The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday issued a slew of directions for speedy disposal of criminal cases against Members of Parliament and Members of Legislative Assembly (MPs/MLAs) and asked High Courts to register a Suo Motu case for effective monitoring and speedy disposal of such cases. A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra said it was difficult for it to form a uniform guideline for trial courts across the country relating to speedy disposal of <keyword id="16453350" type="General" weightage="40" keywordseo="cases-against-mps" source="Orion">cases against MPs</keyword> and MLAs. The top court left it to the high courts to evolve such measures for effective monitoring of such cases. The bench directed that High Court Chief Justices shall register a suo motu case titled "In Re Designated Courts for MPs and MLAs" to monitor the early disposal of pending criminal cases against lawmakers. It directed that the suo motu case be heard by a special bench headed by the Chief Justice or a bench assigned by him or her. It was further directed that the Special Bench of the High Court may list the matter at regular intervals as felt necessary. The top court said the High Court may issue such orders and directions as necessary for expeditious and effective disposal of the cases. The bench further ordered that the Special Bench of the High Court may consider taking the assistance of the Advocate General or prosecutor to assist it. The apex court also directed that cases against MPs and MLAs that are punishable by death should be prioritised over other cases. Then cases punishable with imprisonment for five years or more will be given priority. It further said that the cases would not be adjourned by the trial court except for rare and compelling reasons. The top court said that the High Court may require a Principal District and Sessions judge to bear the responsibility of allocating the subject cases to such courts. The High Court may call upon the Principal District and Sessions judge to send reports on such intervals, it added. The concerned principal and session judge should ensure sufficient infrastructural facilities are available for the trial of such cases, as directed by the top court. The directions of the top court came on a PIL filed by advocate Ashwini Upadhyay seeking speedy disposal of criminal cases pending against MPs and MLAs. Earlier, the Enforcement Directorate (ED) filed a status report stating that there are 51 MPs and 71 MLAs, sitting and former, who stand accused by the agency of offence under the Prevention of Money Laundering Act (PMLA). The report did not specify exactly how many of those are sitting MPs or MLAs and how many are former MPs or MLAs. The Central Bureau of Investigation (CBI) had also submitted a similar report stating that a total of 121 cases are pending trial against sitting and former MPs and MLAs. The number of MPs involved in those cases is 51, out of which 14 are sitting, 37 are former and 5 are deceased. The report further stated that 112 MLAs are involved in CBI cases, out of which 34 are sitting, 78 are former and 9 are deceased. The number of cases pending investigation against MPs and MLAs by the CBI is 37, according to the report the CBI submitted. Senior advocate Vijay Hansari, who was assisting the apex court in the case as amicus curiae, had highlighted a "glaring case of inordinate delay" in the trial of cases against lawmakers, submitting that many cases were pending for over five years. The apex court had sought a status report from Hansaria relating to the pendency and grant of sanctions for prosecution, the expected time for completion of the investigation and reasons for delay in the same. Hansaria had sought directions to ensure that courts dealing with cases against lawmakers should exclusively try such issues. The plea sought speedy disposal of cases against them and pointed out that while judges and babus were suspended for such activities, politicians were condoned by the law. As of now, convicted politicians have been banned from the polls for six years.

SC issues directions to HCs for speedy disposal of criminal cases against MPs, MLAs

MPs and MLAs taking bribes to vote or make a speech in the <keyword id="19910021" type="General" weightage="20" keywordseo="house" source="keywords">House</keyword> are not immune from prosecution, the Supreme Court said on Monday in a landmark, unanimous verdict that overrules its 1998 judgment protecting such lawmakers. Observing that bribery is not protected by parliamentary privileges, a seven-judge constitution bench headed by Chief Justice D Y <keyword id="19985698" type="General" weightage="20" keywordseo="chandrachud" source="keywords">Chandrachud</keyword> held that a five-judge bench's interpretation in the 1998 verdict in the JMM bribery case was contrary to Articles 105 and 194 of the Constitution. Describing the judgment as "great", Prime Minister <keyword id="19895781" type="General" weightage="20" keywordseo="narendra-modi" source="keywords">Narendra Modi</keyword> said in a post on X that it would "ensure clean politics and deepen people's faith in the system". Articles 105 and 194 deal with the powers and privileges of MPs and MLAs in the Parliament and the legislative assemblies. "Corruption and bribery by members of the legislatures erode probity in public life," the CJI, who read the operative part of the verdict, said while pronouncing the verdict today. The bench also comprised Justices A S Bopanna, M M Sundresh, P S Narasimha, J B Pardiwala, <keyword id="19931190" type="General" weightage="20" keywordseo="sanjay-kumar" source="keywords">Sanjay Kumar</keyword> and Manoj Misra. In 1998, the five-judge constitution bench held in its majority verdict on the Narasimha Rao versus CBI case that parliamentarians have immunity against criminal prosecution for any speech made and vote cast inside the House under Articles 105(2) and 194(2). The seven-judge bench was reconsidering the 1998 judgement. While pronouncing the verdict, the CJI said Article 105 of the Constitution seeks to sustain an environment to have deliberations by the lawmakers in the House and this atmosphere is vitiated when a member is bribed to deliver a speech. Justice Chandrachud said the privileges claimed must have a nexus to the collective functioning of the House and must have a relationship with the essential functions of a legislator which he or she has to discharge. The seven-judge bench had reserved its judgement in the matter on October 5 last year. During the arguments, the Centre had submitted that bribery can never be a subject matter of immunity and a parliamentary privilege is not meant to place a lawmaker above law. The top court, in the course of the hearing, had said it will examine whether the immunity granted to lawmakers from prosecution for taking bribes to make a speech or vote in Parliament and state legislatures extends to them even if criminality is attached to their actions. On September 20, 2023, the <keyword id="19936355" type="General" weightage="20" keywordseo="apex-court" source="keywords">apex court</keyword> had agreed to reconsider its 1998 judgement, saying it was an important issue having a significant bearing on "morality of polity". The issue came under the apex court's lens in 2019, when a bench headed by then Chief Justice Ranjan Gogoi was hearing an appeal filed by <keyword id="20405400" type="General" weightage="20" keywordseo="sita-soren" source="keywords">Sita Soren</keyword>, JMM MLA from Jama and daughter-in-law of party chief Shibu <keyword id="19968807" type="General" weightage="20" keywordseo="soren" source="keywords">Soren</keyword>. She was an accused in the JMM bribery scandal. The Gogoi-led bench had referred to a five-judge bench the matter, noting it had "wide ramification" and was of "substantial public importance". Sita Soren was accused of taking bribes to vote for a particular candidate in the Rajya Sabha election in 2012. She contended that the constitutional provision granting lawmakers immunity from prosecution, which saw her father-in-law being let off the hook in the JMM bribery scandal, be applied to her. She moved the apex court against the Jharkhand High Court order of February 17, 2014 refusing to quash the criminal case lodged against her. The three-judge bench had then said it will revisit the apex court verdict in the JMM bribery case involving Shibu Soren, a former Jharkhand chief minister and ex-union minister, and four other party MPs who had accepted bribes to vote against the no-confidence motion threatening the survival of the P V Narasimha Rao government in 1993. The Narasimha Rao government, which was in a minority, survived the no-confidence vote with their support. The CBI registered a case against Soren and four other JMM Lok Sabha MPs but the Supreme Court quashed it citing immunity from prosecution they enjoyed under Article 105(2) of the Constitution. No immunity for MPs, MLAs taking bribe to vote, make speech in House: SC

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> has been informed that cases pending against sitting and former MP/MLAs increased from 4,110 in December 2018 to 4,984 in December 2021. A report submitted by amicus curiae, senior advocate Vijay Hansaria said: "Some of these cases were pending for more than three decades. 2,324 cases were against sitting legislators, and 1,675 cases were against former legislators. In 1,991 cases, even charges were not framed. 264 cases were pending due to stay granted by the High Courts." The amicus filed the report in a case connected with the expeditious trial of MPs and MLAs. According to the report, which provided state-wise data on cases, Uttar Pradesh topped the list with 1,339 cases pending for final disposal as on December 1, 2021, whereas in December 2018, 992 cases were pending, and in October 2020, 1,374 cases were pending. Therefore, data reveals that only few cases were disposed of between October 2020 and December 1, 2021. As on December 4, 2018, UP disposed of 435 cases -- 364 by sessions court and 71 by magistrates. In Bihar, in December 2018, there were 304 cases pending, which rose to 557 in October 2020, and then 571 in December 2021. Out of 571 cases, 341 cases are pending before magistrate courts and 68 cases before sessions judges. The report, which was submitted in the top court on Thursday, added: "It is submitted that despite a series of directions by this Hon'ble Court and continuous monitoring, as many as 4,984 cases are pending out of which 1,899 cases are more than 5 years old. It may be noted that the total number of cases pending as on December 2018 were 4,110, and as on October 2020 were 4,859. Even after disposal of 2,775 cases after December 4, 2018, the cases against MPs/MLAs have increased from 4,122 to 4,984." In 2018, the apex court issued the directive to set up special courts to expedite trials of cases against MPs and MLAs and since then, it has issued many directions, including asking the Centre to set up a monitoring committee to examine reasons for delay of investigation in cases. Citing the volume of cases against the lawmakers, the report said: "This shows that more and more persons with criminal antecedents are occupying the seats in the Parliament and the State Legislative Assemblies. It is of utmost necessity that urgent and stringent steps are taken for expeditious disposal of pending criminal cases." The report added that the Centre hasn't provided any suggestions after the court's order in August last year regarding the setting up of a monitoring committee to evaluate the reasons for delay in investigation. Mahacourting begins as SC to take a call on immediate floor test tomorrow

A total of 163 ( 68 per cent) out of the 241 winners in the Bihar Assembly polls have declared criminal cases against themselves in the poll affidavits, with <keyword id="42678" type="ORGANIZATION" weightage="20" keywordseo="RJD">RJD</keyword> topping the list with around 73 per cent, Bihar Election Watch and Association for Democratic Reforms (ADR) said. Of the 163 MLA-elects, 123 (51 per cent of total affidavits analysed) have serious criminal cases pending against them, including those related to murder, attempt to murder, kidnapping and crimes against women. In the 2015 Assembly elections, 142 (58 per cent) MLAs had self-declared such cases against them in their affidavits. This time, the ADR had analysed the self-sworn affidavits of 241 of the 243 victorious candidates. The ADR did not say anything on such details of remaining winners. The results of the three-phase elections were declared on Wednesday early morning after counting that went on for over 20 hours. Out of the 123 winners, 19 have murder cases, 31 attempt to murder and eight crimes against women against their names. Among the major parties, 54 (73 per cent) of the 74 winners from Tejashwi Yadav-led <keyword id="123786" type="ORGANIZATION" weightage="20" keywordseo="Rashtriya-Janata-Dal">Rashtriya Janata Dal</keyword> (RJD) have pending criminal cases, followed by 47 (64 per cent) out of 73 from BJP, 20 (47 per cent) out of 43 from Janata Dal-United, 16 (84 per cent) out of 19 from Congress, 10 (83 per cent) out of 12 from Communist Party of India-Marxist Leninist Liberation, and five (100 per cent) out of 5 from Asaduddin Owaisi's All India Majlis-e-Ittehadul Muslimeen. Nearly 70% of Bihar election winners have declared criminal cases against them, mostly from RJD

The petitioner in the court contended that the Assembly elections were held in Rajasthan on December 7, 2018 in which the six MLAs were elected on tickets issued by the BSP. The six MLAs -- Sandeep Yadav, Wajib Ali, Deepchand Kheria, Lakhan Meena, Jogendra Awana and Rajendra Gudha -- later defected to the Congress in September 2019. After the truce with Sachin Pilot, the Congress government is safe in numbers as the party has more than the required majority. At <keyword id="9428604" type="COMPANY" weightage="20" keywordseo="the-congress-legislative-party">the Congress Legislative Party</keyword> (CLP) meeting, the two camps shook hands in the presence of the party observers. The two leaders Ashok Gehlot and Sachin Pilot met before the CLP meeting in Gehlot's house. At the meeting, Gehlot gave a call to forget the past, saying, "'Apne tau apne hote hain'. We could have proved majority on the floor of the House even without these 19 MLAs, but then there would have been no happiness around." Gehlot further said, "We will move the confidence motion ourselves. We shall also resolve the grievances of our MLAs who are annoyed with us." The BJP on Thursday announced that it will move a no-confidence motion against the Gehlot government when the special Assembly session commences. This decision came after the Yogi Adityanath government in Uttar Pradesh passed a resolution suspending the MLAs fund for one year. This will help them add ₹1,500 crore for Covid-19 fund. Earlier this month, Maharashtra along with Telangana, Odisha, Rajasthan and Andhra Pradesh announced pay cuts for government employees to back up the state economies amid the Coronavirus outbreak. Maharashtra's deputy chief minister Ajit Pawar then said that the state government employees — including the Chief Minister, MLAs and members of state legislative council — will have to forfeit 60% of their salaries in March in view of the global pandemic. "The salaries of Class I and II will be cut by 50% while that of Class III employees will be cut by 25%. There will be no cut in the salaries of remaining classes in the state bureaucracy," Pawar said. Pawar said that the economy has been affected due to Coronavirus and cutting down on resources due to lockdown is only making it worse. “I hope the public representatives will cooperate with the state finance department as a strong financial support is required for the state in this ongoing fight against coronavirus,” he added. Maharashtra to cut salaries of all its MLAs by 30% for the entire year

New Delhi, Three-fourth of the new Delhi MLAs are millionaires, one-third have not studied beyond senior secondary and more than half have criminal cases against them, according to the Association of Democratic Reforms (ADR). According to ADR, 45 Aam <keyword id="1488996" type="COMPANY" weightage="20" keywordseo="Aadmi-Party">Aadmi Party</keyword> (AAP) legislators of the 62, and seven of the eight <keyword id="58687" type="ORGANIZATION" weightage="20" keywordseo="Bharatiya-Janata-Party">Bharatiya Janata Party</keyword> (BJP) MLAs had declared more than Rs 1 crore assets while filing their nomination papers. There were 44 millionaire MLAs in 2015. The average of assets per MLA in the new Delhi Assembly is Rs 14.29 crore, which is more than double the average of Rs 6.29 crore in 2015. Of the AAP legislators, the average assets per MLA is Rs 14.96 crore and in case of the BJP it's Rs 9.10 crore.  Ajit Pawar decided to step away from his personal residence — where he had a flurry of NCP, BJP and Congress party leaders visit him all day — late in the night. The current chief minister Fadnavis too held a long discussion with deputy CM Ajit Pawar over bringing in the much needed 145 MLAs to form the government. In a dramatic turn of events, Fadnavis and Ajit Pawar were sworn in as chief minister and deputy chief minister respectively by Governor Bhagat Singh Koshyari at 8 am on Saturday at a hush-hush ceremony in Raj Bhavan here, leading to the lifting of the President's rule in the state.

"All district magistrates will ensure that toll plazas under their jurisdiction will provide a separate lane to MPs and MLAs in the event of traffic jams," the letter said, also saying that authorities of the <keyword id="87432" type="ORGANIZATION" weightage="20" keywordseo="National-Highways-Authority-of-India">National Highways Authority of India</keyword> (<keyword id="49448" type="ORGANIZATION" weightage="20" keywordseo="nhai">NHAI</keyword>) are expected to cooperate in the matter. An additional district magistrate said on condition of anonymity told TOI, "Legislators and parliamentarians hardly move without four to five vehicles when they go to Lucknow or Delhi, if they travel on national and state highways where the toll plazas are erected. Though they are already exempted from paying toll tax, when plaza employees ask the unofficial vehicles accompanying them to pay up, these 'honourable' MLAs or MPs and their followers turn rude, sometimes violent. In such cases, the law and order situation is also affected."

And, a third of them are considering doing so. Goibibo and redBus also slashed employee salaries. Rituparna Chakraborty, EVP &amp; co-founder at TeamLease Services says that organisations will implement a ‘balanced approach’ while deciding on who will get impacted by the move to cut wages. “In all possibilities, the senior officials shall bear more of the brunt than others,” she said. Meanwhile, startups like Droom, MakeMyTrip (MMT), ixigo axed jobs too amid the lockdown. Founder Deep Kalra also <a href="https://www.businesstoday.in/current/corporate/startups-cut-jobs-salaries-as-coronavirus-impact-businesses/story/399971.html">told</a> Business Today that pay cuts would happen across top and managerial levels at MMT. Travel, tourism, aviation and hospitality are likely to be worst hit. On the other hand, airlines, which are the worst hit due to the <keyword id="1754604" type="PERSON" weightage="20" keywordseo="coronavirus">Coronavirus</keyword> pandemic, have trimmed employee salaries by up to 30% -- including their chairmen. However a few large groups like Tatas announced that all their working - including contractual employees - will be paid in full. Can the government really intervene? Chakraborty said that the government policies under the Industrial Disputes Act 1947 covers employees (and apprentices) working at salaries less than ₹15,000 per month. It however excludes those employed mainly in a managerial or administrative capacity. Considering that, “the scope of payment of wages shall extend to regular, casual and contractual workers. To that extent, the government has authority to intervene in employment practiced by the private firms. However any action taken by the private firms which is in line with the provisions available to them -- the necessary authorities cannot intervene,” Chakraborty explained. In most cases, lowest paid employees have been shielded from pay cuts. Do businesses have other options? A few organisations can safeguard their employees from bearing the brunt of the pandemic. But even those which can, will not be able to take the hit for a long time. Since there is uncertainty around Covid-19 and its possible impact, more pay cuts and job cuts are in the offing. “Some organisations can give away the salaries if they have deeper pockets. However the question is, for how long and are they willing? There is an extent to which industry can fund unemployment insurance. In the long run, organisations cannot afford to bear the burden of unemployment insurance fully,” Chakraborty added. The nationwide lockdown has already taken a toll on government and private companies alike. If it continues, cash conservation will be a top concern for organisations. “If India's is unable to flatten the curve of the spreading the disease it is a possible eventuality that companies will cut salaries further. However, organisations would do their best to avoid it till it becomes absolutely imperative,” says Chakraborty. Even <a href="https://www.businessinsider.in/india/news/after-telangana-maharashtra-announces-60-pay-cut-for-government-employees/articleshow/74912477.cms">state government employees have had to forfeit salaries</a> in view of the pandemic.
