<ul><li>The <keyword id="6355014" type="UNKNOWN" weightage="20" keywordseo="delhi-high-court">Delhi High Court</keyword> has rejected <keyword id="375475" type="COMPANY" weightage="20" keywordseo="Future-Retail">Future Retail</keyword>'s plea for an ad interim injunction against the global e-commerce giant <keyword id="18635" type="CITY" weightage="20" keywordseo="Amazon">Amazon</keyword>.</li><li>However, the order also said that prima facie Future Retail's resolution approving the Reliance deal was also valid.</li><li>Amazon had sent a legal notice to Future Coupons over Future Group’s ₹25,000 crore deal with Reliance.</li></ul>Reliance Industries agreed to buy Future Group but Amazon objected. The Jeff Bezos-led company already got an order from a Singapore arbitrator stopping the deal between Mukesh Ambani and Kishore Biyani from progressing. In response, Future Group went to the Delhi High Court seeking it to stop the global e-commerce giant from interfering in the deal between. What the court said in its verdict is a case of “operation successful but patient dead”, said Hitesh Jain, Managing Partner at Parinam Law Associates. The court said that Amazon is free to challenge the deal and the spokesperson chose to highlight that part. “We welcome the verdict of the Hon’ble High Court of Delhi rejecting the interim injunction sought by Future Retail and their claim that the Emergency Arbitrator process is invalid under Indian law,” Amazon spokesperson told Business Insider. The court wants authorities to decide based on the application from Amazon and the objections of Future Group, explained Supreme Court advocate Yamuna Natchiappan. However, while allowing Amazon to appeal to other regulators like the Securities and Exchange Board of India (SEBI) or Competition Commission of India (CCI), the Delhi High Court in its order said that there prima facie, the suit filed by Future Retail is maintainable, Emergency Award is valid and Future Retail's resolution approving the Reliance deal was also valid. What’s worse for Amazon? The Delhi High Court has essentially ruled that Amazon cannot use an agreement with one Future group company i.e. Future Coupon to exert control over a deal struck by another company i.e. Future Retail. That would be in violation of India’s Foreign Exchange Management Act (FEMA). Not just that, the court went further to say, that this “amounts to tortious interference.” And, that alone tilts the case in favour of Biyani. “If there is a prima facie case then balance of convenience follows the party who has the prima facie case,” according to Jain. Based on this verdict, Jain believes, Future group can move the Supreme Court against Amazon. Whether it will or not, is yet to be seen. As far as the resolution which Amazon sought to challenge which is the 29th August board resolution that resolution has been held to be valid and therefore there can’t be any interference in relation to the scheme, Future Retail’s legal representative Ameet Naik told <a href="https://twitter.com/ETNOWlive/status/1340991412351893505">ET NOW</a>. The arbitration proceedings between Amazon and Kishore Biyani have begun in Singapore. Former Attorney General of Singapore, V.K. Rajah concluded arbitration hearing on Friday, October 16 and will deliver his ruling on or before Monday, October 26, sources said. Rajah, former Attorney General of Singapore, is the sole arbitrator in the Amazon vs. Future vs. Reliance arbitration matter. An emergency hearing of the arbitration took place in Singapore on Friday. Harish Salve appeared for the Future Retail (being acquired by RIL) while Singapore based lawyer, Davinder Singh appeared on behalf of Future Coupons Pvt Ltd. (FCPL) -- the holding company of Kishore Biyani. Gopal Subramanium, former Solicitor General of India, appeared for Amazon. The hearing is said to have lasted for 5 hours. The arbitrator V.K. Rajah said that he would deliver his judgment on or before Monday. That judgement will eventually decide the fate of Reliance's deal with the Future Group. Amazon's investment in FCPL is around Rs 1,500 crore, which is an insignificant amount for <keyword id="191583" type="PERSON" weightage="20" keywordseo="Jeff-Bezos">Jeff Bezos</keyword> -- the richest man in the world and CEO of Amazon. According to experts, Amazon's legal salvo at Future is indirectly aimed to thwart Reliance's attempt to establish its leadership position in the Indian retail sector. Irked over truckload of bulky documents filed by parties in a batch of petitions arising out of the Amazon-Future Retail case (Reliance Industries acquisition deal with Future Retail), the Supreme Court Tuesday asked whether the purpose was just to drag on or harass the judges and sought a common small compilation of documents. The top court was hearing a fresh petition of Future Group against the Delhi High Court's recent order declining its plea for stay on an arbitration tribunal decision refusing to interfere with the Singapore International Arbitration Centre's (SIAC) Emergency Award (EA) which restrained it from going ahead with the Rs 24,731 crore merger deal with Reliance Retail. The bench was also hearing a counter plea by Amazon, seeking to restrain the regulators from approving the merger deal. It said the last order was passed with the consent of the parties that the regulatory authorities will not approve the merger deal without prior nod from the top court. The dispute over the merger deal has seen several rounds of litigation after SIAC passed the EA in favour of the US firm on October 25, 2020 staying the merger. On October 21 this year, a duly-constituted panel of arbitrators at SIAC reiterated the decision of the EA. Then on October 29, the Delhi High Court declined Future Group's plea for stay on the arbitration tribunal order refusing to interfere with the EA which restrained it from going ahead with the Rs 24,731 crore merger deal with Reliance Retail. The high court sought response from Amazon which had challenged the merger before the SIAC, and listed the appeals by FCPL and FRL for further hearing on January 4, 2022. FRL and FCPL moved the top court recently against the order with fresh pleas. Kishore Biyani and 15 others including FRL and FCPL have been embroiled in a series of litigations with Amazon, an investor in FCPL, over the deal with Reliance. Following the EA, subsequently, a three-member arbitral tribunal was constituted to decide the issues arising from the deal. On September 9, the apex court had stayed for four weeks all proceedings before the high court in relation to the implementation of the EA and also directed statutory authorities like National Company Law Tribunal (NCLT), Competition Commission of India (CCI) and Securities and Exchange Board of India (Sebi) not to pass any final order related to the merger deal in the meantime. Subsequently, the arbitration tribunal under the SIAC rejected on October 21 the FRL plea to lift the interim stay granted by its EA on October 25 last year, observing that "the Award was correctly granted". Amazon had dragged Future Group to arbitration at SIAC in October last year, arguing that FRL had violated their contract by entering into the deal with rival Reliance. The FRL and FCPL had moved the top court against the high court order of August 17 which said that it would implement the earlier order by its single-judge restraining FRL from going ahead with the deal in pursuance of the EA's award. The high court had said that in the absence of a stay, it would have to enforce the order passed by its single judge, Justice J R Midha, on March 18. On March 18, besides restraining FRL from going ahead with its deal with Reliance Retail, the court had imposed costs of Rs 20 lakh on the Future Group and others associated with it and ordered attachment of their properties. On August 6, the Supreme Court gave the verdict in favour of Amazon and held that EA award, restraining the Rs 24,731 crore FRL-Reliance Retail merger deal, is valid and enforceable under Indian arbitration laws. The apex court had also set aside the two orders of February 8 and March 22 of the division bench of the Delhi High Court order which had lifted the single-judge's orders staying the FRL-RRL merger. A bench headed by Justice R F Nariman, since retired, had dealt with the larger question and held that an award of an EA of a foreign country is enforceable under the Indian Arbitration and Conciliation Act. According to a lawsuit viewed by Insider, the claimants suing the <keyword id="11936960" type="UNKNOWN" weightage="60" keywordseo="coffee-chain" source="Orion">coffee chain</keyword> are a husband and wife couple. The husband suffered injuries when hot coffee was spilled on his lap, per the claim.Evan Arlington and his wife, Stephanie Arlington-Macias, filed the lawsuit in the Superior Court of Passaic County on April 4. Per the lawsuit, things went wrong when the pair ordered two hot coffees and one iced coffee at a Dunkin' location in Totowa, New Jersey. "Defendants were negligent in the preparation, sale, and service of the coffee to plaintiff in that it was too hot," the lawsuit said. It added: "As a result thereof, plaintiff Evan Arlington has been severely injured, has suffered and in the future will suffer great pain and mental anguish." Arlington suffered a permanent injury due to the incident, the lawsuit stated. According to the claim, he has also had to allocate funds toward future medical treatments that will subsequently cause him to suffer a loss of income.The wife, Arlington-Macias didn't go unaffected. The lawsuit stated she "suffered a loss of her husband's aid, comfort, conjugal fellowship and consortium," following the incident. According to the filing, Arlington's lawyer William Gold of New Jersey-based law firm Bendit Weinstock has demanded answers from Dunkin' regarding the temperature range that Dunkin' serves hot coffee and the temperature of the beverage was when it was served to Arlington.Dunkin' has been hit with other lawsuits recently over the temperature of their coffees. Last year, Angela Barbarosa from Brockton, Massachusetts, sued the donut chain when she suffered serious burns and nerve damage after a tray of hot coffees she had ordered spilled on her."The Dunkin Donuts employee had negligently failed properly to cap the coffees, or placed them firmly into the tray, and as the tray was brought into the car, the coffees came loose and tipped their scalding hot contents onto the Plaintiff, which scalded her legs and buttocks," <a href="https://www.documentcloud.org/documents/21083754-2183cv00813-barbosa-angela-vs-cadete-enterprises-inc-dba-dunkin-donuts-et-al">the lawsuit stated</a>. The incident left Barbarosa with permanent scars on her body. Dan Cox, a legal expert with 39 years of experience handling lawsuits over hot spillages, told Insider that the question at hand is usually how the beverage was handled. "Everyday coffee &amp; tea drinkers consume millions of beverages without incident," Cox said. "It only becomes an issue when it is used improperly i.e. spilled," he added. Cox suggested the likelihood of claimants winning their case against coffee chains was slim. He said he's worked on more than 80 lawsuits over hot coffee spillages, "with no end in sight." Echoing Cox, personal injury lawyer Kevin Biniazan of Virginia-based law firm Breit Biniazan, told Insider that cases involving hot coffee spillages and injuries that result from it are very difficult to win, and to many people, are the "epitome of frivolous lawsuits." The verdict in the US usually comes to "whether the product or what's being served is unreasonably dangerous," Biniazan said. "The reality is that to win a lawsuit like this, it's not enough to prove that it's hot, you have to prove that it's unreasonably dangerous," he added. "If the person serving the coffee is acting reasonably and doing something that's expected of them in that circumstance, just because it results in the coffee spilling doesn't mean they acted negligently or they acted wrongfully," he continued.

The premium memberships ranked similarly, with Costco costing $120, BJ's costing $110, and Sam's Club costing $100 annually.
