The <keyword id="2743235" type="ORGANIZATION" weightage="20" keywordseo="United-States-Citizenship-and-Immigration-Services">United States Citizenship and Immigration Services</keyword> (USCIS) has backed that claim reasserting that they plan on getting rid of the provision that allows H-4 visa holders to work in the country. <br /><br />H-4 visa holders are basically dependents of the H-1B visa holders. And, currently, the largest beneficiaries of H-4 visas are Indians. They constitute <a href="https://www.theguardian.com/technology/2016/may/19/silicon-valley-wives-women-visa-immigration-work">80 percent</a> of the 125,000 H-4 visas issued back in 2015. Step back and you can see how such a move would impact women immigrants since <a href="http://nytlive.nytimes.com/womenintheworld/2016/05/20/wives-of-silicon-valleys-immigrant-engineers-speak-of-loneliness-and-frustration/">one out of ten</a> H-4 visas are issued to females.<br /><br />Lee Francis <keyword id="4395926" type="PERSON" weightage="20" keywordseo="cissna">Cissna</keyword>, Director of the USCIS, wrote a letter to <keyword id="331434" type="PERSON" weightage="20" keywordseo="Charles-E-Grassley">Charles E Grassley</keyword>, Chairman of the <keyword id="220224" type="ORGANIZATION" weightage="20" keywordseo="Judiciary-Committee">Judiciary Committee</keyword>, stating, “..our plans include proposing regulatory changes to remove H-4 dependent spouses from the class of aliens eligible for employment authorisation, thereby reversing the 2015 final rule that granted such eligibility.”<br /><br />This decision would force the H-4 visa holders back into, what were <a href="http://thesouthasiantimes.info/index.php?param=news/19356/USA/34">called</a>, their ‘Golden Cages’. It was a metaphor for being able to live in the US but without the right to work within the country or get a social security number. <br /><br />The situation was corrected two years ago, when the <keyword id="16284" type="PERSON" weightage="20" keywordseo="Obama">Obama</keyword> administration passed a ruling that gave H-4 visa holders the provision to seek employment while they waited for their green card to be approved. <br /><br />Reports <a href="https://qz.com/1260345/h-4-visa-the-trump-administration-reiterates-itll-scrap-work-permits-for-h-1b-spouses/">suggest</a> that visa trouble won’t stop with H-1B and H-4 visas but also spill over onto the L-1B visa, which is issued to professionals with specialised knowledge. USCIS’ Cissna assures that the only reason any of this is happening is ”...to prevent US workers from being displaced by foreign workers.”

He should own the policy that he is pushing, that he's the architect of."</p><p>Trump has pitched <a href="https://www.businessinsider.com/us-mexico-border-closed-what-could-happen-2019-4">some new, extreme measures</a> to address what he sees as an emergency on the border, including the idea of closing the border entirely. He backed off of that suggestion last week amid protests inside his administration and beyond.</p><h2>Laying the blame</h2><p>Some White House officials have pushed back against notion that Miller was the driving force behind Nielsen's ouster. And one unnamed adviser <a href="https://twitter.com/Acosta/status/1115406831843778560">cited by CNN's chief White House correspondent Jim Acosta</a> on Monday said Trump's action on the border of late "is his failing and his alone ... this is not a Kirstjen Nielsen or Jeff Sessions issue. This is a lack of understanding issue," the source reportedly told Acosta.</p><p>As for the latest shuffle in the Trump administration, Secret Service director <a href="https://www.businessinsider.com/trump-secret-service-chief-randolph-alles-dumbo-ears-2019-4">Randolph Alles</a> is also scheduled to resign, and there are rumblings that more shakeups are coming, <a href="https://twitter.com/jaketapper/status/1115243352214126593">according to CNN anchor Jake Tapper</a>: "Trump administration officials also say WH adviser Stephen Miller wants the president to get rid of the Director of United States Citizenship and Immigration Services Lee Cissna and DHS general counsel John Mitnick," Tapper wrote Monday.</p><p>Now some high-ranking Republicans are concerned.</p><p>"One, those are good public servants," Republican Sen. Chuck Grassley of Iowa said in a Washington Post <a href="https://www.washingtonpost.com/politics/grassley-warns-white-house-not-to-oust-any-more-top-immigration-officials/2019/04/08/0b896e26-5a55-11e9-b8e3-b03311fbbbfe_story.html?utm_term=.431746941968">report</a>, referring to Cissna. Stephen Miller 'should own the policy': Democratic lawmaker suggests nominating Trump adviser Stephen Miller to lead Homeland Security

<p><div class="KonaFilter image-container display-table"><div><div class="image on-image"><p class="source"><span>Reuters</span></p><p class="caption">Homeland Security chief on Thursday questioned whether Russia interfered in the US presidential election to help President Donald Trump win, contradicting the assessment of the US intelligence community.</p></div><p></p></div></div></p><ul><li><strong>Sixty CEOs have sent a letter to Homeland Security Secretary Kirstjen Nielsen denouncing policy changes they say are harming their companies' immigrant workers.</strong></li><li><strong>The executives named several recent changes that make it more challenging for highly skilled foreign workers to renew or apply for visas, or obtain green cards.</strong></li><li><strong>The letter said that ultimately these changes will make life more difficult for their immigrant employees, and likely force them to take their talents elsewhere.</strong></li></ul><p>Dozens of prominent CEOs have sent a <a href="https://www.businessroundtable.org/sites/default/files/letters/Immigration.Nielsen%20Letter%2008232018.pdf?te=1&amp;nl=dealbook&amp;emc=edit_dk_20180824" target="_blank" rel="noopener">letter</a> to Homeland Security Secretary Kirstjen Nielsen denouncing several recent changes to immigration policies that they say have stoked fear among their employees and could ultimately harm US businesses.</p><p>The letter named 60 executives - including Apple's Tim Cook, JPMorgan Chase's Jamie Dimon, Salesforce's Marc Benioff, PepsiCo's Indra Nooyi, BlackRock's Larry Fink, and IBM's Ginni Rometty - and warned the Trump administration that its policies will prompt highly skilled immigrants to take their talents elsewhere.</p><p>"As the federal government undertakes its legitimate review of immigration rules, it must avoid making changes that disrupt the lives of thousands of law-abiding and skilled employees, and that inflict substantial harm on US competitiveness," the letter read.</p><p>Over the last year and a half, the US Citizenship and Immigration Services, or USCIS, agency has implemented a host of changes to the country's legal immigration system that, in many cases, make it more difficult to apply for or renew work visas, or obtain a green card.</p><p>The CEOs pointed to several key changes they said were negatively affecting thousands of employees:</p><ul><li>Inconsistency from immigration officers in <a href="https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2017/2017-10-23Rescission-of-Deference-PM6020151.pdf" target="_blank" rel="noopener">vetting visa applications</a> from workers who have had previous visas approved. "Now, any adjudicator can disagree with multiple prior approvals without explanation," the CEOs wrote.</li><li>Allowing immigration officers to <a href="https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/AFM_10_Standards_for_RFEs_and_NOIDs_FINAL2.pdf" target="_blank" rel="noopener">immediately deny visa applications</a> without first notifying the companies and applicants and without asking for potentially missing information to be submitted. "Companies now do not know whether a work visa petition that was approved last month will be approved when the company submits the identical application to extend the employee's status," the letter said.</li><li>The looming <a href="https://www.judiciary.senate.gov/imo/media/doc/2018-04-04%20USCIS%20to%20CEG%20-%20Buy%20America%2C%20Hire%20America%20update.pdf" target="_blank" rel="noopener">elimination of H-4 visas</a>, which are currently used by the spouses of skilled immigrant workers. "These spouses are often highly skilled in their own rights and have built careers and lives around their ability to contribute to companies here," the letter said.</li><li><a href="https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2018/2018-06-28-PM-602-0050.1-Guidance-for-Referral-of-Cases-and-Issuance-of-NTA.pdf" target="_blank" rel="noopener">Deporting immigrants</a> whose visa renewal or green card applications are denied while they're living in the US. USCIS Director Lee Francis Cissna stoked controversy in February when he dropped the term "nation of immigrants" from the agency's mission statement.</p><p>"Who does the agency serve? I think there's been a misunderstanding of that one the years," <a href="https://www.washingtonexaminer.com/uscis-says-trump-was-not-the-reason-it-dropped-nation-of-immigrants-from-mission-statement" target="_blank" rel="noopener">Cissna said last week</a>. "People kind of naturally fall into the belief that the individuals that we serve are the people that we interact with every day when we take applications or petitions. I don't think that we serve them. Rather, all three have reputations as hawks, and largely shared Trump's agenda and acted aggressively in their various roles within the immigration system.</p><p>That means Trump's border problem goes beyond personnel, Alex Nowrasteh, a senior policy analyst at the libertarian Cato Institute, told INSIDER.</p><p>"The law is the biggest obstacle to Trump implementing many of his favorite policies on the border," Nowrasteh. He's even been vocal about issues like <a href="https://www.washingtonpost.com/immigration/kevin-mcaleenan-is-taking-over-dhs-will-he-be-tough-enough-for-trump/2019/04/08/50d7ae22-59a9-11e9-b8e3-b03311fbbbfe_story.html" target="_blank" rel="noopener">providing aid to Central America</a> as a way to decrease the number of people <a href="https://www.thisisinsider.com/why-migrant-families-crossing-us-mexico-border-in-record-numbers-2019-3" target="_blank" rel="noopener">fleeing the impoverished countries</a>. Trump has vowed to cut such aid.</p><p>But he - or whomever Trump nominates as the next DHS chief - may encounter the same failure Nielsen did if Trump continues to demand policies that violate the law.</p><p>"[McAleenan] is a deeply serious man, he's a man who thinks about policies and impact and numbers and statistics and things of that sort," Aaron Reichlin-Melnick, a policy analyst at the American Immigration Council, told INSIDER. "Whether he is going to be the same as Nielsen remains to be seen, but from all appearances, the next secretary is going to have to deal with a lot of pressure from the White House to make changes."</p><p>The Trump administration can't re-implement large-scale family separations without violating a federal court order, and it can't block migrants from entering the country to seek asylum without running afoul of US law.</p><p>But one of the remaining options to deter migrants is an idea called <a href="https://www.businessinsider.com/trump-officials-consider-binary-choice-child-separation-policy-wapo-2019-4" target="_blank" rel="noopener">"binary choice," which would present migrant parents with an option at the border</a>: be detained indefinitely while their asylum cases are processed, or be separated so that the child doesn't have to stay in custody while the parent is detained.</p><p><div class="KonaFilter image-container display-table"><div><div class="image on-image"><p class="source"><span>Getty Images</span></p><p class="caption">Undocumented migrants wait for asylum hearings outside of the port of entry in Tijuana, Mexico on Monday, June 18, 2018.</p></div><p></p></div></div></p><p><em><strong>Read more</strong>: <a href="https://www.businessinsider.com/trump-mocks-asylum-seekers-calls-system-scam-2019-4" data-analytics-position="5">Trump mocks asylum-seekers at the border, says they 'look like they should be fighting for the UFC'</a></em></p><p>According to <a href="https://www.washingtonpost.com/immigration/trump-removes-secret-service-director-as-purge-of-dhs-leadership-widens/2019/04/08/8bde9912-5a36-11e9-842d-7d3ed7eb3957_story.html?utm_term=.934df4f61b15" target="_blank" rel="noopener">The Washington Post</a>, DHS officials are mulling the option as a way to meet Trump's demand to get "tough" on immigration and end what he has disdainfully referred to as "catch and release," the practice of releasing migrants into the US while their cases go through the court system, potentially allowing them to vanish.</p><p>"I think it's fair to say that binary choice has never gone off the table," Reichlin-Melnick said. "Binary choice has been on the table ever since family separation ended."</p><p>But the true test of the next Homeland Security secretary may not be the toughness of their policies, but the strength of the legal challenges against them, according to Karla McKanders, a law professor and Immigration Practice Clinic director at Vanderbilt University.</p><p>"I do remain apprehensive about the president firing Nielsen, especially with the legacy that she's leaving behind - of child separation, locking children in cages, children being held in tent cities," McKanders told INSIDER. "I think the question a lot of people have is, 'Can it get worse from here?' And how much litigation will need to be filed to block any further policies that undermine the basic rule of law?"</p><p>That doesn't necessarily mean that the status quo at the border will remain intact. But the Trump administration is notorious for enacting more subtle, under-the-radar measures to deter migrants or slow them down, McKanders said.</p><h2>'The judge, jury, and executioner'</h2><p><div class="KonaFilter image-container display-table"><div><div class="image on-image"><p class="source"><span>Associated Press/Gregory Bull</span></p><p class="caption">In this Thursday, July 26, 2018 photo people line up to cross into the United States to begin the process of applying for asylum near the San Ysidro port of entry in Tijuana, Mexico.</p></div><p></p></div></div></p><p>For instance, McKanders recalled witnessing migrants lining up at US ports of entry last December and taking numbers, after Border Patrol agents told them there wasn't enough space to process them all. McKanders said she met a woman who was told to wait two months before they'd let her enter.</p><p>The practice is called "<a href="https://www.nytimes.com/2019/04/08/us/politics/trump-asylum-seekers-federal-judge.html" target="_blank" rel="noopener">metering</a>," but unlike major policies such as "<a href="https://www.thisisinsider.com/category/zero-tolerance" target="_blank" rel="noopener">zero tolerance</a>," metering was done much more subtly - at select ports of entry rather than all of them, and it was never formally rolled out.</p><p>"I've been practicing [immigration law] since about 2006, and I was really surprised to see the informal policies that were in place," McKanders said. "There are informal systems that are at work and unwritten policies that are also having a significant impact on immigration."</p><p>Matthew Kolken, an immigration lawyer in Buffalo, New York, told INSIDER he often works with clients who experience even more underhanded attempts by the Trump administration to deprive migrants of their rights. He said some of their immigration trials have been done via televideo conferencing, while some have been overseen by immigration judges who have just an hour and a half to hear their cases.</p><p><div class="KonaFilter image-container display-table"><div><div class="image on-image"><p class="source"><span>Associated Press/Eric Risberg</span></p><p class="caption">Hundreds of people overflow onto the sidewalk in a line snaking around the block outside a U.S. immigration office with numerous courtrooms Thursday, Jan. 31, 2019, in San Francisco.</p></div><p></p></div></div></p><p>Kolken said he expected that "things will absolutely change" under new leadership at DHS.</p><p>"My concern is that we are about to see a further erosion of due process protections, and that CBP will be empowered to be the judge, jury, and executioner," he said.</p><p>It's not an impossible scenario - Trump reportedly told Border Patrol agents last week to block migrants from entering, despite what federal judges say.</p><p>"If judges give you trouble, say, 'Sorry, judge, I can't do it. We don't have the room,'" Trump said, <a href="https://www.cnn.com/2019/04/08/politics/trump-family-separation-el-paso-kirstjen-nielsen/index.html" target="_blank" rel="noopener">according to two anonymous sources who talked to CNN</a>.</p><p>But not all immigration lawyers are pessimistic. Greg Siskind, an immigration lawyer in Memphis, Tennessee, said he expects that DHS staff would likely disobey such an order, out of fear of being held in contempt or facing personal liability.</p><p>"I'm guessing there will be internal resistance from the career employees who are not going to simply follow any order," he told INSIDER. Chuck Grassley, one of the most powerful members of the Senate, are in a bit of a tiff at the moment.</p><p>Grassley has quite publicly gone against Trump several times over the past two weeks, increasingly putting himself at odds with the president. </p><p>Last week, Grassley referred to Trump as "idiotic" after the president suggested that wind turbines cause cancer.</p><p>Subsequently, Grassley said he <a href="https://www.businessinsider.com/chuck-grassley-defies-trump-supports-release-of-mueller-report-2019-4">supported releasing special counsel Robert Mueller's report</a> on Russian election interference. Trump initially said he was OK with the report being released, but more recently said those calling for it to be made public are a "disgrace." </p><p><em><strong>Read more:</strong><a href="https://www.businessinsider.com/grassley-trump-wind-turbines-cause-cancer-idiotic-2019-4"><span> </span>Top Republican senator says Trump's suggestion that wind turbines cause cancer is 'idiotic'</a></em></p><p>The latest disagreement stems from the <a href="https://www.businessinsider.com/kirstjen-nielsen-departure-signals-trump-wants-more-extreme-dhs-chief-2019-4">ousting of Homeland Security chief Kirstjen Nielsen</a> and the broader shakeup of the agency she's departing. Grassley spoke out against the churn within the Trump administration and took jabs at one of his senior advisers - Stephen Miller.</p><p><span>Grassley <a href="https://www.washingtonpost.com/politics/grassley-warns-white-house-not-to-oust-any-more-top-immigration-officials/2019/04/08/0b896e26-5a55-11e9-b8e3-b03311fbbbfe_story.html?utm_term=.87c512ddfc20#click=https://t.co/5a4oldKND7">told The Washington Post</a> that those who've been removed from Homeland Security, as well as those who are reportedly on the verge of being asked to leave, are "good public servants." </span></p><p><span>"Secondly, besides the personal connection I have with them and the qualifications they have, they are the intellectual basis for what the president wants to accomplish in immigration," the senator added. </span></p><p><span>Grassley said he was "very, very concerned," in particular, over reports that Lee Francis Cissna, the director of US Citizenship and Immigration Services, will be part of Trump's purge of the agency. </span></p><p><em><strong>Read more:</strong> <a href="https://www.businessinsider.com/netanyahu-asked-trump-iran-military-force-terrorist-group-2019-4">Israeli Prime Minister Benjamin Netanyahu said he asked Trump to label Iran's elite military force a terrorist group</a></em></p><p><span>"The president has to have some stability and particularly with the number one issue that he's made for his campaign, throughout his two and a half years of presidency," Grassley said. "He's pulling the rug out from the very people that are trying to help him accomplish his goal."</span></p><p><span>Speaking on Miller, the senator added, "I think it would be hard for him to demonstrate he's accomplished anything for the president."</span></p><p><span>Grassley was asked by The Post to expand on his comments about Miller, to which he responded, "It's pretty hard to elaborate on it when there hasn't been any accomplishments." </span></p><p><span>Miller has <a href="https://www.theatlantic.com/politics/archive/2018/06/stephen-miller-family-separation/563132/">been the architect</a> of the more extreme aspects of Trump's immigration agenda and was reportedly <a href="https://www.businessinsider.com/who-is-stephen-miller-trump-speechwriter-immigration-adviser-2018-1">central to decision making behind Nielsen's ousting</a>. </span></p><p><span>When asked about Grassley's concerns with the departures, a spokesperson said that the senator raised the issue with the members of the White House.</span></p><p><span>"Sen. Grassley hasn't spoken to the president directly on this issue but has expressed his concerns to White House staff," Michael Zona, Grassley's communications director, told INSIDER.</span></p><p><span>The White House did not immediately respond to a request for comment from INSIDER.</span></p><p>The Iowa senator is the president pro Tempore of the Senate, which makes him the second <span>highest-ranking official in the chamber and third in line to succeed to the presidency after the vice president and House Speaker.</span></p><p><span>Grassley has been in the Senate since 1981 and wields significant influence in Washington and in the GOP, which makes his public rebukes of a Republican president notable. </span></p><p><span>Trump's approach to governing has often put him at odds with members of his own party, and top Republicans have spoken out against him on everything from <a href="https://www.businessinsider.com/khashoggi-death-trumps-approach-to-the-case-alienates-him-from-gop-2018-10">US policy toward Saudi Arabia</a> to his decision to declare a national emergency to obtain funding for a border wall.</span></p><p><em><strong>Read more:</strong> <a href="https://www.businessinsider.com/stephen-miller-immigration-hardliner-is-the-descendent-of-refugees-2018-6">Stephen Miller, the Trump aide behind the harshest immigration policies, is a descendant of asylum-seekers</a></em></p><p><span>Grassley initially <a href="https://www.businessinsider.com/government-shutdown-republican-lawmakers-worried-trump-national-emergency-border-wall-2019-1">spoke out in opposition of Trump's national emergency</a> and warned of the precedent it would set, but ultimately voted against a resolution to block the emergency declaration.
