In all the twenty-nine states and two union territories on India, the Chief Minister is the head of the elected government. While the constitution of India recognizes the Governor as the de jury head of the state, the de facto executive authority exists with the Chief Minister. General Elections are conducted for the Vidhan Sabha or the State Legislative Assembly and the Governor invites the winning party or the coalition that has got the majority of seats to form the government. During a ceremonial proceeding, the Governor appoints the Chief Minister who takes charge of the State Assembly along with the Council of Ministers. If the Chief Minister can successfully retain the confidence of the Assembly, he or she can last as the executive head of the state for a term of six years in case of Jammu and Kashmir and five years in case of all the other states in India. Here we discuss the powers and role of the Governor of a state in choosing the chief minister of the state. Powers of the Governor In India, the Governor of a state enjoys three kinds of powers namely executive powers, legislative powers and discretionary powers. The Executive powers of the Governor empower him to administrate, appoint and remove. It works as follows. Appointment of the Chief Minister The Constitution of India vests a set of executive powers in the Governor of the State. The Governor appoints the Chief Minister following the general elections. Once the general elections are over for the state assembly, the process of forming the government begins. The Governor invites the person who has the support of the majority of members in the Legislative Assembly to take charge as the Chief Minister. Once the Chief Minister is appointed, the Governor also appoints the Council of Ministers and as per the advice of the Chief Minister, distributes the portfolios to the appointed ministers. The Chief Minister and the Council of Ministers cannot be dismissed as long as they enjoy a majority in the Legislative Assembly. If no party has won the majority seats in the Assembly during the General Elections, the Governor can use his discretionary powers to select a candidate to become the Chief Minister who will have to prove his or her majority at the earliest possibility. The other powers of the Governor The Governor has the power to appoint a large number of top-level officials in the state including the Advocate General, Chairman and Members of the State Public Service Commission, and the State Election Commissioner. The President of India consults the Governor in the appointment of High Court Judges while the Governor appoints the judges of the District Courts himself. Where the powers of the Governor supersede the powers of the Chief Minister The Chief Minister has no powers to advise the Governor on the functions that he exercises under his discretion. Article 192 empowers the Governor to disqualify a given member of the state Legislature if the Election Commission finds that the legislator is not complying with the provisions found in the article 191. Enabled by the powers given to the Governor by Articles 165 and 177, the Governor can depute the Advocate General to watch the proceedings of both the houses of the State’s Legislature and report if there had been any unlawful functioning.

Bengaluru, Oct 23 (IANS) Taking serious exception to the BJP's poll promise in Bihar of providing free Covid vaccine if the party is voted to power, the Congress in Karnataka termed the saffron party as "Opportunist BJP" while the Karnataka BJP countered it by asking the Congress to "remove hate Modi glasses" and know the difference between governance and poll promise. Launching a scathing attack through his Twitter handle, Leader of the Opposition Siddaramaiah said, "Would the state BJP dare to ask the Union government to provide free Covid vaccines for Kanndiagas too?" He also said that Karnataka Chief Minister Yediyurappa won't make such a promise to Kannadigas. Pointing at Union Finance Minister Nirmala Sitharaman, who is a Rajya Sabha member from Karnataka, Siddaramaiah said, "Sitharaman has made it clear that distribution of Covid vaccine entirely depends on the outcome of the Bihar elections. Should the pandemic not be a concern for the Union government? What does PM Narendra Modi have to say about this? Is it vote over health and life for BJP?" Training his guns on the BJP MPs and other leaders from the saffron party, Siddaramaiah said the state has elected 25 BJP MPs and these MPs have no gumption to even make a formal demand to supply free vaccines to Karnataka. Taking pot-shots at the BJP, Karnataka Pradesh Congress Committee President, D.K. Shivakumar demanded that the ruling BJP at the Centre must come out in the open on whether the Union government has started the procurement of vaccines for this disease. "If they have, they could have at least used them to save their own leaders like Union Minister of State for Railways, Suresh Angadi. Union ministers of Sitharaman's stature should not have been part of such politicking," he said while campaigning for the party candidate in R.R. Nagara, which is going to the polls on November 3. Rebutting these allegations, Karnataka BJP too tweeted, saying: "Dear @siddaramaiah If you remove your 'Hate Modi Glasses' and look around, you will see that PM @narendramodi treats all Bharatiyas as equal. The CM H D Kumaraswamy has been exhaustively delaying the process, hanging on to power. BJP President Siddaramaiah had earlier said that the trust vote probably won’t be held today. The assembly has resumed after it was adjourned till 3 pm, with no progress on the much awaited trust vote. Kumaraswamy said today that he will move to the Supreme Court against the vote. Governor Vala had earlier directed the Speaker to hold the trust vote by 1:30 pm today. Also, the Congress state President was seen heading to the Supreme Court, possibly delaying it further. Kumaraswamy said, “It (trust vote) is crucial and cannot be completed by 1:30 pm. This needs to be discussed.” The opposition, BJP, has been alleging that the ruling party is delaying it, as it does not have the requisite majority. They had also staged an overnight protest by ‘sleeping’ in the Assembly. Governor is interfering: Cong JD(S) spokesman Ramesh Babu said that the CM’s counsel will move the Supreme Court today for a stay on the Governor's Thursday’s order asking him to prove majority by the deadline. “The Governor is interfering in the workings of the Legislative Assembly, which is the domain of the Speaker under the provisions of the Constitution,” Babu said. Congress-JD(S) alliance is to petition on the basis that CM Kumaraswamy had moved the confidence motion in the house on Thursday and the debate had started and so setting a deadline should be stayed by the court. In the meanwhile, one of the Congress MLAs Shreemant Patil is admitted in a hospital in Mumbai, after he complained of chest pains. Yesterday, Congress alleged that BJP has kidnapped them. Delayed Trust The trust vote which was supposed to happen yesterday, was relentlessly delayed by the ruling Congress-JD(S) coalition which might be facing an end of its run. Kumaraswamy will have to prove that his government has majority to carry on, as MLAs have been leaving his fold. BJP party members had staged an overnight dharna or protest over the delay of trust vote. Accusations, speeches and allegations between both Congress and BJP managed to delay the vote, yesterday. Finally, the state’s Governor wrote a letter to CM Kumaraswamy regarding the trust vote after senior BJP MLAs met him at the Raj Bhawan. The case of a kidnapped legislator Yesterday, the Speaker had refused to conduct the trust vote amid allegations by the Congress against the BJP for kidnapping its MLA Shreemant Patil, who had decided to take his resignation back. Speaker Ramesh Kumar had asked home minister MB Patil to give a detailed report of Shreemant after talking to his family. The Speaker said that he had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. The house was disrupted throughout the day on the issue of trust vote and when it was finally adjourned till today, BJP announced a night long strike in the assembly itself till the voting was not done. “We are demanding voting on the motion but the chief minister is reluctant to take it up as he has confirmed himself that he has lost confidence of the House and the people. Everybody knows Congress-JD(S) coalition has only 98 MLAs, we have 105,” said B S Yeddyurappa, BJP party president. Crisis mode The Karnataka state government went into a crisis mode earlier this month, after 16 of its MLAs from both the parties of the coalition government resigned. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs, Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, a few days back.

Karnataka Governor sets another deadline at 6 pm for Kumaraswamy to prove majority

NEW DELHI: For the first time in the 2014 Lok Sabha elections, a poll on Monday predicted a clear majority for any pre-poll alliance with NDTV projecting that NDA would get 275 seats in the 543-member House. This is 16 seats more than the poll had predicted last month. 
 BJP on its own would win 226 seats — the highest tally ever for the party and the best by any party since 1991, the poll done by Hansa Research estimated. UPA would win just 111 seats, with <keyword id="1575" type="ORGANIZATION" weightage="60" keywordseo="Congress">Congress</keyword> sinking to its lowest-ever tally of 92 seats, it said. 
 NDA’s projected win is based on impressive gains over 2009 in UP (an increase of 41 seats), Maharashtra (17), Rajasthan (17), Bihar (12), <keyword id="37102" type="COMPANY" weightage="40" keywordseo="Andhra-Pradesh">Andhra Pradesh</keyword> (12) and Madhya Pradesh (10). In these six states, it stands to gain 109 seats. In most other states too, NDA is projected to gain, though by more modest numbers. 
 
‘TMC will be largest party after BJP, Cong’ 
 The only major states in which the NDA could do worse than five years ago are Karnataka (a loss of seven seats), Chhattisgarh (two) and <keyword id="6357783" type="CITY" weightage="40" keywordseo="West-Bengal">West Bengal</keyword> (one), according to the latest NDTV poll. 
 
In contrast, the UPA is predicted to lose seats vis-a-vis 2009 in almost every major state, with Andhra Pradesh being the worst case, where the Congress tally could drop from 33 five years ago to just six this time. 
 
Barring Karnataka and Chhattisgarh, the only states where the UPA stands to gain are Assam (a gain of two seats) and Bihar, where a gain of six is really only because RJD is now part of the alliance, unlike in 2009. 
 The largest parties after BJP and Congress would be Trinamool with 30 seats, AIADMK with 22, SP with 14 and BJD with 13. DMK, with its allies, is likely to win 14 seats and the Left 22. <keyword id="6356115" type="CITY" weightage="40" keywordseo="AAP">AAP</keyword> is projected to win just one seat in Delhi and none elsewhere, at least in the states for which details were available, which included all those with seven seats or more. 
 None of these parties, however, will be of much significance if the poll’s predictions come true, since the NDA will not need any post-poll allies to form the government and anoint Modi the <keyword id="71" type="POSITION" weightage="40" keywordseo="Prime-Minister">prime minister</keyword>.
