<ul><li><keyword id="6357886" type="General" weightage="20" keywordseo="phonepe" source="Orion">PhonePe</keyword> claims that ‘<keyword id="46876" type="General" weightage="20" keywordseo="pe" source="Orion">Pe</keyword>’ is a distinctive part of their name and <keyword id="7349800" type="General" weightage="20" keywordseo="bharatpe" source="Orion">BharatPe</keyword>’s usage of the term is an infringement.</li><li>PhonePe has three lawsuits against BharatPe over this issue in the Delhi as well as Bombay High Courts.</li><li>Recently, the Bombay High Court rejected its claim saying PhonePe does not have a separate registration for ‘Pe’.</li></ul>The battle for the ‘Pe’ suffix is intensifying and has now compelled BharatPe to approach the Delhi High Court to cancel PhonePe’s trademark over the word. The issue gained prominence after BharatPe launched its ‘buy now pay later’ offering PostPe a month back. PhonePe believes that ‘PostPe’ has a striking resemblance to their brand name and decided to take the legal route in the first place. The company in its plea also claimed that the word ‘Phone’ is not a “unique” or “distinctive” part of its name, the word ‘Pe’ is. Therefore, BharatPe’s use of the word ‘Pe’ is an infringement. Walmart-owned PhonePe approached the Bombay high court to sort out this issue. However, the Bombay high court — in a court order dated October 22 — noted that PhonePe cannot claim exclusivity over the ‘Pe’ suffix as they don’t have a separate registration for it. PhonePe decided to withdraw the injunction post the order to address certain observations made by the court. BharatPe then said that by withdrawing the suit, PhonePe has given up its claim for exclusivity over ‘Pe’. However, PhonePe mentioned they intend to file a follow up suit regarding the same. Now in its plea to the Delhi high court, BharatPe has sought scrapping of multiple registrations held by PhonePe over the ‘Pe’ device mark in the Devanagari script. “By taking on a trademark for the “Pe” device mark in Devanagari Script in classes relating to payment services in a country like India, where Hindi is the primary language of the masses, PhonePe has acted against the larger public interest, and Resilient [BharatPe’s registered name] is committed to undoing this,” BharatPe’s spokesperson said. However, the Delhi high court too <a href="https://entrackr.com/2021/04/delhi-hc-rejects-phonepes-plea-against-bharatpe-over-use-of-pe/">rejected</a> their claim in April this year, citing insufficient evidence. “The evidence presently at hand is insufficient to come to a definitive conclusion that the “Pe” suffix would, in the public consciousness, indelibly be associated with the plaintiff’s services,” Justice Shankar said. The issue between the two companies has been going on since 2018, after the launch of BharatPe. PhonePe had sent its first legal notice to BharatPe in August 2018 over the removal of the suffix in question. In response, BharatPe changed its logo and colour scheme. Has the legal battle between PhonePe and BharatPe over ‘Pe’ been going on for too long?

New Delhi, Leading fintech platform <keyword id="7349800" type="General" weightage="80" keywordseo="bharatpe" source="Orion">BharatPe</keyword> on Thursday said it has initiated criminal and civil proceedings against its former Co-Founder and Managing Director, <keyword id="2988161" type="General" weightage="80" keywordseo="ashneer-grover" source="Orion">Ashneer Grover</keyword>, his wife <keyword id="13057738" type="General" weightage="50" keywordseo="madhuri-jain-grover" source="Orion">Madhuri Jain Grover</keyword> and their relatives over huge misappropriation of company funds. According to reliable sources, the company has asked Grovers to repay company funds to the tune of Rs 88.6 crore with 18 per cent interest which they swindled via various modes like creating fictitious bills, inflated vendor payments and personal use, among others. "BharatPe has initiated civil and criminal action against erstwhile Co-Founder and Managing Director, Ashneer <keyword id="3433" type="General" weightage="100" keywordseo="grover" source="Orion">Grover</keyword>, former Head of Controls, <keyword id="10739150" type="General" weightage="80" keywordseo="madhuri-jain" source="Orion">Madhuri Jain</keyword> Grover, and other connected parties of their family for various claims, including misappropriation of company funds," a company spokesperson told IANS. "We have full faith in the courts and authorities and are confident that justice will be done. As the matter is sub judice, we have no further comment to offer at this stage," the spokesperson added. While the criminal case has been filed with the Economic Offences Wing (EOW) in New Delhi, the Delhi High Court is currently hearing the civil case where the company has asked Grovers to repay company funds they allegedly misappropriated via various means. The other parties in the BharatPe lawsuit are Deepak Jagdishram Gupta, who is Madhuri Jain's brother-in-law and worked as admin head and reported to Madhuri Jain. According to earlier reports, Madhuri Jain herself received invoices for payments and forwarded them to the accounts team. These invoices were allegedly created by Shwetank Jain, who is her brother and has also been named in the lawsuit. According to BharatPe, Grover, his wife and their relatives were engaged in extensive misappropriation of funds and grossly abused company money "to fund their lavish lifestyles". "The Grover family and their relatives engaged in extensive misappropriation of company funds, including, but not limited to, creating fake vendors through which they siphoned money away from the company's expense account and grossly abused company expense accounts in order to enrich themselves and fund their lavish lifestyles," the company had said in an earlier statement. BharatPe had sacked Madhuri Jain over allegations of financial irregularities during her tenure at the company as head of controls. On the other hand, Grover decided to quit himself. Suresh Jain, who is Madhuri's father, has also been named in BharatPe complaint, according to sources. According to sources, the Grovers allegedly spent company money on expensive business class tickets for the entire family for vacationing abroad via first-class air travel, beauty/skin treatments, buying electronic items, providing house staff salaries (driver/maids), 5-star dinners, etc. Ashneer has written his memoir called 'Doglapan' (double standards)-the Hard Truth about Life and Start-ups' which will be available this month. Malaviya, who has been President and Chief Operating Officer (COO) of the publisher's American division Penguin <keyword id="191608" type="General" weightage="100" keywordseo="random-house" source="Orion">Random House</keyword> US since 2019, will assume the role of Interim CEO of Penguin Random House starting January 1, 2023, the publisher's parent company Bertelsmann said in a statement Friday. Malaviya, who will report to Bertelsmann CEO <keyword id="3029301" type="General" weightage="50" keywordseo="thomas-rabe" source="Orion">Thomas Rabe</keyword>, will join the Bertelsmann's Group Management Committee (GMC), as well as continue to be a member of the Penguin Random House Global Executive Committee. "Following Malaviya's appointment, the GMC will comprise 20 top executives of eight different nationalities," the statement said. As interim CEO of Penguin Random House, Malaviya will "lead the creation of new competitive advantages that position the global company for future growth," the statement said. In his capacity as President and COO, Malaviya, 48, was responsible for all publishing operations in the US from supply chain to technology and data and client services. Dohle is stepping down as CEO at the end of 2022, and simultaneously resigning his seat on the Bertelsmann Executive Board, "at his own request and on the best of mutual terms," Bertelsmann said. Dohle said in the statement that after nearly 15 years on the Executive Board of Bertelsmann and at the helm of the global publishing business, he has decided to hand over the next chapter of Penguin Random House to new leadership, following the antitrust decision in the US against the merger of Penguin Random House and Simon &amp; Schuster. In late October this year, the US District Court for the District of Columbia ruled in favour of the Justice Department in its civil antitrust lawsuit to block Penguin Random House's proposed USD 2.2 billion acquisition of Simon &amp; Schuster. The court had found that the effect of the proposed merger would be to substantially lessen competition in the market for the US publishing rights to anticipated top-selling books. Assistant Attorney General Jonathan Kanter of the Justice Department's Antitrust Division had said that the decision protected vital competition for books and was a victory for authors, readers, and the free exchange of ideas. "The proposed merger would have reduced competition, decreased author compensation, diminished the breadth, depth, and diversity of our stories and ideas, and ultimately impoverished our democracy," Kanter had said. Since 2014, Malaviya had the responsibility for all publishing operations in the US from the supply chain to technology and data and client services. He is a member of the Penguin Random House Global Executive Committee and leads the creation of new competitive advantages that position the global company for future growth. Malaviya began his career at Bertelsmann in 2001 as a participant in the Bertelsmann Entrepreneurs Programme. In 2003, he moved within the group to Random House, successfully taking on a number of leadership positions. Malaviya is a two-time recipient of the Bertelsmann Entrepreneur Award for Strategy Execution and serves on the Bertelsmann Technology and Data Advisory Board. He holds an MBA in Finance and Marketing from the NYU Stern School of Business, as well as a Bachelor of Science in Computer Science. Malaviya is also a member of the board of Yale University Press. Rabe described Malaviya as an "outstanding leader and an entrepreneurial publishing professional who knows Penguin Random House inside out.
