The following has been edited for length and clarity.I grew up in a small beach town called Manta in Ecuador with my dad, mom, and two sisters. My dad always taught me that there was nothing I couldn't do.I became interested in computers and technology because of <a target="_blank" class="" href="https://www.businessinsider.com/guides/tech/playstation-plus">PlayStation</a>. Sometimes, I couldn't finish a game because the dialogue and options were in English, so I became very motivated to learn computers and English.<h2 id="aea16f41-f4aa-4e6e-926f-62684543751d">After graduating from high school, I decided I wanted to pursue my education in the US</h2>To apply to a university in the US, you must pass either the <a target="_blank" class="" href="https://www.businessinsider.com/do-colleges-require-standardized-testing-sat-admissions-what-it-means-2024-3">SAT or ACT</a>. I bought an ACT book and prepared for many months to ensure I could get a good score.I knew I couldn't attend college in the US without a scholarship, so I began investigating scholarships and programs. I found the University of South Florida in Tampa offered a scholarship for students from Latin American countries that would get me a student visa.I was awarded the scholarship, which allowed me to receive a stipend of $1,000 a year to cover textbooks and resident status for tuition purposes.<h2 id="1ea4606f-8ed1-484d-bf1a-b39e05b12a66">I began a bachelor's degree in computer engineering in 2012</h2><a target="_blank" class="" href="https://www.businessinsider.com/us-and-uk-life-biggest-differences-after-moving-home-space-2024-7">Coming to the US</a> at 17 was very challenging. It was my first time leaving home, and there was a lot I didn't understand about the US. I had no close friends or family here for support or guidance.It was also very exciting, as it was an opportunity to push myself. It took some time to get used to classes in English. I studied hard from 8 a.m. to 11 p.m. every day.<h2 id="d640f046-61e6-4e77-9c39-669f1b3f751d">In my second semester, I found the Society of Hispanic Professional Engineers</h2>The SHPE is a national organization that empowers Hispanics and offers mentorship programs in STEM. Classmates told me they offered free pizza. I'm really glad I was feeling hungry that day.They were welcoming and taught me the basics of the school system, how to <a target="_blank" class="" href="https://www.businessinsider.com/why-this-is-an-excellent-resume-2013-11">create a résumé</a>, conduct interviews, and apply to grad school. It was a blessing to find them — suddenly, I had a community of people who wanted to help me succeed.<h2 id="e2632ea8-177e-49a0-b62a-e961cc3cb10a">A fellow student advised me to get as many internships as possible</h2>That was the best advice I received for navigating the US system. If I had just focused on the school material and not gained practical experience, I'm not sure I would've been able to find a job after graduating.I had multiple internships as a <a target="_blank" class="" href="https://www.businessinsider.com/recruiter-how-filter-applications-software-engineering-job-post-atl-interview-2024-5">software engineer</a> with local companies in data centers and startups via student work permits. These internships allowed me to gain experience and earn some money.I was extremely fortunate to count on my dad's support to cover any difference between my earnings and expenses.<h2 id="f9d3935c-b09d-48b2-9bb8-dfcaa291a51f">I went on to pursue a master's degree in computer science at Virginia Tech</h2>I sought universities with good computer science programs and scholarships or assistantships. Virginia Tech had an amazing program and great tenured professors, and it offered me an opportunity as a TA, so the decision was obvious.My teaching assistantship paid for all my tuition and also paid me around $20,000 each semester.<h2 id="c9fdec8c-c770-4f06-a7af-8a6bb5f26c51">I started applying for jobs in 2017</h2>I must've applied for over 100 of them. When you apply, employers ask you if they'll need to sponsor you at some point in the future, as not every employer can cover the financial costs associated with the process when the time comes.I received four offers from Microsoft, Verizon, Deutsche Bank, and Disney. Microsoft had the best offer and was willing to sponsor my visa.<h2 id="a93721cf-c9e0-46f2-bd96-3071c98b4800">I started as a software engineer with Microsoft in 2018</h2>When I started my job at Microsoft in Seattle, I could work thanks to a student work permit that lasts one year after graduation and is granted to all F-1 visa students. While working on the student permit, your employer helps you apply for an <a target="_blank" class="" href="https://www.businessinsider.com/h1b-visa-lottery-changes-benefit-startups-hiring-immigrants-2024-2">H-1B</a> visa.I applied for a <a target="_blank" class="" href="https://www.businessinsider.com/big-tech-green-card-applications-pause-2024-5">green card</a> after working on my H-1B visa for a year. By this point, I had lived in the US for about six years and created a whole life here, but the green card process was very painful.<h2 id="a2b4001a-c572-41e4-89cb-053b4e3c883a">The process makes life pretty horrible</h2>Having a work visa and going through the green card process are privileges, but it is very hard to separate the emotional component.There's no guarantee that you'll get to stay. If something goes wrong at any given time, you have to be ready to pack your bags and leave everything behind. I know some people who tried to get it three times and ran out of chances and had to return home.The first few years working were also difficult because I wasn't around anyone who looked like me. I wanted to grow and challenge myself, but at the same time, it made me wonder if I belonged, and doubt and <a target="_blank" class="" href="https://www.businessinsider.com/managing-imposter-syndrome-when-you-are-the-boss-2021-10">imposter syndrome</a> crept in.Luckily, Microsoft paid for the attorneys in the green card process, and no cost came out of my pocket.<h2 id="1eb526a5-91be-4063-bec1-58a529e97297">I had to constantly review what they were putting on the application forms</h2>My key takeaway is that, even if you're working with lawyers, you still have to assume complete ownership of the application process and remember the lawyers supporting you, being human, can make mistakes.I was audited because some of the information that had been submitted was incorrect. It took me six to eight months to provide supplemental information and pass the audit.In 2022, I finally received my green card after three years.<h2 id="bd375841-9305-458d-bfb3-92ac255d1675">Last year, I decided to move into product management and took a new job at Starbucks</h2>In software engineering, you work on problems created by engineers for engineers. I wanted to learn how to build products that our customers actually love, so I ended up becoming a technical product manager.I love the US, I love the city I live in, and I love its people. However, students will still be required to have a visa and may face travel or other visa restrictions due to the coronavirus pandemic. In a recent tweet, US President <keyword id="6354484" type="PERSON" weightage="20" keywordseo="Donald-Trump">Donald Trump</keyword> said that schools must open in the fall. The government added that social distancing measures should be strictly enforced across the operating campuses in the country. This comes on the backdrop of the latest amendments introduced by the US government for students as campuses shift to a remote learning model. On July 7, The Trump administration announced that the international college students who are taking classes online will not be permitted to stay in the US on a student visa. "Nonimmigrant students within the United States are not permitted to take a full course of study through online classes. If students find themselves in this situation, they must leave the country or take alternative steps to maintain their nonimmigrant status such as a reduced course load or appropriate medical leave,” the US Immigration and Customs Enforcement earlier <a href="https://www.businessinsider.in/international/news/ice-says-international-students-taking-online-courses-have-to-transfer-or-leave-the-us-as-dozens-of-schools-shift-to-remote-learning-in-response-to-covid-19/articleshow/76824683.cms">said</a>. The international students can apply for two types of student visas to study in the US — <a href="https://www.uscis.gov/i-9-central/642-f-1-and-m-1-nonimmigrant-students">M-1 nonimmigrant visa and F-1 nonimmigrant visa</a>. The M-1 nonimmigrant visa is extended to those applying vocational or non-academic studies. While the M-1 nonimmigrant visa is granted to students pursuing language courses or other academic training in the country. In the meantime, the Trump administration is also cracking down on the work visas granted to the international employees working in the US — calling them a ‘threat’ to American jobs. US student visa restrictions may be eased slightly to help foreign non-immigrant students

<ul class="summary-list"><li>Vaishali Gauba dreamed of being a journalist in the US but wasn't able to secure an H-1B visa. </li><li>Years later, Gauba secured a work visa in Canada after moving there to study. </li></ul>This as-told-to essay is based on a transcribed conversation with Vaishali Gauba, 29, about her experience navigating the US and Canadian immigration systems. Business Insider verified her visas. The following has been edited for length and clarity.I <a target="_blank" href="https://www.businessinsider.com/moved-to-usa-denmark-pros-prefer-america-2024-3">moved to the US</a> when I was 17, with ambitions of being a journalist.I grew up in Gurugram, India, and moved to New Jersey in 2012 for my undergraduate degree. I studied journalism, media studies, and business management at Rutgers University.I worked with major US news outlets during and after college and wanted to keep working in America, but couldn't secure an <a target="_blank" href="https://www.businessinsider.com/us-startups-sponsor-h1b-work-visas-2024-1">H-1B work visa</a>. I returned to India feeling defeated. Five years later, I <a target="_blank" href="https://www.businessinsider.com/english-man-moved-to-canada-loves-it-surprising-things-2023-10">relocated to Canada</a>.In Canada, I found a clearer path to securing a work permit, and I'm less worried about being uprooted by the immigration system.<h2 id="b6a8d628-2960-4ae2-bfa9-e6651b4da0a4">I interned at US media companies at university</h2>I came to the US on an F-1 visa, which is for full-time students.During my studies, I worked for the student newspaper, The Daily Targum, and also did news internships at CNBC, NBC, and CBS, which each lasted around four months.I remember having to get permission from international student services and the journalism department to do the internships, as there were restrictions around working off-campus for F-1 students. The work had to be related to my field of study.I remember feeling anxious about needing to get so many approvals to work as an <a target="_blank" href="https://www.businessinsider.com/how-employers-can-support-international-students-job-seekers-2022-3">international student</a>, but thankfully, I was permitted to do the internships.Working at big-name publications felt like a milestone, but it was also difficult to balance the internships with two college majors.<h2 id="76d690be-d407-4073-9d70-b7a3d889b3da">I wasn't able to secure an H-1B visa to stay in the US</h2>I became accustomed to the reality that anything related to my professional life required a lot of paperwork. I knew that to continue working in the US, I needed to apply for <a target="_blank" href="https://www.businessinsider.com/ice-arrests-15-students-employed-fake-companies-to-stay-us-2020-10">optional practical training</a>, which allows F-1 students to work for a year in a field related to their studies.I graduated in May 2016, and after my OPT was approved, I started on the CBS Page Program, a rotational program for graduates.I had several assignments there, including on the evening news and The Late Show with Stephen Colbert. I talked with Stephen Colbert at the show's rooftop parties and saw many celebrities on the job.But my time there was limited. The Page Program lasted a year, around the time my OPT expired. After six months on the program, I asked CBS about the possibility of sponsoring me for an H-1B visa but was told they don't offer sponsorships.I didn't realize this when I started working there, but I wanted the experience and to work on my OPT, so I would have done the program regardless.I applied to other jobs, but many applications included a question about whether I'd need a <a target="_blank" href="https://www.businessinsider.com/fake-name-resume-hired-guilty-2024-5">visa sponsorship</a> now or in the future. I felt that this one question was already filtering me out as a candidate and I wasn't getting called for interviews.I spoke with two lawyers about my options. They told me about the <a target="_blank" href="https://www.businessinsider.com/us-ukraine-tech-culture-differences-2024-5">O-1 visa</a> for people with "extraordinary" ability in certain fields. I tried gathering references for the application, but as time went on, I felt my chances were slim.This is partly because the lawyers shared case studies of people who received O-1 visas with me, and I felt they were more arts-orientated than journalism-orientated. I felt the lawyers weren't confident I had a good chance, so I decided not to apply.Extended family members and lawyers suggested I continue my education to stay in the US on another F-1 visa. I eventually decided against this as I didn't think I could learn anything about news from a school program I wasn't already learning at CBS.<h2 id="f3fc1807-fde1-4bd6-b552-e9cd476f3cef">I went back to India feeling defeated</h2>I started to feel lost. I remember lashing out at my dad on the phone when he suggested I come home, but in the end, I had a gut feeling that it was time to return to India, so <a target="_blank" href="https://www.businessinsider.com/left-us-for-northern-ireland-these-cultural-differences-surprised-me-2023-9">I left the US</a> in August 2017.It felt like a defeat. I knew I wanted to be a journalist in America, but I couldn't do it. I'd given so much to the US in terms of time, energy, and money, and it was hard to accept that I had to give up on it because of visa stuff.I spent the next five years in India, working in journalism before pivoting into a brand and communications position. In 2021, I began freelancing in PR and marketing strategy.I planned on doing a master's in digital media to boost my PR career. My boyfriend at the time, who's my husband now, <a target="_blank" href="https://www.businessinsider.com/moving-from-sydney-australia-to-canada-pros-cons-2024-5">moved to Canada</a> for his MBA in 2021, so I started exploring master's options there.<h2 id="d34eb837-2609-4a93-ba9b-25683513eb6c">I've found the Canadian immigration system to be more immigrant-friendly</h2>I came to Canada on a study permit and started my master's program at Toronto Metropolitan University in September 2022.I applied for a work visa in September 2023 after finishing my studies. While it took a long time to get my study permit because of <a target="_blank" href="https://www.cicnews.com/2023/12/breaking-canadian-parliament-committee-provides-recommendations-to-address-immigration-backlogs-1240610.html#gs.bm1bft">the backlog created by COVID-19</a>, the work visa process took less than a month and was fairly easy.Graduating from my master's program made me eligible for an open work permit, which isn't tied to a specific employer. I'm self-employed as a freelancer.Unlike the US <a target="_blank" href="https://www.businessinsider.com/h1b-visa-lottery-changes-benefit-startups-hiring-immigrants-2024-2">H-1B process</a>, I didn't need an employer to sponsor me, and there was no lottery system.While I'm aware that some people have a hard time coming to Canada, my overall experience of Canadian immigration processes has been smooth. I feel it's more favorable to immigrants than the US processes.I couldn't get a work visa in the US, but there was a clearer and more stable path to getting one in Canada.When I left the US in 2017, <a target="_blank" href="https://www.businessinsider.com/trump-first-week-as-president-2017-1">Donald Trump</a> had just become president. My understanding is that it's become <a target="_blank" href="https://www.businessinsider.com/amazon-google-twitter-speak-out-against-trump-h1b-visa-freeze-2020-6">harder to get a work visa in the US</a> since.My work visa expires in October 2024, and I'm open to options for settling in Canada beyond that. Moving back to India is still a small possibility as my partner, and I have family there, but I like the <a target="_blank" href="https://www.businessinsider.com/montreal-canada-city-low-cost-of-living-quality-of-life-2024-6">quality of life in Canada</a>, and I'm less concerned about my life being uprooted here than I was in the US.

I lost my dream job in the US because I couldn't get a work visa. In Canada, the pathway has been much smoother. 

The US has received sufficient number of applications needed to reach the <keyword id="10784391" type="General" weightage="80" keywordseo="congressionally" source="Orion">Congressionally</keyword> mandated 65,000 H1-B <keyword id="6359421" type="General" weightage="20" keywordseo="visa" source="Orion">visa</keyword> cap for the fiscal year 2023, the country's federal agency for immigration services said on Tuesday. The <keyword id="6358066" type="General" weightage="20" keywordseo="h-1b-visa" source="Orion">H-1B visa</keyword> is a non-immigrant visa that allows US companies to employ foreign workers in speciality occupations that require theoretical or technical expertise. Technology companies depend on it to hire thousands of employees each year from countries like <keyword id="3658" type="General" weightage="20" keywordseo="india" source="Orion">India</keyword> and China. The H-1B visa programme is the most sought-after work visa among foreign professionals, including Indians. We have received a sufficient number of petitions needed to reach the Congressionally mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa US advanced degree exemption, known as the master's cap, for fiscal year 2023, the <keyword id="368921" type="General" weightage="50" keywordseo="us-citizenship-and-immigration-services" source="Orion">US Citizenship and Immigration Services</keyword> (<keyword id="137642" type="General" weightage="80" keywordseo="uscis" source="Orion">USCIS</keyword>) said in a statement. USCIS has completed sending non-selection notifications to registrants' online accounts. The status for registrations properly submitted for the FY 2023 H-1B numerical allocations, but that were not selected, will now show, Not Selected: Not selected not eligible to file an H-1B cap petition based on this registration, it said. Meanwhile, the federal agency will continue to accept and process petitions that are otherwise exempt from the cap, it said. Petitions filed for current H-1B workers who have been counted previously against the cap, and who still retain their cap number, are exempt from the FY 2023 H-1B cap, it said. However, USCIS will continue to accept and process petitions filed to extend the amount of time a current H-1B worker may remain in the US, change the terms of employment for current H-1B workers, allow current H-1B workers to change employers, and allow current H-1B workers to work concurrently in additional H-1B positions, it added. US has reached the H-1B visa limit for the financial year of 2023

In yet another immigration-friendly move, the <keyword id="10092361" type="General" weightage="20" keywordseo="Biden-administration" source="Orion">Biden administration</keyword> has agreed to provide automatic work authorisation permits to spouses of H-1B visas holders, a step that would benefit thousands of Indian-American women. The settlement in this regard was reached by the Department of Homeland Security in a class-action lawsuit, which was filed by the <keyword id="620952" type="General" weightage="20" keywordseo="American-Immigration-Lawyers-Association" source="Orion">American Immigration Lawyers Association</keyword> (AILA) on behalf of immigrant spouses this summer. "This (H-4 visa holders) is a group that always met the regulatory test for automatic extension of EADs (employment authorisation documents), but the agency previously prohibited them from that benefit and forced them to wait for reauthorisation. People were suffering. They were losing their high-paying jobs for absolutely no legitimate reason causing harm to them and US businesses," Jon Wasden from AILA said. The litigation successfully achieved the reversal of the US Citizenship and Immigration Services (USCIS) policy that prohibited H-4 spouses from benefiting from the automatic extension of their employment authorisation during the pendency of stand-alone EAD applications. "Although this is a giant achievement, the parties' agreement will further result in a massive change in position for the USCIS, which now recognises that L-2 spouses enjoy automatic work authorisation incident to status, meaning these spouses of executive and managers will no longer have to apply for employment authorisation prior to working in the <keyword id="6356955" type="General" weightage="20" keywordseo="united-states" source="Orion">United States</keyword>," AILA said. "We are delighted to have reached this agreement, which includes relief for H-4 spouses, through our litigation efforts with Wasden Banias and Steven Brown. It is gratifying that the administration saw that settling the litigation for non-immigrant spouses was something that should be done, and done quickly," said Jesse Bless, AILA director of federal litigation. The Obama administration had given work authorisation to certain categories of spouses of <keyword id="6358066" type="General" weightage="20" keywordseo="H-1B-visa" source="Orion">H-1B visa</keyword> holders. So far, more than 90,000 H-4 visa holders, a significant majority of whom are Indian-American women, have received work authorisation. If you have an H-1B visa, your spouse can get automatic work authorisation

<ul><li>An individual travelling to the United States on a business or <keyword id="6369102" type="General" weightage="20" keywordseo="tourist-visa" source="Orion">tourist visa</keyword> -- B-1, B-2 -- can apply for new jobs and even appear in interviews.</li><li>At the same time, the USCIS said that before beginning any new employment, a petition and request for a change of status from B-1 or B-2 to an employment-authorized status must be approved.</li></ul>WASHINGTON: An individual travelling to the United States on a business or tourist visa -- B-1, B-2 -- can apply for new jobs and even appear in interviews, a federal agency said Wednesday, but asked prospective employees to ensure the applicants have changed their visa status before starting the new role. In a note, and a series of tweets, the <keyword id="6354458" type="General" weightage="20" keywordseo="US" source="Orion">US</keyword> Citizenship and Immigration Services (USCIS) said when nonimmigrant workers are laid off, they may not be aware of their options and may, in some instances, wrongly assume that they have no option but to leave the country within 60 days. The maximum 60-day grace period starts the day after termination of employment, which is typically determined based on the last day for which a salary or wage is paid. When a nonimmigrant worker's employment is terminated, either voluntarily or involuntarily, they typically may take one of the several actions, if eligible, to remain in a period of authorised stay in the United States. These include filing an application for a change of nonimmigrant status; filing an application for adjustment of status; filing an application for a "compelling circumstances" employment authorization document; or be the beneficiary of a nonfrivolous petition to change employer. "If one of these actions occurs within the up to 60-day grace period, the nonimmigrant's period of authorized stay in the United States can exceed 60 days, even if they lose their previous nonimmigrant status," the USCIS said. If the worker takes no action within the grace period, they and their dependents may then need to depart the United States within 60 days, or when their authorized validity period ends, whichever is shorter, it said. A US-based diaspora body on Tuesday launched an online petition campaign urging the Secretary of State Anthony <keyword id="10620101" type="General" weightage="20" keywordseo="blinken" source="Orion">Blinken</keyword> to reduce the long waitlist for various types of American visas being issued from <keyword id="3658" type="General" weightage="80" keywordseo="india" source="Orion">India</keyword>. "We request the State Department, Secretary of State Mr Anthony Blinken and the US embassies in India to eliminate wait times for <keyword id="6359421" type="General" weightage="20" keywordseo="visa" source="Orion">visa</keyword> appointments in India. "Even after a two-year-long Covid-era pause in visa appointments at the US embassies in India, the visa appointment situation is far from normal, requiring 300 to 900 days of wait time based on the visa types," Foundation for India and Indian Diaspora Studies or FIIDS said launching its online petition campaign. As per travel.state.gov reports on October 31, there is an average 900+ days' wait time for appointments for visitors' visa (B1/B2), an average 400 days' wait time for students (F, M,J) and an average 300 days' wait time for petition-based temp workers like H, L, O, P and Q across the USA consulates in India (Mumbai, New Delhi, Hyderabad, Chennai and Kolkata), it said. In contrast, the US consulates in China only have an average three days' wait time, FIIDS said. "The 900+ days' delay deprives Indian Americans and Indian immigrants in the USA of having their beloved relatives to visit, whether in the time of difficulties, needs, or for celebrations, impacting their quality of life," it said. "The 400+ days' wait time affects students joining the US universities, that not only impacts students' future but also negatively impacts the US universities," FIIDS said, adding, the 300+ days' wait time is impacting productivity and success of various industries and businesses due to lack of skilled workers. "We urge the US State Department and Sec Blinken to resolve this issue. We believe it is not only important for US interests but the right thing to do on moral and compassionate grounds," FIIDS said in its petition on Change.Org. "As per Reuters news on 27th Sept, the Secretary of State blamed the lack of resources and funding due to lost revenues from fees on this 'self-financed program,'" the petition said. "We request the concerned authorities to take all necessary steps and to seek emergency funds to resolve this backlog. We are eager to assist in any way possible and will forge a coalition of individuals who will rise to the occasion to assist in mitigating this issue," it added.
