Budget 2021: Nirmala Sitharaman meets President Kovind ahead of Budget speech

New Delhi, Feb 1 () Amendments have been proposed to the companies law, Finance Minister Nirmala Sitharaman said on Saturday as she highlighted the debate about criminal liability for acts that are civil in nature.
 Presenting the Union Budget for 2020-21 financial year, she assured taxpayers that the government remains committed to taking measures so that they are free from any kind of harassment.
 The corporate affairs ministry, which is also helmed by Sitharaman, would be seeking amendments to the Companies Act, 2013, to decriminalise various offences following recommendations from a high level committee last year.
 "There has been a debate about building into statutes, criminal liability for acts that are civil in nature. Hence, for Companies Act, certain amendments are proposed to be made that will correct this. Similarly, other laws would also be examined, where such provisions exist and attempts would be made to correct them," Sitharaman said in her nearly 160-minute speech.
 In November, the Company Law Committee -- chaired by Corporate Affairs Secretary Injeti Srinivas -- recommended decriminalising more than half of the existing compoundable offences under the companies law.
 Amendments to 46 penal provisions, "so as to either remove criminality, or to restrict the punishment to only fine, or to allow rectification of defaults through alternative methods", have been suggested by the committee.
 As per the committee's report, 23 out of the 66 remaining compoundable offences under the Companies Act could be re-categorised.
 Such offences could then be dealt with in-house adjudication framework wherein these defaults would be subject to a penalty levied by an adjudicating officer, according to the report.
 Generally, compoundable offences are those which can be settled by paying certain amount of money.
 In 2019, the ministry de-criminalised 16 minor procedural/technical lapses under the Act into 'civil wrongs'. RAM ANS

Govt has proposed amendments to companies law, says FM in Budget speech

New Delhi, Feb 4 () Finance Minister Nirmala Sitharaman, who gave the longest-ever Budget Speech, on Tuesday made fun of it saying she wanted to keep it shorter but ended up breaking her own record. Sitharaman had on February 1 given a curtailed 161-minute speech presenting the Budget 2020-21. This bettered the record of the previous longest Budget Speech made by her in July last year. In July presenting her maiden Budget, Sitharaman had spoken for 2 hours 17 minutes. Speaking at an industry event, Sitharaman said, "...not just my speech which was very long and that's the grouse that I am holding up against the ministry. "I keep telling that in each one of them, and as a matter of fact, I have been persistently nagging them to say last year's was long, I want this year to be shorter. But, somebody conspired to say that Haha...No, you will do it longer." The preparation for this Budget was also the longest as it started after the presentation of the last Budget in July. Some of the issues that the government has not been able to overcome in the recent past are the lack of jobs, the escalating rural distress, bone-dry private investment, and falling consumption. It is widely expected that the government will try to revive the economy's animal spirits-- a term used to describe people's level of confidence in the economy-- which will be essential to the lift the growth in Gross Domestic Product (GDP) from the five year low it hit in the January-March 2019 quarter. The right signals <keyword id="6147670" type="UNKNOWN" weightage="20" keywordseo="budget-2019">Budget 2019</keyword> offers an opportunity for the government to inspire confidence among the country's private investors who have shied away from betting their money on the country's economic prospects. That has led to a rise in unemployment as millions of young Indians join the workforce every year and there just aren't enough jobs created. That in turn has affected consumption. The two biggest numbers that are key to deciding the market confidence are the fiscal deficit projection for 2019-20 and the government borrowing programme. Fiscal deficit is the difference between the amount of money the government makes and the amount spent. The government had said in February that in 2018-19, the deficit would be 3.4% of the GDP. The fiscal deficit target for 2019-20 will decide whether the government takes its targets seriously. The excess of expenditure over earnings, the deficit, is met by borrowing money from the market. "From an investor point of view we want RBI, which is adeauately capitalised, and we want an economy which is adequately liquid. Today, apart from liquidity it is also transmission of credit which is also important. Today we have a scenario where PSU banks are not lending because they are not adequately capitalised," Nilesh Shah of Kotak Asset Management told Business Insider. Bank recapitalisation And that is one of the most significant numbers to look forward to in Sitharaman's speech-- the amount of money that the government will invest in state-owned banks that have been squeezed by a pile of bad loans threatening to rise further. In the last financial year ending March, the government invested a total of ₹1 lakh crore, according to Financial Services Secretary Rajiv Kumar in February. Still, there still isn't enough money floating around in the economy. "As a matter of fact if you look at the 50 year chart, the money supply has grown in the last few years at the same rate as it used to grow in the 1960s when the economy used to grow at 3-4%," market veteran Vallabh Bhanshali, Chairman of the Enam Group, told Business Insider. Banks need money (and confidence) to lend more and they are looking towards the government for support. Demands galore Essentially, everyone from the individual taxpayer to different industry segments-- from farmers to industrialists, from manufacturers to retailers, from real estate developers to banks to home buyers, from car makers to car buyers--- needs some kind of government support. Where is the money going to come from? Disinvestment One way of making up for the shortfall is for the government to sell stake, or fully priavatise, in companies that it owns. All eyes are on the hoardes of sick government companies that are sitting on millions of assets that are under-utilised and therefore, the companies are turning in losses for years. The most high-profile of them is Air India. The government has already indicated that it is looking for a strategic private investor in the airline. Government-owned telecom operators BSNL and MTNL are two other companies that have run out of cash even to pay salaries. Spectrum sale The other big source of government revenue is the sale of spectrum, which yields a lot of money. The government would want the upcoming auction of 5G spectrum to be a big money spinner but the bidders, the telecom operators are buried in debt. While the government would want 5G to give impetus to its Digital India programme, the 5G spectrum has to be reasonably priced. The Budget on the whole will be a tightrope walk. Last year proved to be a mixed bag for the Indian currency. After declining by 14% in the year to October, the rupee rebounded strongly in the last few months of 2018 owing to the decline in oil prices, and closed at 69.71. The value of the rupee has significant implications on India’s fiscal deficit and vice versa. When the rupee declines, the fiscal deficit, which measures the difference between government expenditure and revenue, widens because oil becomes more expensive to import. On the other hand, if India’s fiscal deficit widens, it causes foreign investors to lose confidence in the economy and hence they pull money out of the country, which further weakens the currency. With oil prices expected to grow sluggishly in the initial period of year, the rupee is expected to stay weak. However, the unveiling of the Union <keyword id="6358021" type="ORGANIZATION" weightage="20" keywordseo="budget">Budget</keyword> on 1 February by Finance Minister Arun <keyword id="6390789" type="PERSON" weightage="20" keywordseo="jaitley">Jaitley</keyword> could provide markets and currency speculators with some much-needed clarity as to where the rupee will go in 2019. The Budget, which will be an interim budget since it is an election year, will likely include a conclusive statement on whether the central government will breach or meet its fiscal deficit target for the year - which is 3.3% of <keyword id="35050" type="CITY" weightage="20" keywordseo="gdp">GDP</keyword>. The target has looked increasingly unrealistic in recent months, due in part to lower indirect tax collections, a slow disinvestment process and concessions to farmers. While the government has tried to curtail its capital expenditure, this might not be enough. “It will be quite difficult for the government to achieve its target as the fiscal deficit is currently in the region of 3.9% of GDP” says Gaurav Sharma, a senior manager at Religare Securities. Sharma explained that if this came to pass, it “would seriously hurt the rupee”. However, if the government breaches its deficit target, it will exacerbate investor worries, as a high deficit threatens India’s ability to spend for economic growth and increase it’s borrowing cost. There is room for surprise, though. Even if the fiscal deficit is wider, but less than experts’ predictions, it could provide support for the currency. On the other hand, with elections due in May 2019, the government expected to play into the desires of key voter blocs, and as such, could include further promises of loan waivers and additional financial largesse. The central government, for its part, has said that it will meet its fiscal deficit target. It will boost the rural economy in difficult times for agriculture. Overall a very mature and reformist budget,” said Sadaf Sayeed, Chief Executive Officer, Muthoot Microfin Ltd. 
 Jaitley, in his <keyword id="117156" type="UNKNOWN" weightage="20" keywordseo="Budget-speech">budget speech</keyword>, also rolled out several reforms, one of which was PM Jan Aushadhi Yojana, assuring quality medicines at affordable prices.

However, the tourism industry was not that happy with the budget proposals. 
 
Sharat Dhall, President, Yatra.com said, “The much awaited budget has turned out to be very friendly for the Aam Aadmi but there could have been a bit more in it for the corporate sector. The proposal to increase the tax on ATF (Aviation Turbine Fuel) will result in increase in airfares and dampen air passenger growth which could have been a catalyst for economic growth.” 
 
Still, the pitch to revamp roads and airports across the country was lauded, which would connect people to unexplored destinations.
