The body of the on-duty trainee doctor was found in the seminar room of the state-run hospital on August 9, triggering nationwide outrage. The CBI is investigating the case from the second week of August on an order of the high court. The petitioner prayed in the PIL that the CBI be directed to investigate the <keyword id="22008077" type="General" weightage="20" keywordseo="cyber-offences" source="keywords">cyber offences</keyword> in connection with the "unfortunate and brutal incident." The court asked the Additional Solicitor General Asok Kumar Chakrabarti, representing the central agency, whether it could find a way to block these types of posts. The division bench, presided by Chief Justice T S Sivagnanam, directed the joint director, CBI, Kolkata, to look into the grievance expressed by the petitioner with regard to the issue of such abominable <keyword id="20074678" type="General" weightage="20" keywordseo="social-media-posts" source="keywords">social media posts</keyword>. The bench, also comprising Justice Hiranmay Bhattacharyya, directed the CBI joint director or any other competent officer to file a report in this regard by September 18, when the PIL will come up for hearing again along with other petitions relating to the August 9 rape-murder of the doctor. After the order was dictated, Chakrabarti submitted before the court that the CBI does not have any separate wing to investigate such cyber crimes. Maintaining that the state police has a special unit to monitor such matters, he prayed that the <keyword id="20054502" type="General" weightage="20" keywordseo="West-Bengal-government" source="keywords" meta.keywordsubtype="org" meta.entityname="West Bengal government" meta.hostid="153" meta.entityid="West Bengal government">West Bengal government</keyword>'s cyber crime branch be also directed to file a separate report. The court said that it would consider the prayer on the next date of hearing.

Calcutta High Court seeks CBI report on nasty social media posts on RG Kar hospital rape-murder victim

Mumbai, A special court here on Tuesday rejected a plea moved by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="cbi" source="keywords">CBI</keyword>) seeking a stay on the broadcast of a documentary series on <keyword id="20552870" type="General" weightage="20" keywordseo="indrani-mukerjea" source="keywords">Indrani Mukerjea</keyword>, a prime accused in the Sheena <keyword id="20659410" type="General" weightage="20" keywordseo="bora" source="keywords">Bora</keyword> murder case. CBI special judge S P Naik-Nimbalkar said the court does not have the "inherent power" to stop the broadcast, and asked the probe agency to approach an appropriate forum if advised. The judge held that the prosecution had not brought to his notice any legal provision for such directions. The docu-series, titled 'The <keyword id="20112549" type="General" weightage="20" keywordseo="indrani" source="keywords">Indrani</keyword> Mukerjea Story: The Buried Truth', delves into the disappearance of 25-year-old Bora and is scheduled to premiere on streaming platform Netflix on February 23. In its application filed through public prosecutor C J Nandode, the CBI had asked the court "to issue direction to accused and others concerned for staying/stopping the featuring of the accused persons and the persons connected with the case in the documentary by Netflix and its broadcasting on any platform till the conclusion of the ongoing trial". Bora was allegedly strangled to death in a car by Indrani, her then driver Shyamvar <keyword id="19931853" type="General" weightage="20" keywordseo="rai" source="keywords">Rai</keyword> and former husband Sanjeev Khanna in April 2012. Bora was Indrani's daughter from her previous relationship. Her body was burnt in a forest in the neighbouring Raigad district. The murder came to light in 2015, after Rai revealed about the killing following his arrest in another case. Indrani was arrested in August 2015, and granted bail in May 2022. The other accused in the case, Rai, Khanna and Peter Mukerjea, are also out on bail.

The CBI court also rejected applications of Chanda Kochhar and her husband Deepak Kochhar for home food, beds, mattresses and chairs. The court directed jail authorities to provide them diet food in consultation with the medical officer. The Kochhars were arrested by the CBI on December 23, while <keyword id="18489" type="General" weightage="70" keywordseo="dhoot" source="Orion">Dhoot</keyword> was arrested three days later. All three are currently in judicial custody. Dhoot had challenged his arrest claiming it was illegal and sought immediate release from the case. His lawyer S S Ladda, along with advocate Viral Babar, argued that Dhoot was arrested only because the investigating officer came under pressure after the Kochhar couple's arrest. During the first remand hearing of the Kochhars their lawyer questioned why Dhoot had not been arrested yet, the <keyword id="6379256" type="General" weightage="50" keywordseo="videocon-group" source="Orion">Videocon group</keyword> founder's lawyer pointed out. The Kochhars were afraid that Dhoot might become an approver, advocate Ladda said. The Kocchars' lawyer made sure it was recorded in the remand order that Dhoot had not been arrested, which put pressure on the investigating officer leading to Dhoot's arrest, he claimed. Special Judge M R Purwar, however, didn't find merit in the arguments and rejected Dhoot's plea. The CBI had named Chanda Kochhar, Deepak Kochhar as well as Venugopal Dhoot along with Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy, Videocon International Electronics Ltd and <keyword id="744747" type="General" weightage="50" keywordseo="videocon-industries-limited" source="Orion">Videocon Industries Limited</keyword> as accused in the FIR registered in 2019 under Indian Penal Code sections related to criminal conspiracy and provisions of the <keyword id="6364753" type="General" weightage="50" keywordseo="prevention-of-corruption-act" source="Orion">Prevention of Corruption Act</keyword>. The CBI alleged that ICICI Bank sanctioned credit facilities to the tune of Rs 3,250 crore to the companies of Videocon Group in violation of the Banking Regulation Act, RBI guidelines and the credit policy of the bank. It further alleged that as a part of quid pro quo, Dhoot made an investment of Rs 64 crore in Nupower Renewables through Supreme Energy Pvt Ltd (SEPL), and transferred SEPL to Pinnacle Energy Trust managed by Deepak Kochhar through a circuitous route between 2010 and 2012. ICICI fraud: Special court rejects Dhoot's plea against arrest, Kochhars' demand for home food, bed

The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday issued a slew of directions for speedy disposal of criminal cases against Members of Parliament and Members of Legislative Assembly (MPs/MLAs) and asked High Courts to register a Suo Motu case for effective monitoring and speedy disposal of such cases. A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra said it was difficult for it to form a uniform guideline for trial courts across the country relating to speedy disposal of <keyword id="16453350" type="General" weightage="40" keywordseo="cases-against-mps" source="Orion">cases against MPs</keyword> and MLAs. The top court left it to the high courts to evolve such measures for effective monitoring of such cases. The bench directed that High Court Chief Justices shall register a suo motu case titled "In Re Designated Courts for MPs and MLAs" to monitor the early disposal of pending criminal cases against lawmakers. It directed that the suo motu case be heard by a special bench headed by the Chief Justice or a bench assigned by him or her. It was further directed that the Special Bench of the High Court may list the matter at regular intervals as felt necessary. The top court said the High Court may issue such orders and directions as necessary for expeditious and effective disposal of the cases. The bench further ordered that the Special Bench of the High Court may consider taking the assistance of the Advocate General or prosecutor to assist it. The apex court also directed that cases against MPs and MLAs that are punishable by death should be prioritised over other cases. Then cases punishable with imprisonment for five years or more will be given priority. It further said that the cases would not be adjourned by the trial court except for rare and compelling reasons. The top court said that the High Court may require a Principal District and Sessions judge to bear the responsibility of allocating the subject cases to such courts. The High Court may call upon the Principal District and Sessions judge to send reports on such intervals, it added. The concerned principal and session judge should ensure sufficient infrastructural facilities are available for the trial of such cases, as directed by the top court. The directions of the top court came on a PIL filed by advocate Ashwini Upadhyay seeking speedy disposal of criminal cases pending against MPs and MLAs. Earlier, the Enforcement Directorate (ED) filed a status report stating that there are 51 MPs and 71 MLAs, sitting and former, who stand accused by the agency of offence under the Prevention of Money Laundering Act (PMLA). The report did not specify exactly how many of those are sitting MPs or MLAs and how many are former MPs or MLAs. The Central Bureau of Investigation (CBI) had also submitted a similar report stating that a total of 121 cases are pending trial against sitting and former MPs and MLAs. The number of MPs involved in those cases is 51, out of which 14 are sitting, 37 are former and 5 are deceased. The report further stated that 112 MLAs are involved in CBI cases, out of which 34 are sitting, 78 are former and 9 are deceased. The number of cases pending investigation against MPs and MLAs by the CBI is 37, according to the report the CBI submitted. Senior advocate Vijay Hansari, who was assisting the apex court in the case as amicus curiae, had highlighted a "glaring case of inordinate delay" in the trial of cases against lawmakers, submitting that many cases were pending for over five years. The apex court had sought a status report from Hansaria relating to the pendency and grant of sanctions for prosecution, the expected time for completion of the investigation and reasons for delay in the same. Hansaria had sought directions to ensure that courts dealing with cases against lawmakers should exclusively try such issues. The plea sought speedy disposal of cases against them and pointed out that while judges and babus were suspended for such activities, politicians were condoned by the law. As of now, convicted politicians have been banned from the polls for six years.

Actor <keyword id="1623055" type="General" weightage="50" keywordseo="sooraj-pancholi" source="Orion">Sooraj Pancholi</keyword>, who is facing charges of abetting the suicide of actress Jiah Khan, reached CBI Court along with his mother on Friday morning. Jiah Khan was found dead in her suburban home on June 3, 2013. Sooraj <keyword id="968" type="General" weightage="80" keywordseo="pancholi" source="Orion">Pancholi</keyword> is accused of abetting the suicide of Jiah Khan based on a letter seized on June 10, which the 25-year-old actor purportedly wrote, Mumbai Police booked Pancholi under section 306 (abetment to suicide) and arrested him. Sooraj, son of actors <keyword id="966" type="General" weightage="50" keywordseo="aditya-pancholi" source="Orion">Aditya Pancholi</keyword> and Zarina Wahab, was allegedly in a relationship with Jiah. Here is a timeline of Jiah Khan's suicide case: on June 3, 2013, Jiah Khan's body was found in flat number 102 of Sagar Sangeet Society in Mumbai On June 7, 2013, Mumbai police recovered a six-page suicide note from Jiah's house. On June 10, 2013, Sooraj Pancholi was arrested by the Juhu police after allegations of abetting Jiha for suicide. On July 2, 2013, the Bombay High Court granted bail to Suraj Pancholi and he got released after spending 22 days in jail. In October 2013, Jiha's mother, Rabia Khan, moved to the Bombay High Court demanding a CBI probe. In July 2014, the case was handed over to the CBI. In December 2015, the CBI submitted a report before the court and termed the case as an abetment to suicide. A few days later, Rabia demanded for an SIT to probe the matter. In February 2017, the High Court rejected the demand for the formation of the SIT. The trial court also rejected Rabia's demand for further investigation in 2018. On 15 March 2019, the trial began in the Jiah Khan case. In the year 2021, the case was reassigned to the Special CBI Court because the sessions court said that the jurisdiction of the CBI case is not with the sessions court. On March 21, 2023, the government side closed its case with the statement of 21 witnesses. On April 20, 2023, both sides presented their final arguments after which the court fixed 28 April to announce the verdict.
