It is there to be inspected by lawyers for The New York Times. By the order of a federal judge, the lawyers can only get into the room if they show a government-issued ID to a security guard. They are forbidden from bringing in their own phones, flash drives, or any other electronic devices. They're given a computer — also unconnected from the internet — with a word processing program. After each session, their notes can be downloaded to a different computer, and then the original note-taking computer may be wiped. The Times' lawyers can share their notes with up to five outside consultants to help them understand what the code does. If one of the lawyers wants to show <keyword id="19918823" type="General" weightage="20" keywordseo="openai" source="keywords">OpenAI</keyword> CEO <a target="_blank" href="https://www.businessinsider.com/sam-altman-chatgpt-openai-ceo-career-net-worth-ycombinator-prepper-2023-1">Sam Altman</a> a snippet of the code to ask him questions about it for a deposition, that copy will be destroyed afterward. <a target="_blank" href="https://www.businessinsider.com/openai-valuation-funding-ai-race-competition-2024-10">OpenAI is worth $157 billion</a> largely because of the success of ChatGPT. But to build the chatbot, the company trained its models on vast quantities of text it didn't pay a penny for. That text includes stories from The New York Times, articles from other publications, and an untold number of copyrighted books. The examination of the code for ChatGPT, as well as for <keyword id="19895622" type="General" weightage="20" keywordseo="microsoft" source="keywords">Microsoft</keyword>'s artificial intelligence models built using OpenAI's technology, is crucial for <a target="_blank" href="https://www.businessinsider.com/nyt-sues-open-ai-microsoft-alleging-trained-chatgpt-off-content-2023-12">the copyright infringement lawsuits against the two companies</a>. Publishers and artists have filed about two dozen major copyright lawsuits against generative AI companies. They are out for blood, demanding a slice of the economic pie that made OpenAI the <a target="_blank" href="https://www.businessinsider.com/openai-rivals-anthropic-perplexity-on-prowl-after-wave-exec-departures-2024-10">dominant player</a> in the industry and which pushed Microsoft's valuation beyond $3 trillion. Judges deciding those cases may carve out the legal parameters for how <a target="_blank" href="https://www.businessinsider.com/chatgpt-openai-ai-dictionary-help-understand-nvidia-2023-12">large language models</a> are trained in the US. "Developers should pay for the valuable publisher content that is used to create and operate their products," a Times spokesperson told BI. "The future success of this technology need not come at the expense of journalistic institutions." For the lawsuit, the Times employed an elite law firm, Susman Godfrey, which recently won <a target="_blank" href="https://www.businessinsider.com/dominion-fox-news-settlement-takeaways-what-happens-next-2023-4">Dominion's mammoth $787.5 million settlement from Fox News</a>. Other lawsuits from newsrooms, including The New York Daily News and Mother Jones, have latched on to the case. Susman Godfrey is also representing a group of authors including George RR Martin, Jodi Picoult, and Jia Tolentino, who filed copyright claims months before the Times. If a judge certifies their class-action status, an eventual settlement or judgment could have ramifications for virtually every author and artist whose work has been used to train AI models. On September 12, dozens of lawyers from the tech and journalism companies packed into a magistrate judge's courtroom in lower Manhattan to figure out the best way to divvy up the discovery process, including inspecting ChatGPT's code and training data. Along with the authors' lawyers, they are still deciding who they can depose and how to schedule the depositions. "It's as thrilling as things get for law professors who work in copyright," said Kristelia García, an intellectual property law professor at Georgetown University Law. <h2>Setting the rules</h2>With <a target="_blank" href="https://www.businessinsider.com/ai-regulations-what-lawmakers-president-are-doing-2024-4">Congress taking a backseat on AI regulation</a>, the industry expects courts to set — <a target="_blank" href="https://www.businessinsider.com/music-labels-still-sue-internet-providers-warning-ai-openai-2024-2">or, they hope, not set</a> — the rules. Many publishers, <a target="_blank" href="https://www.businessinsider.com/openai-news-partnerships-media-future-le-monde-prisa-axel-springer-2024-3">including Business Insider owner Axel Springer</a>, have struck deals with generative AI companies to share their content for LLM training. The scope and resources of the Times' lawsuit make it a likely candidate for a precedent-setting Supreme Court. Lawyers are also looking at class action lawsuits from authors, as well a music industry case against Anthropic, as ones to watch. "The New York Times is a journalistic juggernaut," García said. "It's big, it has a lot of content. More importantly, perhaps, it has a lot of market power behind that content." The lawsuit argues OpenAI infringed on its intellectual property in two ways. There is the "input" case — alleging that the LLM illegally hoovered up over 10 million New York Times articles to train ChatGPT and Microsoft Copilot without compensation. And the "output" case — arguing that when asked, ChatGPT can spit out a New York Times article that readers would otherwise pay a subscription for. In court filings, lawyers have repeatedly cited <keyword id="23582967" type="General" weightage="20" keywordseo="napster" source="keywords">Napster</keyword>, which illegally copied millions of songs and made them available for free. OpenAI similarly used high-quality, well-researched, well-written, and fact-based New York Times articles to make ChatGPT so impressive, the Times argues. If anything, OpenAI is worse, according to Justin Nelson, a Susman Godfrey attorney representing authors in a class action lawsuit running parallel to Times' case and in a similar case against Anthropic. Napster was a project from college kids; OpenAI is backed by Microsoft and already worth billions. "Instead of kids, it was a sophisticated company," Nelson told BI. "And instead of doing it for their own personal use, they were doing it for commercial gain. Representatives for OpenAI and Microsoft didn't respond to requests for comment from Business Insider. In court, they argue the legal doctrine of "fair use" protects how their models ingest the articles. The ChatGPT outputs with near-verbatim copies of Times articles were "highly anomalous" <a target="_blank" href="https://www.businessinsider.com/openai-accuses-new-york-times-hiring-someone-hack-its-products-2024-2">results that aren't representative</a> of how the app is used, they say. Napster was sued out of existence, but it inspired the music industry to adopt MP3s and, eventually, streaming — now used for everything from video games to movies. <a target="_blank" href="https://www.forbes.com/sites/stevenbertoni/2012/01/04/spotifys-daniel-ek-the-most-important-man-in-music/">Spotify cofounder Daniel Ek has cited Napster as an inspiration</a>, and <a target="_blank" href="https://genius.com/Sean-parker-sean-parker-s-email-to-spotifys-daniel-ek-annotated">Napster cofounder Sean Parker has praised Spotify as a successor</a>. Copyright lawsuits from journalism organizations may set the pace for all AI generators, predicted García, who worked in the music industry for a decade. AI isn't particularly good at generating movies or doing reporting, but it can convincingly mimic journalism. "Journalism is kind of the canary in the coal mine," García said. "In the same way that music was the canary back in the Napster days, because people could easily torrent an MP3. But you couldn't, at that time, easily torrent a film." Given the sheer number of people involved, the authors' lawsuits could have an even more dramatic effect. A settlement or judgment could change business models. "People get creative in class action settlements," said Matthew Sag, an Emory University law professor studying copyright law and artificial intelligence. "You could cut the authors of America in for a percentage of stock or something." <h2>The source code</h2>The nature of generative AI technology itself lies at the heart of the copyright disputes. <a target="_blank" href="https://papers.ssrn.com/sol3/papers.cfm?abstract_id=4803118">What actually happens</a> when a large language model "learns" a book or news article? What about when ChatGPT digs through the model to answer a query? Does the process make a "copy" in any meaningful sense of the word? Or is the training data just part of a big <a target="_blank" href="https://www.businessinsider.com/openai-destroyed-ai-training-datasets-lawsuit-authors-books-copyright-2024-5">slurry of ones and zeros</a> that no longer meaningfully resemble specific works? The lawyers and consultants poring through ChatGPT's code are trying to answer those questions. They are also examining the LLM training data and plan to ask key OpenAI executives and programmers — under oath — how the models are meant to work. Once the code is read and depositions taken, the parties will be in a better position to argue about "fair use," a notoriously tricky legal doctrine that protects the use of "transformative" creations derived from copyrighted material. If OpenAI really is making copies of books and news articles, Napster-style, then is its training process sufficiently transformative to be considered "fair use"? Judges across the country are "all over the map" in deciding fair use copyright cases, according to Christa Laser, an intellectual property law professor at Cleveland State University, setting up high and unpredictable stakes. "I think that's going to be the big question at the end of the day that's going to go all the way up to the Supreme Court," Laser told BI. "That question of fair use around training data, ingesting and training." A key "fair use" question is whether ChatGPT's creations compete with the original journalistic works — an urgent issue for news organizations. "The news publishers are the first to bring these big suits because they have more on the line," García said. To make a copyright claim, a plaintiff can't just point to a corpus of work used as inspiration. It needs to point to a specific work they say has been copied. In its lawsuit, The New York Times attached tens of thousands of pages of exhibits tabulating 10,553,897 articles. It says OpenAI and Microsoft illegally violated the copyrights for each of them. <a target="_blank" href="https://www.courtlistener.com/docket/68117049/1/52/the-new-york-times-company-v-microsoft-corporation/">Among those articles</a> is <a target="_blank" href="https://www.nytimes.com/2001/02/13/business/napster-decision-reaction-napster-users-make-plans-for-day-free-music-dies.html">a 2001 story</a>, shortly after an appellate court ruled against Napster, where a journalist asked users about what they'd do. They all agreed there was no going back. ''If Napster does shut down, there are more sites out there,'' one user told the reporter. ''And they may get a few, but they can't stop all of them.'' "The core committee (of the state unit) has met in Mumbai to delegate all decision-making powers concerning seat-sharing and the selection of assembly constituencies to Fadnavis," he said. Party observer and Union minister Bhupender Yadav, BJP national secretary Vinod Tawde, Union minister and Mumbai North MP Piyush Goyal also attended the meeting. Of the 288 assembly seats in Maharashtra, the BJP won 104 in 2019. Shelar confirmed finalisation of the "formula for winning, besides the planning and seat-sharing arrangements with the allies". "Fadnavis has been granted full authority in this regard," he said. The BJP-led Mahayuti, also comprising Chief Minister Eknath Shinde's Shiv Sena and the NCP headed by Ajit Pawar, won only 17 of the 48 Lok Sabha seats in the state in the recent parliamentary polls. The BJP's tally came down to 9 from 23 five years ago. The Maha Vikas Aghadi, consisting of the Congress, Shiv Sena (UBT) and NCP (SP), bagged 30 seats. Shelar said, "We have decided to save time by streamlining the planning, discussions, and decision-making processes with all the NDA constituents to finalise the candidates. Once this is done, we can begin preparations for the assembly polls. The list of candidates will be released at the appropriate time." After the BJP's Lok Sabha tally came down to 9 in Maharashtra, Fadnavis had offered to quit the deputy CM's post to enable him to focus on party work ahead of assembly elections. Several opposition leaders, including Rahul Gandhi and Akhilesh Yadav, congratulated Birla too, stressing on "impartiality" and hoping he would allow them to raise the voice of the people and not apply his restraint orders only to opposition benches. Pro-tem Speaker Bhartruhari Mahtab made the announcement of Birla's election after the opposition, which had forwarded the the name of eight-term Congress MP Kodikunnil Suresh as its candidate, did not press for votes to the motion. This is the fifth time that a speaker will serve beyond the tenure of one Lok Sabha. It is also amongst the few occasions that an election became necessary for a post conventionally decided by consensus. As he assumed charge, Birla read out a resolution condemning the Emergency imposed by then prime minister Indira Gandhi in 1975 and asked members to observe a moment's silence, triggering a wave of protests by the opposition. The prime minister emphasised that the functioning of the house, conduct and accountability deepen the foundation of <keyword id="19973112" type="General" weightage="20" keywordseo="democracy" source="keywords">democracy</keyword> in the country. Congratulating Birla, Gandhi said the opposition wanted the House to function "often and well" and added that it was very important that cooperation happens with trust. "The opposition would like to assist you in your work. I am confident you will allow us to speak in the House," he said. Gandhi also pointed out that the opposition this time represents significantly more voices of the Indian people than last time. Samajwadi Party chief Yadav hoped that actions like suspension of MPs would not be taken as they hurt the dignity of the House. He said he also hoped Birla would be impartial towards the opposition and give its leaders equal opportunities. Trinamool Congress leader Sudip Bandyopadhyay and DMK leader T R Baalu echoed the sentiment. Bandyopadhyay said the functioning of the House always depends on the attitude of the treasury benches. "It is my firm belief and so far parliamentary democratic practice is concerned, the House belongs to the opposition," he said. He referred to the suspension of opposition MPs in the 17th Lok Sabha and said it was "not desirable". "You might have been elected by my BJP friends (but) hereafter there is no politics between you and the powers... You have to treat the opposition and the ruling party in the same manner. Kindly be impartial," added Baalu. Birla, 61, the BJP's MP from Kota, has risen through the ranks of the party. He is a third-term MP from Kota in Rajasthan and been a member of the Rajasthan Legislative Assembly thrice. "Treasury and opposition benches run the House together, the strength of Indian democracy is in listening to everyone, and running the House with everyone's agreement. I will expect that I run the House with everyone's agreement. Even if there is lone member from a party, they should get sufficient time," Birla said. "It will be my expectation that the House runs without obstruction. We are elected by people with hope, which is why I urge there should not be disruptions in the House." There can be criticism, but obstruction is not a tradition of the House, Birla said. "I never want to act against any member, but everyone wants the high standard of parliamentary tradition to be maintained. For that I have to make tough decisions at times," the speaker said. During the course of the proceedings, Birla intervened several times, reminding members to be precise and raise issues they wanted to during the debate on the motion of thanks to the president's address. He said the members should remember for the next five years that others should take their seat when the speaker is standing, Union Minister and LJP (Ram Vilas) leader Chirag Paswan took a jibe at the opposition for forcing an election for the speaker's post. In many opposition ruled states, he said, the post of both speaker and deputy speaker in the assembly is held by the ruling party. Birla's election follows a rare showdown by both the ruling alliance and the opposition bloc after the effort for a consensus was failed. The opposition's last-minute decision to go for a contest came after senior BJP leaders did not agree to the precondition that the INDIA bloc must be offered the post of deputy speaker in lieu of supporting Birla. "INDIA parties exercised their democratic right and moved motions in support of Kodikunnil Suresh as <keyword id="19990696" type="General" weightage="20" keywordseo="Lok-Sabha-speaker" source="keywords">Lok Sabha Speaker</keyword>... Voice Vote was taken. Thereafter, INDIA parties could have insisted on division. They did not do so. "This is because they wanted to a spirit of consensus and cooperation to prevail, a spirit singularly lacking in the actions of the PM and the NDA," Congress leader Jairam Ramesh said in a post on X. With the NDA having 293 MPs in its kitty and the INDIA bloc 233 in the Lok Sabha, the numbers were clearly in favour of Birla. The Lok Sabha currently has 542 members after Rahul Gandhi resigned from one of the two seats he was elected from. At least three independent members also support the opposition. Balram Jakhar is the only presiding officer to have served two complete terms extending seventh and eighth Lok Sabha.

New Delhi, The BJP, the biggest beneficiary of electoral bonds with donations worth over Rs 6,000 crore in the last four years of the scheme, got funds from several corporates and individuals, including Megha Engineering, Future Gaming, and Reliance-linked <keyword id="21044437" type="General" weightage="20" keywordseo="qwik-supply" source="keywords">Qwik Supply</keyword>. Hyderabad-based Megha Engineering, which won several contracts for infrastructure projects, donated Rs 584 crore to the BJP, <keyword id="21047704" type="General" weightage="20" keywordseo="qwik-supply-rs" source="keywords">Qwik Supply Rs</keyword> 395 crore, and Future Gaming Rs 100 crore, according to data released by the Election Commission on Thursday. The BJP also got Rs 346 crore from Keventers Food Park, MKJ Enterprises and Madanlal Ltd -- three firms with the same <keyword id="19896626" type="General" weightage="20" keywordseo="kolkata" source="keywords">Kolkata</keyword> address, Vedanata contributed Rs 226 crore, and Haldia Energy Rs 81 crore. <keyword id="19919721" type="General" weightage="20" keywordseo="vedanta" source="keywords">Vedanta</keyword> was also a key contributor to the Congress with donations worth Rs 125 crore. The opposition party also received funds from <keyword id="21047706" type="General" weightage="20" keywordseo="western-up-power-and-transmission" source="keywords">Western UP Power and Transmission</keyword>, MKJ Enterprises and Yashoda Super Speciality Hospitals. The BJP also got donations worth Rs 80 crore from <keyword id="21047705" type="General" weightage="20" keywordseo="western-up-power-and-transmission-company" source="keywords">Western UP Power and Transmission Company</keyword>, and Rs 42 crore from Welspun. Industrialist Lakshmi Mittal donated Rs 35 crore to the BJP in individual capacity, while several other individuals donated funds in the range of Rs 10-25 crore to the ruling party. The Election Commission made public a fresh data set of electoral bonds, including their alpha-numeric numbers that can help match their purchasers with the political parties that received the funds. Two separate lists of the donors and the recipients were published by the poll panel on its website after the details were submitted to it by the State Bank of India earlier in the day as per a Supreme Court order.

According to sources, Ashok Chavan is likely to be BJP's Rajya Sabha candidate from Maharashtra putting Congress in a tight spot. Ashok Chavan resgined from the primary membership of the Congress party on Monday. Chavan submitted his resignation to Maharashtra Pradesh Congress Committee President Nana Patole. "I have resigned from the Assembly membership as an MLA. I have given my resignation to the Speaker. I have resigned from the Congress Working Committee and the Congress primary membership," Chavan told reporters after resigning from Congress on Monday. Ashok Chavan was the Vice President and General Secretary of the Maharashtra Pradesh Youth Congress Committee from 1986 to 1995. He served the Maharashtra Legislative Assembly for three terms, starting in 1999 and ending in May 2014. He served as the Chief Minister of Maharashtra State from December 8, 2008, to November 9, 2010. On November 9, 2010, the Congress Party asked him to resign from office over corruption allegations relating to the Adarsh Housing Society scam. In the 2014 general elections, Chavan was elected from the Nanded constituency but lost the seat in 2019 Pratap Patil Chikhalikar of the BJP. New Delhi, The <keyword id="19914482" type="General" weightage="20" keywordseo="aap" source="keywords">AAP</keyword> on Friday claimed the CBI is planning to arrest Delhi Chief Minister Arvind <keyword id="19895701" type="General" weightage="20" keywordseo="kejriwal" source="keywords">Kejriwal</keyword> in the next few days and will serve him a notice by the evening. While the party did not say in which case Kejriwal is likely to be arrested, it said that this was being done to prevent the AAP from stitching an alliance with the Congress for the upcoming Lok Sabha elections as the <keyword id="19894848" type="General" weightage="20" keywordseo="bjp" source="keywords">BJP</keyword> is scared of the two parties coming together. While there was no immediate response from the Central Bureau of Investigation (CBI) to the AAP's claims, the BJP said AAP leaders are trying to create confusion and generate sympathy for Kejriwal. The Congress and the AAP are likely to have a seat-sharing pact in Delhi, Gujarat and Haryana for the Lok Sabha polls and the talks between the two sides are in the final stages, sources said on Thursday. Addressing a press conference here, Delhi cabinet minister and senior AAP leader <keyword id="19945966" type="General" weightage="20" keywordseo="saurabh-bharadwaj" source="keywords">Saurabh Bharadwaj</keyword> said as soon as reports of finalisation of seat-sharing talks between the Congress and the AAP started coming in, the ED sent a seventh summons to Kejriwal in the excise policy case. "We have learnt from reliable sources that the CBI is planning to arrest Kejriwal. The CBI will also serve a notice to Kejriwal either this afternoon or by the evening," Bharadwaj said. Kejriwal will be arrested in the next two to three days, he said. "We are getting messages that if the AAP-Congress alliance is formed, Arvind Kejriwal will be arrested. The BJP is scared of the AAP-Congress alliance. You can arrest Kejriwal if you want, but the alliance will be forged," he said. The Enforcement Directorate has issued a fresh summons to Kejriwal asking him to appear before it for questioning in the Delhi excise policy-linked money laundering case on February 26, sources said on Thursday. This is the seventh summons issued by the ED to the chief minister, who skipped the previous six. AAP Rajya Sabha MP Sandeep Pathak said people will take to the streets if Kejriwal is arrested. "There will be a tsunami. Their (BJP) political calculations will go wrong. We are not scared of being arrested. We are forging this alliance for the country," he said. Delhi BJP president <keyword id="20040814" type="General" weightage="20" keywordseo="virendra-sachdeva" source="keywords">Virendra Sachdeva</keyword> said Kejriwal knows that the talks on the AAP's alliance with the Congress are failing but AAP leaders have been spreading rumours since Thursday and are trying to generate sympathy for the chief minister. "Kejriwal may delay his punishment with the help of lawyers but ultimately, the people of Delhi will punish him harshly in the coming elections," the BJP leader said. The AAP and Kejriwal should remember that Congress leader Ajay Maken had submitted the first written complaint to the lieutenant governor regarding the liquor "scam" under his government, Sachdeva said. The BJP won all the seven seats in Delhi with 51 per cent votes in the 2014 Lok Sabha polls and 59 per cent in 2019. In the 2024 Lok Sabha elections, the people of Delhi will give 70 per cent votes to the BJP, he asserted.
