<keyword id="6354780" type="General" weightage="20" keywordseo="karnataka" source="Orion">Karnataka</keyword> ranks at the top of the 18 large and mid-sized Indian states, with a population of over one crore each, in <keyword id="6357043" type="General" weightage="20" keywordseo="justice" source="Orion">justice</keyword> delivery -police, judiciary, prisons, and legal aid - in the country, as per the <keyword id="8082077" type="General" weightage="20" keywordseo="india-justice-report" source="Orion">India Justice Report</keyword> (<keyword id="4918298" type="General" weightage="20" keywordseo="ijr" source="Orion">IJR</keyword>) 2022.<br /><br />However, the latest data also indicated that as of December 2022, <keyword id="3658" type="General" weightage="20" keywordseo="india" source="Orion">India</keyword> had 19 judges per million population, a backlog of 4.8 crore cases, and prisons were over-occupied at over 130 per cent, more than two-thirds of the prisoners (77.1 percent) are undertrials, and vacancy among high court judges is at 30 percent.<br /><br />According to the India Justice Report (IJR) 2022, which ranks states on delivery of justice in the country, Karnataka is at the top followed by Tamil Nadu, Telangana, Gujarat, and Andhra Pradesh. Uttar Pradesh is at rank 18 which is the lowest, as per the report released here on Tuesday.<br /><br />The report said that in the list of seven small states, with a population of less than one crore each, Sikkim is at the top followed by Arunachal Pradesh, Tripura is at rank three and Goa is at rank seven.<br /><br />The report has tracked the performance of states in capacitating their justice delivery structures to effectively deliver mandated services and based on the latest official statistics, from authoritative government sources, it brought together otherwise siloed data on the four pillars of justice delivery - police, judiciary, prisons, and legal aid.<br /><br />Each pillar was analysed through the prism of budgets, human resources, workload, diversity, infrastructure, and trends (intention to improve over a five-year period), against the state's own declared standards and benchmarks. The IJR also separately assessed the capacity of the 25 state human rights commissions. The report stressed that vacancy is an issue across police, prison staff, legal aid, and the judiciary.<br /><br />It further added that for 1.4 billion people, India has about 20,076 judges with about 22 per cent of sanctioned posts vacant and vacancy among high court judges at 30 per cent.<br /><br />It said that as of December 2022, India had 19 judges per million population when calculated against the sanctioned strength, and a backlog of 4.8 crore cases. The Law Commission had desired, as early as 1987, it should be 50 judges per million in a decade's time from then, it added.<br /><br />The report said prisons are over-occupied at over 130 per cent and more than two-thirds of the prisoners (77.1 per cent) are awaiting the completion of investigation or trial. It further added that in the police, women are only about 11.75 per cent, despite their numbers doubling in the last decade and about 29 per cent of the officer positions are vacant. The police-to-population ratio is 152.8 per lakh, whereas the international standard is 222.<br /><br />According to the report, most states have not fully utilised funds given to them by the Centre and their own increase in spending on the police, prisons, and judiciary has not kept pace with the overall increase in state expenditure.<br /><br />It added that the justice system as a whole remains affected by low budgets and India's per capita spend on free legal aid - which 80 per cent of the population is eligible for - is a meagre Rs 3.87 per annum. Except for two Union Territories, Delhi and Chandigarh, no state spends more than 1 per cent of its total annual expenditure on the judiciary, said the report.<br /><br />The IJR was initiated by Tata Trusts in 2019, and this is the third edition. Karnataka at top in delivery of justice among 18 large states: India Justice Report

Only 22 per cent of the prison population are convicts while 77 per cent are 'undertrials' or people awaiting the completion of investigation or trial, the latest data published in the <keyword id="8082077" type="General" weightage="100" keywordseo="india-justice-report" source="Orion">India Justice Report</keyword> (<keyword id="4918298" type="General" weightage="80" keywordseo="ijr" source="Orion">IJR</keyword>) 2022 has revealed.<br /><br />The report found that the number of undertrials is the highest it's been since 2010, having nearly doubled from 2.4 lakh in 2010 to 4.3 lakh in 2021: an increase of 78 per cent.<br /><br />"With the exception of Andaman and Nicobar Islands, Arunachal Pradesh, Mizoram, <keyword id="6356054" type="General" weightage="50" keywordseo="tripura" source="Orion">Tripura</keyword>, and Madhya Pradesh, the undertrial population of all states and Union Territories (UTs) exceeds 60 per cent," the report added.<br /><br />Between 2017 and 2021, all states/UTs, with the exception of Arunachal Pradesh, Meghalaya, Nagaland and <keyword id="6354306" type="General" weightage="50" keywordseo="puducherry" source="Orion">Puducherry</keyword>, showed an increase in undertrial population, it said.<br /><br />While prolonged detention of undertrials is an indication that trials are taking a long time to complete, the report said, "This increases administrative workload, puts further strain on meagre budgets and impinges on spend per prisoner."<br /><br />At the end of 2021, 11,490 prisoners across the country had been incarcerated for more than 5 years, considerably higher than 7,128 in 2020 and 5,011 in 2019, the report found. However, of the total undertrials released during the year, 96.7 per cent left prison within one year, either on bail or on acquittal/ discharge, or got converted into convicts on completion of the trial, it added.<br /><br />Across the country, overcrowding is a universal and persistent condition, said IJR which uses the government's own statistics and data to compare and track the improvements and shortfalls in each state's structural and financial capacity to deliver justice. <br /><br />The report stated that prison populations had risen steadily from 4.81 lakh in 2019 to 4.89 lakh in 2020, and 5.54 lakh in 2021: while the number of people admitted to 1,319 prisons during 2021 increased by 10.8 per cent to 18.1 lakh from 16.3 lakh the year before.<br /><br />"16 states and three Union Territories housed more prisoners than their overall capacity. 15 states/ UTs posted increases over the year before with Bihar recording the highest increase from 113 per cent in 2020 to 140 per cent in 2021. At 185 per cent Uttarakhand had the highest average occupancy rates," the report said.<br /><br />"Nationally, roughly 30 per cent (391 prisons) record occupancy rates of 150 per cent and above, and 54 per cent (709 prisons) run above 100 per cent capacity. More than half of the prisons in 23 states/UTs are overcrowded," the IJR found.<br /><br />"Illustratively, among the 18 large and mid-sized states, Haryana has the highest share of overcrowded prisons... In <keyword id="20154" type="General" weightage="80" keywordseo="tamil-nadu" source="Orion">Tamil Nadu</keyword>, 15 of the total 139 prisons show overcrowding beyond 100 per cent-- and two show an occupancy beyond 150 per cent," the report said.<br /><br />Among the small states, four of Meghalaya's five prisons are overcrowded, followed by Himachal Pradesh with 14 of 23 of all its prisons running beyond 100 per cent capacity. Goa's single prison, too, was 33 per cent above capacity.<br /><br />"The increase in prison populations, despite the release of prisoners on temporary bail or emergency parole, may be attributed to two factors--an increase in arrests and the courts not functioning (except for urgent bail hearings)," the IJR highlighted.<br /><br />This IJR is a collaborative effort undertaken in partnership with DAKSH, Commonwealth Human Rights Initiative, Common Cause, Centre for Social Justice, Vidhi Centre for Legal Policy and TISSPrayas.<br /><br />The Model Prison Manual lays down a benchmark of one correctional officer for every 200 prisoners and one psychologist/counsellor for every 500.<br /><br />To meet the benchmark of one correctional officer for every 200 prisoners, there need to be at least 2,770 sanctioned posts of correctional staff across the country.<br /><br />"In reality, in 2021, there were only 886 correctional staff against 1,391 sanctioned posts. Nationally, on average, one correctional staff member serves 625 inmates; and vacancies stood at 36 per cent, a slight decrease from 40 per cent in 2020 and 42 per cent in 2019," the report stated.<br /><br />With the exception of Tamil Nadu and Chandigarh, no other state/UT meets the benchmark of one correctional officer for 200 inmates, it added.<br /><br />Although the Manual doesn't provide a benchmark, policy documents suggest 33 per cent reservation for women and the report said that as of 2021, no state fulfilled this quota. Nationally, women accounted for only 13.8 per cent of the total staff, a marginal increase from 13.7 per cent in 2020 and 12.8 per cent in 2019, it said.<br /><br />The report revealed that Karnataka was the only state where women constituted 32 per cent of total prison staff.<br /><br />"In 17 states/ UTs, the share of women does not cross 10 per cent. 77% inmates in prisons undertrials, says India Justice Report

<p>Benny Johnson has been demoted from his role as chief content at the Independent Journal Review after an internal review concluded he violated several company standards, a person familiar with the matter told Business Insider on Friday.</p><p>The announcement was made by IJR founder Alex Skatell on an editorial call.</p><p>"Alex made it very clear to the company that Benny is being demoted," the person said.</p><p>Johnson, according to the source familiar with the matter, will no longer be managing any employees at the conservative, upstart news website. He will also be forced to take communications training and be subject to a daily review, in addition to serving out a one-week suspension, the source said.</p><p>Johnson's exact new role at the company was not immediately clear. A spokesperson for IJR did not immediately respond to a request for comment.</p><p>The demotion came <a href="http://www.businessinsider.com/independent-journal-review-ijr-identity-trump-2017-3" target="_blank">after a Business Insider story</a>, citing current and former IJR staffers, revealed Johnson to have been a verbally abusive manager who had violated company ethics. He was accused of plagiarism in 2015 by his colleagues, two years after he had previously been fired from BuzzFeed for serial plagiarism.</p><p>A company review conducted this week found that in the 2015 story in question, Johnson appeared to "have not been properly quoted or attributed during the creation process."</p><p>Johnson was previously reprimanded by human resources for his verbal conduct with employees, a person familiar with the matter said.</p><p>Earlier this week, IJR suspended Johnson, viral editor Kyle Becker, and content editor Becca Lower over a post that was published which peddled a baseless conspiracy theory about former President Barack Obama.</p><p>In an all-staff email, Emily Hulsey, IJR's director of editorial operations, said that after the&#xa0;internal review, the company decided to also suspend Becker for two weeks and Lower for one day. <p></p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"><img src="https://static-ssl.businessinsider.com/image/58cafe4c112f701b008b4a51-2400/ap16361108355012.jpg" alt="barack obama michelle obama" data-mce-source="AP Photo/Carolyn Kaster" data-mce-caption="Barack and Michelle Obama speak during an event and their families at Marine Corps Base Hawaii."><p class="source"><span>AP Photo/Carolyn Kaster</span></p><p class="caption">Barack and Michelle Obama speak during an event and their families at Marine Corps Base Hawaii.</p></img></div><p></p></div></div>A reporter at the Independent Journal Review resigned on Thursday and another apologized following the decision to publish a story that suggested there was a potential connection between former President Barack Obama's Hawaii vacation and a state judge's ruling blocking President Donald Trump's second travel ban.<p>One source told Business Insider that Congressional reporter Joe Perticone decided to quit on Thursday for various reasons,&#xa0;but the&#xa0;story "seems to have been the&#xa0;straw that broke the camel's back."</p><p>Earlier in the day, Kyle Becker, the website's viral editor, wrote a story titled "Ex-President Obama Made 'Surprise Visit' to Hawaii, Just Days Before Judge Issued Travel Ban Ruling."&#xa0;</p><p>In the story, he pointed&#xa0;out that Obama visited Hawaii "just days ahead" of a judge's decision to halt Trump's executive order barring individuals from six&#xa0;countries from traveling to the US. The story&#xa0;also mentioned that&#xa0;that the president stayed at a "private undisclosed location," and that the judge who ruled in the case&#xa0;and Obama&#xa0;attended Harvard at the same time.</p><p>"This is not to allege the former president met with Judge Derrick Watson, but merely to point out the timing and the opportunity was there ahead of a controversial court ruling," Becker wrote.</p><p>Observers quickly noted that there was no evidence to support the story, <a href="https://twitter.com/woodruffbets/status/842445867252625413">which resembled a piece</a> posted on the far-right conspiracy site InfoWars on Thursday.</p><p><span>IJR later removed the piece, saying in an editor's note that the article "does not meet our editorial standards of represent IJR's vision or values."</span></p><p>In an internal email to IJR staffers, <a href="https://twitter.com/oliverdarcy/status/842465563217649665" target="_blank">obtained by Business Insider</a>, Becker apologized to&#xa0;his colleagues, saying it was "unwarranted to fuel baseless speculation," and he&#xa0;"should have shown restraint by not publishing the story in the first place."</p><p>"I take responsibility for showing a lack of judgment with the execution of a story this morning of already dubious pedigree that I would have done better just avoiding," Becker wrote.</p><p>He added: "I let the company down at a time when there's a lot of national attention on us, and it is not lost on me that the spillover of the story onto us as a company was harmful and unnecessary."</p><p>Thursday's story came at a time of&#xa0;heightened scrutiny on the five-year-old digital publication, which has taken fire for its close relationship with the Trump administration</p><p>The right-leaning news site first broke the news that Neil Gorsuch would be Trump's nominee to replace late-Justice Antonin Scalia on the Supreme Court, and got tipped-off to a dinner Trump attended at his hotel that other reporters were bared from.</p><p>IJR's Erin McPike was also granted the <a href="http://www.politico.com/story/2017/03/rex-tillerson-reporters-asia-state-236109">only seat on the plane</a> with&#xa0;Secretary of State Rex Tillerson during his first major international trip, breaking with precedent that reporters pay to rent a seat on the plane with the secretary. The State Department said the decision was an attempt for the department to save money, but was also "<span>part of an effort to include a broader representation of U.S. media."</span></p><p><span></span><span>Perticone joins other recent high-profile departures from the&#xa0;site, which was created by two former Republican staffers, and focuses on political news with a focus on conservative millennials.</span></p><p>"Joe's a fantastic reporter with great instincts for covering the Hill," IJR founder Alex Skatell said in a statement. Reporter at right-leaning news website quits after site publishes Obama conspiracy theory

Mark Meadows, the leader of the conservative House Freedom Caucus, reportedly got emotional after reading about the potential effects of the House GOP's healthcare bill on sick Americans.</p><p>According to <a href="http://ijr.com/2017/05/881482-cbo-health-care-bill-sick-people-face-higher-premiums-even-priced-market/">Haley Byrd at the Independent Journal Review</a> and <a href="http://www.washingtonexaminer.com/meadows-floats-more-funding-for-repeal-bill-after-cbo-score/article/2624096">Robert King at the Washington Examiner</a>, reporters showed Meadows a section of <a href="http://www.businessinsider.com/cbo-score-house-gop-healthcare-bill-ahca-macarthur-upton-amendments-2017-5">the Congressional Budget Office's report on the American Health Care Act</a>, which passed the House with only Republican votes on May 2.</p><p>The section Meadows viewed pertained to preexisting conditions. The report said <a href="http://www.businessinsider.com/cbo-score-ahca-premiums-sick-preexisting-conditions-2017-5">people with preexisting conditions in states that could accept a new waiver</a> from an AHCA provision could see their premiums skyrocket and possibly even be priced out of the insurance market.</p><p><a href="http://ijr.com/2017/05/881482-cbo-health-care-bill-sick-people-face-higher-premiums-even-priced-market/">IJR's Byrd reported</a> that Meadows was "surprised" when he was shown section that outlined the potential negative effects. After reading it, he became "emotional and choked back tears."</p><p>"<span>Listen, I lost my sister to breast cancer," Meadows <a href="http://ijr.com/2017/05/881482-cbo-health-care-bill-sick-people-face-higher-premiums-even-priced-market/">said, according to Byrd</a>. "I lost my dad to lung cancer. If anybody is sensitive to preexisting conditions, it's me. I'm not going to make a political decision today that affects somebody's sister or father because I wouldn't do it to myself."</span></p><p><span><a href="http://www.washingtonexaminer.com/meadows-floats-more-funding-for-repeal-bill-after-cbo-score/article/2624096">The Examiner similarly reported</a> that Meadows became "emotional" upon reading the report.</span></p><p><span>Meadows told reporters that he would support changes to the bill in the Senate to properly fund high-risk pools to protect those with preexisting conditions. He said that if the bill did not have "enough funding there to handle preexisting conditions and drive down premiums ... then we will have failed."</span></p><p>The waivers were added in an amendment from Rep. In an interview with the conservative-leaning Independent Journal Review <a href="http://ijr.com/2017/03/814687-trumps-diplomat/">published Tuesday night</a>, Tillerson said, "I didn't want this job. I didn't seek this job. My wife told me I'm supposed to do this."</p><p>"I was supposed to retire in March, this month," Tillerson said, "I was going to go to the ranch to be with my grandkids."</p><p>President Donald Trump <a href="http://www.businessinsider.com/trump-names-rex-tillerson-secretary-of-state-2016-12">chose Tillerson in December</a>, just over a month after Trump's surprise election victory. After a meeting with the then-president-elect, Tillerson said he was "stunned" when Trump asked him to be secretary of state. Tillerson's selection also came as a surprise to some observers due to his lack of government experience.</p><p>IJR reporter Erin McPike wrote Tillerson indicated that Trump saw his decades-long career at Exxon Mobil as a qualifying factor for the role, which is responsible in part for establishing US diplomatic policies globally.</p><p>Trump had been mulling over several other candidates for the job. Mitt Romney, the 2012 Republican presidential nominee, was one of them. Romney was seen as a favorite by some, but the Romney-Trump meetings <a href="http://www.businessinsider.com/kellyanne-conway-trump-mitt-romney-secretary-of-state-2016-11">stirred up a grassroots furor</a> among some Trump loyalists because Romney strongly opposed Trump during the campaign.</p><p>Despite Tillerson's apparent reticence, he indicated he is committed to sticking with the job: "I serve at the pleasure of the president," he said.</p><p>The secretary of state has had a <a href="http://www.businessinsider.com/rex-tillerson-asia-trip-press-2017-3">rough first few weeks on the job</a>. And it has reached a level that we are very concerned about the consequences of North Korea being allowed to continue on this progress it's been making on the development of both weapons and delivery systems." </span></p><p><span>Nuclear proliferation experts have <a href="http://www.businessinsider.com/how-the-us-will-deal-with-north-korea-2017-3" target="_blank">told Business Insider</a> that North Korea's eventual goal for its weapons program is to create an ICBM with a thermonuclear warhead that can reach the US mainland. </span></p><p><span>North Korea does not yet have that capability, but its latest high-profile tests show steady progress in that direction.</span></p><p><span>Stratfor Senior Military Analyst Omar Lamrani told Business Insider how the world would change if North Korea achieved its goal of building a weapon that can threaten Americans on American soil.</span></p><p><span>"North Korea has been perceived in the past as engaging in a nuclear weapons program as a way to trade for concessions from the US and South Korea," said Lamrani. "</span><span>But that paradigm doesn't hold anymore - North Korea decided to invest in a nuclear missile program not to trade it away, but as the ultimate security guarantee and the ultimate deterrent against outside attacks."</span></p><p><span>As it stands, the US and its allies would already <a href="http://www.businessinsider.com/north-korea-nuke-nuclear-strike-us-2017-1" target="_blank">face a tremendously difficult task</a> in disabling the entire North Korean nuclear weapons program, as hundreds of mobile missile launchers scattered across secret locations in a densely forested, mountainous peninsula make it a nightmarishly complicated to remove in one swift blow. </span></p><p><span><div class="KonaFilter image-container display-table"><div><div class="image on-image"><img src="https://static-ssl.businessinsider.com/image/58c806f76ad50a19038b47e4-1200" alt="north korea missile launch" data-mce-source="KRT via AP Video" data-mce-caption="In this image made from video released by KRT on Tuesday, March 7, 2017, North Korea launches four missiles in an undisclosed location North Korea. North Korea's latest progress towards this feat has deeply troubled US officials and observers. </span></p><p><span>"North Korea has made such progress now that the US feels that it does not have time anymore," said Lamrani, who added that an ICBM in the hands of Kim Jong-un would mean the US could no longer credibly threaten North Korea with nuclear force, representing a "point of no return" in multilateral relations. </span></p><p><span>But even though war with North Korea would be disastrous and potentially cost millions of lives, the window for US intervention is closing fast.</span></p><p><span>If North Korea develops credible ICBMs, as they may in coming years, the US will be left with three options, according to Lamrani:</span></p><blockquote><p><span>1. Continue with diplomacy and sanctions while building up ballistic missile <keyword id="6354810" type="ORGANIZATION" weightage="100" keywordseo="Defense">defense</keyword>.</span></p><p><span>2. Cave to North Korea's demands to be seen as a viable state, accept its nuclear program, and recognize the regime internationally.</span></p><p><span>3. Go to war and risk a nuclear holocaust on US soil, while simultaneously killing millions in North Korea with nuclear arms. </span></p></blockquote><p><span><div class="KonaFilter image-container display-table"><div><div class="image on-image"><img src="https://static-ssl.businessinsider.com/image/58628bedf10a9a6c008b557f-768/afp-n-korea-plans-nuclear-push-in-2017-top-defector.jpg" alt="kim jong un" data-mce-source="KCNA via Agence France-Presse" data-mce-caption="North Korean leader Kim Jong-Un delivers a speech to top delegates of the Workers' Party of Korea (WPK) in Pyongyang"><p class="source"><span>KCNA via Agence France-Presse</span></p><p class="caption">North Korean leader Kim Jong-Un delivers a speech to top delegates of the Workers' Party of Korea (WPK) in Pyongyang</p></img></div><p></p></div></div></span></p><p><span>The US currently employs the first option simply because it's the least worst choice, but Tillerson recently said the US's "strategic patience" with North Korea has ended. </span></p><p><span>Additionally, a <a href="http://www.armscontrolwonk.com/archive/1202966/guest-post-connecting-the-osint-dots-on-sri-lankan-north-korean-military-deals/" target="_blank">recent joint report from Arms Control Wonk and Reuters</a> uncovered an extremely complicated network of businesses and obfuscation that the Kim regime uses to rake in millions by selling military radios and other goods, despite sanctions. </span></p><p><span>Another Reuters report quoted North Korean officials as saying it does not fear or care about US sanctions, and it's planning a preemptive first strike of its own while their recent tests suggest it's closer than ever to capabilities that would allow them to overwhelm US missile defenses. </span></p><p><span>While the US can build up all the defenses it wants, <span>"missile defense is not a surefire way to negate the threat posed by another country's nuclear-capable ballistic missiles," <a href="https://twitter.com/KelseyDav">Kelsey Davenport</a><span>, the director of nonproliferation policy and a North Korea expert at the </span><a href="https://www.armscontrol.org/about/kelsey_davenport">Arms Control Association</a><span>, told Business Insider in January. </span></span></span></p><p><div class="KonaFilter image-container display-table"><div><div class="image on-image"><img src="https://static-ssl.businessinsider.com/image/58cbaa455124c98c5b4555f0-800" alt="Terminal High Altitude Area Defense (THAAD) interceptors arrive at Osan Air Base in Pyeongtaek, South Korea, in this handout picture provided by the United States Forces Korea (USFK) and released by Yonhap on March 7, 2017.
