New H-1B visa rules make it more expensive and harder to hire workers from India — but they may not hold ground

However, a majority of organizations are reviewing retirement or long-term benefits and looking for new ways to package them. In fact, 25% of the organizations are planning to include variable pay in the wage definition. But, a similar percentage of them are also unsure about what to do, reveals a new WTW report on ‘State of Retirement benefits in India’. Variable pay is also known as performance pay and is given to an employee based on the results of their performance. It is usually offered in addition to the employee's fixed salary on completion of certain targets. One out of three organizations in India are also likely to increase the basic pay as a part of the new wage code. The four <keyword id="9986984" type="General" weightage="20" keywordseo="New-labour-codes" source="Orion">new labour codes</keyword> approved by the President of India are — Code on <keyword id="6356975" type="General" weightage="100" keywordseo="wages" source="Orion">Wages</keyword>, 2019, the Industrial Relations Code, 2020, the Code on Social Security, 2020 and the Occupational Safety, Health and Working Conditions Code, 2020. These four codes will replace the existing 29 labour laws in India. Code on Wages will ensure timely payment of salaries and wages both in organized and unorganized sectors. Industrial Relations Code expands the definition of worker to be included under — skilled, unskilled, manual, technical, clerical and operational workers. Code on Social Security is about social security schemes like EPF, EPS, ESI — which are beneficial to the employees and workers. <cmsannotation type="cmsannotation" annotationid="Gratuity pay would rise" comment="subhead" text="Gratuity pay would rise">Gratuity pay would rise</cmsannotation> According to the report, 40% of organizations are expecting the code to have a significant impact on their profits; and are considering options to update their gratuity policy to mitigate the impact. While 28% say that they will not change their gratuity policy and are not expecting any change in their P&amp;L. Gratuity benefits are projected to have the largest impact in the new definition of wages. It is paid to employees who exit their companies after working for over five years. In the new code, the gratuity is expected to increase significantly, particularly for organizations where the basic pay to gross pay ratio has been quite low previously. <cmsannotation type="cmsannotation" annotationid="No change in PF contributions" comment="subhead" text="No change in PF contributions">No change in PF contributions</cmsannotation> The report further suggests that over 46% of the organizations would continue to contribute 12% of basic salary as per prevailing regulation in the provident fund. During COVID-19 pandemic, a lot of companies had provided extra sick leaves to their employees as the infection required proper isolation and rest. This has led three out 10 organizations to restructure their leave policies, the report says. The number of candidates being turned away due to drug tests was "a big enough number that it hurts," he said, without giving more detail.The rules on vetting truckers were changed in 2020. Under the new driver Drug &amp; Alcohol Clearinghouse system for recording drug and alcohol violations, 72,000 drivers were prohibited from work as of September, <a href="https://clearinghouse.fmcsa.dot.gov/Learn#news-events">per government data</a>. All employers and truckers must update their records annually and all employers must consult the database before they approve a new driver. Menstruation is not a type of illness that requires leave, but it is the time when women go through biological changes and need rest. While some have bearable symptoms, for others the effects are severe and a few companies allow their female employees to work from home; or access paid/unpaid leaves. Only a handful of countries allow menstrual leaves A small group of countries like India, Japan, Taiwan, Indonesia, South Korea and Zambia provide menstrual leaves. In India, there is no legal right for women to get menstrual leaves but Bihar provides two days of government-approved leave during periods. In South Korea, a law ensures that women employees get additional pay if they do not take leave during menstruation. In Indonesia, women have the right to take two days of menstrual leaves per month - which are not counted as additional leaves. In Taiwan, women are allowed to take three days of ‘menstrual leave’ per year - which are not counted as sick leaves. Japanese Labour Standards Law states, "When a woman for whom work during menstrual periods would be especially difficult has requested leave, the employer shall not employ such woman on days of the menstrual period." In Zambia, women are legally entitled to take a day off every month. Spain could become the first European country to offer three day menstrual leave

As many as ten central trade unions are going ahead with the one-day nationwide strike to protest against changes in labour laws even as BJP-backed BMS and <keyword id="224774" type="ORGANIZATION" weightage="80" keywordseo="National-Front">National Front</keyword> of Indian Trade Unions have pulled out. Essential services are expected to be hit, as a result. 
 
These ten unions claim a combined membership of 15 crore workers in public as well as private sector enterprises including banks and insurance companies and they have decided to go ahead with the strike after their talks with a group of senior ministers earlier this month failed to yield desired results. 
 
Union leaders said the strike will affect the functioning of essential services like transport and supply of power, gas and oil, even as Bharatiya Mazdoor Sangh (BMS) claimed that power, oil and gas supplies will not be affected as a large number of public sector workers in these areas would not participate in the industrial action. 
 
As many as 12 central trade unions had given this strike call over a 12-points charter of demands, including withdrawal of the proposed anti-worker amendments in labour laws and stopping the disinvestment and privatisation of PSUs. 
 
BMS later pulled out saying the government needed to be given time to fulfil its promises on the basic demands. The National Front of Indian Trade Unions will also stay out. Speaking on behalf of other unions, <keyword id="679206" type="UNKNOWN" weightage="80" keywordseo="All-India-Trade-Union">All India Trade Union</keyword> Secretary D L Sachdev said that all ten central trade unions recognised by government will go on strike tomorrow. 
 
He claimed that "many state units of BMS will also join the strike". 
 
Earlier in the day, BMS General Secretary Virjesh Upadhyay told reporters that "a large number of public sector undertakings who are members of central trade unions are not going on strike tomorrow. 
 
"Thus, the services like power, oil and gas supply will not be affected. Big PSUs like NTPCBSE -0.95 %, NHPCBSE -2.42 % and PowerGrid will not observe strike tomorrow. Therefore, the power supply will not be affected". 
 
Upadhyay said the National Front of Indian Trade Unions has also decided not to go on strike and wants to give some time to government, at least till the Winter Session of the Parliament, for fulfilling its assurances like uniform minimum wages across the board and enhancing wage ceiling for bonus.

Ten trade unions to go on strike tomorrow protesting against changes in labour laws

The US State Department in a federal notification Wednesday proposed to make changes to its existing visa regulations under which <keyword id="738953" type="PERSON" weightage="20" keywordseo="Foreign-professionals">foreign professionals</keyword>, which would fall under H-1B, would not be issued temporary visa for business, as has been widely prevalent currently. If finalized, this proposal will eliminate any misconception that the "B-1 in lieu of H policy" provides an alternative avenue for foreign professionals to enter the US to perform <keyword id="438013" type="PERSON" weightage="20" keywordseo="skilled-labour">skilled labour</keyword> that allows, and potentially even encourages them and their employers to circumvent the restrictions and requirements relating to the H nonimmigrant classification established by the Congress to protect US workers, the State Department said. The move is likely to impact a lot of Indian companies who send their technology professionals on B-1 visas for a short stay to complete the jobs on site in the US. On December 17, 2019, the California Attorney General announced a $800,000 settlement against <keyword id="6354512" type="COMPANY" weightage="20" keywordseo="Infosys">Infosys</keyword> Limited to resolve allegations that approximately 500 Infosys employees worked in California on Infosys-sponsored B-1 visas rather than H-1B visas, the State Department said. "The proposed changes and the resulting transparency would reduce the impact of foreign labour on the US workforce of aliens performing activities in a specialty occupation without the procedural protections attendant to the H-1B classification," it said. In its federal notification issued on Wednesday, the State Department said US architecture firm seeking protection from rising labour costs in the country might believe it could lay off its US architects and contract for the same professional architectural services to be provided by a foreign architecture firm. If the foreign firm sought H-1B visas for its architects, it would be required to pay the prevailing wage for architects in the area of intended employment in the United States, presumably the same wage the US architects had been paid, and meet the other requirements enacted by the Congress to protect US workers. But under the B-1 in lieu of H policy, the foreign architects could ostensibly seek B-1 visas and travel to the US to fill a temporary need for architecture services, so long as they retained a residence in the foreign country and continued to receive a salary, perhaps significantly lower than what is customary for US architects, dispersed abroad by the foreign firm (or under the auspices of a foreign parent or subsidiary), the State Department said. Under the Department's guidance, visas could be issued for multiple architects planning temporary work in the United States, in certain situations. However, a foreign employer may succeed in undermining US immigration law and policy by rotating architects between the US and the foreign country to effectively fill the position of one US architect at a significantly lower cost, the notification said. "If the architects who intended to perform skilled labour were "of distinguished merit and ability... seeking to perform (temporary architectural services) of an exceptional nature requiring such merit and ability, one might argue the current regulatory language suggests this type of labour is a permissible basis for B-1 nonimmigrant visa issuance," the State Department said. This potential outcome is harmful to US workers and contrary to policies of the Trump Administration, it said. The State Department said the application process for a B-1 visa does not include similar procedural requirements to protect US workers like that of H-1B visas. Also, the fees for the B-1 visas are far less than that of H-1B visas. While the Congress required H-1B employers to pay significant fees to fund assistance to the US workforce as well as prevention and detection of fraud related to skilled labour, employers are not required to pay comparable fees to employ skilled workers under the B-1 in lieu of H policy, it said. According to the notification, the State Department estimates that this proposal will affect no more than 6,000 to 8,000 foreign workers per year, specifically aliens intending to provide services in a specialty occupation in the US. As per its estimate, up to 28 per cent of the approximately 8,000 annual B-1 visa issuances under the B-1 in lieu of H policy were to foreign workers who applied for a visa to perform services in a specialty occupation for a small entity in the US. US wants to scrap temporary business visas for H-1B speciality occupations

Gun homicides were almost eliminated. </li></ul>On the icy morning of March 13 1996, an embittered man walked into a Scottish elementary school with four handguns and 743 rounds of ammunition.He shot dead 16 children and one teacher, and finally himself. The event — known as the Dunblane Massacre, for the small town where it took place — put the UK in a state of shock. It is a story that will be tragically familiar to the parents of the 19 children and two adults killed at <a href="https://www.insider.com/children-injured-dead-uvalde-texas-elementary-school-shooting-2022-5">Robb Elementary School in Uvalde, Texas</a>, on Tuesday. <div type="image" title="A black-and-white school class portrait of the elementary school pupils and teacher that were attacked in the Dunblane Massacre in 1996." height="1000" width="2000" msid="91816210" hostid="261"></div>But after Dunblane, some bereaved parents helped set in motion a change in the law that made private handguns virtually impossible to obtain in most of the UK. Horror, absolute outrage, a universal outrage," was how <keyword id="12008836" type="UNKNOWN" weightage="60" keywordseo="gun-control" source="Orion">gun control</keyword> campaigner Gill Marshall-Andrews characterized the public mood following the shooting. Marshall-Andrews had long tried to energize a campaign on gun controls. But she never got much traction. It took the horror of Dunblane for her work to get significant attention, and she joined three other advocates — including <a href="https://www.theguardian.com/commentisfree/2022/may/26/british-laws-dunblane-gun-control-texas-school-massacre">bereaved Dunblane father Mick North</a> — to set up the Gun Control Network, which along with <a href="https://edm.parliament.uk/early-day-motion/12238/snowdrop-petition">an influential petition</a> became one of the driving forces against the UK's gun lobby. <div type="image" title="children return to Dunblane Primary School, nine days after a gunman killed 16 children, their teacher and himself in Dunblane, Scotland" height="1476" width="2000" msid="91816211" hostid="261"></div>Eight days after the shooting, the then-ruling Conservative Party tasked senior judge Lord Cullen with <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/276631/3386.pdf">a major public inquiry</a> in which Cullen recommended stricter limitations, but not an outright ban on handguns.A tightening of the law followed, outlawing high-caliber guns such as those used at Dunblane, but still allowing some handguns to be used at shooting ranges and clubs. But public sentiment for a full handgun ban was growing. "Everywhere we turned people wanted to help us," Marshall-Andrews said. Their campaign has no money, she said. But the — notoriously fickle — British press rallied around the issue, she said. Leading advertising agency Saatchi and Saatchi <a href="https://www.adeevee.com/1998/05/gun-control-network-ban-outdoor/">worked with the group on an influential poster campaign</a>. <h2>The gun lobby strikes back</h2>The UK's gun culture has never been nearly as pervasive, or as politically powerful, as that in the US. The UK has no written constitution, and a simple majority of lawmakers is enough to change more or less any law.But, <a href="https://www.theguardian.com/commentisfree/2022/may/26/british-laws-dunblane-gun-control-texas-school-massacre">as Mick North wrote for The Guardian</a>, a homegrown powerful gun lobby mounted resistance. Marshall-Andrews said: "We were told by the shooting fraternity that there was no way we were going to get a ban on handguns because pistol shooting was the fastest-growing sport in the country at the time," she said. The Gun Control Network began to get death threats, she said, and even hoax bombs sent to their mailing address.
