A single-judge bench of Justice Navin Chawla passed the restraining order against the multinational consumer goods company. The lawsuit against Dabur was filed by Marico Limited seeking an ad interim injunction to prevent Dabur from circulating or forwarding its WhatsApp and print advertisements for its amla hair oil. It claimed that Dabur's advertisement disparaged the reputation and goodwill of its product, "Nihar Natural Shanti Badam Amla Hair Oil," and its registered "Nihar" trademarks. The court in its judgment stated that Marico failed to establish a prima facie case against the print advertisement but did demonstrate a prima facie case regarding the WhatsApp message/advertisement. Regarding the print advertisement, Marico argued that Dabur's opening statement, "Yaad Rakhna, Sasta Amla, Balo ko Mehenga Padega" (Remember, cheap Amla will cost your hair a lot), was alarming and threatened consumers, suggesting that other inexpensive Amla hair oils were inferior and harmful calling it generic disparagement. While the court declined to injunct the print advertisement, it restrained Dabur and its associates from circulating the WhatsApp message or advertisement for Amla hair oil during the pendency of Marico's lawsuit. Regarding the absence of any explicit reference to Marico in the challenged print advertisement, the court stated that any such reference would require a leap of imagination, which it deemed unwarranted. The court viewed the advertisement as merely suggesting potential negative consequences of using cheaper Amla hair oils in terms of quality and price. Justice Chawla also emphasised that an advertisement should be evaluated from the perspective of an ordinary consumer, who would likely view it as puffery, rather than from the standpoint of a sensitive competitor like Marico. The court concluded that the advertisement merely expressed an opinion that purchasing cheaper Amla hair oil might be harmful to hair, but it was not defamatory towards all hair oils of lower price compared to Marico's product. Regarding the circulation of the challenged WhatsApp advertisement, the court noted that the ordinary consumer would not have access to both the WhatsApp message/advertisement and the print advertisement simultaneously. The connection between the two could only be made by individuals who received the WhatsApp advertisement alongside the print advertisement. Cooling raw material prices will help. </li><li>Demand for staples have been stable, but the beauty and personal care category has not yet recovered fully. </li><li>The summer has seen a decline or low growth in ice creams and juices due to unseasonal rains. </li></ul>With cooling raw material costs, the FMCG sector is expected to kick in the first quarter of FY24 with ‘good quality’ profits, backed by improvement in margins. Input costs have been cooling over the last few quarters and have either remained stable or seen mild moderation, and companies have not been passing them off very generously in the form of price cuts. “We expect most of the companies to register stronger sequential gross profit margin (GPM) improvement in 1Q24F with input cost inflation cooling down further, high-priced inventory getting consumed and the full effect of earlier-taken price hikes playing out,” said a research report by Nomura. Certain categories such as hair oils, edible oils and soaps had witnessed price cuts in earlier quarters, which will flow through in the first quarter, as per BNP Paribas. Also, new price cuts and promotions were seen in laundry, edible oils and other home care categories during the quarter but no major price cuts were seen in biscuits and salts. Double digit revenue growth expected Price cuts and volume growth for the sector are directly proportional for the sector, and as of now most of growth seen in the sector was pricing-led. But that’s changing, analysts say. Demand from urban areas has been stable, with slight sequential improvement in rural demand as well. Also, the demand for staples have been stable, but the beauty and personal care category has not yet recovered though improving due to the price cuts. All in all, the sector should be able to present a good revenue growth for the quarter – notwithstanding the cooler summer this April-June with unseasonal rains that affected sales of juices and ice creams. “We estimate staples/discretionary (ex-ITC) pack to register 10.2%/8.8% revenue growth. We expect a good quarter from Nestle, Godrej Consumers and ITC and a weak print from Marico,” says a report by Kotak. Antique Stock Broking also expects the FMCG sector (not including ITC) to report early double digit revenue growth with moderation in pricing led growth. ITC is expected to see a fall in revenue as its agri business is expected to see a drop due to high-base effects. Nomura expects Nestle, Tata Consumers and Dabur to report the highest revenue growth YoY, and with ITC and Marico to post lower value growth. as analysts believe that the sector is poised for a good show in the first half of FY24 with a raw material cost tailwind. “However, in the second half of FY24 we expect revenue growth to moderate as pricing benefits should fade and growth would have to be volume-led,” said a report by BNP Paribas. There has been no aggressive price war as of now in the sector as of now, but if price cuts are not taken by large players in the segment, it might lead to unorganized players gaining market share. In the last one year, many consumers have ‘downtraded’ to unbranded products or local brands during periods of high inflation. “Prices of most stock keeping units (SKUs) have increased sharply over the last two years. Soap and detergent prices have risen 40-50% over that period. So far the price cuts have been limited and largely confined to the value segment. We believe price cuts might be needed to drive volumes,” said BNP Paribas. We believe that domestic margins will pass through the decreased cost to consumers and still be able to protect their margins barring some minor basis point cut. After biscuits, Indian villagers are cutting down on clothes and hair oil too

It’s good news for those who were afraid of what goods and services tax (<keyword id="6354679" type="ORGANIZATION" weightage="100" keywordseo="GST">GST</keyword>) holds in terms of prices for groceries, household and personal care products. The prices will not be changed for at least six to eight weeks after GST is implemented on July 1st, since companies dealing in these areas aren't too sure about the affect that these companies will have on their cost of operations. While several household products like cookies, toothpastes, soaps and hair oils will be taxed lower at 18% after GST as compared to the present charge of about 22% in the current indirect tax structure of excise duty and value-added tax. However, other household detergents like shampoos and skincare products will be charged higher GST of 28%. "While our intent is to pass on the benefits of lower GST in the relevant categories where rates are coming down to consumers as soon as it is feasible, there are still some open issues where we need clarity such as how area-based exemptions will be handled, that will impact pricing decisions," <keyword id="6369697" type="COMPANY" weightage="100" keywordseo="Godrej">Godrej</keyword> Consumer MD Vivek Gambhir told <a href="http://economictimes.indiatimes.com/industry/cons-products/durables/good-news-your-grocery-expenses-wont-rise-after-gst-rollout/articleshow/59360111.cms">ET</a>. In case of items for which rates are going to increase after GST, there are no price changes planned. As per retailers and distributors, products of <keyword id="6365619" type="CITY" weightage="100" keywordseo="Hindustan-UniLever">Hindustan Unilever</keyword>, <keyword id="6361485" type="CITY" weightage="100" keywordseo="Marico">Marico</keyword>, <keyword id="62997" type="CITY" weightage="100" keywordseo="Dabur">Dabur</keyword>, <keyword id="73802" type="COMPANY" weightage="100" keywordseo="Colgate">Colgate</keyword>, <keyword id="6361491" type="CITY" weightage="100" keywordseo="Procter-Gamble">Procter &amp; Gamble</keyword> and <keyword id="6359432" type="PERSON" weightage="100" keywordseo="Britannia">Britannia</keyword> will remain unchanged at least until August. "There are hardly any changes in either price or grammage for the new stock that will hit the market from next week onwards," said an HUL distributor requesting anonymity. "We can't change price points such as Rs 5 and Rs 10. The only option would be to reduce or increase weight, but it won't be based on just GST on final products," said Mayank Shah, group product manager at Parle Products. "We need one-two months to see if the new tax has any impact on the cost of products and what will be the credit on input to offset them." Also, there would be no changes in the prices of milk, another household item that constitutes country's largest consumer segment - milk and curd. "We will drop prices of milk powder and baby food by close to 5%," said RS Sodhi, managing director of <keyword id="6531735" type="ORGANIZATION" weightage="100" keywordseo="Gujarat-Cooperative-Milk-Marketing-Federation">Gujarat Cooperative Milk Marketing Federation</keyword> (GCMMF), owner of <keyword id="26280" type="COMPANY" weightage="100" keywordseo="amul">Amul</keyword>. "But the new pricing will reach consumers only after a week or 10 days once the existing inventory gets exhausted." On Tuesday, Coca-Cola India had announced that it will increase prices of its aerated beverages and reduce the prices of packaged drinking water brand Kinley. It added that since aerated beverages will be attracting the maximum GST rate of 40%, they will be the worst hit segment post GST.

GST won’t increase your grocery bills, not for a few weeks at least

&#xa0;India has been a big market for cosmetic, beauty and personal health care products. According to a study words like 'natural', 'organic', 'botanical', 'free from' some harsh chemical, and even 'religious compliance' helps in the sale of products. 
 According to a survey carried out by research firm <keyword id="365383" type="COMPANY" weightage="20" keywordseo="Euromonitor">Euromonitor</keyword>, says that over half of Indian consumers reported 'natural or organic' features influencing hair and skin care purchase decisions. 
 
71% of the consumers feel that a face cream or lotion will be chosen by them if it claims to be natural, 38% said that they would buy hair products if it had botanical ingredients. Religious aspects will be also be taken into consideration by 17%.&#xa0; 
 "Time-pressed consumers are seeking convenience in beauty and personal care routines and are aware of damaging effects of harsh chemicals. This has spurred demand for natural beauty and personal care products as a safer alternative. In a market like India where herbal and ayurvedic hair and skin care has a legacy of usage (for example, henna, bhringraj or brahmi oil, or herbal face packs), awareness and benefits of herbal or botanical ingredients are high," <keyword id="332696" type="COMPANY" weightage="20" keywordseo="Euromonitor-International">Euromonitor International</keyword> survey analyst <keyword id="3704149" type="UNKNOWN" weightage="20" keywordseo="priyanka-bagde">Priyanka Bagde</keyword> told ET. 
 
It has been confirmed by the executives at online stores and supermarkets that natural products rock the shelves. 
 "Consumers are looking for simplicity. Brands with too much complexity and claims hard to understand need to revisit their consumer proposition," said Devendra Chawla, president-food and FMCG, <keyword id="44949" type="CITY" weightage="20" keywordseo="Future-group">Future Group</keyword>. 
 Looking at the trend, the cosmetic giant L’Oreal has rolled out an ayurvedic shampoo, conditioner and cream under its Garnier Ultra Blends brand, <keyword id="6365619" type="CITY" weightage="20" keywordseo="Hindustan-UniLever">Hindustan Unilever</keyword> relaunched Ayush and acquired hair oil brand Indulekha, while <keyword id="40233" type="COMPANY" weightage="20" keywordseo="emami">Emami</keyword> bought out Kesh King Hair oil. 
 "Millennial consumers are leading the trend - they are increasingly seeking the natural, untouched, un-made-up look from their beauty care products. As they become savvier about 'green' choices, we are seeing a marked shift in preferences in favour of natural products," Praveen Jaipuriar, marketing head-personal care of <keyword id="62997" type="CITY" weightage="20" keywordseo="Dabur">Dabur</keyword>, maker of <keyword id="4710578" type="CITY" weightage="20" keywordseo="Vatika">Vatika</keyword> shampoo and <keyword id="63066" type="ORGANIZATION" weightage="20" keywordseo="Fem">Fem</keyword> bleach told ET. 
 The trend accelerated with <keyword id="6355107" type="PERSON" weightage="20" keywordseo="Baba-Ramdev">Baba Ramdev</keyword>’s <keyword id="6356684" type="UNKNOWN" weightage="20" keywordseo="patanjali">patanjali</keyword> Ayurved about an year ago. Other companies like Dabur and <keyword id="162901" type="COMPANY" weightage="20" keywordseo="Himalya">Himalya</keyword>, traditionally had that natural tag. 
 
Euromonitor's Bagde added: "While herbal and ayurvedic companies like Dabur, Himalaya and Patanjali are promoting their natural and herbal products to encash this demand, other players are either extending their product lines to add natural features or are acquiring well-known ayurvedic brands to stay competitive."

Indians prefer desi products, consider religion also before buying personal care items

<ul><li>Top FMCG companies have cut prices of soap, detergents and hair oils.</li><li>Competition has gone up in the sector after many smaller, regional players making a comeback.</li><li>FMCG players said last quarter that they had to cede some of their market share to smaller players.</li><li>At the time, rise in agri commodity prices is making some of them hike prices of items like coffee and other beverages. </li></ul>After facing the onslaught of smaller and regional players in the last quarter, FMCG majors are on a path to cut prices to boost volumes as well sales. This pricing action is being seen mostly in categories that contribute large volumes and with a high share of unorganized players — like soaps, detergents, hair oils and edible oils. <keyword id="6365619" type="General" weightage="20" keywordseo="hindustan-unilever" source="Orion">Hindustan Unilever</keyword> has taken price cuts to the tune of 9-10% in soaps, <keyword id="6361491" type="General" weightage="20" keywordseo="procter-gamble" source="Orion">Procter &amp; Gamble</keyword> too cut <keyword id="443581" type="General" weightage="20" keywordseo="detergent-prices" source="Orion">detergent prices</keyword> by 11%. <keyword id="4283144" type="General" weightage="20" keywordseo="patajali" source="Orion">Patajali</keyword> slashed its soap as well as hair oil prices, as per a recent report by Kotak Institutional Equities. Top FMCG players said at the end of the April-June quarter that they had to cede some of their market share to smaller players. As per Nomura, their impact on market share on organized players is under control as of now, but needs to be watched closely. A lot of these players have shut up during the pandemic, but have ‘mushroomed’ back. “As the raw material prices have come down and have remained stable, there is increased competition from smaller players. Hence, most FMCG companies have undertaken price cuts to pass on the raw material benefits, and at the same time, they have increased ad spending to protect their market share,” Preeyam Tolia, senior research analyst of FMCG at Axis Securities told Business Insider India. Moreso, the volume growth trend has slowed down for most FMCG players due to slower-than-expected growth in the rural areas. Besides, the trend of downtrading had taken over during the era of high inflation last year, when players had to increase their prices. In Q1, even as volume growth remained tepid, the profitability of FMCG companies was high due to softening of prices of certain raw materials. Palm oil prices were down 2% month-on-month and by 26% year-on-year. Copra/coconut oil prices (updated until July 2023) remained in deflation, down 8% month-on-month and by 11% year on year. “Currently crude and palm oil used to make soaps and inputs such as soda ash used in detergents are showing a downward price trend, that is the reason many soap brands have reduced the prices to increase their volume and are passing on the margin benefits to consumers,” said Sraboni Haralalka, executive director at Wodehouse Capital Advisors. Can price cuts help? Most experts believe that the benefits of these price cuts on volume growth can be seen with a lag, in the second half of the current fiscal year. A few however believe volume growth itself might not be enough for companies that have been banking on pricing-led growth in the last few quarters. “Most other categories did not resort to any pricing action (apart from soaps, detergents, hair-oil, edible-oils), leading to anniversarying of pricing and lesser contribution to overall value growth. We expect no or negligible contribution from pricing in coming quarters; optically lowering overall value growth for the sector,” said Nomura. Added to that, the ability to take a next round of price cuts might also be lowered, experts believe as the prices of crude are inching up again. While crude oil prices were down by 14%, they have jumped 8% on a month-on-month basis – showing that the trend might see a back up. “We must look at the impact of the recent increase in crude oil prices. Any further increase in crude oil price would delay the price cuts and, hence, volume recovery,” says Tolia. Shampoo, coffee &amp; toothpastes get pricier While tea and biscuits prices have remained steady, the prices of coffee have inched up due to hardening agri commodity prices — especially in the case of cereals and milk in the last few months. “Prices remained stable in dairy except for Nestle, which increased the prices of its milk powder and curd by 2% and 5%, respectively. Nestle took another round of around 3-5% of price increases in its baby food portfolio, taking cumulative increases to 6-11% in the past six months,” said Kotak Institutional Equities. Health food drinks witnessed price rises of around 2-8% by Abbott, Danone and Mondelez. “Agri-commodities products have surged up. Food companies such as Nestle and Britannia may either increase product prices or take a hit on their margins and focus on volume growth,” said Haralalka. Products like confectionery, toothpastes and shampoos also saw price hikes from players like Vicco, HUL, Dabur and P&amp;G. Also price rises are seen in face and body washes, deodorants, air fresheners, men’s grooming and feminine hygiene – especially in areas where end consumer purchasing power is high. The margins in personal care products are higher and consumers don’t downgrade as easily as they do in the laundry or hair oil segments. The year of FY24 is expected to be a year of volume growth as FMCG companies are fighting to bring back their ‘small pack’ consumers. At the same time, inflation on the horizon is presenting a very cloudy picture for companies – making them re-think their pricing strategy in a way that ensures volume and margins hold steady.

Soap Opera: FMCG players kick off price war to bring back what’s lost

<ul><li>From crackers to clothes to basic household items, lower middle classes have been spending very little in the last few months. </li><li>Most consumer companies are seeing sales and volume growth in their premium products while volumes in value buys are truncating. </li><li>The current festive season which reported bumper sales also saw little participation from the lower middle classes as per RAI. </li></ul>Mahadev Samarth (name changed), a firecracker seller from Meerut enjoyed a bumper sales season this year. Yet he has a lot of inventory left over in bijli crackers or match crackers – which never got sold. Not because they were too expensive, but because the <keyword id="15526256" type="General" weightage="20" keywordseo="lower-income-households" source="Orion">lower income households</keyword> that buy such crackers could no longer afford them. “Most of my pricey range of rockets and more were sold but at the lower end, there are barely any sales,” he told Business Insider India. The lower middle classes also seem to have held off their festival celebrations and that’s evident in sales of other goods as well, be it clothes or household items. “Retailers were indicating that items at higher price points were witnessing better sales than discretionary items at lower price points in the month of August, which was also a non-occasion month. This may indicate that the <keyword id="2725447" type="General" weightage="20" keywordseo="lower-middle-class" source="Orion">lower middle class</keyword> may have put a temporary pause on shopping due to inflation,” said a report by Retailers Association of India (RAI) at the end of September. The October sales in general have been robust, as <a href="https://www.businessinsider.in/business/news/retail-sales-jump-19-from-pre-pandemic-levels-west-india-leads-recoveryrai-survey/articleshow/95502977.cms">per RAI’s latest report</a>. The lower middle classes have been becoming tight fisted for a long time now, and even the upbeat festival mood has not changed that. In fact, lagging growth in rural areas (where half of India’s lower middle class resides) and its slow recovery is affecting many large companies in their value buy segment. Price cuts are not helping There is another indicator to tell us the spending habits of India’s vast lower middle class – hawai chappals or the humble flip flops. With prices starting from around ₹100, they are the most value-buy purchases in the footwear segment known for their comfort and longevity. The segment has seen a degrowth of 20% in the last six months in terms of value, as per Relaxo Footwear’s Q2 earning commentary. “So in the shoe division, our growth in the last six months is around 30%. So there is a healthy growth coming in the shoe division, which is sports shoes and sports sandals. So that has grown well, but open footwear, which is Hawaii, has degrown,” said Gaurva Dua, executive director of Relaxo, who also said that they are facing pricing pressures in the segment. At the same time, their sports shoes and out-of-home footwear segments performed well – indicating the dichotomy in spending patterns as seen in the case of cracker sales. Marico too says it has seen its business growing at one end and truncating at the other. And, reducing prices is not helping, indicating either heavy reduction in consumption or downtrading to local or unbranded products. Its popular hair oil brand’s Parachute’s volumes reduced 3% and revenue by 11% in the second quarter. Its price reduced by 8% and the company has rolled out further cuts in Q3, says an Axis Capital report. On the other hand, its premium personal care segment posted a strong 40% year on year increase. The heat of inflation The consumption story which had started to show an uptrend post-lockdowns has been exhibiting an uneven growth. This is especially true after consumer price inflation hit an eight-year high of 7.79% in April this year. Ever since it remained above 7% every month, easing only temporarily to 6.7% in July, until it reached <a href="https://www.businessinsider.in/finance/news/retail-inflation-eases-to-6-7-in-october-from-7-4-in-september/articleshow/95512476.cms">similar levels in October</a>. Even as retail inflation eased to a three-month low in October, <keyword id="67286" type="General" weightage="20" keywordseo="food-inflation" source="Orion">food inflation</keyword> remained at around 7%, with essentials like meat, cereal, milk and vegetables eating into the household budgets of the lower middle classes. And this softened consumption story is showing little signs of recovery if the earnings commentary of consumer product and FMCG companies are to be believed. Dabur too has taken a hit in the second quarter, as around 46% of its revenues come from the value segment, targeted to rural markets. This time, however, its urban growth lagged too, for the first time in six quarters. Unlike Marico which believes that its overall volumes will grow at mid-single digits volume growth in the second half of the year, Dabur expects only a marginal growth. “Dabur’s 2Q rural demand (as tepid with 1% y-y growth) and lagged urban (6% y-o-y growth) for the first time in six quarters, with downtrading to smaller packs visible owing to inflationary pressures. Management expects near-term pressure on volumes to continue, but to be marginally better q-q,” said a report by Nomura. The Indian middle class accounts for around 28% of India’s total population – at 1.3 billion. Of this, the lower middle class makes up for around 14%, as <a href="https://www.livemint.com/news/india/the-anatomy-of-india-s-middle-class-1556088919798.html">per a Mint report</a>. Apart from making up a distinct consumption class, this aspirational segment and its growth momentum is key to <a href="https://m.economictimes.com/news/economy/indicators/middle-60-india-can-help-gdp-growth-to-10-study/articleshow/54725412.cms">the nation’s GDP growth</a>. However, they are also the most vulnerable. In times of most crises, be it inflation or economic slowdown, the lower classes are the first to be affected and the last to recover – a factor that’s now taking a toll on companies and retailers who build their business models around them.
