New Delhi, Parents who give their daughters-in-law a hard time for not being able to fulfil their desire of "preserving their family tree", need to be educated that it is their son and not his wife whose chromosomes will decide the <keyword id="20152579" type="General" weightage="20" keywordseo="childs-gender" source="Orion">child's gender</keyword>, the <keyword id="6355014" type="General" weightage="20" keywordseo="delhi-high-court" source="Orion">Delhi High Court</keyword> has observed. The <keyword id="6355392" type="General" weightage="20" keywordseo="high-court" source="Orion">high court</keyword>, which was dealing with a case of dowry death of a woman after being allegedly harassed by her husband and in-laws for bringing insufficient dowry and giving birth to two daughters, said in contemporary times, the idea of a woman's worth being tied to material considerations contradicts the principles of equality and dignity. "The persistent prevalence of regressive mindsets and instances exemplified by cases involving insatiable demands for dowry underscores a broader societal concern. It highlights the challenges faced by married women, whose intrinsic value and dignity should not be contingent upon their parents' ability to meet the insatiable financial demands from their in-laws," Justice Swarana Kanta Sharma said. The <keyword id="6355392" type="General" weightage="20" keywordseo="high-court" source="Orion">high court</keyword> said it is disturbing to witness a scenario where parents wish for the well-being of their daughter and her comfort after she leaves her paternal house and tries to settle in the matrimonial home but instead of providing her love and support, the new bride is met with unrelenting greed and harassment from in-laws family. It said the trauma is multiplied and becomes lifelong when the victim of a dowry-related offence gives up her life due to constant torture and harassment, especially when the two daughters she has given birth to and loved also become a ground to harass and traumatise her as if she is solely responsible for the <keyword id="20152579" type="General" weightage="20" keywordseo="childs-gender" source="Orion">child's gender</keyword>. "Surprisingly, the genetic science in this regard is ignored according to which, the genetic determination of gender of the unborn child when the child is conceived, involves the combination of X and Y chromosomes, with females possessing two X chromosomes (XX) and males having one X and one Y chromosome (XY)." "According to <keyword id="20139732" type="General" weightage="20" keywordseo="encyclopedia-britannica" source="keywords">Encyclopedia Britannica</keyword>, the outcome of fertilisation depends on whether an unfertilised egg fuses with a sperm carrying an X or Y chromosome, resulting in the birth of a girl or boy, respectively," the high court said. It said the court had dealt with numerous cases of harassment, nagging and suicide or dowry deaths due to the victim being victimised for giving birth to daughters after being constantly harassed over not being able to fulfil her husband and in-laws' desire of "preserving the family tree". Justice Sharma said the court is "constrained to observe that such people need to be educated that it is their son and not their daughter-in-law whose chromosomes through the union of a married couple will decide the gender of their child. "Even if this judgement becomes the birthplace of such enlightenment, it will go a long way to change the mindsets of perpetrators of such crimes and save lives of innocent married women, by using principles of science through principles of law," she said. The high court made the observations while denying bail to the husband in a dowry death case. The allegations against the accused were that he along with his family members used to torture his wife for dowry leading to her committing suicide. It has been alleged by the complainant, father of the deceased woman, that the accused and his family pressured his daughter for additional dowry and financial demands, causing significant distress. It has also been alleged by him that she was taunted and mistreated for giving birth to two daughters. The high court, in its order, said prima facie at this stage, a woman has lost her life for giving birth to daughters, which should be unacceptable to a conscientious society and such offences have to be considered grave and serious when the trial is yet to begin. "In view of the above facts and circumstances, and since the allegations against the present applicant/accused are grave and serious in nature, the charges are yet to be framed and the material witnesses are yet to be examined, this court is not inclined to enlarge him on bail," it said. The court further opined that in a society that emphasises equality and strives for equal progress of women and women empowerment, incidents like this are etched as disheartening markers on the path of equal societal advancement for women. It said the notion that a woman's value diminishes if her parents cannot fulfil dowry expectations of her husband and in-laws reflects a deep-seated bias and discrimination against women. Such expectations not only violate the principles of gender equality but also contribute to an environment where women are objectified and reduced to mere transactions, the court said while acknowledging the profound distress experienced by parents, who in the earnest pursuit of their daughter's happiness, bestowed everything they had to allegedly fulfil the dowry demands of her in-laws.

The reason for serving these notices via a website or newspaper is primarily because the actual addresses of spouses abroad are unknown to the aggrieved party. Once the notices are served, only then can the court proceedings commence. While there is no official data, various NGOs believe that in Punjab and Gujarat alone, around 25000 women have been abandoned by their spouses. And according to a report on the <a href="https://timesofindia.indiatimes.com/nri/other-news/one-nri-wife-calls-home-for-help-every-8-hours/articleshow/62782501.cms">Times of India</a> in February 2018, the Ministry of External Affairs received 3,328 distress calls from NRI women between 1 January 2015 and 30 November 2017 — an average of more than three calls a day or one every eight hours. And the primary causes of the distress were abandonment, harassment, dowry demands, physical abuse and passport seizure. The husbands often use lenient laws in the country they live in to get ex parte divorces and slither out of paying their wives maintenance. In a bid to counter these shocking numbers, the above-mentioned proposal to issue notices via the website will be discussed at a meeting that will be attended by officials from <keyword id="4318185" type="ORGANIZATION" weightage="20" keywordseo="Union-Women-and-Child-Development-Ministry">Union Women and Child Development Ministry</keyword> (WCD) and MEA next week. Other measure proposed by the WCD to the law ministry included impounding or cancellation of passport and attachment of their assets in India. Another recommendation is to make it mandatory to register NRI marriages within a week of the wedding.

Indian government is formulating a plan to help abandoned NRI wives get justice

The upcoming U.N. vote to ratify the declaration titled "End Violence against Women" <a href="http://www.ikhwanweb.com/article.php?id=30731">has rankled</a> <keyword id="6354912" type="COUNTRY" weightage="60" keywordseo="Egypt">Egypt</keyword>'s <keyword id="60382" type="ORGANIZATION" weightage="60" keywordseo="Muslim-Brotherhood">Muslim Brotherhood</keyword>, so much so that they released an official statement on their English language website.
They call the declaration "euphemistically" named.
They say it's misleading. They say it's deceptive. They say that it will unravel the very fabric of the civilized world ... a fabric where control, particularly over women, lies firmly in the hands of men.
The rights they don't want to see include:
1. Granting girls full sexual freedom, as well as the freedom to decide their own gender and the gender of their partners (ie, choose to have normal or homo- sexual relationships), while raising the age of marriage.
2. Providing contraceptives for adolescent girls and training them to use those, while legalizing abortion to get rid of unwanted pregnancies, in the name of sexual and reproductive rights.
3. Granting equal rights to adulterous wives and illegitimate sons resulting from adulterous relationships.
4. Granting equal rights to homosexuals, and providing protection and respect for prostitutes.
5. Giving wives full rights to file legal complaints against husbands accusing them of rape or sexual harassment, obliging competent authorities to deal husbands punishments similar to those prescribed for raping or sexually harassing a stranger.
6. Equal inheritance (between men and women).
7. Replacing guardianship with partnership, and full sharing of roles within the family between men and women such as: spending, child care and home chores.
8. Full equality in marriage legislation such as: allowing Muslim women to marry non-Muslim men, and abolition of polygamy, dowry, men taking charge of family spending, etc.
9. Removing the authority of divorce from husbands and placing it in the hands of judges, and sharing all property after divorce.
10. Cancelling the need for a husband’s consent in matters like: travel, work, or use of contraception.
As if this set of rules isn't scary enough, there's a decent swath of America who would agree with these reasons.
