Pant, and a host of former army generals have called for a crackdown on the social media platform for being partisan against India’s “national interests”. Goenka has also filed a petition with the Supreme Court directing the government to create a mechanism to keep content and advertisements on Twitter in check. Tweets criticising India's Supreme Court get tagged as 'hate speech' and incur the judge's wrath ⁠— Twitter caught in the crossfire

The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday issued a slew of directions for speedy disposal of criminal cases against Members of Parliament and Members of Legislative Assembly (MPs/MLAs) and asked High Courts to register a Suo Motu case for effective monitoring and speedy disposal of such cases. A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra said it was difficult for it to form a uniform guideline for trial courts across the country relating to speedy disposal of <keyword id="16453350" type="General" weightage="40" keywordseo="cases-against-mps" source="Orion">cases against MPs</keyword> and MLAs. The top court left it to the high courts to evolve such measures for effective monitoring of such cases. The bench directed that High Court Chief Justices shall register a suo motu case titled "In Re Designated Courts for MPs and MLAs" to monitor the early disposal of pending criminal cases against lawmakers. It directed that the suo motu case be heard by a special bench headed by the Chief Justice or a bench assigned by him or her. It was further directed that the Special Bench of the High Court may list the matter at regular intervals as felt necessary. The top court said the High Court may issue such orders and directions as necessary for expeditious and effective disposal of the cases. The bench further ordered that the Special Bench of the High Court may consider taking the assistance of the Advocate General or prosecutor to assist it. The apex court also directed that cases against MPs and MLAs that are punishable by death should be prioritised over other cases. Then cases punishable with imprisonment for five years or more will be given priority. It further said that the cases would not be adjourned by the trial court except for rare and compelling reasons. The top court said that the High Court may require a Principal District and Sessions judge to bear the responsibility of allocating the subject cases to such courts. The High Court may call upon the Principal District and Sessions judge to send reports on such intervals, it added. The concerned principal and session judge should ensure sufficient infrastructural facilities are available for the trial of such cases, as directed by the top court. The directions of the top court came on a PIL filed by advocate Ashwini Upadhyay seeking speedy disposal of criminal cases pending against MPs and MLAs. Earlier, the Enforcement Directorate (ED) filed a status report stating that there are 51 MPs and 71 MLAs, sitting and former, who stand accused by the agency of offence under the Prevention of Money Laundering Act (PMLA). The report did not specify exactly how many of those are sitting MPs or MLAs and how many are former MPs or MLAs. The Central Bureau of Investigation (CBI) had also submitted a similar report stating that a total of 121 cases are pending trial against sitting and former MPs and MLAs. The number of MPs involved in those cases is 51, out of which 14 are sitting, 37 are former and 5 are deceased. The report further stated that 112 MLAs are involved in CBI cases, out of which 34 are sitting, 78 are former and 9 are deceased. The number of cases pending investigation against MPs and MLAs by the CBI is 37, according to the report the CBI submitted. Senior advocate Vijay Hansari, who was assisting the apex court in the case as amicus curiae, had highlighted a "glaring case of inordinate delay" in the trial of cases against lawmakers, submitting that many cases were pending for over five years. The apex court had sought a status report from Hansaria relating to the pendency and grant of sanctions for prosecution, the expected time for completion of the investigation and reasons for delay in the same. Hansaria had sought directions to ensure that courts dealing with cases against lawmakers should exclusively try such issues. The plea sought speedy disposal of cases against them and pointed out that while judges and babus were suspended for such activities, politicians were condoned by the law. As of now, convicted politicians have been banned from the polls for six years.

SC issues directions to HCs for speedy disposal of criminal cases against MPs, MLAs

Hyderabad police have registered a criminal case against micro-blogging platform Twitter, Facebook-owned <keyword id="790242" type="COMPANY" weightage="20" keywordseo="WhatsApp">WhatsApp</keyword> and Chinese short-video making app TikTok on charges of facilitating the spread of hatred and anti-national content on their platforms in the country. The Cyber Crime <keyword id="48675" type="COMPANY" weightage="20" keywordseo="police-station">Police Station</keyword> registered the case following the direction from a city court on a petition filed by a local journalist. This is believed to be the first case against the leading social media platforms for facilitating spread of hatred and anti-national content in the country. The case against the social media platforms was registered under various sections of the Indian Penal Code (IPC), including for promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony, conspiracy to wage or attempt to wage war, or abetting waging of war against Indian government, obscene acts and songs in public, statements <keyword id="8818833" type="PERSON" weightage="20" keywordseo="conducing">conducing</keyword> to public mischief and criminal conspiracy. Silveri Srishailam, who had filed the petition in a Nampally court seeking action against the three social media apps, claimed that more than 1,200 groups were created after the protests against CAA, NRC and NPR began in the country, which were spreading anti-national content. He even claimed that some Pakistanis were members in these groups. He made <keyword id="8842132" type="COMPANY" weightage="20" keywordseo="twitter-communications-india-limited">Twitter Communications India Limited</keyword> and its India MD Manish Maheswari, WhatsApp Inc and its India head Abhijit Bose, and Tik Tok and its head Nikhil Gandhi the respondents in the case. When asked, a WhatsApp spokesperson shared an earlier statement that the company cared deeply about the safety of its users in India. "WhatsApp has made significant product changes and worked with partners across civil society, engaged with relevant government authorities and other technology platforms to help address the harmful consequences of misinformation," the spokesperson said. Inside sources told IANS that Twitter has not received any information on any such development so far. TikTok said it is looking into the matter. While WhatsApp has 400 million users in India, TikTok has crossed 200 million users. According to Statista, Twitter had nearly 35 million active users in India in 2019. Though the FIR was registered on February 18, the issue came to light on Thursday. A police officer said that notices would be issued to the respondents seeking their comments. The petitioner also sought ban on 42 apps, which he claimed were working against India.

Twitter's decision to 'proactively' remove Prashant Bhushan's tweets opposed by internet rights body

According to a CNN report, citing sources, the dates listed in deposition notices filed with the court are "not always the dates that the two sides agree to officially begin the questioning". The absence of Musk and Agrawal marks another twist in the fierce legal case that is slated to begin in the Delaware Court of Chancery in the US from October 17. The testimony of both "is considered central in the litigation over Musk's deal to buy -- and then his attempt to get out of buying -- Twitter for $44 billion," the report said late on Monday. Earlier court filings revealed that Musk's deposition was slated for September 26-27 and may run into September 28 if needed. Another filing said Agrawal was also due to be questioned starting Monday. "One person familiar with the matter said Agrawal's deposition is being rescheduled," the report mentioned. Musk is still expected to be deposed this week. Both the depositions will not be a public one. Earlier, in a minor win for Tesla CEO Elon Musk, a US court allowed his legal team to make a case that a $7.75 million severance payment to Peiter 'Mudge' Zatko, Twitter's former head of security, allows him to terminate the $44 billion takeover deal. Judge Kathleen McCormick ruled last week that Musk can amend his counterclaims to include the payment to Zatko. The ruling means that Musk can use the Zatko payment for his argument regarding terminating the deal. Twitter did not oppose the motion, Barron's had reported. Twitter is also seeking if there is a connection between its former head of security and Musk. Twitter shareholders had voted to approve the buyout by Musk amid the legal battle. Elon Musk and Twitter CEO Parag Agarwal escaped questioning ahead of trial

New Delhi, Jan 24 () Capital markets regulator Sebi on Friday disposed of a case of alleged insider trading in the scrip of Pantaloon Retail India Ltd (PRIL) against an individual.
 The firm is now known as Future Enterprises Ltd.
 Abhishek Jalan was alleged to have violated Prohibition of Insider Trading norms by allegedly trading on NSE in the scrip of PRIL DVR in the futures segment while in possession of unpublished price sensitive information on account of him being part of the senior management of the firm.
 However, the regulator, from the submissions of Jalan, noted that he had placed a sell order through a web based application provided by his broker and mistakenly selected PRIL futures instead of futures of GMR Infrastructure Ltd.
 Upon realising his mistake, he bought the same quantity of PRIL futures on market price to square off the futures position with a time lapse of around 3 minutes.
 Besides, he incurred a net loss of Rs 350 on account of the transactions.
 The regulator thus disposed of the proceedings against Abhishek Jalan.
 In a separate order, Sebi dismissed the proceedings against three entities -- Manjusha Lodha, ABL Infrastructure Pvt Ltd and Surinder Singh Kadyan -- for alleged irregularities while dealing in scrip of Indiabulls Integrated Services Ltd, formerly known as SORIL Holdings and Ventures Ltd.
 Allegations of disclosure lapses were levelled against Lodha and ABL Infrastructure with respect to change in their shareholding in the firm. 
 Surinder Singh Kadyan was alleged to have violated insider trading norms. However, Sebi disposed of the proceedings considering their submissions. SRS

China’s National Health Commission said 39,452 new cases were reported on Monday, including 36,304 local asymptomatic cases. Meanwhile, the protests which broke out in the eastern metropolis of Shanghai during the weekend, have spread to Beijing where hundreds of people converged on Sunday evening near Liangmahe river in the central city. Crowds carrying lighted candles in memory of those killed in the fire at an apartment block reported under COVID-19 <keyword id="91743" type="General" weightage="20" keywordseo="lockdown" source="Orion">lockdown</keyword> in Urumqi in Xinjiang shouted slogans against the arbitrary lockdowns by the government to curb the spread of the virus and in solidarity with the weekend protests in Shanghai. Several diplomats and foreigners watched the protests as they took place close to the diplomatic residential compound in Beijing. Eyewitness accounts said the protests went on for several hours and the police detained a number of people. Protesters in Shanghai on Saturday and Sunday called on Chinese President Xi Jinping and the ruling Communist Party to step down besides opposing the lockdowns and forcible evictions of people into coronavirus medical shelters. Student protests also broke out at the prestigious Tsinghua University in Beijing and Communication University in Nanjing. Photos and videos posted online showed students holding vigils for the Urumqi fire victims and launching protests at universities in Beijing and Nanjing. In the latest notice, Tsinghua University has informed students that they can go home if they wish ahead of the January spring festival holidays. In recent weeks, protests have erupted in Guangdong, Zhengzhou, Lhasa, the provincial capital of Tibet and other cities, with participants asking for an end to prolonged lockdowns and Covid tests, the Hong Kong-based South China Morning Post reported on Monday. The People’s Daily, the Communist Party’s mouthpiece on Sunday vowed in a front-page commentary to “unwaveringly” stick with the existing controls to curb the spread of Covid-19, which first broke out in the central Chinese city of Wuhan in late 2019 and then became a pandemic. Earlier in the day, Twitter moved the Karnataka High Court against the Indian government's order to take down some content on its platform, on the grounds that the content blocking orders from the <keyword id="296566" type="General" weightage="80" keywordseo="it-ministry" source="Orion">IT Ministry</keyword> do not pass "the test of the grounds provided under Section 69A of the IT Act". Twitter alleged in its writ petition that multiple accounts and content included in the blocking orders are either "overbroad and arbitrary", fail to provide notice to the "originators" of the content, and are "disproportionate" in several cases, sources told IANS. In a June letter, the IT Ministry had warned Twitter of strict action if it does not comply with some content takedown orders. Twitter has now sought judicial review of some of the content that forms a part of various blocking orders, requesting relief from the court to set aside these blocking orders. "These blocking orders are being challenged on the basis that they are procedurally and substantially deficient of the Section 69A requirements," read the writ petition. Instead of showing a fresh feed of tweets, “Something went wrong, try again,” popped up as a message. The platform seems to have resumed operations for certain users. The grounds of Chidambaram’s recent arrest The case filed against Chidambaram that led to his arrest is related to the INX Media scam. This is a 2008 deal that threatens to put the ex-minister into a serious trouble along with his son Karti Chidambaram. Though Chidambaram has claimed that he has no connections with the companies that have received the alleged bribe money in return to issuing an undue foreign investment promotion clearance to INX Media, the High court has recently identified him as the kingpin of the said scam. The details of the case against Chidambaram The underline of the case against Chidambaram is the accusation that he has helped the founders of INX Media to prevaricate justice even after they had been found to violate the foreign investment laws of the country. In the year 2007, INX Media allegedly received foreign funding of Rs 305 crores whereas they had secured permission to raise only Rs 4.62 crores as shares. When the firm was questioned by the Financial Intelligence Unit in 2008, the founders of INX Media allegedly contracted the firm that Karti Chidambaram owned in order to sort out the issue. The CBI now claims that rather than ordering to investigate into the said case, Chidambaram misused his powers through the Foreign Investment Promotion Board that was under him to grant fresh approval for the foreign funds that were already received by INX Media. The probe agency alleges that in return to the favors that Chidambaram did to INX Media, the kickbacks were routed to him through the Shell Companies connected to Karti Chidambaram. In February 2018, Karti Chidambaram was arrested and kept in jail for 23 days for interrogation. In March 2018, <keyword id="1210108" type="PERSON" weightage="20" keywordseo="Indrani-Mukerjea">Indrani Mukerjea</keyword>, the promoter of INX Media confirmed the CBI that a deal worth $1 million took place between them and Karti Chidambaram for making the FIPB grant the approval favoring the INX Media. She also turned as an approver in the said case on July 11, 2019. What is Chidambaram’s response to the allegations? In defending his innocence, Chidambaram has claimed that neither he nor any one in his family was accused of any kind of offence and that both the ED and CBI did not file a charge sheet or FIR against anyone of them. The sources close to him also said the companies that are involved in the INX media scam are not connected to Chidambaram or his son. They also claim that there had been no money trail that is found routing the alleged kickbacks to Chidambaram. What the Delhi High Court says? When reading out the judgment, Justice Sunil Gaur said, "Facts of the case prima facie reveal that petitioner (Chidambaram) is the kingpin, that is, the key conspirator in this case,"
