"We will try to convince all the finance ministers. Yesterday I had the opportunity to discuss with the finance minister of Maharashtra and I told him, you please go to the meeting and put up this proposal for reducing GST up to 12 per cent on flex engines, cars, and scooters," he said. Addressing IFGE's India Bio-Energy and Tech Expo in New Delhi, the Union Minister added that factors such as economic viability, proven technology, availability of raw material, and marketability of the finished product are in favour of the development of these engines. Gadkari said that developing flex-fuel engines is the target of the government, and we have the "proven technology" to make it possible. "I feel that now the flex fuel is very, very important. Already the managing director of Tata, Suzuki and Toyota, they have decided to start flex engine car in the country," the Union Minister stated. Gadkari added, "So the flex engine is the ultimate target. As far as the market is concerned, there is huge potential. So that is the important reason that it is going to be advantageous to the common man also," the Minister stated. He said, "Many of the generator manufacturers are working to change the diesel generators into ethanol. One of the companies is also they are taking an interest in converting 5 lakhs of telecommunication towers there and 250 crore litre consumption of diesel. Now they are also changing into ethanol." He further stated that the raw material is already available in India, there is a need to think about ways to increase the production of biomass, which can be useful for making biofuel. Gadkari asked states to pitch for reducing GST on flex engine vehicles

The Karnataka State Consumer Disputes Redressal Commission has directed the hospital and two <keyword id="20000183" type="General" weightage="20" keywordseo="doctors" source="keywords">doctors</keyword> to pay Padmavathi, a resident of Jayanagar, Rs 50,000 as litigation expenses. It has also directed <keyword id="22497673" type="General" weightage="20" keywordseo="New-India-Assurance-Co-Ltd" source="keywords" meta.keywordsubtype="org" meta.entityname="New India Assurance Co Ltd" meta.hostid="261" meta.entityid="New India Assurance Co Ltd">New India Assurance Co Ltd</keyword>, which had issued a policy covering the hospital expenses, to pay her Rs five lakh for "the professional and <keyword id="21130249" type="General" weightage="20" keywordseo="medical-negligence" source="keywords">medical negligence</keyword> caused." The then 32-year-old woman underwent the surgery on September 29, 2004 at the <keyword id="22497672" type="General" weightage="20" keywordseo="Deepak-Hospital" source="keywords" meta.keywordsubtype="org" meta.entityname="Deepak Hospital" meta.hostid="261" meta.entityid="Deepak Hospital">Deepak Hospital</keyword>, with the two doctors allegedly performing the hernia operation. On completion of the surgery, her appendix was also removed, according to the Commission's order last month. Immediately, on the next day, she complained of severe pain for which she was prescribed some pain killers and assured that it is post surgery discomfort and that it will get cured. She suffered acute stomach and back pain for several years and was also admitted in the same hospital twice later, the order noted. Padmavathi later approached another private hospital here in 2010 and during a scan, it was noticed that some foreign body existed in the abdominal and back portion of her body and it was suggested to her to get it (surgical needle) removed. She then underwent surgery and the 3.2 cm surgical needle was removed following which she approached the consumer forum with a complaint the following year. The forum noted that the complainant was aged about 32 years, when she underwent all these surgeries and removal of the surgical needle. "Definitely she suffered severe pain and inconvenience till removal of the surgical needle," the order stated. Hence, she is entitled to get "global compensation" of Rs five lakh and the insurance company (New India Assurance Company Limited) is directed to pay the amount while the two doctors are liable to pay litigation expenses of Rs 50,000 to the complainant, it further added.

The Union Finance Ministry had begun consultations on the budget a few days ago with different stakeholders of economy. Infosys says Karnataka govt withdrawing pre-show cause notice on GST notice

Speaking at the inauguration of the new <keyword id="22890667" type="General" weightage="20" keywordseo="GST-Bhawan" source="keywords">GST Bhawan</keyword> in Udaipur, Rajasthan, Sitharaman emphasized the importance of a preventive approach in handling tax-related issues. She highlighted that government officials should prioritize solving problems at the stage where they are mere doubts, rather than allowing them to develop into full-blown grievances. "Before addressing a grievance, if we spend time through outreach to clear the doubts and suspicions in their minds, those doubts won't escalate into grievances" said Finance Minister Sitharaman. Sitharaman also highlighted the significance of effective information sharing in this process. She suggested that by engaging in sector-wise outreach and addressing any doubts that arise, officials could prevent potential issues from turning into grievances. "I request that before grievances arise, we should definitely carry out outreach sector by sector. If there are any doubts in their minds after this and some changes need to be made accordingly, we can make those changes as well. So, more than anything else, we need to focus on information sharing" added Sithraman. Furthermore, the inter-governmental settlement process saw the central government disbursing Rs 50,307 crore to CGST and Rs 41,600 crore to SGST from the IGST collected. This resulted in total revenue of Rs 94,153 crore for CGST and Rs 95,138 crore for SGST for April 2024 after regular settlement. During the financial year 2023-24 the total gross GST collection recorded at Rs 20.18 lakh crore, exceeding Rs 20 lakh crore with a 11.7 per cent increase compared to the previous fiscal year. The average monthly collection for this fiscal year, that ended in March 2024 stood at Rs 1.68 lakh crore, surpassing the previous year's average of Rs 1.5 lakh crore. The surge in recent GST collections reflects a positive trajectory for India's economy, underscoring robust domestic consumption and buoyant import activity. The total amount of compensation released to the States/UTs so far, including thus Rs 17,000 crore, during the year 2022-23 is Rs 1,15,662 crore, the Ministry of Finance said in a statement on Friday. "This is despite the fact that total Cess collection till October 2022 is only Rs.72,147 crore and the balance of Rs. 43,515 crores is being released by the Centre from its own resources. With this release, the Centre has released, in advance, the entire amount of Cess estimated to be collected this year till March-end available for payment of compensation to States," the statement added. This decision was taken to assist the States in managing their resources and ensuring that their programmes especially the expenditure on capital is carried out successfully during the financial year. "Even in May this year, the Central Government had released Rs. 86,912 crores as provisional GST compensation to States for the period Feb-May'2022 despite the fact that there was only about Rs. 25,000 crores in the GST Compensation Fund, by making arrangement of funds of around Rs. 62,000 crores from its own resources," the statement said. Goods and Services Tax was introduced in the country with effect from July 1, 2017, and states were assured compensation for loss of any revenue arising on account of the implementation of GST as per the provisions of the GST (Compensation to States) Act, 2017 for a period of five years. For providing compensation to States, Cess is levied on certain goods and the amount of Cess collected is being credited to Compensation Fund. Centre releases ₹17,000 cr as GST compensation to States/UTs

Chennai, Tamil Nadu's ruling <keyword id="19897149" type="General" weightage="20" keywordseo="dmk" source="keywords">DMK</keyword>, a key constituent of the INDIA bloc, in its manifesto released on Wednesday promised to repeal the Citizenship Amendment Act, 2019 if the opposition alliance wins the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> polls. Restoration of statehood to Jammu and Kashmir and holding polls there, scrapping the New Education Policy 2020, slashing fuel prices, annulling Article 361 of the Constitution that provides protection to governors from legal action and appointment of Governors following consultation with Chief Ministers, were among the key promises made by the DMK. The recommendations of the M S Swaminathan committee will be adopted to ensure that MSP for agricultural products "is set at total production cost plus 50 per cent," the DMK said. Also, it announced that if voted to power, the INDIA bloc will withdraw the Agnipath scheme and reintroduce "permanent recruitment service" in the Indian Armed forces. "From now on, population census, including caste-wise census and census concerning people below the poverty line, will be conducted by the Union government once every five years simultaneously." The DMK will firmly insist on the removal of Article 356, which allows the dismissal of duly elected state governments and imposition of President's rule. The Congress party's ally in Tamil Nadu said that "new constraints" on States' borrowing capacity, imposed by the union government beyond the limits in each state's FRBM-equivalent Act will be eliminated. "A recommendation to share cess revenues with states will be made. It will be proposed that the Finance Commission increase the horizontal devolution of tax revenue (to all States together) from 42 per cent to 50 per cent." The Union government's financial contributions to states will be based on the income tax and GST collected in those states. Thus, financial contributions will be assured based on the taxes collected within each state. The finance provided to states will be permanently determined based on the 1971 population. A 33 per cent reservation for women in Parliament and legislative assemblies will be implemented immediately. "DMK will insist that the Union government enact a law providing menstrual leave to women, emphasizing the journey towards gender equality." Petrol and diesel prices "will be set at Rs 75, Rs 65 (per litre)" and cooking gas cylinders shall be made available at Rs 500 (per cylinder). "The introduction of the Uniform Civil Code will be strictly prevented" to preserve India's secular nature as stated in the Constitution's preamble. "The 2019 CAA law will be repealed, and all minorities will be treated equally without any discrimination. The recommendations of the Sachar Committee for the improvement of the lives of Muslims and other minority communities will be implemented." Facilitation will be provided for <keyword id="21027983" type="General" weightage="20" keywordseo="sri-lankan-tamil" source="keywords">Sri Lankan Tamil</keyword> refugees to get Indian citizenship. Assistance will be provided to those who wish to return to Sri Lanka. Also, the manifesto said efforts will be made to implement reservation for minorities at the all-India level, similar to Tamil Nadu. "The financial assistance previously provided to minority educational institutions has now been stopped. Action will be taken to resume this assistance." For "political" reasons, funding from foreign countries to non-governmental organisations (NGOs) has currently been stopped. "The Foreign Exchange Regulation Act will be properly amended, and measures will be taken to ensure these financial aids continue to reach NGOs without any problems." The proposal of 'One Nation, One Election' will be abandoned, and for the allocation of Lok Sabha seats to states, the current practice, based on the 1971 census will continue. All "people-unfriendly" laws introduced by the BJP government over the last 10 years will be reviewed immediately by the INDIA alliance government. The "labour-hostile laws" introduced by the BJP government will be "reformed." Through the Employees' Provident Fund (EPF), the Union government will ensure a minimum pension of Rs 5,000 per month. "The <keyword id="19996334" type="General" weightage="20" keywordseo="vishwakarma-scheme" source="keywords">Vishwakarma Scheme</keyword>, introduced by the BJP government to encourage caste-based occupations, will be restructured on the basis of social justice."

DMK vows to repeal CAA if INDIA bloc is voted to power

The <keyword id="6355040" type="General" weightage="80" keywordseo="gst-council" source="Orion">GST Council</keyword> is likely to introduce an 18 per cent tax rate on corporate guarantees extended by parent companies to their subsidiary firms for getting loans from banks, according to reliable sources. The issue was taken up by the <keyword id="6354679" type="General" weightage="100" keywordseo="gst" source="Orion">GST</keyword> Council's law committee during various meetings held recently. The law committee is of the view that extending a corporate guarantee is a related party transaction that is considered as a supply. The logic is that since supplies come in the 18 per cent GST bracket, this should also be applicable to corporate guarantees. The law committee has recommended adopting valuation rules in line with safe harbour rules under the <keyword id="6370810" type="General" weightage="20" keywordseo="income-tax-act" source="Orion">Income Tax Act</keyword> for providing corporate guarantees. Under these rules, in eligible international transactions, the minimum acceptable commission/fee is 1 per cent of the amount guaranteed. Therefore, it was proposed that there is a need to consider adopting the same in the case of related party transactions under GST as well. The final decision will be taken at the GST Council meeting on Saturday. A corporate guarantee is an arrangement among group companies by which a parent company agrees to act as a guarantor for a subsidiary company while securing credit facilities from a bank. These arrangements are executed either without any consideration or with a nominal commission on the loan amount. The GST Council is also expected to take up the issue on whether this 18 per cent GST should be levied on personal guarantee, as well given by promoters/directors for loans given by banks to a company. In the case of a personal guarantee, the law committee cited the <keyword id="6354335" type="General" weightage="50" keywordseo="reserve-bank-of-india" source="Orion">Reserve Bank of India</keyword>'s mandate which states that no consideration by way of commission, brokerage fees, or any other form could be paid to the director by the company, directly or indirectly, in lieu of providing a personal guarantee to the bank for borrowing credit limits. This appears to suggest that the 18 per cent GST is not strictly applicable in cases of personal guarantees.
