New Delhi: The <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> on Wednesday said it will hear on September 17 the appeal of US-based creditor Glas Trust Company LLC against a judgment of the <keyword id="19916400" type="General" weightage="20" keywordseo="nclat" source="keywords">NCLAT</keyword>, which had stayed insolvency proceedings against ed-tech firm BYJU's and approved its Rs 158.9 crore dues settlement with the <keyword id="19901245" type="General" weightage="20" keywordseo="bcci" source="keywords">BCCI</keyword>. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra was urged by a battery of lawyers that the plea be heard urgently keeping in mind the subsequent developments in the case. The plea was mentioned by senior advocate NK Kaul, appearing for the ed-tech major, that the case needed to be heard at the earliest. The submission was supported by Solicitor General Tushar Mehta, appearing for the BCCI, and senior lawyer Abhishek Singhvi, also appearing for the ed-tech firm. Kaul said another plea in the case has also been filed and that is listed for hearing on September 17 and hence, the present plea be either heard on that day or the hearings in both the cases be advanced to this Friday. "We will hear both the pleas on September 17," the CJI said. Senior advocate Shayam Divan, appearing for the US-based creditor, said let the matters be heard together on September 17. Earlier on August 22, the bench had refused to pass an interim order to ensure that the committee of creditors (CoC) does not hold any meeting in pursuance of the insolvency proceedings against the embattled ed-tech firm. It had listed the plea for a final hearing on August 27. The bench had said the developments, which may take place in the meantime, can be negated if it finds there was no merit in the appeal of the US-based creditor against the judgment of appellate insolvency tribunal NCLAT. The plea was mentioned earlier also on August 20 by Byju's and the BCCI and the top court had then also refused to pass an interim order to restrain the Insolvency Resolution Professional (IRP) from constituting a committee of creditors (CoC) in the insolvency proceedings against the ed-tech firm. In a major setback to Byju's, the top court had on August 14 stayed the verdict of NCLAT, setting aside the insolvency proceedings against the ed-tech major and approving its Rs 158.9 crore dues settlement with the Indian cricket board. The August 2 verdict of the NCLAT had come as a huge relief for Byju's as it had effectively put its founder Byju Raveendran back in control. The top court, however, had prima facie termed the NCLAT verdict as "unconscionable" and stayed its operation while issuing notices to Byju's and others on the appeal of the ed-tech firm's US-based creditor against the judgment of the insolvency appellate tribunal. The case stemmed from Byju's default on a Rs 158.9 crore payment related to a sponsorship deal with the BCCI. The top court had directed the BCCI to keep a sum of Rs 158 crore it had received from Byju's after a settlement in a separate escrow account till further orders. "Issue notice. Pending further orders there shall be a stay of the impugned order of August 2 of NCLAT. In the meantime, BCCI shall maintain the amount of Rs 158 crore, which shall be realised in pursuance of a settlement, in a separate escrow account until further orders," the bench had said. The NCLAT had approved the Rs 158.9 crore dues settlement with the BCCI and set aside the insolvency proceedings against Byju's. Byju's had entered into a "Team Sponsor Agreement" with the BCCI in 2019. Under the agreement, the ed-tech firm got exclusive rights to display its brand on the Indian cricket team's kit and some other benefits. Byju's had to pay a sponsorship fee. The company met its obligations till the middle of 2022 but defaulted on subsequent payments of Rs 158.9 crore. After insolvency proceedings were initiated, Byju's entered into a settlement with the BCCI. On July 16, the Bengaluru bench of the <keyword id="19902197" type="General" weightage="20" keywordseo="national-company-law-tribunal" source="keywords">National Company Law Tribunal</keyword> (NCLT) had admitted 'Think and Learn', Byju's parent company, to the insolvency resolution process on a plea filed by the BCCI over default in payment of outstanding dues of almost Rs 158.9 crore. While suspending the board of the ed-tech firm, the NCLT had appointed an interim resolution professional to run the operations of the company, suspended the company's board of directors, and brought it under moratorium by freezing its assets. The US-based lenders suspected that the settlement amount was being diverted from the credit they had extended to Byju's.

Supreme Court agrees to list plea related to insolvency proceedings against ed-tech firm Byju's

The CEO of edtech startup Headway breaks down how the company used AI tools to improve its ad performance by 40%

BlackRock, which owns less than 1 per cent of Byju's, has valued its shares at about $209.6 apiece, down from the peak of $4,660 in 2022, reports TechCrunch. Byju's did not immediately comment on the latest valuation cut. This isn't the first time BlackRock has cut the worth of its holding in Byju's. Investment firm Prosus, which owns nearly 9 per cent in Byju's, has also <keyword id="20163425" type="General" weightage="20" keywordseo="marked-down" source="Orion">marked down</keyword> the value of its stake in Byju's to less than $3 billion, representing a decline of more than 86 per cent from the previous funding round valuation of $22 billion. In November last year, Prosus first slashed the fair value of Byju's to $5.97 billion. "Byju's is facing multiple headwinds. We and other shareholders are working everyday to improve the situation. We are in close discussions with the company every day," a senior Prosus executive was quoted as saying in reports late last year. Byju's was preparing to go public in early 2022 through a SPAC deal that would have valued the company at up to $40 billion. According to reports, Byju's needs at least Rs 500-Rs 600 crore to pay off dues of employees and vendors.

Moreover, they will also get medical, dental, and vision coverage through the Consolidated Omnibus Budget Reconciliation Act (COBRA) for up to 18 months, with Guild covering the premiums for the first six months. Denver, Colorado-based Guild has extended the equity exercise period by two years, allowing employees to continue accessing the company's upskilling programmes, said the report. Last year, the budget allocation for the education sector was ₹93,224 crore, which was ₹6,000 less than the previous year, constituted 2.67% of the central government’s estimated budget for 2021-22. <div type="image" title="Education sector budget over last five years" msid="89176503" hostid="261" caption="&amp;lt;p&amp;gt;Education sector budget over last five years&amp;lt;/p&amp;gt;"></div> According to the Economic Survey 2020-21, the expenditure on education by the union government as a proportion of the Gross Domestic Product (GDP) has been around 3% between 2014-15 to 2018-19. The National Education Policy (NEP), 1968 recommended the spending on education to be 6% of the GDP. NEP 2020 has reaffirmed this recommendation. However, the experts expect this percentage (2.67%) to go up to at least 8-9% this year. “At least 8-9% of GDP should be put aside for education. More allocation isn't only necessary at primary, secondary and higher education but, we need to also look at schemes for skilling our youth that are outside of the education system and make them eligible for employment opportunities currently there,” said Prateek Shukla, cofounder and chief executive officer (CEO) of Masai School. Here’s what we can expect from the Union Budget 2022-23 — 1. Increase in spending on teachers’ training The COVID-19 pandemic shifted the teaching mode from offline to online, which was difficult for some teachers to cope with the latest technology. Experts say that the government should draw their attention towards the teachers training programmes, as there is a massive need for the educators to be well versed with the latest technologies. Budget allocation to National Education Mission (NEM) in 2021-22, which consists of — Samagra Shiksha and teacher training and adult education, was ₹31,300 crore — a 2% decrease as compared to 2019-20. The Budget 2021-22 allocated to teachers training and adult education was ₹250 crore. “There is a gap in faculty training. We need to empower our experienced educators to understand new tools and techniques. It is important now to allocate budgets toward upskilling the existing instructors and training of fresher teachers, ensuring qualitative pedagogy. Further, there is a need to reimagine effective assessments focused on using digital methods and amplifying their benefits," said Ravi Panchanadan, managing director (MD) and CEO of Manipal Global Education Services (MaGE). Puneet K, President of the Narayana Group said, “There is an urgent need to raise the quality of our teachers, at the level of subject knowledge and in the use of technology and other tools for teaching. Furthermore, implementing the NEP requires a fundamental shift in the mindset of teachers towards engagement rather than instruction. This can only be achieved through a significant investment of time, effort, and funds on teacher upskilling. The government must consider this in its budgetary allocations.” 2. Access to smart devices like laptops, smartphones at subsidised prices Shifting of classes to online mode created a huge requirement for laptops and smartphones. A National Council of Educational Research and Training (NCERT) survey conducted in August 2020 revealed that at least 27% students in India did not have access to smart devices, which ultimately led to learning loss during the COVID-19 lockdown. According to a PRS India report, the Central government shared ₹818 crore across states and union territories to promote online learning. The Economic Survey 2020-21 observes that, as of October 2020, the percentage of students in government and private schools owning a smartphone increased from 36.5% in 2018 to 61.8% in 2020 in rural India. Experts believe that this year the government should roll out more initiatives, which can help students to get access to laptops and smartphones at subsidised rates because the future is online and the online classes will continue even after the pandemic comes to an end. “While we have ensured continuity, it is mainly limited to city limits due to erratic digital connectivity, which must be fixed on a war footing. Along with accessible internet, it is also vital to ensure that learners in need of digital assets are supported. Scholarships or subsidies to purchase laptops, smartphones, and other tech requirements, including more imaginative ways to utilise old digital assets, need to be explored, further,” said Panchanadan of MaGe. 3. Bring more focus on the edtech sector The edtech sector in India has been exponentially growing especially during the pandemic when the entire world moved towards digitalisation. The industry, which attracted a lot of private players like Byju’s, Vedantu, UpGrad and many more, is poised to become a $30 billion in size in the next ten years, according to a report by advisory firm RBSA Advisors <a href="https://economictimes.indiatimes.com/tech/technology/indian-edtech-industrys-market-size-to-reach-30-billion-in-10-years-report/articleshow/82295097.cms">cited</a> by the Economic Times. Education Minister Dharmendra Pradhan, on January 3, 2022, said that the Ministry of Education is in talks with the Ministry of Law and Ministry of Electronics and Information and Technology to work out a common policy to regulate the edtech sector in India as it has been gaining traction from the past two years. The edtech players in the market are expecting the Budget 2022-23 to have higher focus on the edtech sector and are also expecting to bring down the GST slab on educational services. “The 2022 budget is expected to have a higher focus on the edtech sector as a whole, with significant investments to enhance greater access to robust and improved digital infrastructure. The GST for educational services is expected to be brought down to 5% from the existing 18%, to increase accessibility and feasibility for students from lower and middle-class families. With greater internet penetration, the upcoming budget is expected to announce various initiatives to accelerate digital innovation in the edtech sector,” said Vaibhav Singh, co-founder of Leap Scholar, an online platform which provides guidance and coaching for study abroad. Indian education sector’s budget wishlist – Subsidised access to laptops and smartphones, focus on edtech

<keyword id="1464841" type="General" weightage="20" keywordseo="Edtech" source="Orion">Edtech</keyword> firm <keyword id="6384897" type="General" weightage="20" keywordseo="BYJUs" source="Orion">BYJU's</keyword> will not be able to meet its March 2023 deadline to achieve group-level <keyword id="6515078" type="General" weightage="20" keywordseo="profitability" source="Orion">profitability</keyword>, as it envisioned in its earnings in October last year, reliable sources said on Monday. On top of it, its results for most of the months for the current fiscal year are delayed again. Sources told IANS that the company, which has sacked thousands of employees to date and has taken deeper cuts, is still unable to achieve profitability at group level amid mounting losses. In October after firing 2,500 employees and consolidating its business in the country, Mrinal Mohit, CEO, BYJU'S India business, had said that "these measures will help us achieve profitability in the defined time frame of March 2023". At a group level, BYJU's had said its top priority is to achieve "overall profitability by March 2023". However, this appears impossible now with the company still struggling to stem growing losses. Last week, the edtech major laid off another 15 per cent of its employees, or more than 1,000 people, mainly from its engineering teams, as the company continues phased layoffs to remain growth-oriented in a global economic meltdown. Between April-July 2022, the company logged a revenue of Rs 4,530 crore. Post that, there has been no communication from the company about the pending results. The edtech unicorn reported a loss of Rs 4,588 crore for the fiscal year that ended on March 31, 2021. BYJU's had claimed it clocked gross revenues of nearly Rs 10,000 crore in FY22. Meanwhile, according to sources, BYJU's acquisition of Delhi-based offline test preparatory services provider Aakash for nearly $1 billion is still incomplete and Aakash Chaudhry, Co-Promoter and Managing Director of Aakash Educational Services Limited (AESL), has resigned from the board. When reached, Aakash declined to comment. New reports emerged in December that BYJU's, which may have seen a definite erosion in its last market value at $22 billion, hasn't paid several of its vendors for months. According to Morning Context, "some of the payments are due since March and there is trouble with their clearance. In the eight months to October 2022, cumulative dues to vendors have crossed Rs 90 crore". When reached, BYJU's had not offered a comment on this report. In seemingly fresh trouble for BYJU's, some lenders had asked the edtech unicorn to repay part of a $1.2 billion <keyword id="6360217" type="General" weightage="20" keywordseo="loan" source="Orion">loan</keyword> they recently bought into as they renegotiate terms of the debt. BYJU's to miss March 2023 deadline for group level profitability, results delayed again

Many players have witnessed impressive growth since the lockdown led to closure of educational institutes. </li><li><keyword id="3395125" type="PERSON" weightage="20" keywordseo="Cuemath">Cuemath</keyword>, an edtech platform focused on Math and coding grew 3X last year and is expecting to top that this year. It is also confident of becoming a unicorn by 2022.</li><li>We talk to <keyword id="1390946" type="PERSON" weightage="20" keywordseo="Arvind-Iyer">Arvind Iyer</keyword>, Marketing Director, Cuemath who tells us about the platform's growth story and all that its doing to bring more students to its platform.</li></ul>The last one year has been a blessing in disguise for the edtech industry. While over the past few years the sector had being growing steadily, the pandemic gave the sector just the tailwind it needed. According to a recent report released by transaction advisory firm RBSA Advisors, the <keyword id="11507888" type="UNKNOWN" weightage="20" keywordseo="Indian-edtech">Indian edtech</keyword> sector will take off, from its current market size of about $700-800 million to $30 billion in the next 10 years. While we have seen players that cover the entire spectrum of education, multiple subjects, test preparations, competitive exams, there also are subject-specific platforms that are making their presence felt in the domain. Cuemath was started in 2013 by <keyword id="3395126" type="PERSON" weightage="20" keywordseo="Manan-Khurma">Manan Khurma</keyword> who had just graduated from <keyword id="55119" type="COMPANY" weightage="20" keywordseo="Indian-Institute-of-Technology">Indian Institute of Technology</keyword> (IIT) Delhi. After graduating, he started teaching, predominantly Maths, to a lot of aspirants to help them crack the JEE. His experience with many of the students made him realize that most of them did not have clarity on the fundamentals of the subject. Resultantly, they were struggling with advanced concepts like trigonometry and calculus. That led to the genesis of Cuemath, that started out in an offline format but has now gone online. The platform, in the initial few years, found growth primarily through word-of-mouth. What started in India soon found takers in other countries too, considering every child, across the globe, has to learn Math. In fact, currently, Cuemath is present in 20 countries, a number that the leaders hope to take to 50 by the end of this year. “Math is a universal need. It’s not a niche need. Every kid around the world needs to do Math. Therefore, every student is our target student. We are therefore creating and enhancing our market. And since Math is a basic global requirement, we get an edge over our competition,” said Arvind Iyer, Marketing Director, Cuemath. Currently, Cuemath’s key markets are across four regions, North America and Canada; the Middle East, especially Dubai and Qatar, UK and Europe, where its business is growing steadily. The startup currently has plans of scaling 3-4X times in the US alone this year. “Cuemath is present in 20-odd countries, and it wants to reach over 50 countries by the end of this year. This plan includes strengthening its presence in North America, APAC, UK and Europe, and the Middle East, as well as entering countries in Africa and South America,” explained Iyer. The platform also underwent a rebranding recently to represent its evolution in the past 1.5 years, primarily its pivot from an offline to an online entity. The rebranding entails a new logo and colour palette. <div type="image" title="cuemathTwitter" msid="83830583" hostid="261"></div> Explaining the thought behind the rebranding, Iyer said, “We want to make parents and students believe in the power of math and its potential to unlock innumerous possibilities. We intend to project ourselves as a brand of consequence where intuition for math trumps marks and performance in exams. Being a company that works at scale across geographies, we needed a winning strategy that will be in alignment with our mission to be a Global Math Leader of the future - to portray trust, expertise, and freshness, globally. This needed a fresh way of looking at our brand, our visual identity, and our communication objectives which are: to come across as trustworthy but not formal, to sound lighthearted but not juvenile, to have academic rigor but not be strict and to be viewed as innovative not newfangled.” It has also refreshed its tagline to ‘Get better at Math, Get better at everything else’. When it comes to marketing, the platform has been following a targeted approach, while monitoring its funnel conversion metrics closely. “We are constantly improving our communication assets to make them work harder for the parent, and get them to discover the Cuemath method. We believe in always adding value to the lives of parents, students and teachers. Everything we do is a reflection of what they seek and find useful. Having said that, our focus this year is going to be on building brand awareness and performance marketing to acquire new students through all our social, digital, TV and PR channels,” explained Iyer. If a recent estimate from <keyword id="50041" type="COMPANY" weightage="20" keywordseo="KPMG">KPMG</keyword> is to be believed, India has more than 3,500 <keyword id="2989202" type="PERSON" weightage="20" keywordseo="edtech-startups">edtech startups</keyword>. So how does one break the clutter? “I strongly believe that the pedagogy we adopt here at Cuemath is a major factor to give us an edge over our competitors. We are obsessed about having this constant zeal to help the child so that his or her learning graph just keeps going higher. We take pride in portraying math as a life skill which can make children better at everything by enhancing their critical and analytical thinking which many of our competitors don’t do,” he added. Owing to the fact that the knowledge of Math is a universal requirement, Iyer is confident that they will be able to capture the global markets too. Since 2017, it has grown over 10 times, from Rs 15 crore to now a Rs 150 crore company. From 7000 students on its platform in 2017, the platform grew to 60,000 students in 2020. From 1000 in 2017, it increased its teachers count to 10,000 in 2020. “We have very strong unit economics, which means we don’t lose any money on a consumer acquisition but on an overall level since we are re-investing all of our revenue back into growth, we aren’t profitable yet. So profitability right now isn’t a goal, but growth is the focus. The Math market around the world is a 20 Billion Dollar market and we plan to win that market. Our focus is to drive growth and become a unicorn, a billion dollar company by the end of 2022,” concluded Iyer on an optimistic note.

The long-term engagement, which begins as Messi embarks on his final campaign to win the World Cup as captain of Argentina, will see him feature in campaigns promoting BYJU'S 'Education For All'. Abhishek Desai, Founder, CricHeroes, told IANS that it does sound like the irony that where you are laying off people on one side and hiring Messi as your global brand ambassador. "But I think that's the cost everyone pays for growing too fast. It's not that the company does not have money but growing too fast it creates a lot of redundancy in the organisation. Sooner or later you have to fix that and I think these layoffs are a result of that," said Desai. "Not only BYJU's but we are seeing something similar in Twitter also right now which is a public company. Until and unless we come out of this mindset, such incidents are bound to happen," he added. According to Syed Nadeem Jafri, Founder and Chief Mentor of Hearty Mart, laying off employees is part of any organisational journey. "However, hiring Messi is to counter the dent in the image, which might have happened due to the laying-off move, which seems more like a PR image-building ploy rather than any strategic plan behind it," said Jafri. In Kerala, BYJU's earlier decision to wind up their operations had asked 140 of the 170 employees to quit. However, after conciliatory talks that were led by Chief Minister Pinarayi Vijayan with BYJU's on Wednesday, it was decided that the edtech unicorn will not shut its operations at the <keyword id="6400701" type="General" weightage="50" keywordseo="technopark" source="Orion">Technopark</keyword> campus here. The company said they have decided to relook at the restructuring plans and continue its development centre in the Trivandrum Technopark office. Shrijay Sheth, Founder of Legalwiz.in, told IANS that businesses need to realise the value of sustainable hiring to build a long-term employer brand. "What is important here is to provide enough resources to the cohort for finding alternative opportunities, and minimize their personal damage. Entrepreneurs as their core function hold trusteeship of the overall welfare of the stakeholders, including employees," Sheth said. It will be hiring across tech, product and marketing teams. “The ongoing hiring is a part of our company's expansion plan, in India and abroad, as we look to substantially invest in our workforce by the end of 2022," said Krishna Kumar, founder and CEO of Simplilearn. It claims that 20% of its hiring or 160 employees would be freshers and college graduates. In the coming months, it will also be recruiting a CXO, vice president, and a senior vice president both for India and the US. In the US, it aims to appoint various C-suite level executives who will assist in strengthening and structuring the team present in the country. Kumar believes that the demand for upskilling and reskilling will prevail in the industry. “Over the past couple of years, the shift to online training and education led to a growth spurt in the number of providers in the industry. The industry is currently witnessing a transition phase with hybrid models of work and study,” he added. Founded in 2010, the company claims to conduct more than 3,000 live classes, with an average of 70,000 learners who collectively spend more than 500,000 hours each month on the platform. Its peers like Unacademy, Vedantu are laying off its workforce due to lower funding. Overall, the edtech industry has reportedly laid off 8,000 people due to economic slowdown.
