has similar echoes to the defamation lawsuits we see today. Victoria Street (formerly Victoria Price) sued the network over her portrayal in "Judge Horton and the Scottsboro Boys," a 1976 docudrama that recounted one of the many trials in the <a target="_blank" class="" href="https://www.pbs.org/wgbh/americanexperience/features/scottsboro-ruby-bates-and-victoria-price/">highly publicized Scottsboro case,</a> in which she and another white woman named Ruby Bates accused nine Black teenage boys of raping them on a train forty years earlier. Eight of the nine were sentenced to death for the crime despite a lack of medical evidence, but none were executed after Bates recanted her testimony and the accused received new trials on appeals. Street, who never recanted her testimony, took offense to the way she was portrayed and sued the network on charges of libel and invasion of privacy, arguing that she was no longer a public figure. <a target="_blank" href="https://www.nytimes.com/1982/10/19/obituaries/victoria-p-street-dies-at-77-a-figure-in-scottsboro-case.html">The case was ultimately settled</a> out of court, and Street died at 77 a few years later in 1982. Scores more defamation lawsuits have been filed in the years since, against everything from the 2013 Michael Bay movie "Pain &amp; Gain" (the real kidnapping victim <a target="_blank" href="https://www.hollywoodreporter.com/business/business-news/hollywood-docket-clemency-project-erin-887395/">didn't like</a> how the character based on him was portrayed as "an unlikeable, sleazy, rude, abrasive braggart") to the 2017 FX drama "Feud: Bette and Joan" (Hollywood legend Olivia de Havilland, then 101, would have <a target="_blank" href="https://www.theguardian.com/film/2018/mar/16/feud-olivia-de-havilland-sues-fx">preferred to be excluded</a> from this narrative). And while we're still <a target="_blank" href="https://www.businessinsider.com/why-hollywood-remakes-franchises-avatar-percy-jackson-one-piece-2024-3">retreading (and re-retreading) old IP</a> and always chasing the dangling carrot of the ever-elusive Original Idea, more and more shows are riffing on true events. Except instead of focusing on historical figures (though there's plenty of that too), they're increasingly about contemporary stories and people who arguably aren't hugely public personas. And unlike Macbeth and Joan of Arc, those people will absolutely sue you. <h2>Harvey's <keyword id="19905885" type="General" weightage="20" keywordseo="lawsuit" source="keywords">lawsuit</keyword> may not deter Netflix from making more shows like this</h2><a target="_blank" href="https://markets.businessinsider.com/stocks/nflx-stock">Netflix is an incredibly lucrative company</a> with presumably deep pockets — it's settled with everyone from a Georgian chess grandmaster <a target="_blank" href="https://variety.com/2022/tv/news/netflix-queens-gambit-lawsuit-settlement-nona-gaprindashvili-1235361680/">who says she was defamed</a> in "The Queen's Gambit," to former New York prosecutor Fairstein for "When They See Us," to <a target="_blank" href="https://www.businessinsider.com/griselda-blanco-family-settles-lawsuit-against-netflix-sofia-vergara-2024-2">drug queenpin Griselda Blanco's family</a> over "Griselda." Whether they fight Harvey's case in court or opt to settle, the amount it would cost to do either won't bankrupt them. That much we know. The real question is whether the sheets are balanced in the end: Would the cost of legal fees and a potential settlement or damages be more or less than what Netflix has made off "Baby Reindeer"? If it's more, will that stop Netflix and others from making more of these legally risky but creatively compelling shows? Harvey's lawyer Roth doesn't think Netflix particularly cared about the risk of legal action when it greenlit "Baby Reindeer." "I think they say, 'We're going to make so much money on this. If someone sues us, let them sue us,'" Roth says. There's also an argument to be made that any press, even a lawsuit, is good press. "I don't know if I have any inside knowledge about Netflix in particular, but I can say this: This is a very unique time for streamer wars, and Disney+ and Netflix and all these companies trying to land on top, or Netflix trying to stay on top," Jeff Lewis, a First Amendment attorney in Los Angeles, told Business Insider. "And it could be for this window of time, while there's some uncertainty as to which streamer will survive, perhaps Netflix might be more willing to take a risk and get more attention and eyeballs on their screens in exchange for paying some lawyer fees. Who knows?" That said, there's a chance Netflix will have to pay a hefty settlement to make the Harvey situation go away. The streamer has the advantage of the suit being filed in California, which has "one of the most robust pro-defendant defamation laws in the country," Lewis says, pointing out that an anti-SLAPP motion would dismiss the case and make Harvey responsible for paying all of Netflix's legal fees. Sure enough, on July 29, Netflix filed an anti-SLAPPP motion and a motion to dismiss the case, arguing that the claims in "Baby Reindeer" are "substantially true" and that any reasonable viewer would know that the show is not "a documentary representing literally true details and imagery." The streamer's filings included a declaration from Gadd, which detailed instances of harassment he says he faced from Harvey, and a declaration from Laura Wray, another woman who says she was once stalked by Harvey. But if Netflix doesn't win its motions, which are still awaiting judgment as of this writing, Harvey could potentially see a payout anywhere from $200,000 all the way into "mid-seven figures," according to Lewis. Jackie Ward, a Los Angeles-based entertainment attorney specializing in rights and clearances, points to the million-dollar donation Netflix made to the Innocence Project as part of Fairstein's settlement for "When They See Us" as a comparable example. "For Netflix to make something where they think that they do have some sort of liability, to make that go away for something like a million dollars, it's probably worth it to them for a company of that size," Ward says. "A smaller distributor, maybe not."

Ackman said that after meeting with students at the university last week, he believes the climate at Harvard is "dire and getting worse" with several Jewish students "being bullied, physically intimidated, spat on" and in some cases, "physically assaulted," in a more than 3,000-word letter he sent to Harvard president Claudine Gay on Saturday, and <a target="_blank" href="https://twitter.com/BillAckman/status/1720987581549080965">reposted</a> to X on Saturday night.
