New Delhi, Feb 17 () The mandate for e-commerce platforms to deduct 1 per cent TDS from sellers will add an undue burden on them, which "worsens the regulatory bias" against online platforms, industry body IAMAI said on Monday. The government, in the Budget, announced a new levy of 1 per cent TDS (tax deducted at source) on e-commerce transactions, which is to be collected from the sellers by the e-commerce companies. "Deduction of TDS, over and above TCS deduction under GST, is yet another compliance on digital platforms that are not applicable to their offline counterparts, which worsens the regulatory bias against online platforms," the Internet and Mobile Association of India (IAMAI) said in a statement. Previously, Amazon India and Flipkart had said they were studying the proposal on levy of 1 per cent TDS, and could reach out to the government for clarifications. IAMAI said the present FDI norms only encourage online marketplaces in the B2C (business-to-consumer) sector that are well recognised as digital intermediaries by law. These platforms only facilitate sellers and buyers to interact, and are not actually engaged in the act of buying or selling goods, it noted. "Such platforms are neither the payee nor the recipients of the payment, therefore asking them to collect and deposit taxes is akin to imposing liabilities of inventory based model on digital platforms," IAMAI said, adding that such a levy undermines their intermediary roles. "Furthermore, any form of withholding taxation only creates cash flow irregularities for businesses, and that in turn locks in precious working capital for the small-scale sellers," it said. E-commerce companies are already collecting 1 per cent TCS (tax collected at source) under GST (goods and services tax) from sellers. IAMAI pointed out that reconciliation of TCS has proved to be a major challenge under GST, and imposing TDS for direct taxes risks replicating that challenge. "All such complications raise compliance burden for small sellers and make digital platforms unattractive to conduct business for them. Further, the lack of parity between offline and online sellers could potentially act as an entry barrier for smaller sellers in tier III and IV cities from joining the digital economy," IAMAI said. The association said it is a dichotomy that on one hand, the government recognises e-commerce as a tool for empowerment and is exploring options to promote onboarding of MSMEs, while on the other hand, imposition like TCS and TDS are making it difficult for such MSMEs to conduct their business via online platforms. IAMAI said it has, in its submission to the Finance Ministry, also sought clarity on certain areas in this matter. These include the implication of 'gross amount' or the amount on which TDS is to be deducted, the implication of the term 'deemed payer' as to which agency is actually supposed to deduct the said TDS, clarification on the role and liability of third-party digital payment facilitators, implications for cases involving overseas service providers, among others, it said. IAMAI has suggested that a consultation be held with the industry on this matter, and said the timeline of April 1, 2020 for the implementation of the provision as mandated is "clearly not feasible for e-commerce services to abide by". The industry body said the levy would pose a challenge to small businesses, including small scale sellers, onboarding digital platforms as well as new emerging tech start-ups looking to set up operations in India. "Such impediments do not augur well for the Startup India and Digital India vision that seeks to develop a robust USD 1 trillion digital economy in India by 2025," it said. SR KPM RVKRVK

About 6 crore <keyword id="19948101" type="General" weightage="100" keywordseo="income-tax-returns" source="keywords">income tax returns</keyword> have been filed for income earned in 2023-24, of which 70 per cent were filed under the new <keyword id="22442211" type="General" weightage="20" keywordseo="simplified-tax-regime" source="keywords">simplified tax regime</keyword> which offers lower rate of tax, Revenue Secretary Sanjay Malhotra said on Tuesday. Addressing the post-budget session of PHD Chamber of Commerce and Industry, Malhotra said there were apprehensions as to whether people would shift to the simplified tax regime. "About 6 crore filed for last year and 70 per cent is under the new income tax regime. The whole move has been towards simplicity with the ultimate purpose being to reduce the <keyword id="20380188" type="General" weightage="20" keywordseo="compliance-burden" source="keywords">compliance burden</keyword>," Malhotra said. For the 2022-23 fiscal, 8.61 crore ITRs were filed. The idea behind comprehensive income tax review as announced in the <keyword id="19936553" type="General" weightage="20" keywordseo="budget" source="keywords">Budget</keyword> is to make the tax law simpler. "We will come up with a draft and then we will seek suggestions," Malhotra said. Currently, India has two <keyword id="20155151" type="General" weightage="20" keywordseo="personal-income-tax" source="keywords">personal income tax</keyword> regimes. In the old income tax regime, the <keyword id="20452955" type="General" weightage="20" keywordseo="tax-rates" source="keywords">tax rates</keyword> are relatively high but taxpayers can claim several exemptions and <keyword id="20385232" type="General" weightage="20" keywordseo="deductions" source="keywords">deductions</keyword>. However, in the <keyword id="19935168" type="General" weightage="20" keywordseo="new-tax-regime" source="keywords">new tax regime</keyword>, tax rates are lower but fewer deductions.

New Delhi, Jan 13 () Markets regulator Sebi has deferred by two years to April 2022 its directive for listed companies to split the roles of chairman and managing director in view of demand from corporates and to keep compliance burden lower in the wake of the current economic scenario.
 Under the Sebi norms, the top 500 listed entities by market capitalisation were mandated to comply with the requirement of separation of the roles of chairperson and managing director (MD) or chief executive officer (CEO) with effect from April 1, 2020.
 The norms were aimed at improving corporate governance structure of listed companies.
 Now, the date of implementation of the regulatory provision has been deferred to April 1, 2022, according to a gazette notification dated January 10.
 While the notice did not specify any reason for the move, sources said that the decision to defer the implementation has been taken in view of demand from corporates and also to ease the compliance burden amid a slowing economic growth rate.
 The Securities and Exchange Board of India (Sebi) has been receiving various representations with respect to the regulatory requirements including from industry bodies like FICCI and CII. The representations highlighted the present levels of unpreparedness of listed entities to comply with the directive.
 Data from stock exchanges reveal that presently, only around 50 per cent of the top 500 listed entities are in compliance with the regulatory provision.
 Currently, many companies have merged the two posts as CMD (chairman-cum-managing director), leading to some overlapping of the board and management, which could lead to conflict of interest and consequently the regulator in May 2018 came out with its norms to split the post.
 The norms were part of the series of recommendations given by the Sebi-appointed Kotak committee on corporate governance.

On June 22, <keyword id="19956758" type="General" weightage="20" keywordseo="Finance-Minister" source="keywords">Finance Minister</keyword> Nirmala Sitharaman said that the next meeting of the GST Council will take place in mid to late August. The aim of this meeting will be to discuss the pending issues of the last meeting. The council is expected to discuss rate rationalisation and compliance, among others. The GST Council, consisting of the Union Finance Minister and representatives from all States and Union Territories, was established to make decisions on various aspects of GST, including <keyword id="20452955" type="General" weightage="20" keywordseo="tax-rates" source="keywords">tax rates</keyword>, exemptions, and administrative procedures. It played a crucial role in shaping the GST framework in India. The last meeting of the GST Council was held on 22 June 2024 this year. The GST Council proposes exemptions for specific services offered by Indian Railways to the general public, as well as for intra-railway transactions. In a move to assist small taxpayers, the Council, in its last meeting, extended the deadline for furnishing returns from April 30 to June 30 for the fiscal year 2024-25 and subsequent years. The Council, in its last meeting, recommended the phased rollout of biometric-based Aadhaar authentication for GST registration applicants across India. The Council recommended a uniform GST rate of 12 per cent on all milk cans, regardless of their material (steel, iron, or aluminium), to eliminate disputes. The Finance Minister, during the last GST meeting, reiterated the central government's intent to bring petrol and diesel under the Goods and Services Tax (GST) framework. She highlighted that the groundwork for this inclusion was laid during the initial implementation of GST and emphasized that the decision now lies with the state governments. The central government has long maintained that incorporating petrol and diesel into GST would streamline tax rates and potentially reduce prices for consumers.

54th GST Council meeting to take place on September 9 in New Delhi

New Delhi, Mar 23 () Days after easing compliance norms for listed entities with regard to submission of fourth quarter and annual earnings, markets regulator Sebi on Monday further extended the relaxation to listed entities that have listed their debt securities such as non-convertible debentures and commercial papers. In a circular, Sebi said it has decided to grant relaxation to listed entities that have listed their non-convertible debentures (NCDs), non-convertible redeemable preference shares (NCRPS) and commercial papers (CPs), as well as municipal debt securities, from certain compliance. The regulator has extended the deadline by 45 days till June 30 for submitting half-yearly financial results for NCDs, NCRPS and CPs, while it has given a time period of another 30 days till June 30, for filing annual earnings. The decision has been taken in the wake of the coronavirus pandemic, which has resulted in many restrictions, including free movement of people, thereby hampering businesses and day-to-day functioning of the companies. Finance Minister Nirmala Sitharaman also tweeted about Sebi's move to ease the compliance requirement for listed companies. "In an ongoing exercise to ease the compliance burden during the CoronavirusOutbreak, @SEBI_India has decided to relax some compliance provisions with regard to listed entities that have listed their NCDs, NCRPS, CPs and municipal debt securities," the finance minister said in a tweet. Besides, the regulator has given a relaxation of 60 days till May 31 for companies planing to list their debt securities. Under the norms, issuer has to submit its latest audited financials, which should not be older than six months. However, allowed to file unaudited financial with limited review for the sub period in the current financial year. Further, the regulator has extended the deadline by 60 days and 45 days till June 30 for initial and final disclosures, respectively. With regard to issuer of municipal bonds, Sebi has granted an extension of 30 days till June 30 for filing financial results and 45 days each for submitting half-yearly investor grievance report and quarterly report on accounts maintained by issuer. The circular will come into force with immediate effect. On Thursday, the Securities and Exchange Board of India gave a 45-day relaxation for companies to file their fourth-quarter results as well as an additional one-month time to submit their annual results.
