<keyword id="399907" type="General" weightage="100" keywordseo="meta" source="Orion">Meta</keyword>, a small business operating in the immersive and experiential technology industry since 2010, has filed a lawsuit against Facebook for trademark violation, alleging that <keyword id="6354630" type="General" weightage="50" keywordseo="mark-zuckerberg" source="Orion">Mark Zuckerberg</keyword>'s name change violated its established brand. The installation art company said that for 12 years, it has powered the types of experiences and products that Facebook is now building and has served the same creators and consumers that Facebook is now targeting. META's lawsuit alleged that Facebook unlawfully seized its mark and name -- willfully violating its trademark rights and engaging in egregious acts of unfair competition. "On October 28, 2021, Facebook seized our META mark and name, which we put our blood, sweat, and tears into building for over twelve years," the company said in a post late on Tuesday. "Today, after eight months of trying to negotiate with Facebook in good faith to no avail, we were left with no choice but to file a lawsuit against them." "This case is about ensuring the collective protection of rights to our work, innovation, and intellectual property, which we have devoted our lives to buildinga" as we evolve towards a more equitable digital and social future," said the original Meta. "META has spent 12 years supporting, developing, and protecting the creator community, creators' rights, and ironically, creators' intellectual property," said <keyword id="14503512" type="General" weightage="50" keywordseo="justin-bolognino" source="Orion">Justin Bolognino</keyword>, META's <keyword id="1035155" type="General" weightage="20" keywordseo="founder-ceo" source="Orion">Founder &amp; CEO</keyword>. "Facebook's actions, illegally usurping our name and mark, have not only put our business in jeopardy, but that of the entire industry and the intellectual property rights of the innovators that have helped build it," he alleged. Meta (formerly Facebook) was yet to react to the lawsuit. The complaint alleged that Facebook is now doing exactly what Meta has done for over a decade -- conducting the same immersive experiences, at the same events and venues, and working with the same creators and companies. "As a result of Facebook's actions, consumers are likely to mistakenly believe that Meta's products and services emanate from Facebook or that META is affiliated with Facebook. The Meta mark is now infected by the toxicity that is inextricably linked with Facebook," said the company. <keyword id="14503513" type="General" weightage="50" keywordseo="bolognino" source="Orion">Bolognino</keyword> said that Facebook acts like it can freely destroy the communities Meta has helped develop, overrun the industry, and obliterate its business. It develops immersive technologies including <keyword id="11896065" type="UNKNOWN" weightage="60" keywordseo="vr" source="Orion">VR</keyword> and AR.<a href="https://www.businessinsider.com/facebook-new-name-meta-rebrand-metaverse-zuckerberg-apps-2021-10?r=US&amp;IR=T">Facebook rebranded itself as Meta</a> in October last year, and announced it would be shifting focus to so-called "<keyword id="11121339" type="UNKNOWN" weightage="60" keywordseo="metaverse" source="Orion">metaverse</keyword>" technologies. So far this has included <a href="https://www.businessinsider.com/mark-zuckerberg-demo-cambria-vr-pixelates-out-headset-2022-5?r=US&amp;IR=T">VR</a> and AR technologies.The lawsuit argues Meta's rebrand combined with its metaverse mission has damaged MetaX's business."Meta has been crushed by Facebook's flagrant, unlawful conduct," the company said in its lawsuit.MetaX's founder Justin "JB" Bolognino said in a <a href="https://twitter.com/jbolognino/status/1549432827325865986">statement</a> on Twitter the company put "blood, sweat, and tears" into building its brand, which was "seized" by Meta.MetaX said the rebrand had already led to confusion with consumers, and that one had asked whether one of its products was "a Facebook thing."The lawsuit also says the two companies' logos are "conceptually identical" as they both use symmetrical shapes that resemble the letter "M."MetaX claims Facebook was aware of its existence years before its rebrand to Meta, saying in 2017 Bolognino had an exchange of emails with senior Facebook employees who had seen an experience it had hosted at an event."Facebook and Bolognino then engaged in further discussion about Meta's products and services, leading Facebook to solicit Meta to collaborate with Facebook on future work," the lawsuit says.It adds the two companies pitched a joint project involving augmented reality and AI, but gives no details about what the project was.According to the lawsuit, Bolognino wrote to Meta in December 2021 voicing concerns that the rebrand could harm his business.In a letter attached to the lawsuit as evidence a Meta employee responded to Bolognino saying the two companies provide "drastically different goods and services."The lawsuit says MetaX spent eight months corresponding with Facebook in "good faith" and provided the tech giant with documents pertaining to its trademark rights.MetaX is seeking an injunction to stop Meta from continuing to use the word "Meta" in connection with its business or services as well as monetary damages. It does not specify how much money MetaX is seeking.Meta did not immediately respond when contacted by Insider. Bolognino did not immediately respond when contacted by Insider outside of US working hours.
