<ul class="summary-list"><li>The Fed's interest rate cut will ease financing conditions for homebuilders, analysts told BI.</li><li>But other issues will keep supply constrained, from material costs to labor shortages.</li></ul>The Federal Reserve's rate cut will surely impact the housing market, but its effect likely won't affect arguably the most important part of the equation: keeping affordability tight. To be sure, elevated borrowing costs are partially to blame for the affordability crisis plaguing US home buyers, and lowering them will offer relief.Rates soared to multi-decade highs a year ago, and further reductions in the Fed's benchmark rate should help bring borrowing costs down over time. However, it'll also add to the supply-demand imbalance, as more buyers are lured off the sidelines by cheaper mortgages. Pressures will rise for <a target="_blank" class="" href="https://www.businessinsider.com/us-housing-affordability-home-shortage-market-construction-population-cities-zillow-2024-6">new housing construction to meet demand</a>, but financing is still tight for home builders, stifling momentum to bring more housing online.According to the National Association of Home Builders, manufacturing loans climbed from near 5% lows to 13% since March 2022."The more immediate effect for housing from the rate cut is going to be seen in the builder and the land developer loan conditions," Danushka Nanayakkara-Skillington, NAHB's associate vice president of forecasting, told Business Insider.But how this translates into a much-needed supply boost is a different story, and there are factors the Fed cut won't fix.Lingering uncertaintiesFor instance, Nanayakkara-Skillington noted that material pricing, from drywall to steel mill products, has weighed heavily on homebuilders since the pandemic.While <a target="_blank" href="https://markets.businessinsider.com/news/commodities/lumber-prices-plunge-home-building-season-demand-falls-flat-2024-6">lumber costs</a> have normalized, she expects a <a target="_blank" href="https://www.nahb.org/blog/2024/08/canadian-lumber-tariffs">recent tariff hike</a> on Canadian wood to increase prices in the coming months.Tariffs on Chinese transformers — which NAHB considers a "<a target="_blank" href="https://www.nahb.org/advocacy/top-priorities/material-costs/transformers">sorely</a>" needed component delaying housing projects — have caused prices to jump 73% in the last four years, she said.There are also shortages to consider. Nanayakkara-Skillington cited that 57% of surveyed homebuilders say there are not enough lots to build on, adding pricing pressure to the available supply.Urban Institute senior fellow Michael Neal told BI that local regulation is needed to remedy this issue. Zoning challenges should be addressed to unleash lot availability, he said, while inspection costs and timelines should be reduced.But the biggest issue is a lack of skilled workers, Nanayakkara-Skillington said. "Because we lost about a million construction workers during the Great Recession, we still lack that. So we need people desperately to come into the trades," she said, citing that there are about 250,000 open jobs right now.Nonetheless, the Fed cuts should improve homebuilder sentiment in the coming months after a period of declines amid high borrowing costs, both analysts said. Dim views on existing homesWhile it's difficult to forecast when the housing market will come back into balance, much depends on whether lower rates entice homeowners to start selling.According to Fitch Ratings, that's unlikely for now.Since most owners hold a mortgage rate well below the current 6% level, mortgage rates will need to fall significantly lower to boost supply, which will only happen if the Fed keeps cutting. The rating agency noted that about 24% of outstanding mortgages are priced above 5%, meaning that homeowners will stay put until rates hit that level. This won't happen until 2027, Fitch said."While new home inventory has grown by 29% since the start of the pandemic, improving the supply of existing homes, which are approximately 80% housing sales, is necessary to improve prices and housing market activity," the agency said.At the same time, easing Fed policy might not stir housing activity for another reason, Neal said."Part of the Fed's decision, I think, reflected concerns about whether or not people will have jobs," he noted. "At the same time, if you think rates are going to fall today, do you think rates are going to fall tomorrow?"This thinking might cause people to delay further, he said.Wherever supply comes to stand, a knock-on effect of lower rates and higher builder sentiment may be felt in the stock market. In the past three of five rate cutting cycles, the bank noted that homebuilder shares outperformed the S&amp;P 500 in the three-months following the first cut.

Paul got his first bottle of pills from Hims in May. He said he didn't really need the generic Viagra, but after a friend bragged that he'd been using it for years to "go multiple rounds," Paul figured he'd give it a shot. So he signed in to Hims and found that the process of getting it from the direct-to-consumer telehealth company was almost disturbingly easy. Paul, who's in his early 40s, answered some multiple-choice questions online, a doctor supposedly reviewed his responses, and then a bottle of pills showed up in the mail a couple of days later.He's used the drug twice, though it doesn't really work how he thought it would. Nobody had explained what to expect, which probably wouldn't be the case in a regular healthcare setting. When I asked Paul (a pseudonym) why he didn't just go to his regular doctor for the issue, his answer was succinct: "Speed, convenience, positive my doctor would say no." His primary-care provider had mentioned a while back that he thought Viagra was overprescribed.The <a target="_blank" href="https://www.businessinsider.com/booming-direct-consumer-healthcare-business-2018-10">direct-to-consumer health industry</a> has exploded in recent years. The pandemic accelerated the rise of telehealth, which these DTC companies are a part of both culturally and <a target="_blank" href="https://www.businessinsider.com/dea-proposed-rules-controlled-substances-buprenorphine-startups-2023-3">legally</a>. Grand View Research estimates that the global telehealth market was worth $101.2 billion in 2023 and that it's growing rapidly. Multiple startups have popped up to capitalize on this growth, with <a target="_blank" href="https://www.businessinsider.com/top-investment-firms-vcs-making-most-telehealth-investments-2021-7">venture capital and investor dollars flowing in</a>. Hims &amp; Hers Health has a market cap of over $4 billion. Ro, one of the other main players in the industry, has raised over $1 billion and has a valuation of $6.6 billion, according to PitchBook.These companies sell a wide array of products to help with everything from weight loss to mental health. Much of their business proposition, however, is targeted specifically at young men and, more specifically, at their insecurities. Are you worried about your hairline? Your fertility? What about getting an erection? Are you scared to talk to a doctor face-to-face about any of this? Well, Hims promises you can "skip the awkward doctor visits" and offers "ED meds from your couch." A "healthy, handsome you" is only a click away."These platforms are basically set up to minimize the distance from advertising and hooking the consumer to getting a prescription in their hand," said Matthew McCoy, an assistant professor in the Department of Medical Ethics and Health Policy at the University of Pennsylvania. "The advantage of that is efficiency — people, understandably, don't have a lot of time always to spend on these sorts of things. The downside of that is risks that you're not making fully informed decisions or that the kind of advice that you're getting is being colored by the company's financial incentives rather than a doctor's honest opinion of what's in your medical best interest."Those at the forefront of the DTC health revolution have American guys right where they want them: insecure, on edge, and ready to open their wallets.<hr />There are some variations in how these services work, but the gist is this: You go to a website (probably because you saw some ad for it), fill out a questionnaire about your condition, maybe chat with a doctor (though often you don't), and then voilà, a prescription is on its way to you in what's promised to be discreet packaging."It typically bypasses traditional healthcare settings, and often there's little to no involvement of a healthcare provider," said Ashwini Nagappan, a doctoral candidate at UCLA's Fielding School of Public Health who has studied DTC medicine and ethics.There is some altruistic appeal: DTC medication services can help with access for people who live in remote areas or can't easily get to a doctor. But for many clients, and especially young men, the upside is that it's simply more convenient than a traditional appointment."In general, men are less likely to utilize healthcare when compared to women," said Joshua Halpern, the chief scientific officer at Posterity Health, a male-fertility clinic, and an adjunct assistant professor of urology at Northwestern University's Feinberg School of Medicine. "And we know that many young men don't even have a primary-care physician to begin with, so the process of establishing care can be daunting, especially when it can take months to get an appointment."Even if they do have a relationship with a medical provider, it may not be the type where they feel comfortable bringing up sensitive or stigmatized issues. Research indicates that when it comes to seeking care for sexual-health concerns, privacy is a primary consideration for young men. A review of literature on DTC telemedicine and men notes that men who use DTC platforms <a target="_blank" href="https://wjmh.org/DOIx.php?id=10.5534/wjmh.230057">cite convenience</a> as an important motivation, as well as embarrassment and discretion. Financial factors, interestingly, aren't very much in play. A survey conducted in late 2019 and early 2020 found that men under 40 and in the middle-income range were <a target="_blank" href="https://pubmed.ncbi.nlm.nih.gov/36310185/">likelier to use</a> DTC telehealth services than older, wealthier men.While DTC services may help with timely access and do some work on destigmatizing certain issues, there are substantial drawbacks. Men using these services might not get the comprehensive evaluation they need to uncover underlying conditions and address their overall health, Halpern said, and they may not be seeing a healthcare provider who is most appropriate for managing their condition."They can also end up paying more for care that would be more affordable elsewhere or even covered by their medical insurance," he said.His research suggests that some platforms may also be providing what's known as guideline-discordant care, meaning patients are getting unnecessary tests and inappropriate treatments, such as testosterone replacement for men who are trying to conceive, which can be detrimental in some cases. Plenty of doctors have <a target="_blank" href="https://www.businessinsider.com/doctors-worry-about-how-startup-hims-prescribes-viagra-online-2019-2">sounded the alarm about DTC telehealth companies</a>, and some firms have gotten into legal trouble, too. The Department of Justice has charged the leaders of the <a target="_blank" href="https://www.businessinsider.com/ai-adderall-targeted-advertising-opioid-crisis-cerebral-purdue-pharma-2023-7">ADHD-focused telehealth company Done</a> with fraud over its Adderall prescription practices and advertising.<hr />For all the issues with DTC companies, it's fair to note that traditional healthcare settings are far from perfect. Patients can lie to their doctors in person. Providers don't always have a full view of their patients' health or everything they're taking. Navigating insurance and appointments is a hassle. But handing out drugs in a faceless manner across the internet is markedly different from what has happened in healthcare historically, and it presents different risks. <blockquote class="pullquote-wrapper pullquote-breakout"> <q class="pullquote-quotation">These companies are in the business of selling drugs.</q> </blockquote> "When you're in person or you're doing telehealth through a more established healthcare entity, there is a little bit more collection of your medical history," Nagappan said.While DTC platforms say they serve a valuable purpose in getting young men to address medical needs they would otherwise ignore, the monetary factors involved are different from those at a regular physician's office."These companies are in the business of selling drugs," McCoy said. "A medical provider ideally is in the business of providing the best medical care, which sometimes involves writing prescriptions for drugs, but sometimes involves alternative modalities or nothing at all."One man who got generic Viagra through Hims told me he went through the platform to avoid the "8 million" questions his doctor would ask — and he knew he'd probably be approved. "I mean, whenever you deal with these drug companies that are trying to do direct-to-consumer, you've got to know that their doctors are just checking a box," he said. "They're not going to give you too much crap. If you have a pulse, they're going to give you a prescription." (He was also concerned about privacy, but he said the packaging wasn't as discreet as he'd hoped — "Hims" was on the shipping label, and he knows his mail guy.)These companies make money if you buy something, and it's even better if you set up a recurring subscription, so advertising that leans into young men's fears can be especially fruitful."You might say that makes them a target for high-pressure, potentially even manipulative marketing in a way that we should worry about," McCoy said.The dynamic is similar to pharmaceutical ads on TV for drugs like Ozempic or Cialis. Instead of getting advice from disinterested parties, like their doctors, people are getting messages from quite interested parties — pharmaceutical companies — hoping they show up at their next medical visit and make an ask.A spokesperson for Hims said in an email that a "core tenet" of the company is "to help people address issues that may be hard to talk about, but are important for feeling good and being healthy" and that its platform and customer experience is "is designed to help customers bypass the various hurdles that come with getting the care and accessing necessary treatments." When asked how doctors are compensated, they said it's a time-based model that takes into consideration time spent and "certain efficiency metrics," but it's not about prescriptions written. The spokesperson emphasized that "the health and well-being of our customers will always be our top priority" and confirmed that fees are only charged if someone receives treatment. A spokesperson for Ro said that it's a "misconception" that its patient base skews younger and that 87% are over 30. They said that providers' prescribing decisions do not impact their compensation and provided a link to their operating system.DTC telehealth can play a role in people getting treatment they may otherwise not seek, whether for alcoholism or depression or hair loss, and at the very least it can help people realize they're not so alone in whatever issue that's ailing them. While I was reporting for this story, a friend told me he got a hair-loss prescription from Hims after his barber mentioned his bald spot — to me, that seems fine.But it's hard not to recognize these companies' financial incentives and the ways they may distort care. They're prescribing all sorts of drugs constantly and not asking too many questions in the process. The last month of 2020 should've been a happy time for real-estate agents. The catastrophe of the pandemic had turned into an improbable housing-market boom, as home sales reached 14-year highs. But instead of celebrating their unexpectedly prosperous year, a lot of agents were pissed.In private chats and message boards, they complained about new rules that would publicly expose their commissions. For homebuyers, the amount an agent gets paid has historically been out of sight, out of mind. But as part of a November 2020 settlement between the Department of Justice and the industry's top trade group, the National Association of Realtors, real-estate search sites like Zillow and Redfin would soon start publicizing exactly how much buyers' agents stood to collect on nearly every home for sale in America.Among real-estate agents, no topic is more sensitive than their commissions. In private comments at the time, screenshots of which were shared with Business Insider, agents revealed just how squeamish they were."It's no one's business," one disgruntled agent commented in a private Facebook group. "Do we go around asking people how much they make?""Someone has it in for real estate," another responded.In the middle of the vitriol, a brave agent — whom I'll call Julie — applauded the move, suggesting it could help rid the industry of one of its dirty secrets: a sly tactic called steering.Because of America's convoluted home-sales system, the seller typically pays out agents on both sides of a transaction. The commission is baked into the home's final price — it's usually between 5% and 6% of the total — and split evenly between the buyer's and seller's agents. Technically, the seller can promise as little as $0 to the buyer's agent; after all, why pay for someone you didn't hire? But there's a catch: Offer less than the going rate, and you risk getting the cold shoulder from other brokers and fewer eyeballs on your listing. Agents might steer their clients toward the homes that offer the standard commission and away from ones that don't. The practice screws over both sellers, who might miss out on offers, and buyers, who might unknowingly pass over their dream home."Whether or not people admit it, steering due to commission rate definitely happens and it is incredibly wrong," Julie wrote in a Facebook comment."Wrong," someone else replied, "or the real world?"Steering is notoriously difficult to prove or quantify, but evidence of the practice can be found littered throughout the housing market. The extent of steering is a main point of contention in the multibillion-dollar <a target="_blank" href="https://www.businessinsider.com/real-estate-agents-lawsuits-buy-sell-homes-forever-housing-market-2023-6">class-action lawsuits over agent commissions</a>; the plaintiffs say the threat of steering is a big reason commissions have barely budged over the years. Wendy Gilch, a consumer advocate who focuses on transparency in real estate with her company, Selling Later, likened this moment to "a reset button" for the industry."It's a great opportunity to start over," Gilch told me.<hr />It's hard to know how much steering actually happens, mostly because a buyer might never know they were a victim in the first place.The first article in NAR's code of ethics says Realtors must "protect and promote the interests of their client," and the organization's official position can be summed up simply: Steering doesn't exist. It's a myth, the argument goes, created by those who want to dismantle the system and force buyers and sellers to pay their agents separately. But multiple agents told me there are all kinds of ways shady practitioners try to skirt the rules.For instance, some agents might filter out listings with subpar commissions before passing along options to their clients. Or if they do show their client a house, they could insinuate that a low commission is a warning sign that the seller is hard to deal with or invent reasons the house isn't a good fit. They could also caution that if they're not getting their desired commission from the seller, they'll expect the buyer to make up the difference. Agents are within their rights to do that, but it can discourage a cash-strapped buyer from pursuing a home."All a Realtor has to do is make a face about a house and they put a question in the buyer's mind as to whether or not it would be wise to put an offer in on a house," Doug Miller, a real-estate attorney in Minnesota, said in an email.Critics say the stickiness of the going commission rate is evidence of steering's ubiquity. The cut that's split between agents on both sides of the deal has basically fluctuated between 5% and 6% of the total sale price since at least 1992, despite the widespread adoption of home-search technology, an increase in the number of agents, and huge differences in agents' experience and skill. In recent years, greater numbers of agents have been fighting for clients, while technology has streamlined their jobs and made it possible for anyone to look up homes online. In a competitive market, critics say, you'd expect the price of agents' services to come down. But data from RealTrends indicates that in 2021, even as home prices were skyrocketing and agents were signing up en masse, the typical commission rate actually went up. <blockquote class="pullquote-wrapper pullquote-breakout"> <q class="pullquote-quotation">All a Realtor has to do is make a face about a house and they put a question in the buyer's mind as to whether or not it would be wise to put an offer in.</q> </blockquote> A recent <a target="_blank" href="https://papers.ssrn.com/sol3/papers.cfm?abstract_id=4596391">analysis</a> of roughly 265,000 listings on Redfin in 34 large metropolitan areas found that, in a typical market, more than 85% of listings offered the two most common commission rates for buyers' agents. In Austin, Houston, and Kansas City, Missouri, more than 95% of listings offered a commission to the buyer's agent of 3% or 2.5%.The authors of the study wondered whether buyers' agents might forward fewer low-commission listings to their clients, which would mean fewer page views on sites like Zillow and Redfin. They found that, all else being equal, low-commission listings received significantly fewer page views on Redfin — even the homes that offered agent payments just slightly below the going rate got fewer eyeballs. Homes with lower buyer-agent commissions also took longer to sell and were less likely to sell at all than those offering the standard rate.Agents I talked with stressed that there are plenty of honest, hardworking representatives who just want the best for their clients. I believe them. But there are also just lots of agents out there, and the <a target="_blank" href="https://www.businessinsider.com/bad-real-estate-agents-realtors-homebuyers-sellers-housing-market-2023-7">bar for entry into the industry is shockingly low</a>. In most states, getting a license to work as a real-estate agent requires paying a few hundred dollars, doing several weeks' worth of coursework, and passing a multiple-choice test. It's no surprise, then, that there are some 1.5 million NAR members, or more than two Realtors for every available home on the market. And that doesn't even count all the agents who aren't members of the organization — there are about 1.3 million licensees in the US who don't belong to the group, meaning they can't use the Realtor title and don't subscribe to its code of ethics.The low standards and lack of oversight can create hazardous conditions for buyers and sellers. A few years ago, the now defunct discount brokerage Rex Real Estate released recordings of roughly 600 calls in which other agents vowed to avoid properties listed by Rex that offered less-than-satisfactory commissions. In one call, court documents say, a Keller Williams agent told a Rex representative: "If you are not offering any buyer's commission, then that's fine. I'm not going to show that [property], and you're probably going to run into the same issue with everybody here." Another ReMax agent said, "I'm not going to show a listing where I'm not guaranteed a commission."Brendon Bowers, a former real-estate agent who spent a couple of years working as a branch manager for Rex in the Phoenix market, told me he encountered this sort of thing all the time. He said buyers' agents might call and say, "'Why is there no buyer's commission?" or "Why do I have to negotiate this? Nevermind, we're just going to go on to the next one." Steering, he added, is "just flat-out a part of real estate."A spokesperson for the NAR told me that Rex was cherry-picking from thousands of calls and that these agents may have eventually shown their clients the homes, however begrudgingly. But even the mere threat of steering is enough to keep commissions from dropping, Stephen Brobeck, a senior fellow at the Consumer Federation of America, told me. The problem isn't that steering is rampant, Brobeck said; if most listings in a market already offer uniform commission rates, there's no need for an agent to steer their client in the first place. It's the fear of steering that maintains the system. A seller might hear of examples of steering, or get a warning from their agent of the risks involved in offering substandard commissions, and decide it's worth it just to promise the going rate. After all, everyone else is doing it.<hr />Class-action plaintiffs, the Consumer Federation of America, and the Department of Justice have proposed something called decoupling, in which buyers and sellers just pay their agents separately, as a way to get rid of steering. The DOJ has argued that as long as sellers pay a commission to the buyer's agents, they'll be pressured to promise the going rate. In the proposed alternative, sellers would promise a commission only to their agent. For buyers, it would be more complicated; they'd have to figure out how to pay their agent directly, and how much. They could either pay the broker out of pocket or arrange to get a rebate from the seller once the deal closes.Such changes could come sooner rather than later. With commissions under heightened scrutiny, more agents are getting buyers to sign buyer-broker representation contracts laying out the rate the agent expects to get paid, regardless of what the seller offers in the listing. If an agent wants 3% of the sale price and the house you buy provides only 2%, you might have to pick up the difference. If you're working with a good agent, that will probably feel worth it. But if sellers stop offering commissions altogether, buyers might have to make some tough choices. Many more buyers might choose to go it alone rather than pay out of pocket for an agent's services. Or they could pay their agents a flat fee or an hourly rate instead of a commission, though it's unclear how many agents would take that deal. Buyers might also start writing offers on homes that are contingent on making sure their agent gets paid: "I'll offer you $400,000 for your house, but you've got to give me back $12,000 so I can cut a check to my broker." But there's still no guarantee that sellers would agree to that, especially in a hot market like the one we've seen over the past few years. <blockquote class="pullquote-wrapper pullquote-right"> <q class="pullquote-quotation">Nobody expects agents to work for free, but the near uniformity of commission rates is strong evidence that buyers and sellers aren't bargaining nearly as much as they should be.</q> </blockquote> The NAR says decoupling would only heighten the inequalities in the housing market. Rich people could afford to get an agent and enjoy all the benefits that come with one, while poorer buyers might be left on their own. Others in favor of decoupling say the industry would be forced to get creative to ensure that as many buyers as possible could still access agents. Meanwhile, buyers and sellers would negotiate harder and maybe save thousands of dollars on a sale.Nobody expects agents to work for free, but the near uniformity of commission rates is strong evidence that buyers and sellers aren't bargaining nearly as much as they should be. If you're a buyer, there are steps you can take to avoid falling victim to steering. Be wary of relying too much on an agent to feed you listings; it's worth doing your own research, too. On sites like Zillow and Redfin, you can often see the commission being offered to the buyer's agent. If a listing is offering less than what's typical in your area and your agent is acting weird about it, that might be a red flag. There are lots of willing brokers out there; if you suspect steering, agents told me, you've got plenty of options for a second opinion.Again, there are good, honest agents out there who deserve every penny of their commission. But you don't have to talk to many buyers to realize that not everyone meets that standard.I recently called up Julie, the agent in the private Facebook group who spoke up about steering a few years ago. She asked that I not use her real name because she didn't want to be drawn into the controversy over commissions and all the lawsuits the NAR is facing; if things were tense back in 2020, they've only gotten more heated since then. But her feelings about the issue hadn't changed."I am responsible for taking care of my clients to the best of my ability," she told me. "I tell my clients it's not their job to provide for me. But my list of "must haves" truly were the things I needed for buying an apartment to make sense. And where I looked had already expanded far beyond the spots I ideally wanted. I wasn't asking for the impossible, just something very particular and very hard to find. He was always very responsive and polite (until he wasn't, more on that later), sending me leads as soon as he saw something promising come on the market. But with a few exceptions, the "leads" my agent "found" were always things I'd already seen on StreetEasy, sometimes weeks earlier. Strike two.In fairness, all agents have a disadvantage here, because the internet has come to democratize homebuying. For many years, even though sites like Realtor.com existed, buyers were at the mercy of agents to know what was for sale. This was because, a 2005 antitrust lawsuit from the US Department of Justice lays out, Realtors used their control of the listing services to strangle the nascent online housing market and punish agents who listed homes publicly. All that ended in 2008, when a massive settlement opened up the floodgates of public listings. These days, most agents largely have the same listings the rest of us do.So my agent wasn't going to find me my <a target="_blank" href="https://www.businessinsider.com/why-cant-millennials-buy-homes-first-time-buyers-mortgage-rates-2023-12">dream house</a>, and the work of hunting was basically on me. But I still needed his expertise to vet the apartment and negotiate a deal that would surely come with reams of byzantine paperwork. Didn't I?According to Stephen Brobeck, a senior fellow at the Consumer Federation of America, many of us don't. Homebuying, he says, is "not rocket science." But the real-estate industry has made it hard for many buyers to understand just how little having an agent can help. "I call it the 'Alice in Wonderland' world, because things are not as they seem. And when you understand them, they don't make much sense."For me, I finally climbed out of the rabbit hole and woke up when my agent led me into a bidding war.<hr />The apartment was bright, airy, just a few blocks from McCarren Park, and more than 1,200 square feet — practically a mansion by Williamsburg standards. But there were worrying signs. The unit's bottom floor was below street level, and the block itself was in a flood zone. After touring the unit with the agent, I had a bunch of questions. The inquiries I parroted, most of which I'd learned from Googling, were pretty straightforward: Any pending or anticipated building repairs, assessments, or compliance measures? For example, in New York City, larger buildings need to periodically erect costly scaffolding to inspect their facade — you want to know if that's around the corner. I was expecting something massive, confusing, and formal, but, again, it turned out that was for later, something for a lawyer to review, not the agent. I've read tweets from reply guys longer than the bidding document.The bid almost worked. It was down to me and one other buyer, someone very similarly situated and with a similar bid, according to my agent.This is when he finally struck out. When I made my bid, I went to the absolute maximum of what I felt comfortable spending, leaving zero wiggle room. But now my agent said that wasn't enough. He knew my finances and kept telling me how he knew I could afford to go higher. "What's 50k really going to mean to you over the lifetime of the apartment?" But I knew that was $50,000 more than I was willing to spend, $50,000 more than I thought it was worth. Buying a house can make even the largest sums seem negligible if you're not careful. But $50,000 is still $50,000. When I held firm, my agent couldn't hide his exasperation. He said something about me needing to "get serious." I realized he wanted the deal to go through more than I did. After all, that was the only way he got paid.I lost the bidding war, and a couple months later I was cosmically relieved I had. During record-breaking rains in <a target="_blank" href="https://www.businessinsider.com/city-state-budget-shortfall-deficit-california-denver-boston-new-york-2024-4">New York City</a> last fall, the corner with that apartment flooded several feet above street level. I imagined just how awful it would have felt to have overextended myself to buy that apartment only to end up financially and literally underwater.Brobeck described the real-estate industry as "rife with conflicts of interest," including many scenarios far worse than what I faced. Where my agent was merely pushy, others have gone on to "double-dip" on payments from both buyers and sellers, to drive up the price their client pays to increase the commission, and even share confidential information from one client with another. The National Association of Realtors' own 2015 report says, "The real estate industry is saddled with a large number of part-time, untrained, unethical, and/or incompetent agents."I didn't want to pay someone who I felt was working against me, especially when I didn't see what they were bringing me in return. So I fired the agent and had a go on my own. I typed up my own bid form (all of 174 words) and kept an eye on StreetEasy, and a few weeks later I toured an open house.The price was out of my budget, but the unit had been sitting on the market for a few months. So I came in with a low bid, the sort of tactic my agent had discouraged. Rather than toss it out, the seller and I negotiated. By the time they said "best and final," the seller had carved six figures off the asking price. Not bad for my first negotiation. Just before closing, while on a walkthrough with the seller's agent, I asked how my representing myself had affected things. He was candid: "Not splitting the commission meant they could do $50,000 lower." Like so many sellers, the prior owners had baked my agent's 3% commission into the selling price, and without it, I could save the difference. $50,000 is $50,000.The <a target="_blank" href="https://www.businessinsider.com/lawsuits-verdict-realtors-brokerages-real-estate-agents-home-buying-selling-2023-11">class-action settlement with the NAR</a> is going to make it a lot harder for sellers to be forced to pay for buyers' agents. Going forward, for people like me without an agent, a savvy seller may pay just 3% of the sales price to their own agent instead of 6% to be split with a buyer's agent. Some homebuyers may still want an agent, especially those who don't feel comfortable representing themselves or don't have the time, but faced with the prospect of paying directly for agents who offer less and less of an edge, I expect many more people will go their own way, and save tens of thousands of dollars in the process. Experts estimate that nationwide, after the NAR settlement, buyers may save up to $30 billion a year.A few weeks after I moved into my new apartment, I ran into my ex-girlfriend. I told her I had bought a place, and she was thrilled for me. Then I sheepishly added: "So, that whole agent thing, turns out you're right. It was a scam after all." According to CCPA Chief Commissioner <keyword id="1868624" type="General" weightage="50" keywordseo="nidhi-khare" source="Orion">Nidhi Khare</keyword>, the CCPA has directed Flipkart to notify consumers of all 598 pressure cookers sold on its platform, recall the pressure cookers and reimburse their prices to the consumers and submit a compliance report of the same within 45 days. The company has also been directed to pay a penalty of Rs 1,00,000 for allowing sale of such pressure cookers on its e-commerce platform and violating rights of consumers. The <keyword id="6378065" type="General" weightage="50" keywordseo="central" source="Orion">Central</keyword> government, from time to time, notifies the <keyword id="10524664" type="General" weightage="50" keywordseo="quality-control-orders" source="Orion">Quality Control Orders</keyword> specifying compulsory conformity to a standard and use of standard mark for a product to protect consumers from risk of suffering injury and harm and in the interest of people at large. The <keyword id="13478363" type="General" weightage="50" keywordseo="domestic-pressure-cooker" source="Orion">Domestic Pressure Cooker</keyword> (Quality Control) order, which came into effect from February 1, 2021, mandates conformity to IS 2347:2017 for all domestic pressure cookers. Therefore, since February 1, 2021, all pressure cookers are required to conform to IS 2347:2017 and due diligence is required to be done whether the pressure cookers are offered for sale online or offline. The CCPA observed that provisions in the 'Flipkart terms of use' such as mandatory use of the words 'Powered by Flipkart' on every invoice of the product and distinguishing sellers as gold, silver and bronze for distribution of various benefits indicates the role played by Flipkart in sale of the pressure cookers on its e-commerce platform. Flipkart admittedly earned a total fee of Rs 1,84,263 through sale of such pressure cookers on its e-commerce platform. It was observed by CCPA that when Flipkart has gained commercially from the sale of such pressure cookers, it cannot alienate itself from the role and responsibility arising out of their sale to consumers. Other changes, like <a href="https://www.businessinsider.com/bad-real-estate-agents-realtors-homebuyers-sellers-housing-market-2023-7">higher standards for real-estate agents</a> and more transparent agent commissions, could make things simpler for homebuyers who are currently faced with a complex, overwhelming, and oftentimes frustrating process."As a general rule, the idea is, 'If it ain't broke, don't fix it,'" Rob Hahn, an entrepreneur and longtime consultant to local Realtor associations, told me. "I'm like, 'Well, I think it is kind of broken.' And I think the pandemic really showed us how broken it is."<h2>Why buying a house is so complicated</h2>At the most basic level, home sales are complicated because people are complicated. Buying a house is often the largest purchase someone will make in their lifetime. Each buyer comes to this monumental transaction with their own search criteria and financial history, making it hard to take a one-size-fits-all approach. "Buying and selling a home is fundamentally different than every other transaction," DelPrete told me. "Full stop."The sheer financial scale of homebuying is a good reason to make it more complex than, say, buying a gallon of milk or a car. Even if you accept a bit of intricacy, real estate remains a stodgy industry — and regulation is at the core of that resistance to change. Property sales, especially after the global financial crisis, are enmeshed in a dense web of national and state laws. Many of these rules are necessary to protect consumers from getting ripped off, but in some cases they can also overcomplicate the process. It might seem more efficient if the company helping you find a home could also hook you up with a mortgage and home insurance and handle your appraisal and inspection. But that kind of setup could leave consumers vulnerable to being overcharged and underserved. There are strict rules to limit kickbacks between agents, mortgage lenders, and title companies, for example, so that buyers aren't aggressively steered toward certain firms just because money is being exchanged behind their backs. But that doesn't mean it doesn't happen.Or take the home-appraisal process. Mortgage lenders used to hire an appraiser directly to value the house and help determine how much money they'd be willing to loan for it. But lenders ended up abusing this power, putting pressure on appraisers to value properties higher to drive up prices. Regulations required a separation between the lenders and appraisers, giving rise to a new class of independent middlemen: appraisal-management companies. These firms are hired by a lender to find an appraiser to do the job, pocketing a cut of the money for their services. Does this ward off bad behavior? In some cases. But it also adds time and costs to the process, an extra step that most buyers probably don't even know about. It's clear that these rules are weighing on potential buyers. A 2022 <a href="https://www.nar.realtor/sites/default/files/documents/2023-home-buyers-and-sellers-generational-trends-report-03-28-2023.pdf">survey</a> of homebuyers conducted by the National Association of Realtors found that 30% of respondents between the ages 24 and 32 — the cohort most likely to include first-time buyers — said understanding the process was the most difficult part of the purchase. In another <a href="https://www.zillow.com/agent-resources/agent-toolkit/first-time-home-buyers-checklist/" target="_blank" rel="noopener">survey</a> by Zillow, 24% of buyers said they didn't completely understand everything they signed when buying a home. The various hoops buyers have to jump through also add to the cost of a purchase: Last year, the typical homebuyer with a mortgage spent a little over $4,000, or 1% of the average sale price, on closing costs like the appraisal, title insurance, and recording fees, said ClosingCorp, a provider of real-estate closing-cost data. Taxes, which are usually paid by the seller, added another $3,200.Then there's the challenge of digitizing an old-school process. People may like to rent a movie or buy a pizza with the click of a button, but that doesn't mean they want the same experience for a home purchase, DelPrete told me. Sure, people can tour homes with a virtual-reality headset, but buyers still want to walk around in a house before they make an offer. And once they start to envision themselves welcoming guests into the living room or watching their kids play in the backyard, they're practically guaranteed to act irrationally. That's when it's helpful to have a living, breathing person there to offer a levelheaded perspective. Despite the best efforts of would-be disruptors to cut out this middleman, 88% of buyers this year enlisted a real-estate agent, a Zillow survey found. That figure is even higher than it was prior to the pandemic, in 2019, when 82% of buyers used an agent. <blockquote class="pullquote-wrapper pullquote-breakout"><q class="pullquote-quotation">People are talking about launching manned missions to Mars, but we're actually still in the Stone Ages here</q></blockquote>Even some of the more minor attempts to update the process have been met with much hand-wringing. Take, for instance, the various laws around electronic signatures. The COVID-19 pandemic hastened the adoption of remote online notarization, which allows buyers and sellers to close a deal without having to go to an office and sign paperwork. But Washington, DC, and seven states, including California and Georgia, still don't allow fully remote closings because of legal hiccups or fraud concerns — an indication of just how fragmented the industry is and how slowly it can move when it comes to adopting new technology. "People are talking about launching manned missions to Mars, but we're actually still in the Stone Ages here," DelPrete told me. "We're in the caves, trying to create fire and get everybody to do electronic signatures."In many ways, tech has made the process of buying a home in 2023 harder than it was in 2003, "despite a lot of smart people with a lot of money spending two decades trying to make it easier," John Berkowitz, the CEO of Ojo, which owns the home-search and guidance site Movoto, told me. Consumers today are flooded with options thanks to the many startups that have jumped in to help buyers do things like get a mortgage online or <a href="https://www.businessinsider.com/all-cash-offer-win-home-bidding-war-startups-mortgage-2022-3">buy a home with a cash-backed offer</a>. In theory, more options should be a good thing, but that hasn't been the case in real estate."If you have no idea what you're doing, and you don't know who to trust, more choice is just overwhelming," Berkowitz said. And because all these companies are spending on marketing and referral fees to acquire customers, those costs end up being funneled down to buyers and sellers. "They're actually — not because of bad intentions — making it harder," he added.<h2>How things change</h2>Industry players have tried plenty of strategies to bring homebuying out of the dark ages, but any changes that occur won't involve cutting corners. All the paperwork, while a headache, is designed to make sure inexperienced buyers and sellers are aware of the costs involved and aren't being screwed over by much more sophisticated, nefarious players. Twenty years after the advent of online home searches, the next step in innovation, Berkowitz told me, will be focused on assembling all the pieces of the real-estate transaction in one place — a one-stop shop where customers can enter their information and then find the best providers to work with at each step in the journey. The secret sauce that companies are chasing would involve matching someone with the right agent, the right lender, and then all the other parties along the way. Bobby Bryant, the founder and CEO of the real-estate tech firm Doss Group Inc., envisions an app in which everything — search, mortgage, insurance — is available as a seamless experience for consumers. He compared it to calling an Uber: It may feel quick and easy for a consumer, but the company controlling the app still has to deal with the old-school components of a physical driver getting from point A to point B while obeying traffic rules along the way. "How does one create the Amazon of real estate?" Bryant said. "You have to almost do it by way of creating a super app that brings it together, streamline the process, and make it more economical, easier for everybody involved."Zillow, which has already helped make the initial search for a home easier, is trying to make this dream a reality. The company has spent the past couple of years teasing what it calls a "housing super app," but so far, we don't have many details on what it would actually look like. In a recent earnings call with analysts, Zillow CEO Rich Barton described it as a way to provide customers with "a much more digital, convenient, and integrated housing transaction." The idea sounds enticing, but a real-estate super app is still a long way from going mainstream. And not everyone is convinced that such a development would be a boon for regular homebuyers. Wendy Gilch, a consumer advocate, podcast host, and the founder of Selling Later Search, said she worried that a streamlined process could mean less choice for consumers. The idea of capturing all parts of the transaction might make for a great pitch to investors, but consumers could be wary of handing all that power to one company. "If you're going to one place for everything, are you going to be getting the best?" Gilch said. Short of a tech-enabled homebuying nirvana, there are some other changes that could make the process easier for consumers. Universal adoption of e-signatures, for instance, could cut down on the hassle at closing. And title insurance, while necessary, <a href="https://www.businessinsider.com/title-insurance-scam-mortgage-homebuying-2022-2">is an oligopoly</a> that could be made much cheaper and more transparent for consumers.<blockquote class="pullquote-wrapper pullquote-breakout"><q class="pullquote-quotation">The technology is there to make it easier, less expensive, faster</q></blockquote>On a larger scale, state regulators could <a href="https://www.businessinsider.com/bad-real-estate-agents-realtors-homebuyers-sellers-housing-market-2023-7">raise the barriers to entry</a> for real-estate agents to reflect the seriousness of their role in one of life's biggest decisions. Today, state requirements to get a real-estate license can be as little as two weeks' worth of online classes and a passing grade on a multiple-choice test. Raising the bar to make sure agents know their stuff would help ensure buyers understand the process from beginning to end. And, <a href="https://www.businessinsider.com/real-estate-agents-lawsuits-buy-sell-homes-forever-housing-market-2023-6">as I've written about before</a>, two ongoing class-action lawsuits against the National Association of Realtors and several of the country's largest brokerages could radically alter the way agents are paid, potentially making transactions simpler and more transparent. Saul Klein, an early internet evangelist in the real-estate industry, told me he sees an approaching "paradigm shift." Between the litigation over agent commissions and the ongoing quest to streamline homebuying, there are "major, major changes" on the horizon, Klein said. "The technology is there to make it easier, less expensive, faster," Klein told me.
