<ul class="summary-list"><li>Large companies like Disney and Uber have arbitration clauses in their Terms of Use.</li><li>Arbitration is when a neutral third party settles a dispute instead of a jury trial.</li></ul><p>Companies are using a simple strategy to avoid courtroom litigation when disaster<strong> </strong>strikes: the fine print.</p><p>Terms and conditions have become a ubiquitous part of life for many people, from purchasing concert tickets to applying for a credit card. The legal agreement between businesses and their customers spells out both parties' responsibilities under a contractual relationship.</p><p>That legal agreement can include an <a target="_blank" class="editor-rtfLink" href="https://www.businessinsider.com/how-plaintiffs-law-firms-bring-mass-arbitration-cases-class-actions-2021-11">arbitration clause</a> that removes a customer's right to sue a company when things go wrong — whether the customer knows it or not. Instead, they can be forced to use a neutral third party to settle a dispute instead of a jury at trial.</p><p>In some cases, companies are using infinite arbitration clauses, which can extend to individuals beyond the original contractual parties, requiring all disputes to be settled out of the courtroom, and can be enforceable even after terminating a service.</p><p>"Infinite clauses stretch to the horizon and last forever. They are less a contractual provision and more a kind of arbitration servitude," David Horton, a professor at the University of California, Davis, School of Law, wrote in the University of Pennsylvania Law Review.</p><p>It's a near-century-old practice that some legal experts say should be modernized for the digital age.</p><h2 id="27cb7a2c-c011-4afd-9917-00dc1588da6c">The Disney case</h2><p>In the case of large companies, arbitration clauses included in one service can often apply to any service the company offers.</p><p>This scenario gained attention earlier this year after a New York State man filed a <a target="_blank" class="editor-rtfLink" href="https://www.businessinsider.com/disney-wrongful-death-lawsuit-theme-park-2024-8">wrongful-death lawsuit against Disney</a> and a restaurant operator who runs a pub at Disney Springs. Disney does not own the restaurant.</p><p>Jeffrey Piccolo's lawsuit said his wife, Kanokporn Tangsuan, died in October 2023 from a "severe acute allergic reaction" after dining at Raglan Road Irish Pub and Restaurant, where they asked a staff member on "numerous occasions" if allergen-free options were available. The staff member assured them the restaurant did, but Tangsuan collapsed inside Planet Hollywood later that night and was transported to a local hospital, according to the complaint.</p><p>A medical examiner's investigation determined she died due to "anaphylaxis due to elevated levels of dairy and nut in her system."</p><div type="image" title="A photo of a sign on a water tower with the Disney Springs logo" height="1704" width="2560" msid="115384767" hostid="261" sizebytes="276990"></div><p>In response, Disney filed a motion to compel arbitration, arguing that Piccolo could not sue the company because he had agreed to its Terms of Use when signing up for a free Disney+ trial years earlier and again when purchasing tickets to its theme park. Disney quickly found itself in a <a target="_blank" class="editor-rtfLink" href="https://www.businessinsider.com/disney-wrongful-death-lawsuit-legal-argument-pr-nightmare-2024-8">PR nightmare</a> as people online called the move "very dystopian" and urged users to cancel their Disney+ subscriptions in retaliation.</p><p>After the criticism, Disney reversed course and dropped its motion to compel arbitration. The case is pending in the Ninth Judicial Circuit Court in Orange County, Florida.</p><p>"At Disney, we strive to put humanity above all other considerations. With such unique circumstances as the ones in this case, we believe this situation warrants a sensitive approach to expedite a resolution for the family who have experienced such a painful loss," Josh D'Amaro, the chairman of Disney Experiences, said in a statement.</p><p>Although Disney relented, Piccolo isn't the only one to get caught up in the fine print, and he likely won't be the last.</p><p>Lawyers and legal experts who spoke to Business Insider said there is little consumers can do to avoid arbitration clauses in an era when signing contracts often happens with the tap of a finger.</p><p>"I think the only thing we can do is opt out of the internet," Joseph Cammarata, a partner at Chaikin, Sherman, Cammarata &amp; Siegel, P.C. in Washington DC, told Business Insider.</p><h2 id="7db68ead-3086-4a47-adf0-1c0cf75edcf6"><strong>Large companies use arbitration to avoid damaging their reputations in a public trial</strong></h2><div type="image" title="Preview of John and Georgia McGinty alongside the crashed Uber vehicle." height="3264" width="2962" msid="115384769" hostid="261" sizebytes="435138"></div><p>Like Disney, Uber made headlines this year for a 2023 lawsuit filed by Georgia and John McGinty in the Superior Court of New Jersey.</p><p>In a September court filing, the couple said they were riding in an Uber in March 2022 when the driver ran a red light and crashed into another vehicle. The court filing said Georgia sustained multiple injuries, including rib, cervical, and lumbar spine fractures. She also experienced damage to her abdominal wall, pelvic floor, and a protruding hernia.</p><p>John sustained "severe" fractures to his left arm and wrist and a fractured sternum, according to the lawsuit.</p><p>Uber responded by filing a motion to compel arbitration, which that court denied. However, Uber appealed, and New Jersey's appellate division sided with the company, which said the McGinty's could not have a courtroom trial because Georgia agreed to its Terms of Use in 2022 for an unrelated Uber Eats order. The couple pushed back, saying their underage daughter made that order and have filed an appeal.</p><p>"While the plaintiffs continue to tell the press that it was their daughter who ordered Uber Eats and accepted the Terms of Use, it's worth noting that in court they could only 'surmise' that that was the case but could not recall whether their daughter ordered food independently or if Georgia assisted," an Uber spokesperson said in a statement.</p><div type="image" title="Georgia McGinty, who was involved in an Uber car crash." height="3024" width="4032" msid="115384772" hostid="261" sizebytes="674730"></div><p>Stacey Lee, a professor of law and ethics at Johns Hopkins Carey Business School, told BI that consumers are increasingly running into arbitration clauses, but how businesses use them isn't necessarily new.</p><p>"It has always been the default for businesses to want to go to arbitration for a number of reasons," Lee said.</p><p>"You're not going to have a class action lawsuit, you're not going to have it plastered on top of the front page, there's limited discovery, and businesses have a little more control over who the arbitrators are," she said.</p><p>Arbitration usually has three arbitrators selected from the Arbitration Association of America. They're often business professionals with experience in a specific field.</p><p>"Their knowledge of the customs and norms of the industry is very different than a judge's, and because they're on the business side, they have a tendency to agree more with the business interpretations of how things work," Lee said.</p><p>Cammarata said companies know juries might be less sympathetic to their arguments.</p><p>"They want to limit public accountability and responsibility," he said. "A jury may listen and say, 'Uber, are you kidding me?'"</p><p>However, arbitration isn't inherently anti-consumer or unfair to the average person. Compared to courtroom litigation, arbitration can cost less money and be a quicker process. People also can request an appeal in arbitration, but it's not the same as a courtroom trial, where they would have the right to do so.</p><p>This private form of settling legal disputes arose with the Federal Arbitration Act in 1925, making it nearly 100 years old. John Carpenter, a partner at the California-based law firm Carpenter &amp; Zuckerman, said the arbitration clause is due for an update.</p><p>"The problem is we're applying a statute that goes back to 1925 to 2024," Carpenter said, "It's an entirely different world. The world we live in now wasn't even conceivable in 1925."</p><p>Carpenter said that arbitration was generally used to determine one-on-one agreements, but now "it's being used digitally in terms of use agreements and essentially contracting away an entire branch of government with a click."</p><h2 id="dcbb6564-3ff6-4ae5-98ab-600c97fc4c6e"><strong>How consumers protect themselves from arbitration clauses</strong></h2><p>Cammarata said one way consumers can navigate arbitration is to check if a company's terms of use has an opt-out clause. That, however, relies on consumers reading through the businesses' Terms of Use, which are often lengthy and written in legal jargon.</p><p>"First of all, they haven't read it, so they don't even know that they agreed to arbitration, let alone to opt out," he said.</p><p>Lee said that while courts tend to be critical of arbitration clauses in employment agreements, they're less so regarding things like streaming services or rideshare apps.</p><p>"Increasingly, courts are like, 'You can read. You scroll through and click yes. It is now your responsibility," Lee said. "You can walk away from the service, and it doesn't affect your life, liberty, or pursuit of happiness."</p><p>John said he believes courts need to reexamine the Federal Arbitration Act.</p><p>"It's going to require legislative action to take a look at this," he said.</p>

How century-old arbitration laws are failing consumers in the digital age

<ul class="summary-list"><li>Microsoft told customers that a software bug caused inconsistent collection of log data.</li><li>The bug affected key security products, including Microsoft Sentinel and Entra.</li></ul><p><a target="_blank" class="" href="https://www.businessinsider.com/microsoft-punts-365-ai-bundle-pilot-tests-copilot-2024-9">Microsoft</a> is telling customers that it failed to consistently collect log data for several important cloud services, according to an update viewed by Business Insider.</p><p>A log is a record of events within a program, such as account sign-ins. This record of events could include instances of unauthorized access to networks and accounts. If logs are not recorded properly, then any records of potential problems are lost and the company and its customers may have missed intrusions.</p><p>Between September 2 and September 19, "a bug in one of Microsoft's internal monitoring agents resulted in a malfunction in some of the agents when uploading log data to our internal logging platform," Microsoft wrote in the customer notification.</p><p>There's no evidence of cyberattacks stemming from this incident.</p><p>"This issue did not impact the uptime of any customer-facing services or resources -- it only affected the collection of log events. Additionally, this issue is not related to any security compromise," the notification explained.</p><p>Affected products included Microsoft Entra, an identity-management service. Microsoft Sentinel, a security information and event-management product, was also impacted, along with Microsoft Defender for Cloud and Microsoft Purview, a data loss prevention product.</p><p>"Microsoft Sentinel customers may have experienced potential gaps in security related logs or events, possibly affecting customers' ability to analyze data, detect threats, or generate security alerts," the update warned.</p><p>BI asked Microsoft to comment on this episode on Thursday and Friday. Spokespeople Frank Shaw and Jill Austin, along with the company's outside PR firm WE Communications, didn't respond to multiple requests for comment. </p><p>This is a particularly a big deal for Microsoft because the company has been saying that <a target="_blank" class="" href="https://www.businessinsider.com/internal-microsoft-email-shows-security-leadership-shakeup-2023-12">security</a> is a top priority. It recently introduced a Security Futures Initiative, largely in response to its mishandling of security incidents, including what the Department of Homeland Security called "<a target="_blank" class="" href="https://www.businessinsider.com/microsoft-security-issues-government-report-chinese-hacks-2024-4">cascade</a>" of errors that allowed Chinese hackers in 2023 to access thousands of cloud customer emails.</p><p>The idea was that Microsoft would make security its first priority in everything. It's become so important that every Microsoft employee will be evaluated on a "core priority" of security in performance reviews, according to an excerpt of an email shared with BI.</p><p>"If you're faced with the tradeoff between security and another priority, your answer is clear: Do security," Microsoft CEO Satya Nadella wrote in an email to employees in May.</p><p>"In some cases, this will mean prioritizing security above other things we do, such as releasing new features or providing ongoing support for legacy systems," the CEO added. A look back at first Apple Watch — How Apple entered the wearable space

<p><em>This article is part of "</em><a target="_blank" rel="" href="https://www.businessinsider.com/how-5g-wireless-technology-shaping-our-world-2023-7"><em><u>5G and Connectivity Playbook</u></em></a><em>," a series exploring some of our time's most important tech innovations.</em></p><p>Before the eruption of Vesuvius in AD 79, a building near one of Pompeii's south gates was a bustling hub. Artisans crafted baskets and maps, and the structure's communal space was home to gatherings and restaurants. The people who worked in the building — some of whom were enslaved — likely lived there.</p><p>"We've got a lot of businesses operating in the same space," Allison Emmerson, an archeologist and associate professor at Tulane University, told Business Insider. "While we're digging this up, we're thinking about the lives of the lower classes of Pompeii — not just at the time of the eruption but throughout the city's history."</p><p>Emmerson leads the multidisciplinary, international team excavating this building. She's the director of the <a target="_blank" href="https://sites.google.com/view/tulaneatpompeii">Pompeii I.14 Project</a>, a collaboration between the Archaeological Park of Pompeii, Tulane University, Oxford University, and Indiana State University that started in 2021. The project's focus is a city block, Insula 14, on the southeastern side of Pompeii. Its researchers are interested in the margins of the Roman city: both its literal physical edge and the marginalized residents who lived there.</p><p>The Pompeii I.14 Project is one of a growing number of archeological endeavors using interconnected technology to better understand and preserve the past. While <a target="_blank" class="" href="https://www.businessinsider.com/giza-great-pyramid-tomb-ground-penetrating-radar-great-western-cemetery-2024-5">technology</a> has always been an essential part of the field, how archeologists collect, record, and analyze findings has advanced as tech has progressed.</p><p>One way researchers are applying these innovative tools is by creating a digital twin: a detailed virtual counterpart of a real-life entity. People in various trades, including <a target="_blank" href="https://www.bloomberg.com/news/features/2022-04-05/digital-twins-mark-cities-first-foray-into-the-metaverse">city planning</a> and <a target="_blank" href="https://www.iotworldtoday.com/transportation-logistics/bmw-dassault-team-to-add-digital-twins-for-car-design">car design</a>, are increasingly using digital twins. While the process of creating digital twins can differ, these computerized 3D replicas can give researchers a more dynamic look at what they're studying, enable greater <a target="_blank" class="" href="https://www.businessinsider.com/antikythera-mechanism-mystery-gravitational-waves-calendar-2024-7">collaboration</a>, and facilitate a remarkable level of preservation.</p><h2><strong>Building a digital twin</strong></h2><p>The <a target="_blank" href="https://sites.google.com/view/tulaneatpompeii/interactive-multimedia?authuser=0">Pompeii digital twin</a>, which combines geospatial technology with a rich repository of data collected at the site, lets researchers examine the area from their universities, collaborate remotely with other researchers, and visualize how it has changed over time.</p><p>"Having the digital twin makes it an entirely new ball game," Emmerson said. "It really allows us to go back as if we're in the excavation."</p><p>Alex Badillo, an assistant professor at Indiana State University, is the Pompeii project's head of digital data initiatives. Before the excavation, Badillo and the other members of the digital team used drone imagery, <a target="_blank" class="" href="https://www.businessinsider.com/bronze-age-lost-tomb-ireland-rediscovered-photogrammetry-2024-1">photos</a>, and structure-from-motion photogrammetry — a technique for turning 2D images into 3D models — to create a scaled and georeferenced replica of the Pompeii city block.</p><div type="image" title="A digital 3D replica of a square city block with buildings, grass, and wall structures" height="1198" width="1940" msid="112410473" hostid="261" sizebytes="93486"></div><p>Over time, the information gathered by the archeological team working at the site has made this model more detailed and dynamic. This data is what transforms the 3D model into a digital twin: The design changes based on what the team learns through excavation. Unlike static 3D models, <a target="_blank" href="https://amses-journal.springeropen.com/articles/10.1186/s40323-020-00147-4">digital twins</a> include an evolving set of data and the means to update and adjust the model based on new information.</p><p>To get this information, Badillo implemented a digital workflow at the dig site. The Pompeii site team used iPad Pro tablets to record data, take photos, 3D scan, and digitally sketch their findings. That information is saved in custom digital forms on the iPad and sent to cloud storage when the researcher has access to WiFi or a cell network. From there, it's added to an online dashboard used by the entire team.</p><p>"If someone is digging in the trench and they're wondering what was analyzed from the deposit yesterday, they can go to the iPad they have in the field and pull up all of that information," Emmerson said.</p><p>Badillo told BI that the information gathered on the iPad — data like structure measurements, soil characteristics, and artifacts found — is added to the 3D model. Together, these components make the digital twin, which archeologists can use to revisit, explore, and analyze the site. After the 3D model is complete, Badillo and his team will continue this workflow at the next dig.</p><p>"You can move through the web scene, and if forms have been filled out for that location, you can click to get extremely detailed information," Badillo said. "Being able to look level by level, make measurements — it's all been a game changer."</p><h2><strong>Benefits of digital twins</strong></h2><p>One of the major advantages of digital twins is the ability to examine site elements exactly as they appeared during the initial excavation.</p><p>Giles Spence Morrow, a research fellow at Vanderbilt University and an assistant professor at McMaster University, began a digital-twin project in 2011 focused on Huaca Colorada, a ceremonial mound built and occupied between AD 650 and 1,000 in Peru.</p><p>Like Badillo, Morrow uses photogrammetry to create the site's digital twin. Wernke has also combined 3D imagery with archeological information gathered at his research site to make a digital twin.</p><p>Through their collaboration, Morrow and Wernke are investigating how digital twins can be augmented through immersive virtual reality. Morrow said they used VR headsets to view their digital twins from a first-person perspective, something that's possible only with strong <a target="_blank" class="" href="https://www.businessinsider.com/5g-advanced-standalone-6g-qualcomm-huawei-mwc-2024-3">internet connectivity</a>.</p><p>Wernke said that exploring digital twins through virtual reality was "as close as we can come to reproducing the feeling or experience" of being at their field sites. When Morrow and Wernke use VR headsets to examine their digital twins, they can leave notes, markups, and maps within the VR scene.</p><p>"The value of this kind of detailed 3D, immersive documentation is hard to overstate, because excavation is an inherently destructive process," Morrow said.</p><p>The unavoidable destruction of an excavation site is partly why Jamie Hodgkins, an associate professor at the University of Colorado, Denver, and her team were interested in creating a digital twin of a burial site within an Italian cave. They <a target="_blank" href="https://today.ucsd.edu/story/uc-san-diego-researchers-take-a-digital-snapshot-of-an-ancient-infant-burial-site">digitally re-created</a> the oldest documented European burial of an infant female, a child who died nearly 10,000 years ago. The interactive 3D model preserves the burial as they found it.</p><p>The team took dozens of photos of each delicate skeleton piece as it was discovered. "By the end, we had thousands of images of all the skeleton pieces," Caley Orr, an associate professor at the University of Colorado Anschutz Medical Campus who coauthored the study, told BI.</p><p>"This let us reconstruct the burial digitally and see in 3D how it was laid out underground," Orr said. "But we never saw it that way in real life because it revealed itself as we went through each layer of dirt."</p><h2><strong>Expanding the field</strong></h2><p>Hodgkins told BI that digital twins could become more common in archeology. While they're valuable to working archeologists now, she said that part of what makes them so useful is how they could benefit the field over time.</p><p>Hodgkins said past archeological research lacked documentation of spatial relationships between <a target="_blank" class="" href="https://www.businessinsider.com/photos-archaeological-mysteries-ancient-artifacts-hikers-discoveries-melting-glaciers-alps-2024-7">artifacts</a>. Without that information, she added, it can be difficult to understand how artifacts, remains, and other discoveries relate to each other.</p><p>Digital twins could help bridge this gap and give researchers a way to look at field sites just as they found them. "You can never put an artifact back," Hodgkins said. "But if an archeologist 50 years from now wants to ask a question that we didn't think of, they can look at what we have, see the excavation as it was happening, and consider these spatial relationships."</p><p>Hodgkins is also part of a multiproject, transcontinental <a target="_blank" href="https://jamiehodgkins.wixsite.com/mysite/homer">research consortium</a> that aims to teach students how to collect site data to create digital twins. She said that if more people knew this technique, sites could be compared globally.</p><p>"What we want is to train future archeologists," Hodgkins said. "We won't really understand how humans were <a target="_blank" class="" href="https://www.businessinsider.com/ancient-stone-tools-first-humans-north-america-2024-5">moving across the planet</a>, how they were interacting with each other, and how the environment was affecting them unless we can compare data across sites."</p><p>"Digital twins can help us answer the big questions," she added. "But you can't create them if you don't collect the right kind of data."</p>

Digital-twin technology could be an archaeologist's most powerful tool

Payments made via Unified Payments Interface (UPI) reported a 45% yearly growth, according to data from the National Payment Corporation of <keyword id="19895063" type="General" weightage="20" keywordseo="India" source="keywords">India</keyword> (<keyword id="19998946" type="General" weightage="20" keywordseo="NPCI" source="keywords">NPCI</keyword>).<br /><br />The value of transactions also saw a growth of over 35%, totaling Rs 20.64 trillion. This marks the third consecutive month when total transactions exceeded Rs 20 trillion. In June 2024, the total UPI transaction value was Rs 20.07 trillion, while in May it was Rs 20.44 trillion.<br /><br />NPCI data also showed that the average daily transaction value through UPI in July 2024 was Rs 466 million, or about Rs 66,590 crore. Compared with June, the volume of <keyword id="19957378" type="General" weightage="100" keywordseo="UPI-transactions" source="keywords">UPI transactions</keyword> grew by 3.95% in July, while the value of transactions increased by 2.84%.<br /><br />In the first four months of the current fiscal year (2024-25), UPI recorded transactions amounting to Rs 80.79 trillion, across approximately 55.66 billion transactions. In 2023-24, total UPI transactions were 131 billion, compared to 84 billion in 2022-23.<br /><br />The monthly bulletin of the <keyword id="19899810" type="General" weightage="20" keywordseo="reserve-bank-of-india" source="keywords">Reserve Bank of India</keyword> (RBI) reported that over the last four years, UPI transactions have seen a ten-fold increase in volume, from 12.5 billion transactions in 2019-20 to 131 billion transactions in 2023-24, which accounts for 80% of the total digital payment volumes.<br /><br />Unified Payments Interface (UPI) transactions experienced substantial growth, increasing by 57% year-on-year in FY24. The company says these insights have helped it identify innovative antiaging solutions. It also says it has used an AI platform to optimize product formulas to minimize the number of lab tests needed.</p><h2>Monitoring perpetual systems</h2><div type="image" title="A drone for overhead line inspection is in the Eon TestingLab." height="682" width="1024" msid="111691358" hostid="261" sizebytes="38158"></div><p><strong>Application</strong>:<strong> </strong>Essential services require 24/7 oversight and immediate identification of breakdowns. AI-enabled systems can conduct consistent oversight and spot weaknesses.</p><p><strong>Example</strong>: E.ON, a German utility company, uses AI to maintain its electricity infrastructure. It deploys semi-automated drones to monitor its power-transmission systems. AI software analyzes the drone images to assess whether any components, such as electrical cables and transmission towers, are defective.</p><p>The company is also testing an AI solution to predict when parts of its energy infrastructure, such as a cable, might need repairs. Executives hope that by detecting failures before they occur, they can prevent disruption. In the past, farmers sprayed whole fields with herbicide to manage weeds. This meant they also sprayed crops and barren soil, wasting valuable resources and time.</p><p>The company uses computer vision and machine learning to detect individual weeds and apply herbicide only where it's needed. It said this has reduced herbicide use by up to two-thirds.</p><p>A sprayer mounted on a tractor uses cameras and AI to identify a weed's position as the tractor moves across a field. Suffolk Technologies Group, a venture-capital group associated with the construction company, partnered with the startup NewMetrix to develop an AI-based safety tool. The team digitized incident data and developed a predictive model.</p><p>A key component was tracking "safety observations" — the term used for when the team is looking for circumstances that are not in line with safety protocols, such as someone not wearing appropriate protective clothing.</p><p>The data indicated that the frequency of safety observations was correlated with the total number of on-site safety incidents. As a result of this insight, the team directed the workers to conduct safety observations based on a formula derived from the total number of job hours worked.</p><p>The data-driven strategy was effective. Suffolk said that after implementing the approach, it saw a 25% improvement in the total recordable incident rate during the past fiscal year.</p><p>"Over the course of the last few years since we've provided more focus on observations, we've seen an overall downward trend closer to 60% in terms of incident rates," a Suffolk spokesperson told BI.</p><h2>Complying with regulations</h2><div type="image" title="A plate of cubed cheese garnished with herbs and an olive" height="2568" width="3424" msid="111691368" hostid="261" sizebytes="372784"></div><p><strong>Application</strong>: Many companies are sitting on years' worth of valuable product-related data they don't have the time or resources to mine for insights. Cheesemakers must meet certain requirements set out by the US Food and Drug Administration, such as those for moisture and fat content. The company uses AI to create optimal cheese recipes that meet these standards.</p><p>Todd Stertz, a manager for cheese and powders at Tetra Pak, said that while many cheese plants had "vast amounts of historical data," the cheesemakers "did not always use it to the maximum potential." For instance, the data could give insight into how certain manufacturing conditions in the past had affected things like cheese moisture.</p><p>"The vast amount of data is not easy for a human to digest," Stertz said. "It takes a long time to come up with a decision afterwards."</p>

10 AI applications for companies that want to streamline their business and improve customer experiences

There are also pizza-preparing robots.</p><p>But nowhere else do those technologies come together quite like they do in Grapevine. The intended result is the convenience increasingly common in smaller-format retail settings combined with the low-markup pricing that typically can only be found when buying in bulk.</p><p>Several shoppers told Business Insider they had been using the scan-and-go tech for a while at other locations, and that it performed smoothly for the grand opening. Any hiccups they noticed were attributed to the unusually high volume of customers shopping Thursday morning for the store's opening.</p><p>Sam's Club said the individual pieces of technology have been working well. <ul class="summary-list"><li>Twin Health uses a "digital twin" to counsel patients with type 2 diabetes or obesity.</li><li>A 66-year-old CEO says the program changed his life and put his disease in remission.</li></ul><p>Three years ago, Devlin Donaldson was preparing for an early death.</p><p>The busy CEO of a nonprofit<strong> </strong>had suffered a stroke in 2018. That's how he discovered he'd already been living with type 2 diabetes for years.</p><p>After his diagnosis, things didn't change much. Despite bouncing around from medication to medication, and listening to "uninspiring" diet advice from a nutritionist, his health was not improving, and his blood sugar was out of control.</p><p>"Every time I went to my doctor, it was like, 'well, that's not working,' here's another prescription, here's another prescription," Donaldson told Business Insider. "At some point, I just sort of lost hope, and I said, 'Forget it. I'm just going to die young.'"</p><p>So he was pretty skeptical when he signed up to try out a digital "twin" designed to improve his condition and help him slash his stack of medications.</p><p>Ultimately, a digital twin is just an app full of advice on how to eat and move.</p><p>But, Donaldson said, the personalized insights transformed his understanding of his body, and the challenges he faced. Three years later, his diabetes is in remission.</p><h2 id="cf3dda96-8995-4af2-82e0-af94242eaa6c"><strong>'Digital twin' tech is a fast-growing type of precision medicine</strong></h2><div type="image" title="CGM on a man's arm" height="1414" width="2121" msid="110420245" hostid="261" sizebytes="76806"></div><p id="cf3dda96-8995-4af2-82e0-af94242eaa6c"><a target="_blank" href="https://market.us/report/digital-twins-in-healthcare-market/#:~:text=Personalized%20Healthcare%20Solutions,improving%20patient%20experiences.">Digital twins in healthcare</a><strong> </strong>are being used at <a target="_blank" href="https://www.businessinsider.com/what-is-a-longevity-clinic-executive-physical-2024-5">longevity clinics</a> and in hospitals. They can track a patient's health over time, suggesting personalized interventions. The goal is to optimize treatment plans, making them more compatible with each person's unique preferences and biology. It's a type of precision medicine that's growing fast.</p><p>Donaldson was one of the first customers at Twin Health. Twin Health is the only company that leverages digital twin AI for diabetes "reversal" — or, as doctors prefer to say, "remission." Competitors like Virta Health and Omada don't place as much emphasis on individualizing their diabetes reversal advice.</p><p>Donaldson was a reluctant participant in the program at first. "I wasn't super enthusiastic," he said. "I didn't want to get my hopes up."</p><p>But since it was free — paid for through his employer's healthcare plan — he tried it out. (Some employers require patients with diabetes to use Twin to get their prescriptions covered.)</p><p>Plus, he couldn't help feeling at least a little intrigued by Twin's promise of healing. This wasn't about managing his disease; they were going to try to get rid of his diabetes, or so they said.</p><p>"My understanding was diabetes was something you lived with for your whole life," he said. "Once you got it, you had it."</p><p>Twin sent a box to his home that included a digital scale, a blood pressure cuff, a smartwatch, and a continuous glucose monitor (CGM) to track how different foods and activities impacted his blood sugar levels throughout the day. Then his "twin" settled in and got to work, noticing patterns in his routines and measuring his health.</p><h2 id="1c928e4f-ce5d-4f0e-86f1-9c636cdd96cb"><strong>Working with the 'twin' involves logging food, and getting regular exercise</strong></h2><div type="image" title="hiking person legs" height="1415" width="2119" msid="110420247" hostid="261" sizebytes="179966"></div><p>Calling it a twin is a bit of a misnomer, really. Donaldson says his "twin" is much more like a dashboard he can check to get advice about <a target="_blank" href="https://businessinsider.com/high-protein-fiber-pancakes-man-lost-weight-reversed-diabetes-2024-5">which foods are best</a> to eat when, or how he's doing with his steps goal. It also monitors his medications, glucose levels, and blood pressure.</p><p>He manually enters everything he eats, which is arduous but enlightening, he said. If his blood sugar starts going up, he's noticed that getting out for a walk can help bring it back down. He knows his body reacts better when he starts eating <a target="_blank" href="https://businessinsider.com/weight-loss-tips-man-lost-40-pounds-10-inches-walking-nutrients-order-2024-5">his veggies before the protein</a> in a meal, feeding his stomach a base of some fiber.</p><div type="image" title="screenshot of twin app showing blood glucose spike after 'orange' meal " height="1575" width="1047" msid="110420248" hostid="261" sizebytes="45222"></div><p>"It becomes very much about my body," he said. "All of my information goes in and it talks to me like a smarter version of myself saying, 'you ate this, this was really good. You ate this, this was really bad.' And it begins to give me this feedback cycle."</p><p>Registered dietician Nicola Guess, who studies the prevention and management of type 2 diabetes at Oxford University, and who is not involved with Twin, said she was "pleasantly surprised" with how the system works.</p><p>"This is where tech can be so useful," Guess said. While <a target="_blank" href="https://www.instagram.com/p/C6HT4lAI5_x/?hl=en&amp;img_index=2">she's generally not a fan</a> of people with normal blood sugar using CGMs (because there's <a target="_blank" href="https://www.businessinsider.com/man-weight-loss-12-pounds-spiking-increasing-blood-sugar-levels-2023-10">very little the CGM can tell us</a> about the metabolic health of non-diabetic patients) she said the way Donaldson uses his CGM makes a lot of sense.</p><p>"It is true: if you have type 2 diabetes, your excursions, your glucose can cause you to go blind," she said. "If people feel empowered by being able to real-time check on what that is, I get that completely."</p><p>It's more than what an Apple Watch or a Fitbit would do. In addition to data from the CGM, there are regular blood pressure cuff readings and the bathroom scale measures his body composition. Donaldson can also ask his Twin questions while he's on the go, like when he showed up to a work event where they were only serving pasta.</p><p>"What do I do?" he asked Twin.</p><p>"Enjoy it" was the response he received on his phone a short time later.</p><p>"One thing is not going to be the end of you," he realized.</p><div type="image" title="twin health app screenshot showing blood sugar levels throughout day" height="1650" width="1053" msid="110420250" hostid="261" sizebytes="46816"></div><h2 id="64bc68dd-2260-41d6-948d-3504b4f9790b">Healthcare that's free until you get results</h2><p>Twin's outcome-based payment system is a "brilliant" healthcare model, Guess said. Sometimes called "value-based" healthcare, this new approach requires a company like Twin to actually improve a patient's wellbeing — by improving their blood sugar or propelling weight loss, for example — before they can charge the employer.</p><p>"The onus is on a company not to produce something that looks good, it has to <em>be</em> good," Guess said.</p><p>The sector is growing fast, too — with investments in value-based care companies far outpacing hospital construction spending, per <a target="_blank" href="https://www.mckinsey.com/industries/healthcare/our-insights/investing-in-the-new-era-of-value-based-care">McKinsey &amp; Company</a>.</p><p>Guess said while "most of what we know about what diet can do" for type 2 diabetes is well established, the app is still a nice way to bring it all home for people in an approachable way. (Though she tends to recommend a more <a target="_blank" href="https://med.stanford.edu/news/all-news/2022/070/keto-mediterranean-diet-diabetes.html">Mediterranean-style diet over low-carb</a> plans.)</p><h2 id="688045c8-1911-48d3-a027-c4b23e54521c"><strong>Donaldson lost more than 40 pounds, and improved "all the numbers" including cholesterol</strong></h2><div type="image" title="picture of trimmer devlin in 2022" height="1367" width="1025" msid="110420252" hostid="261" sizebytes="100432"></div><p>Within a month, Donaldson was hooked.</p><p>"That constant, real-time feedback, it becomes addictive," he said. "I think it's the future of a big section of medicine for people to learn how to live healthy."</p><p>His <a target="_blank" href="https://www.businessinsider.com/diet-and-exercise-strategies-for-lower-blood-sugar-reverse-type-2-diabetes-2024-5">twin was giving him new ideas for which foods to eat</a> and when. He started eating more nuts for snacks and vegetables at meals, bumping up his fiber intake. At home, Twin recommended he make a chicken avocado salad with mustard dressing, or some salsa verde carnitas.</p><p>"It makes me eat a lot more naturally," he said. Fewer canned goods, more fresh veggies and satiating protein instead. "Our world is not trying to help us stay healthy. And what my twin does is help me figure out how to navigate the world in a healthy way."</p><div type="image" title="Someone spooning dressing over roasted broccoli." height="1415" width="2119" msid="110420255" hostid="261" sizebytes="173022"></div><p>His twin also made him realize he needed to make sleep a far bigger priority in his life.</p><p>"You know you need to get sleep to feel good, but <a target="_blank" href="https://www.businessinsider.com/sleep-more-cut-calories-without-dieting-study-suggests-2022-2">sleep is so important</a>," he said. Watching his sleep trends gathered in the smartwatch provided by Twin, he noticed "when I started sleeping better, I started losing more weight."</p><p>"Within six months, I went to 200 pounds — bang!" he said. "My good cholesterol went up, my bad cholesterol came down, my triglycerides came down, my inflammation scores all dropped. I mean, all the numbers went in the right directions so quickly."</p><p>His twin also encouraged him to drink a little bit of apple cider vinegar each day, and take a multivitamin. These were the Twin recommendations that Guess didn't think were as great, especially the vitamin.</p><p>"<a target="_blank" href="https://www.businessinsider.com/how-to-improve-longevity-supplements-vs-exercise-and-diet-2024-3">Multivitamins</a> aren't a good idea if you don't need them," she said. "The idea that more vitamins and minerals is better is false."</p><p>"It's kind of weird," she said. "They're doing all of this data collection to really give precise information and it's like, 'Bam! We're going to give everyone a multivitamin."</p><h2 id="c581cf6e-d13e-46a3-81e1-8922ffa50dde"><strong>The Twin is geared to get patients off medications and ditch their CGM — saving employers money</strong></h2><div type="image" title="twin health app screenshot showing patient off medication" height="2436" width="1125" msid="110420260" hostid="261" sizebytes="61608"></div><p>Soon, Donaldson's diabetes was in remission. He quit taking Ozempic and other diabetes medications like Januvia and Farxiga, and he's dropped from size 44 pants when he started the program to size 34 today, eliminating some of the <a target="_blank" href="https://www.businessinsider.com/why-dexa-scan-better-than-bmi-2023-12">dangerous visceral fat </a>that sits around the waistline.</p><p>"I became very passionate about it because I saw results so quickly," he said.</p><p>Seeing how restoration, movement, and nutrition all work together sparked a "radical life change."</p><p>Though he says he has had some recent health issues that have pushed him back on the cheap diabetes pill <a target="_blank" href="https://www.businessinsider.com/metformin-diabetes-weight-loss-anti-aging-drug-long-covid-prevention-2023-2">metformin</a>, he thinks within a month or two he'll be able to go medication-free again. His weight has also crept up about 20 pounds, but he's feeling confident he can lose about 10 of those again and then maintain a stable weight.</p><p>"What they've taught me is everybody screws up, but now you know what to do to be healthy again," he said. "I think I got into a really weird mental place with the disease, but the twin gave me hope, the hope got me committed, and that actually gave me life."</p>

As Indian startups face turbulence in the global funding winter, experts on Monday said they need to reserve cash, create a long-term goal and adopt a culture of customer feedback to survive in 2023.<br /><br />On the occasion of the 'National Startup Day', envisioned by Prime Minister <keyword id="6354477" type="General" weightage="80" keywordseo="narendra-modi" source="Orion">Narendra Modi</keyword> last year, industry experts said that the founders must continuously monitor the trends which are happening in the world.<br /><br />Indian startups fired more than 18,000 employees in 2022 amid a funding winter and macroeconomic uncertainty.<br /><br />"Investing in R&amp;D can be one of the finest ways to actually tackle disruption. In a world of rapidly evolving dating standards, the largesse is always in doubt when it comes to the right thing to do. According to a study by dating app QuackQuack, people still hold chivalry in high regard. But it’s not confined to male-centric traditions only, and has transcended gender boundaries. The concept of mediaeval knightly code of morals has evolved to denote equality and respect; not just opening doors and pulling out chairs.<br /><br />As per a survey of 18-25 year olds, 45% GenZ daters now regard acts of respect and consideration as chivalry. A considerable percentage of women too (37%) said their expression of chivalry might be different at times. Shared responsibilities in a relationship and going the extra mile for their partner is a part of chivalry, they say.<br /><br />The study also highlights that 43% of GenZ, as opposed to 21% of millennials, think the traditional gender roles in online dating are evolving. The study sampled 15,000 online daters, 18-30, spanning metropolitan and small cities and suburbs, participated in the study.<br /><br />“We have seen a remarkable and consistent change in the gender dynamics. With women confidently taking the initiative and men embracing vulnerability, expressing emotions more openly than the preceding generation of daters,” said Ravi Mittal, founder and CEO of QuackQuack.<br /><br /><strong>First move: A disappearing concept?<br /><br /></strong>Since time immemorial, custom has had it that men generally ask women out. The study now shows that this too is changing as gender fluidity takes centre stage. The study shows that 23% of men under 28 revealed being approached by women.<br /><br />This shows that GenZs, both men and women, are comfortable taking the lead, enabling a more equal approach to planning and organising romantic engagements.<br /><br />In turn, rejection is also not a woman’s domain now. Men can reject too, said 21% of GenZ daters between 20 and 26. As many as 18% of women revealed getting rejected by their love interest for conflicting values or perspectives.<br /><br /><strong><em>Mard ko dard – </em>Fade away</strong><br /><br />The way men behave in relationships and while dating can be ascribed to pop culture often. The stereotype of ‘men don’t cry’ seems to be finally giving way with the study finding 47% of GenZ daters from Tier 1 and 2 cities that these concepts are being banished in today’s day and age. <br /><br />The study says that GenZ daters are embracing emotional openness and vulnerability, challenging the notion that expressing feelings is a sign of weakness. This shift allows individuals to be authentic and transparent without fear of judgement.
