The <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="345" meta.entityid="Supreme Court">Supreme Court</keyword> on Friday granted <keyword id="20018932" type="General" weightage="20" keywordseo="interim-bail" source="keywords">interim bail</keyword> to <keyword id="19919270" type="General" weightage="20" keywordseo="Delhi-Chief-Minister" source="keywords">Delhi Chief Minister</keyword> <keyword id="260213" type="General" weightage="20" keywordseo="Arvind-Kejriwal" source="Orion">Arvind Kejriwal</keyword> in a <keyword id="19899231" type="General" weightage="20" keywordseo="money-laundering" source="keywords">money laundering</keyword> case lodged by the ED in the alleged <keyword id="20571419" type="General" weightage="20" keywordseo="excise-policy-scam" source="keywords">excise policy scam</keyword> but he will remain in jail as the CBI had later arrested him in a related matter. The top court said it is up to <keyword id="19895701" type="General" weightage="100" keywordseo="Kejriwal" source="keywords">Kejriwal</keyword> to decide if he should continue as chief minister. "We are conscious of the fact that Arvind Kejriwal is an elected leader," a bench of Justices Sanjiv Khanna and Dipankar Datta said while also noting that Kejriwal has suffered incarceration for over 90 days. It also referred the questions pertaining to legality of his arrest in the Enforcement Directorate (ED) case to a larger bench. The court said since the matter is concerned with the right to life and the issue of arrest has been referred to a larger bench, Kejriwal be released on interim bail. The top court framed three questions related to power, necessity of arrest under section 19 of the Prevention of Money Laundering Act and policy of arrest by the ED. It said Kejriwal will be released on interim bail in terms of the conditions in the order of May 10. While releasing Kejriwal on interim bail on May 10 for electioneering during the recently concluded Lok Sabha polls, the top court had imposed conditions on him that he will not visit his office or the Delhi Secretariat during the tenure of his interim bail. Besides imposing slew of conditions, it had asked Kejriwal to not sign any official file unless absolutely necessary to obtain the Lieutenant Governor's sanction during the 21-day interim bail period. On May 17, the top court had reserved its verdict on Kejriwal's plea challenging legality of his arrest by the ED on March 21 in the case. The apex court had on April 15 sought a response from the ED on Kejriwal's plea challenging his arrest in the money laundering case. The Aam Aadmi Party (AAP) chief has challenged in the top court the April 9 order of the Delhi High Court that had upheld his arrest in the case. The high court had upheld Kejriwal's arrest in the case, saying there was no illegality about it and that the ED was left with "little option" after he skipped repeated summonses and refused to join the investigation. On June 20, he was granted bail by a trial court here on a personal bond of Rs 1 lakh in the case. However, the ED had moved the Delhi High Court the next day and contended that the trial court's order granting bail to Kejriwal was "perverse", "one-sided" and "wrong-sided" and that the findings were based on irrelevant facts. The high court, on June 21, imposed an interim stay on the trial court's bail order till passing of an order on ED's application for interim relief. On June 25, the high court had passed a detailed order staying the trial court order. Kejriwal was also arrested by the CBI on June 26 in connection with the corruption case related to the alleged excise policy scam. The plea challenging his arrest by the CBI is pending before the Delhi High Court. The matter relates to alleged corruption and money laundering in the formulation and execution of the Delhi government's excise policy for 2021-22, which has now been scrapped.

Supreme Court grants interim bail to Kejriwal, refers legal questions on arrest by ED to larger bench

In a relief to BRS leader K <keyword id="19948894" type="General" weightage="20" keywordseo="Kavitha" source="keywords">Kavitha</keyword>, the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords">Supreme Court</keyword> on Tuesday granted her bail in corruption and money laundering cases linked to the alleged Delhi excise policy scam. A bench of Justices B R Gavai and K V Viswanathan noted that Kavitha had been in custody for around five months and the probe against her by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="CBI" source="keywords" meta.keywordsubtype="org" meta.entityname="CBI" meta.hostid="153" meta.entityid="CBI">CBI</keyword>) and the Enforcement Directorate (ED) was complete in these cases. "As such, custody of the appellant (Kavitha) is not necessary for the purpose of investigation," the bench said. It set aside a July 1 order of the Delhi High Court which denied bail to the BRS leader in the two cases. The high court had dismissed Kavitha's bail pleas, saying she was prima facie one of the main conspirators in the criminal conspiracy related to the formulation and implementation of the now-scrapped Delhi Excise Policy 2021-22. The SC asked her to furnish bail bonds of Rs 10 lakh each in the two cases. While asking Kavitha to surrender her passport to the trial court, the bench said she shall not make any attempt to tamper with evidence or influence witnesses. During the hearing, the bench questioned the fairness of the <keyword id="20083460" type="General" weightage="20" keywordseo="probe-agencies" source="keywords">probe agencies</keyword> in investigating these cases and rapped them for "pick and choose". It also asked the ED and the CBI about the "material" they had to show that Kavitha was involved in the alleged scam. The bench was hearing Kavitha's pleas seeking bail in the corruption and money laundering cases linked to the alleged scam. Senior advocate Mukul Rohatgi, appearing for Kavitha, sought bail saying the probe against her has already been completed by the two agencies. He said she has been in custody for five months in the ED's money laundering case and for over four months in the CBI's case. Rohatgi also referred to the August 9 apex court verdict granting bail to co-accused and senior AAP leader Manish Sisodia in the two cases. Additional Solicitor General S V Raju, appearing for the probe agencies, claimed that Kavitha had destroyed/formatted her mobile phone and her conduct amounted to tampering with evidence. Rohatgi termed the allegation "bogus". The ED had arrested Kavitha (46) from her Banjara Hills residence in Hyderabad on March 15 and the CBI had arrested her from Tihar jail on April 11. SC grants bail to BRS leader K Kavitha in Delhi excise policy cases

As the counsel for <keyword id="19895701" type="General" weightage="20" keywordseo="Kejriwal" source="keywords">Kejriwal</keyword> sought some clarity on when the order is expected, Justice Neena Bansal Krishna said it is likely to be pronounced at 2:30 pm on Monday. The high court had on July 17 reserved its order on Kejriwal's plea challenging his arrest by the CBI in the <keyword id="19900622" type="General" weightage="20" keywordseo="corruption-case" source="keywords">corruption case</keyword> stemming from the alleged excise policy scam. The court had reserved the order on the AAP leader's <keyword id="19911554" type="General" weightage="20" keywordseo="bail-plea" source="keywords">bail plea</keyword> on July 29 after hearing arguments of the counsel for Kejriwal and CBI. Challenging his arrest, Kejriwal's counsel had contended that it was an "insurance arrest" to ensure that he stays in prison. Calling his arrest a "sham", Kejriwal's lawyer had argued that the CBI did not want to arrest him and had no material to take him into custody, and the sequence of events made it clear that he was arrested to ensure that he remained in prison. The counsel for the CBI had opposed both pleas of Kejriwal, and said terming his arrest an "insurance arrest" was unjustified and added that he was the 'sutradhaar' of the excise scam and there was evidence to show his involvement in the offence. Kejriwal was arrested by the CBI on June 26 from Tihar Jail, where he is still lodged in judicial custody in a connected money laundering case filed by the ED. The chief minister, who was arrested by the ED on March 21, was granted bail by the trial court in the money laundering case on June 20. However, the trial court's order was stayed by the high court. On July 12, the Supreme Court granted interim bail to Kejriwal in the money laundering case. The excise policy was scrapped in 2022 after the Delhi lieutenant governor ordered a CBI probe into alleged irregularities and corruption involving the formulation and execution of the policy. According to the CBI and the ED, irregularities were committed while modifying the excise policy and undue favours extended to licence holders.

SC gives Arvind Kejriwal interim bail till June 1

Delhi Chief Minister <keyword id="19901384" type="General" weightage="100" keywordseo="Arvind-Kejriwal" source="keywords">Arvind Kejriwal</keyword> will return to <keyword id="56350" type="General" weightage="20" keywordseo="tihar-jail" source="Orion">Tihar jail</keyword> on Sunday as his interim bail in a money laundering case linked to the alleged Delhi liquor policy scam ends on Saturday (June 1). Kejriwal was given interim bail by the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> to campaign for the Lok Sabha elections on May 10 and was asked to surrender to Tihar jail on June 2. The Delhi CM had earlier moved the Supreme Court for an extension of interim bail. On Wednesday, the Supreme Court rejected his plea, stating that since he was given liberty to move the trial court for regular bail, the plea here is not maintainable. Meanwhile, Delhi's Rouse Avenue Court on Saturday reserved the order on the interim bail plea moved by Kejriwal, citing medical reasons in a money laundering case related to the alleged excise policy scam. The court fixed June 5 for the pronouncement of the order on the plea seeking 7-day bail, while refused to pass the order today itself as requested by Kejriwal's Lawyer. Senior Advocate N Hariharan, who appeared for Kejriwal, submitted that the interim bail was to campaign for his party (the Am Aadmi Party), which is a national party. "I am out for 20 days and had I not done it, you would've said see he didn't campaign and fell ill. It was a lot of stress due to the campaigning and you know that stress is a aggrevator of diabetes. What was alarming was that keto levels rose in the urine. The aspect of concern is the high level of sugar and the keto numbers," Kejriwal's advocate submitted in the plea. Appearing for the Directorate of Enforcement (ED), Solicitor General Tushar Mehta and Additional Solicitor General SV Raju submitted that Arvind Kejriwal suppressed facts including about his health conditions. During preliminary arguments, ED lawyers stated that they have objections to filing interim bail as well. This court cannot modify the Supreme Court order. He's on interim bail because the SC granted it, what he is asking here is an extension of the Supreme Court order," the ED lawyers submitted. "This interim bail plea is required to be dismissed as it is full of suppression of facts. The Supreme Court had granted Liberty to him that he can file regular bail but the liberty to seek an extension of interim bail was not granted to him. He has said that these tests require 7 days, but the nature of the test has been suppressed," they further stated. ED also raised maintainability issues on interim bail plea and submitted that instead of getting a medical test done, he was travelling across. Medical tests would take more than one hour. ED further submitted that the applicant in fact has gained 1 kg weight and falsely claimed that he has lost 7 kg weight. The Registrar of the Supreme Court has passed a speaking order and the same has been suppressed by them. There is a reason for suppression and it is because he had been travelling for campaigning purposes, but he didn't get the tests done then, ED said. Recently Kejriwal through his legal team filed two different bail applications before the concerned court. His regular bail plea is listed for a hearing on June 7, 2024. Earlier, Arvind Kejriwal posted an emotional message on Friday and said that he is proud that he is going to jail to save the country from dictatorship. In his video message, Kejriwal said, "Tomorrow the 21 days are getting over, the day after tomorrow I have to surrender. I don't know how long they will keep me in jail this time. But my spirits are high. I am going to jail to save the country from dictatorship. I am proud of this. They tried to break me many times, tried to make me bow down but I didn't." The bench of Justice Swarna Kanta Sharma said, ED was in possession of enough material which had led them to arrest Kejriwal. Non-joining of the investigation by Kejriwal, delay caused by him was also impacting those in judicial custody. The material collected by the Enforcement Directorate reveals that Arvind Kejriwal conspired and was actively involved in the use and concealment of proceeds of crime. The ED case also reveals that he was involved in his personal capacity as well as the convenor of <keyword id="19935664" type="General" weightage="20" keywordseo="Aam-Aadmi-Party" source="keywords" meta.keywordsubtype="org" meta.entityname="Aam Aadmi Party" meta.hostid="261" meta.entityid="Aam Aadmi Party">Aam Aadmi Party</keyword>. The court further stated that this court is of the opinion that the accused has been arrested and his arrest and remand have to be examined as per law and not as per the timing of elections. Kejriwal's challenge to the timing of arrest before General elections in the absence of any mala fide on part of ED not sustainable, said the court. Arvind Kejriwal through the plea alleged that the ED has at the time of arrest "failed to establish" that the petitioner is guilty of committing activities stipulated under Section 3, i.e., be it one of concealment, possession, acquisition, use of proceeds of crime as much as projecting it as untainted property or claiming it to be so. Kejriwal was arrested on March 21 by the Enforcement Directorate in relation to the excise policy case. The trial court on April 1, sent Arvind Kejriwal to judicial custody till April 15, 2024. ED alleged that the Aam Adami Party (AAP) is the major beneficiary of the proceeds of crime generated in the alleged liquor scam. The agency also claimed that Kejriwal was directly involved in the formation of the excise policy. The case pertains to alleged irregularities and money laundering in framing and implementing the Delhi Excise Policy 2022, which was later scrapped. While Kejriwal was not named in the FIRs registered by the ED or the Central Bureau of Investigation in the Delhi excise policy case, his name first found a mention in the ED's chargesheet, wherein the agency claimed that he allegedly spoke to one of the main accused, Sameer Mahendru, in a video call and asked him to continue working with co-accused and AAP communications-in-charge Vijay Nair. Nair was among the first people to be arrested by the CBI in the case, in 2022. Subsequently, former deputy chief minister Manish Sisodia and Rajya Sabha MP Sanjay Singh were arrested in connection with the case. The latter, however, was granted bail by the Supreme Court last week. Kejriwal arrest not in contravention of Law, remand can't be termed 'illegal': Delhi HC

A Delhi court on Monday sent Chief Minister <keyword id="19901384" type="General" weightage="20" keywordseo="arvind-kejriwal" source="keywords">Arvind Kejriwal</keyword> to <keyword id="6358969" type="General" weightage="20" keywordseo="judicial-custody" source="Orion">judicial custody</keyword> till April 15, while the AAP supremo moved an application to have three books -- Bhagavad Gita, Ramayana and How Prime Ministers Decide. He was produced before Special <keyword id="21152631" type="General" weightage="20" keywordseo="Judge-Kaweri-Baweja" source="Orion">Judge Kaweri Baweja</keyword> of the Rouse Avenue Court on the expiry of his previously extended <keyword id="6357808" type="General" weightage="20" keywordseo="Enforcement-Directorate" source="Orion">Enforcement Directorate</keyword> (ED) custody in connection with the money laundering case related to the alleged excise policy scam. On March 28, Judge Baweja had extended his ED custody, holding that there were "sufficient reasons". However, she had allowed him to meet his family members and lawyers. On Monday, the CM was produced amid heavy security while counsel for both ED and <keyword id="19919267" type="General" weightage="20" keywordseo="cm-kejriwal" source="keywords">CM Kejriwal</keyword> made submissions virtually. Senior Advocates Vikram Chaudhary and Ramesh Gupta appeared for him and Additional Solicitor General (ASG) S.V. Raju for the probe agency. Seeking his judicial custody, ASG Raju said "we (ED) seek his judicial custody and no more ED remand". Alleging the same as it had alleged last time, the ED said: "He (<keyword id="19895701" type="General" weightage="100" keywordseo="kejriwal" source="keywords">Kejriwal</keyword>) is non-cooperative and is giving evasive replies." The ASG made another similar submission as last time saying that CM Kejriwal isn't giving password to his phone. The court was told by ASG that the ED might seek his custody later. After a brief hearing, the judge sent CM Kejriwal to judicial custody till April 15. The accused has also moved an application to be provided with a special diet, medicines, books and religious locket which he wore while being in custody. Earlier, the probe agency had sought the Chief Minister's custody for seven more days. However, after hearing the arguments, the court had extended the AAP supremo's ED remand by four days till April 1, observing that there appear to be "sufficient reasons" to permit his further custodial interrogation, particularly keeping in view the submissions of the ED. The probe agency had submitted that he is required to be confronted with the material collected and statements recorded so far in the course of the investigation. The court had directed the investigation officer to ensure that further interrogation and confrontation, etc., of the accused is done without any delay. Judge Baweja had allowed CM Kejriwal to meet his family members, including his wife, daughter, PA and advocates. Moreover, the court had directed the agency to conduct the interrogation at a place with CCTV coverage and for the preservation of the footage. The ED was also asked to provide the requisite medication to CM Kejriwal and get him medically examined in accordance with the law during the period of his custody. The ED arrested CM Kejriwal on March 21 after questioning him for over two hours at his official residence in Delhi. The ED has termed CM Kejriwal the "kingpin and the key conspirator" of the alleged excise scam in collusion with other ministers of the Delhi government, AAP leaders, and other persons.

Excise policy case: Delhi court sends CM Kejriwal to judicial custody till April 15

New Delhi [India], October 4 (ANI): The Enforcement Directorate on Wednesday arrested Aam Admi Party MP <keyword id="6360239" type="General" weightage="20" keywordseo="Sanjay-Singh" source="Orion">Sanjay Singh</keyword> in connection with a money laundering case linked to the now-withdrawn new excise policy of Delhi, officials said. It is the second high-profile arrest in the case after former Delhi deputy chief minister Manish Sisodia. Rao was allegedly found to be acting as a south lobby. The investigating agency suspects that he committed irregularities through cartelization. Rao is the second person to be arrested in the excise policy. The CBI had earlier arrested Vijay Nair, former CEO of events company- Only Much Louder. The Enforcement Directorate (ED) has also arrested liquor trader Sameer Mahendru of Indo Spirit. He is said to have business links with Arun Ramachandra Pillai, a resident of Hyderabad and one of the persons booked by the CBI in the case. Rao's arrest came after several rounds of raids conducted by the CBI and ED at various places in Hyderabad, including in the office of a media house. He was also reportedly questioned by the CBI a couple of times in the case. According to the CBI investigation, Arun used to collect money from Sameer Mahendru for onward transmission to the accused public servants through Vijay Naidu. The liquor license holders allegedly issued bills to retail vendors to divert funds to public servants involved in irregularities. This is where some companies from Hyderabad are believed to have helped in illegal transactions. Further questioning of the CBI is likely to unearth the role of some other suspects in the case. Six to seven to eight businessmen and a couple of politicians and officials from Telugu states are believed to be involved in the case. The officials hailing from Telugu states are said to be holding key positions in the Delhi government. The Hyderabad-based businessmen were reported having colluded with politicians and officials in the Delhi government to influence the liquor policy of that state to derive monetary benefits from it. Assets worth Rs 28.65 crore of various individuals and entities linked to the case have also been attached by the federal agency after a provisional order under the <keyword id="19912399" type="General" weightage="20" keywordseo="prevention-of-money-laundering-act" source="keywords">Prevention of Money Laundering Act</keyword> (PMLA) was issued. Official sources said the party may be nam<keyword id="19956083" type="General" weightage="20" keywordseo="ED" source="keywords">ed</keyword> as an accused in the next supplementary chargesheet to be filed in this case. If so, it will be the second political party to be arraigned as accused in a money laundering investigation after the Aam Aadmi Party. AAP has recently been named by the ED in the Delhi excise policy case. The CPI(M) vehemently denied the charges of wrongdoing and money laundering. The attached assets include 18 immovable properties, valued at Rs 28.65 crore, consisting of lands and buildings in Kerala of the beneficiaries of the "scam", including an immovable property worth Rs 10 lakh registered in the name of a district secretary of the Communist Party of India (Marxist) for a party office, the ED said in a statement. The attachment also includes eight movable properties, including a credit balance of Rs 63.62 lakh in eight "undisclosed" bank accounts of the CPI(M) local area committees in Thrissur, it added. The agency claimed that the CPI(M) received these funds from the beneficiaries as donations through the governing body and the party is "in possession of proceeds of crime" which has been invested in the purchase of immovable properties and credited to its five bank accounts in the Karuvannur Service Cooperative Bank Ltd. The bank is promoted by the party. The CPI(M) rejected the ED charges, saying it would legally and politically fight any move by the agency to arraign it in the case linked to the alleged multi-crore Karuvannur bank scam. Party state secretary M V Govindan alleged that the ED was trying to make opposition parties and their leaders accused in various cases due to political reasons. He also accused the central agency of attempting to create a smokescreen as it had failed to collect any evidence against the party. The ED believes that the land parcel attached by it was meant for the CPI(M) party office and was purchased using alleged kickbacks from the loanees or beneficiaries of the loans sanctioned by the Karuvannur Service Cooperative Bank. The agency has relied on the "confessional" statements of at least two accused in this case who claimed in their statements recorded before a judicial magistrate that the purported irregularities in the bank were orchestrated at the behest of CPI(M) Thrissur district committee leaders. The ED alleged that "bogus loans" were sanctioned by the Karuvannur Service Cooperative Bank on the same property multiple times without the knowledge of members of the society. "Investigation found benami loans were sanctioned to non-members against inflated property valuations in the names of other members and such loan funds were siphoned off and laundered by the accused beneficiaries," it said, adding that the loan amounts were disbursed in cash to avoid a money trail. "Such benami and illegal loans were sanctioned at the behest of the secretary and the governing body of the society in connivance with the then-bank manager, at the behest of the Thrissur district committee, CPI(M). "In return, the Thrissur district committee, CPI(M), collected money in the form of donations and salary cut from the beneficiaries and society committee members into their undisclosed and illegally opened bank accounts in the same society," the agency said. These funds, according to the ED, were utilised for the purchase of land worth Rs 10 lakh by the secretary of the Thrissur district committee of the CPI(M) for the construction of the party office, which has now been attached as proceeds of crime. Govindan said it has been a decades-long practice of registering the office and other assets of party units in the name of the respective district committees. What role does the party have in the office constructed by one of its local committees, he asked. But the ED is now trying to tarnish the image of the CPI(M) in the name of the assets of one such party unit, Govindan claimed. "We will fight it legally and politically. We haven't got any notice in this regard so far," he told reporters. The ED filed a chargesheet in this case against 55 accused entities in November last year. The money laundering case stems from 16 FIRs registered by the <keyword id="20086884" type="General" weightage="20" keywordseo="kerala-police" source="keywords">Kerala Police</keyword> (<keyword id="20146853" type="General" weightage="20" keywordseo="crime-branch" source="keywords">Crime Branch</keyword>) in Thrissur in 2010. "Happy to be back," says Delhi CM Arvind Kejriwal; To hold press conference, road show today

New Delhi, The <keyword id="19914482" type="General" weightage="20" keywordseo="aap" source="keywords">AAP</keyword> on Friday claimed the CBI is planning to arrest Delhi Chief Minister Arvind <keyword id="19895701" type="General" weightage="20" keywordseo="kejriwal" source="keywords">Kejriwal</keyword> in the next few days and will serve him a notice by the evening. While the party did not say in which case Kejriwal is likely to be arrested, it said that this was being done to prevent the AAP from stitching an alliance with the Congress for the upcoming Lok Sabha elections as the <keyword id="19894848" type="General" weightage="20" keywordseo="bjp" source="keywords">BJP</keyword> is scared of the two parties coming together. While there was no immediate response from the Central Bureau of Investigation (CBI) to the AAP's claims, the BJP said AAP leaders are trying to create confusion and generate sympathy for Kejriwal. The Congress and the AAP are likely to have a seat-sharing pact in Delhi, Gujarat and Haryana for the Lok Sabha polls and the talks between the two sides are in the final stages, sources said on Thursday. "We have learnt from reliable sources that the CBI is planning to arrest Kejriwal. The CBI will also serve a notice to Kejriwal either this afternoon or by the evening," Bharadwaj said. Kejriwal will be arrested in the next two to three days, he said. "We are getting messages that if the AAP-Congress alliance is formed, Arvind Kejriwal will be arrested. The BJP is scared of the AAP-Congress alliance. You can arrest Kejriwal if you want, but the alliance will be forged," he said. The Enforcement Directorate has issued a fresh summons to Kejriwal asking him to appear before it for questioning in the Delhi excise policy-linked money laundering case on February 26, sources said on Thursday. This is the seventh summons issued by the ED to the chief minister, who skipped the previous six. AAP Rajya Sabha MP Sandeep Pathak said people will take to the streets if Kejriwal is arrested. "There will be a tsunami. Their (BJP) political calculations will go wrong. We are not scared of being arrested. We are forging this alliance for the country," he said. The BJP won all the seven seats in Delhi with 51 per cent votes in the 2014 Lok Sabha polls and 59 per cent in 2019.
