The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday issued a slew of directions for speedy disposal of criminal cases against Members of Parliament and Members of Legislative Assembly (MPs/MLAs) and asked High Courts to register a Suo Motu case for effective monitoring and speedy disposal of such cases. A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra said it was difficult for it to form a uniform guideline for trial courts across the country relating to speedy disposal of <keyword id="16453350" type="General" weightage="40" keywordseo="cases-against-mps" source="Orion">cases against MPs</keyword> and MLAs. The top court left it to the high courts to evolve such measures for effective monitoring of such cases. The bench directed that High Court Chief Justices shall register a suo motu case titled "In Re Designated Courts for MPs and MLAs" to monitor the early disposal of pending criminal cases against lawmakers. It directed that the suo motu case be heard by a special bench headed by the Chief Justice or a bench assigned by him or her. It was further directed that the Special Bench of the High Court may list the matter at regular intervals as felt necessary. The top court said the High Court may issue such orders and directions as necessary for expeditious and effective disposal of the cases. The bench further ordered that the Special Bench of the High Court may consider taking the assistance of the Advocate General or prosecutor to assist it. The apex court also directed that cases against MPs and MLAs that are punishable by death should be prioritised over other cases. Then cases punishable with imprisonment for five years or more will be given priority. It further said that the cases would not be adjourned by the trial court except for rare and compelling reasons. The top court said that the High Court may require a Principal District and Sessions judge to bear the responsibility of allocating the subject cases to such courts. The High Court may call upon the Principal District and Sessions judge to send reports on such intervals, it added. The concerned principal and session judge should ensure sufficient infrastructural facilities are available for the trial of such cases, as directed by the top court. The directions of the top court came on a PIL filed by advocate Ashwini Upadhyay seeking speedy disposal of criminal cases pending against MPs and MLAs. Earlier, the Enforcement Directorate (ED) filed a status report stating that there are 51 MPs and 71 MLAs, sitting and former, who stand accused by the agency of offence under the Prevention of Money Laundering Act (PMLA). The report did not specify exactly how many of those are sitting MPs or MLAs and how many are former MPs or MLAs. The Central Bureau of Investigation (CBI) had also submitted a similar report stating that a total of 121 cases are pending trial against sitting and former MPs and MLAs. The number of MPs involved in those cases is 51, out of which 14 are sitting, 37 are former and 5 are deceased. The report further stated that 112 MLAs are involved in CBI cases, out of which 34 are sitting, 78 are former and 9 are deceased. The number of cases pending investigation against MPs and MLAs by the CBI is 37, according to the report the CBI submitted. Senior advocate Vijay Hansari, who was assisting the apex court in the case as amicus curiae, had highlighted a "glaring case of inordinate delay" in the trial of cases against lawmakers, submitting that many cases were pending for over five years. The apex court had sought a status report from Hansaria relating to the pendency and grant of sanctions for prosecution, the expected time for completion of the investigation and reasons for delay in the same. Hansaria had sought directions to ensure that courts dealing with cases against lawmakers should exclusively try such issues. The plea sought speedy disposal of cases against them and pointed out that while judges and babus were suspended for such activities, politicians were condoned by the law. As of now, convicted politicians have been banned from the polls for six years.

SC issues directions to HCs for speedy disposal of criminal cases against MPs, MLAs

New Delhi, Three-fourth of the new Delhi MLAs are millionaires, one-third have not studied beyond senior secondary and more than half have criminal cases against them, according to the Association of Democratic Reforms (ADR). According to ADR, 45 Aam <keyword id="1488996" type="COMPANY" weightage="20" keywordseo="Aadmi-Party">Aadmi Party</keyword> (AAP) legislators of the 62, and seven of the eight <keyword id="58687" type="ORGANIZATION" weightage="20" keywordseo="Bharatiya-Janata-Party">Bharatiya Janata Party</keyword> (BJP) MLAs had declared more than Rs 1 crore assets while filing their nomination papers. There were 44 millionaire MLAs in 2015. The average of assets per MLA in the new Delhi Assembly is Rs 14.29 crore, which is more than double the average of Rs 6.29 crore in 2015. Of the AAP legislators, the average assets per MLA is Rs 14.96 crore and in case of the BJP it's Rs 9.10 crore. The richest AAP legislators as per their election affidavit are Dharampal Lakra (Mundka), followed by Promila Tokas (R.K. Puram) and <keyword id="8770122" type="PERSON" weightage="20" keywordseo="raaj-kumar-anand">Raaj Kumar Anand</keyword> (Patel Nagar). <keyword id="1955618" type="PERSON" weightage="20" keywordseo="Rakhi-Birla">Rakhi Birla</keyword> (Mangolpuri) is the poorest AAP legislator with Rs 76,000 assets, followed by Sanjeev Jha (Burari) at Rs 10 lakh and Som Dutt (Sadar Bazar) at Rs 11 lakh. There has been a sharp jump in the number of MLAs with registered criminal cases. In 2020, 43 MLAs declared criminal cases against them while in 2015, 24 MLAs had criminal cases. The number of MLAs with serious criminal cases, which included rape, attempt to murder and crimes against women, is 37. In terms of education, 23 MLAs are between 8th pass and 12th pass, 42 graduates and above, and five diploma holders. While 39 MLAs are aged between 25 years and 50 years, 31 are in the 51-80 years age group. Of the 70 MLAs, eight are women against six in 2015. The <keyword id="1077342" type="COMPANY" weightage="20" keywordseo="Delhi-election">Delhi Election</keyword> Watch and the ADR analysed the affidavits of all 70 newly elected MLAs.

The results of the analysis were hardly surprising - 77 (35%) of the 221 newly-elected MLAs have declared criminal cases against themselves. Of these, 54 MLAs have declared serious criminal cases against them, which could include anything from murder to kidnapping. While 34% of the previous assembly (2013) had a criminal background the percentage was significantly lower in 2008 at 24%. The elections in the southwestern Indian state of Karnataka this week has been fraught with high drama. The results of 222/224 seats were as follows - the BJP won 104 seats, the <keyword id="190679" type="ORGANIZATION" weightage="20" keywordseo="Indian-National-Congress">Indian National Congress</keyword> bagged 78 seats and the <keyword id="123462" type="ORGANIZATION" weightage="20" keywordseo="Janata-Dal">Janata Dal</keyword> (Secular) won 37 seats. According to the ADR analysis, 42 of the 104 MLAs from the Bharatiya Janata Party (BJP) have criminal backgrounds, while 23 of the 78 MLAs from the <keyword id="1571" type="ORGANIZATION" weightage="20" keywordseo="Congress-party">Congress party</keyword> and 11 out of 37 Janata Dal (Secular) MLAs declared criminal cases against them in their affidavits. Other shocking but not-so-shocking revelations from this report include: Assets <ul><li>215 out of 221 MLAs declared assets of over Rs 1 crore. </li><li>15 MLAs from the three leading parties declared assets of more than Rs 100 crore.</li><li><keyword id="28100" type="ORGANIZATION" weightage="20" keywordseo="MLA">MLA</keyword> N. Nagaraju declared the highest assets of over Rs 1,015 crore whereas D.K Shivakumar (Rs 640 crore) came in second and Suresh B.S. (Rs 460 crore) third - all three belong to the Congress Party.</li><li>SA Ramadas from Krishnaraja constituency in Mysuru is the poorest MLA with assets to the tune of just ₹39 lakh. </li></ul>Gender <ul><li>There are only seven women among the 222 newly elected MLAs.</li></ul>Education <ul><li>61% declared that they are graduates or above, 36% declared themselves as Class V-XII pass</li><li>One MLA has declared he is ‘literate’ while “one did not give his educational qualification in his affidavit."</li></ul>Age <ul><li>135 MLAs are between 41 and 60 years old</li><li>64 are between 61 and 60 years old</li><li>15 MLAs are between 25 and 40 years old </li><li>Three are above 80 years old.</li></ul>

35% of newly elected members of parliament in this Indian southern state just declared a fairly criminal past

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> has been informed that cases pending against sitting and former MP/MLAs increased from 4,110 in December 2018 to 4,984 in December 2021. A report submitted by amicus curiae, senior advocate Vijay Hansaria said: "Some of these cases were pending for more than three decades. 2,324 cases were against sitting legislators, and 1,675 cases were against former legislators. In 1,991 cases, even charges were not framed. 264 cases were pending due to stay granted by the High Courts." The amicus filed the report in a case connected with the expeditious trial of MPs and MLAs. According to the report, which provided state-wise data on cases, Uttar Pradesh topped the list with 1,339 cases pending for final disposal as on December 1, 2021, whereas in December 2018, 992 cases were pending, and in October 2020, 1,374 cases were pending. Therefore, data reveals that only few cases were disposed of between October 2020 and December 1, 2021. As on December 4, 2018, UP disposed of 435 cases -- 364 by sessions court and 71 by magistrates. In Bihar, in December 2018, there were 304 cases pending, which rose to 557 in October 2020, and then 571 in December 2021. Out of 571 cases, 341 cases are pending before magistrate courts and 68 cases before sessions judges. The report, which was submitted in the top court on Thursday, added: "It is submitted that despite a series of directions by this Hon'ble Court and continuous monitoring, as many as 4,984 cases are pending out of which 1,899 cases are more than 5 years old. It may be noted that the total number of cases pending as on December 2018 were 4,110, and as on October 2020 were 4,859. Even after disposal of 2,775 cases after December 4, 2018, the cases against MPs/MLAs have increased from 4,122 to 4,984." In 2018, the apex court issued the directive to set up special courts to expedite trials of cases against MPs and MLAs and since then, it has issued many directions, including asking the Centre to set up a monitoring committee to examine reasons for delay of investigation in cases. Citing the volume of cases against the lawmakers, the report said: "This shows that more and more persons with criminal antecedents are occupying the seats in the Parliament and the State Legislative Assemblies. It is of utmost necessity that urgent and stringent steps are taken for expeditious disposal of pending criminal cases." The report added that the Centre hasn't provided any suggestions after the court's order in August last year regarding the setting up of a monitoring committee to evaluate the reasons for delay in investigation. The matter also came up before the Supreme Court but did not pass any order since the matter was already pending before the <keyword id="49015" type="ORGANIZATION" weightage="20" keywordseo="Rajasthan-High-Court">Rajasthan High Court</keyword>. The petitioner in the court contended that the Assembly elections were held in Rajasthan on December 7, 2018 in which the six MLAs were elected on tickets issued by the BSP. The six MLAs -- Sandeep Yadav, Wajib Ali, Deepchand Kheria, Lakhan Meena, Jogendra Awana and Rajendra Gudha -- later defected to the Congress in September 2019. After the truce with Sachin Pilot, the Congress government is safe in numbers as the party has more than the required majority. At <keyword id="9428604" type="COMPANY" weightage="20" keywordseo="the-congress-legislative-party">the Congress Legislative Party</keyword> (CLP) meeting, the two camps shook hands in the presence of the party observers. The two leaders Ashok Gehlot and Sachin Pilot met before the CLP meeting in Gehlot's house. At the meeting, Gehlot gave a call to forget the past, saying, "'Apne tau apne hote hain'. We could have proved majority on the floor of the House even without these 19 MLAs, but then there would have been no happiness around." Gehlot further said, "We will move the confidence motion ourselves. We shall also resolve the grievances of our MLAs who are annoyed with us." <ul><li>The Supreme court in <keyword id="3658" type="LOCATION" weightage="20" keywordseo="India">India</keyword> has issued directives to political parties and candidates to give ‘wide publicity’ to any and all ongoing criminal allegations against them. </li><li>The court has also asked the parliament to bring in laws that allows for the removal of political leaders that are accused of committing ‘heinous and grievous’ crimes. </li><li>Earlier this year the central government had informed the supreme court that there were currently 3,045 pending cases against MPs and MLAs.</li></ul>India is in a precarious political situation where more than <a href="https://timesofindia.indiatimes.com/india/36-of-mps-mlas-facing-trial-in-3045-criminal-cases/articleshow/63261553.cms">one-third</a> of its members of parliament (MPs) and members of the legislative assembly (MLAs) are currently facing trial, according to the <keyword id="2954047" type="PERSON" weightage="20" keywordseo="NN-Vohra-Committee">NN Vohra Committee</keyword>. The <a href="https://www.thehindu.com/news/national/cant-bar-politicians-with-criminal-charges-from-contesting-elections-parliament-should-frame-laws-sc/article25035435.ece">supreme court has instructed</a> candidates and political parties to disclose any and all pending criminal cases pending against them to the Election Commission (EC) at the time of nomination. And, the five-judge constitution bench of the supreme court held that political parties are obligated to publish the information about their respective websites so that voters can make an informed decision when they’re choose the candidate to vote for. That being said, the supreme court also added that only candidates who have been convicted will be disqualified from participating in the elections, not ones who have only been accused. Ironically. But for those who have been accused of ‘heinous and grievous’ crimes, the supreme court has urged the parliament to form laws that would enable the removal of such political leaders. Leaving no stone unturned To ensure that political parties and candidates can’t exploit any loophole of the directive, the supreme court has specifically detailed that the submissions to the EC have to be in ‘block letters’. And, in addition to making the information available online, the supreme court has also said that the political party has to give ‘wide publicity’ to these facts through declarations in the newspapers as well as over electronic media. After nomination papers have been filed, candidates have to publicise their respective criminal records on television, not once, but thrice. Criminalisation of politics at entry-level The study <a href="https://economictimes.indiatimes.com/news/politics-and-nation/criminalisation-of-politics-felt-in-strongest-form-in-1993-mumbai-serial-blasts-supreme-court/articleshow/65949574.cms">conducted</a> by NN Vohra committee found that India’s intelligence agencies such as RAW, CBI and IB unanimously agreed that there was a criminal network running parallel to the government of India. And, with the EC having limited powers, there’s nothing it can do about candidates entering the political race when they’ve only been accused of a crime, but are yet to be convicted. On average, in the 10 years following 2004, the <keyword id="6368295" type="ORGANIZATION" weightage="20" keywordseo="law-commission">Law Commission</keyword> of India <a href="https://www.deccanherald.com/national/1-every-14-lawmaker-had-694524.html">reported</a> that 18% of the candidates in state and national elections have had pending criminal cases against them. Even back in 1990, the Goswami Committee on Electoral Reforms pointed out how money and muscle power were crippling the Indian electoral system. Ahead of the 2019 general elections, this may require parties to switch up their strategies since 1,765 MPs and MLAs of 4,896 are currently facing a criminal trial or the other. There are over 3,045 pending cases of crimes against women according to the an analysis done by the central government in collaboration with the Association for Democratic Reforms (ADR).

Supreme court pushes for strong laws to decriminalise politics in India

"All district magistrates will ensure that toll plazas under their jurisdiction will provide a separate lane to MPs and MLAs in the event of traffic jams," the letter said, also saying that authorities of the <keyword id="87432" type="ORGANIZATION" weightage="20" keywordseo="National-Highways-Authority-of-India">National Highways Authority of India</keyword> (<keyword id="49448" type="ORGANIZATION" weightage="20" keywordseo="nhai">NHAI</keyword>) are expected to cooperate in the matter. An additional district magistrate said on condition of anonymity told TOI, "Legislators and parliamentarians hardly move without four to five vehicles when they go to Lucknow or Delhi, if they travel on national and state highways where the toll plazas are erected. Though they are already exempted from paying toll tax, when plaza employees ask the unofficial vehicles accompanying them to pay up, these 'honourable' MLAs or MPs and their followers turn rude, sometimes violent. In such cases, the law and order situation is also affected."

Maharashtra political twist BJP won 102 seats in the recent assembly elections but need a partner to reach the magic number of 145, to form the government. While Sena had won 56 seats, NCP won 54 seats and Congress won 44 seats. As Sena and BJP disagreed on seat sharing, endless discussions and delays led to a President’s rule in the state. Ajit Pawar had decided not to U-turn yet again as widely expected. Siding with the BJP and Modi, he tweeted on Sunday that the BJP and NCP alliance will stay. This confused the already dazed voters of Maharashtra, who were under the assumption that Pawar had broken away from his mother party, led by his uncle Sharad Pawar. To clear the air, Sharad Pawar tweeted that Ajit Pawar’s message was misleading and that they still with the Sena.  Ajit Pawar decided to step away from his personal residence — where he had a flurry of NCP, BJP and Congress party leaders visit him all day — late in the night. The current chief minister Fadnavis too held a long discussion with deputy CM Ajit Pawar over bringing in the much needed 145 MLAs to form the government. In a dramatic turn of events, Fadnavis and Ajit Pawar were sworn in as chief minister and deputy chief minister respectively by Governor Bhagat Singh Koshyari at 8 am on Saturday at a hush-hush ceremony in Raj Bhavan here, leading to the lifting of the President's rule in the state.

Supreme Court reserves order on Maharashtra government formation till tomorrow

The decision was taken in a BJP legislature party meeting held here on Thursday. After the meeting, Kataria told reporters that the motion of no confidence will be moved in the assembly session beginning Friday. He said the proposal was being finalised. "Coronavirus cases are on the rise and the law and order situation is badly deteriorating. Attempts were made to link those, who were arrested by the SOG (Special Operations Group) over allegations of conspiring to topple the government, with BJP but the government failed in this. We will mention all these issues in the proposal," Kataria said. He said even though the political crisis in the Congress has been resolved, all is still not good in that party as "one is going to east and the other to west". He said the BJP and its ally Rashtriya Loktantrik Party (RLP) have a total of 75 MLAs and of them, 74 were present in Thursday's legislature party meeting held at the BJP's office. He said union agriculture minister <keyword id="268357" type="PERSON" weightage="20" keywordseo="Narendra-Tomar">Narendra Tomar</keyword> was also present in the meeting and talked about agriculture-related issues. Poonia aleged that the Ashok Gehlot-led state government is a "government of contradictions". BJP MLA Madan Dilawar, who has challenged in the high court the merger of six <keyword id="6356515" type="COMPANY" weightage="20" keywordseo="bahujan-samaj-party">Bahujan Samaj Party</keyword> (BSP) MLAs with Congress, said the Rajasthan government has gone into a "state of coma" and therefore the opposition party has to move the no-confidence motion. "This government is unstable and the works of people are not being done. We already had our preparations for the motion but it was finalised today in the meeting after taking the MLAs in confidence," he said. Dilawar also said all 75 BJP and RLP MLAs will support the motion. BJP national vice president and former chief minister <keyword id="6361795" type="PERSON" weightage="20" keywordseo="Vasundhara-Raje">Vasundhara Raje</keyword>, national vice president and state in charge <keyword id="5336554" type="PERSON" weightage="20" keywordseo="Avinash-Khanna">Avinash Khanna</keyword> and other senior leaders were present in the meeting. The opposition party's decision comes days after an "amicable resolution" of the nearly month-long political cisis in Rajasthan. Congress leader Sachin Pilot had openly rebelled against chief minister Gehlot last month along with 18 other party MLAs. He was then sacked as deputy chief minister and the party's Rajasthan chief. The Congress on Monday had said the crisis in Rajasthan was a "closed chapter" and all legislators supporting its government will work towards strengthening the state government and fighting COVID-19 and economic calamities. Rajasthan BJP to move no-confidence motion against Ashok Gehlot led-Congress government

The CM H D Kumaraswamy has been exhaustively delaying the process, hanging on to power. BJP President Siddaramaiah had earlier said that the trust vote probably won’t be held today. The assembly has resumed after it was adjourned till 3 pm, with no progress on the much awaited trust vote. Kumaraswamy said today that he will move to the Supreme Court against the vote. Governor Vala had earlier directed the Speaker to hold the trust vote by 1:30 pm today. Also, the Congress state President was seen heading to the Supreme Court, possibly delaying it further. Kumaraswamy said, “It (trust vote) is crucial and cannot be completed by 1:30 pm. This needs to be discussed.” The opposition, BJP, has been alleging that the ruling party is delaying it, as it does not have the requisite majority. They had also staged an overnight protest by ‘sleeping’ in the Assembly. Governor is interfering: Cong JD(S) spokesman Ramesh Babu said that the CM’s counsel will move the Supreme Court today for a stay on the Governor's Thursday’s order asking him to prove majority by the deadline. “The Governor is interfering in the workings of the Legislative Assembly, which is the domain of the Speaker under the provisions of the Constitution,” Babu said. Congress-JD(S) alliance is to petition on the basis that CM Kumaraswamy had moved the confidence motion in the house on Thursday and the debate had started and so setting a deadline should be stayed by the court. In the meanwhile, one of the Congress MLAs Shreemant Patil is admitted in a hospital in Mumbai, after he complained of chest pains. Yesterday, Congress alleged that BJP has kidnapped them. Delayed Trust The trust vote which was supposed to happen yesterday, was relentlessly delayed by the ruling Congress-JD(S) coalition which might be facing an end of its run. Kumaraswamy will have to prove that his government has majority to carry on, as MLAs have been leaving his fold. BJP party members had staged an overnight dharna or protest over the delay of trust vote. Accusations, speeches and allegations between both Congress and BJP managed to delay the vote, yesterday. Finally, the state’s Governor wrote a letter to CM Kumaraswamy regarding the trust vote after senior BJP MLAs met him at the Raj Bhawan. The case of a kidnapped legislator Yesterday, the Speaker had refused to conduct the trust vote amid allegations by the Congress against the BJP for kidnapping its MLA Shreemant Patil, who had decided to take his resignation back. Speaker Ramesh Kumar had asked home minister MB Patil to give a detailed report of Shreemant after talking to his family. The Speaker said that he had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. The house was disrupted throughout the day on the issue of trust vote and when it was finally adjourned till today, BJP announced a night long strike in the assembly itself till the voting was not done. “We are demanding voting on the motion but the chief minister is reluctant to take it up as he has confirmed himself that he has lost confidence of the House and the people. Everybody knows Congress-JD(S) coalition has only 98 MLAs, we have 105,” said B S Yeddyurappa, BJP party president. Crisis mode The Karnataka state government went into a crisis mode earlier this month, after 16 of its MLAs from both the parties of the coalition government resigned. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs, Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, a few days back.
