Governments have said it, the courts have said it. Even the World Health Organisation (WHO) has said and reiterated this fact. Yet, in India, people are rushing to the pharmacies and hospitals with prescriptions for the drug leading to a crunch in its supply. “People are buying Remdesivir because that’s what the doctors are prescribing,” Pragati Medical, a pharmacy in Hyderabad, told Business Insider. As COVID-19 claims more victims in its second surge, Remdesivir⁠ — currently a drug of last resort against the novel coronavirus⁠ — has become a hot property with its own black market where it could cost, sometimes, up to five times the price. Even Twitter is awash with people requesting vials of the drug to treat their loved ones currently in intensive care units (ICUs). The utter chaos and confusion over Remdesivir in India is making the COVID-19 second wave worse

New Delhi, The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday stayed the conviction of Congress leader <keyword id="5268" type="General" weightage="100" keywordseo="rahul-gandhi" source="Orion">Rahul Gandhi</keyword> in a 2019 defamation case over his Modi surname remark, restoring his status as an MP. A three-judge bench of Justices B R Gavai, P S Narasimha and <keyword id="14272" type="General" weightage="80" keywordseo="sanjay-kumar" source="Orion">Sanjay Kumar</keyword> said no doubt that the utterances were not in good taste and that a person in public life is expected to exercise caution while making public speeches. "No reason has been given by the trial judge for imposing maximum sentence, the order of conviction needs to be stayed pending final adjudication," the bench said. The top court was hearing a plea by Gandhi challenging the Gujarat High Court verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his "Modi surname" remark. Former Gujarat minister Purnesh Modi had filed a criminal defamation case in 2019 against Gandhi over his "How come all thieves have Modi as the common surname?" remark made during an election rally in Kolar in Karnataka on April 13, 2019.

A quarter of all jobs in India’s judicial system are vacant⁠— delaying 28 million pending cases

<ul><li>ByteDance, TikTok’s publisher, is fighting the ban against the app stating that it will only hurt the civil right to free speech. </li><li>TikTok is currently banned in the south Indian state of Tamil Nadu for ‘encouring pornography’. </li><li>But, pornography on social networking platforms is an industry wide problem that other companies — like WhatsApp and Instagram — are also struggling with. </li></ul>ByteDance, the Chinese publisher behind turning musical.ly into TikTok, is fighting the ban <a href="http://v">imposed</a> by the <keyword id="6360667" type="UNKNOWN" weightage="20" keywordseo="madras-high-court">Madras High Court</keyword> in India’s apex judicial institution, the Supreme Court. In petitioning for the ban to be quashed, the mobile app publisher states that ban “amounts to curtailing of the rights of the citizens of India” as per a court filing seen by <a href="https://in.reuters.com/article/tiktok-india-court/ban-on-tiktok-app-would-harm-free-speech-chinas-bytedance-tells-indias-supreme-court-idINKCN1RN0MX">Reuters</a>. The plea will be <a href="https://www.thehindu.com/news/national/sc-to-hear-on-april-15-plea-challenging-hc-order-to-ban-tiktok-app/article26781547.ece">presented</a> in the Supreme Court on April 15 in front of a judicial bench comprising of Chief Justice Ranjan Gogoi and Justices Deepak Gupta and Sanjiv Khanna. The court had earlier refused the ‘urgent listing’ of the same plea on April 8. About 39% of the video streaming platform’s 500 million users are from India, most of them between the ages of 16 to 24. Keeping that demographic in mind, the public interest litigation (PIL) filed against TikTok alleged that some of the content on the platform was leaving children vulnerable to sexual predators and encouraging paedophiles. Subsequently, South Indian state of Tamil Nadu issued an interim order to bar any downloads of the mobile app citing that the social network was responsible for ‘<a href="https://www.businessinsider.in/tiktok-ban-in-india-for-hosting-porn/articleshow/68720430.cms">encouraging pornography</a>’. The interim order also bans TikTok videos from being shared by media outlets and wants a response from the Central Government around whether or not they will bring in a law similar to the Children’s Online Privacy Protection Action (COPPA) in the US before April 16.

 An investigation by the BBC found that hundreds of sexual comments and videos were being shared on TikTok by teenagers and children. And, while the company deleted most of the comments — most of the users are still on the platform despite TikTok’s own regulations against sexual content directed at children. That being said, pornography on social networks in India is an industry wide issue that isn’t specific to TikTok. In fact, banning TikTok will probably only make users shift to other platforms that have the same functionality as there is no dearth of option in the mobile app market. For instance, Instagram — the popular photo sharing app — has been <a href="https://tech.economictimes.indiatimes.com/news/mobile/on-instagram-in-india-its-sex-for-sale/67968584">pointed out</a> for facilitating sexual solicitation. And, WhatsApp groups have become the new safe haven for child pornography after India implemented a nationwide porn ban on website that were allegedly hosting indecent videos with underage participants. An <a href="https://economictimes.indiatimes.com/tech/internet/probe-finds-child-pornography-in-indian-whatsapp-groups/articleshow/67430347.cms">investigation</a> by AntiToxin Technologies, an Israeli online safety startup, found that hundreds of videos were being shared globally under the cloak of the platform’s end-to-end encryption. TikTok is the second Chinese mobile app with a large Indian user base to face problems in India after the battle royale game, PlayerUnknown’s BattleGrounds was <a href="http://v">banned</a> in various districts of Gujarat. And, India isn’t the only country calling for a ban on TikTok. The video sharing mobile app has already been banned in China, Indonesia (now repealed) as well as in India’s own neighbor, Bangladesh. Banned for hosting porn, TikTok cites damage to free speech in its appeal to India’s Supreme Court

<keyword id="2934282" type="UNKNOWN" weightage="100" keywordseo="Gujarat-Food-and-Drug-Control-Authority">Gujarat Food and Drug Control Authority</keyword> (FDCA) on Monday said it removed the ban on the sale of <keyword id="75190" type="CITY" weightage="100" keywordseo="Nestle">Nestle</keyword> India’s ‘<keyword id="6369404" type="PERSON" weightage="100" keywordseo="Maggi">Maggi</keyword>’ noodles after the <keyword id="48485" type="ORGANIZATION" weightage="100" keywordseo="Bombay-high-court">Bombay High Court</keyword> lifted the nationwide ban on it in August. 

	“FDCA had lifted the ban on Maggi in Gujarat after the Bombay High Court passed an order to lift the ban across India. We took the decision based on the court order,” Gujarat FDCA Commissioner H G Koshia said. 
 The <keyword id="6370685" type="ORGANIZATION" weightage="100" keywordseo="Gujarat-Government">Gujarat government</keyword> had banned the sale of Maggi for a month in June this year after the lead and monosodium glutamate levels in the noodles were found to be above the prescribed limits. Later, the ban was subsequently extended till September. However, the Gujarat FDCA revoked the ban mid-way in August following court order. On August 13, the Bombay High Court had lifted the nationwide ban imposed by Indian food regulators on Maggi noodles, and asked its manufacturer Nestle India Pvt Ltd to go for a fresh test of samples in three independent laboratories across India. 

	But Maggi is still not available in Gujarat markets, as the company is following court order to get its samples tested from three approved laboratories. The state government had in the first week of June banned Maggi sale in the state after the product failed the food safety test. The government had also asked the company to withdraw all its stock of Maggi from the state. 
 

	At that time, the government claimed that all 27 samples collected from different parts of the state had failed the tests, as lead content was found above the prescribed limit in 14 samples while monosodium glutamate, which should not be there at all, was found in all the samples. 
 

	Nestle India had on Friday said that all samples of Maggi have cleared tests conducted by three laboratories, as mandated by Bombay High Court, paving the way for the instant noodles brand to be back in the market after it was banned over the presence of excess lead. The company said it will now commence manufacturing and will sell “only after the newly manufactured products are also cleared by the designated three laboratories”.

Gujarat government lifts ban on sale of Maggi noodles on Bombay HC's order

In a major setback to the 17-member consortium of banks, which is trying to recover loans of more than Rs 8,000 crore from Vijay Mallya’s <keyword id="6373962" type="CITY" weightage="100" keywordseo="Kingfisher-Airlines">Kingfisher Airlines</keyword>, the <keyword id="6360101" type="ORGANIZATION" weightage="80" keywordseo="Gujarat-High-Court">Gujarat High Court</keyword> has announced that declaring 'wilful defaulter' and debarring access to loans from banks is unconstitutional. 
 The court, in its judgment, said <keyword id="30067" type="ORGANIZATION" weightage="80" keywordseo="RBI">RBI</keyword>'s 'master circular' doesn’t have and any standing under Sections 21 and 35A of the Banking Regulation Act, 1949. 
 The court said the circular was in violation of the <keyword id="540275" type="UNKNOWN" weightage="100" keywordseo="RBI-Act">RBI Act</keyword> or the Banking Regulations Act, 1949, and gave too much power to banks through "the circular that confers uncanalised, unbridled and untrammelled power upon the banks to decide the future of any borrower and makes the bank a judge in its own cause and also the decision whether the other banks should lend money to the borrower declared as a wilful defaulter." 
 
The judgment noted, "The RBI circular is required to have the phrase ‘in public interest’ or ‘in interest of depositors’ or ‘in interest of banking policy’ and should indicate relevant materials and reasons that the circular was being issued after considering the interest mentioned.” 
Most legal experts were of the view that banks have been abusing their power to declare a borrower 'wilful defaulter’ even before a court’s judgment.
