<ul><li>In order to meet the objectives, the <keyword id="6364876" type="General" weightage="50" keywordseo="bar-council-of-india" source="Orion">Bar Council of India</keyword> Rules for registration of foreign lawyers and foreign Law Firms in <keyword id="3658" type="General" weightage="100" keywordseo="india" source="Orion">India</keyword> has been framed.</li><li>The Bar Council of India stated that the standards of Indian lawyers in proficiency in law are comparable with international standards.</li><li>Hence, the legal fraternity in India is not likely to suffer any disadvantage in case law practice in India is opened up to foreign lawyers.</li></ul> The Bar Council of India(BCI) has allowed foreign lawyers and law firms to practice foreign law and diverse international law and international arbitration matters in India. The council said, "Taking an all-inclusive view, the Bar Council of India resolves to implement rules enabling the foreign lawyers and Foreign Law Firms to practice foreign law and diverse international law and international arbitration matters in India on the principle of reciprocity in a well defined, regulated and controlled manner." In order to meet the objectives, the Bar Council of India has framed the Bar Council of India Rules for registration of foreign lawyers and foreign Law Firms in India, 2021 under its rule-making powers under clauses (d), (e), (ic), (1) and (m) of sub-section (1) of section 7 and clauses (ah), (ag), (c), (e) and (h) of sub-section (1) of section 49 read with sections 24, 29 and 47 of the Advocates Act, 1961 and under all other enabling provisions. Bar Council of India is of the view that opening up a law practice in India to foreign lawyers in the field of practice of foreign law; diverse international legal issues in non-litigious matters and in international arbitration cases would go a long way in helping the legal profession/ domain grow in India to the benefit of lawyers in India too, the council said. Bar Council of India stated that the standards of Indian lawyers in proficiency in law are comparable with the international standards and the legal fraternity in India is not likely to suffer any disadvantage in case law practice in India is opened up to foreign lawyers in a restricted and well-controlled and regulated manner on the principle of reciprocity as it would be mutually beneficial for lawyers from India and abroad and these Rules are an attempt by the Bar Council of India in this direction. These rules will also help to address the concerns expressed about the flow of Foreign Direct Investment in the country and making India a hub of <keyword id="4446295" type="General" weightage="50" keywordseo="international-commercial-arbitration" source="Orion">International Commercial Arbitration</keyword>. In case, we sleep over the matter, the legal fraternity of India may be left behind in providing legal/professional expertise in accordance with the rule of law in a manner consistent with the best interests of this fast-growing class of clients in India, it said. Let us ensure that an opportunity for creating development and growth for the legal profession and in the legal sphere in India is not lost, stated BCI. Many countries have already allowed foreign lawyers to practice foreign law and diverse international legal issues and arbitration matters in their countries in restricted fields with specific and prescribed conditions, BCI notification said. Further, the notification stated, "It is also to be noted that the Bar Council of India is keen to progress on the idea of an MoU between the Bar Council of India, the Government of India (through Ministry of Law and Justice ) on one part and the Law Society of England and Wales, Government of U.K., Bar Council of England and Wales, on the other." "The U.K. Delegates have also assured the Bar Council of India that the Authorities in the U.K. are also keen and interested in the means of collaboration, cooperation and joint practice between Indian advocates and UK lawyers," added the notification. Moreover, having regard to the aim and object of the International Commercial Arbitration introduced in the Arbitration and Conciliation Act, 1996, foreign lawyers cannot be debarred to come to India and conduct arbitration proceedings in respect of disputes arising out of a contract relating to international commercial arbitration, stated BCI. Bar Council allows foreign law firms, lawyers to practice in India

The Bar Council of India has issued directives and cease and desist notices in compliance with a judgment pronounced on July 3, 2024 by the <keyword id="19900621" type="General" weightage="20" keywordseo="Madras-High-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Madras High Court" meta.hostid="261" meta.entityid="Madras High Court">Madras High Court</keyword>. The judgment underscores that the legal profession is a noble service to society and not a business driven by profit motives. In this regard, BCI directs the online platform to remove all listings, profiles, and advertisements related to <keyword id="22033472" type="General" weightage="20" keywordseo="legal-practice" source="keywords">legal practice</keyword>s by advocates immediately and no later than four weeks from the date of the notice. Cease and desist any operations enabling the advertisement or solicitation of legal practice by advocates. Submit a detailed compliance report outlining the actions taken to the BCI by August 10, 2024 Failure to comply with these directives will result in the BCI initiating legal proceedings and seeking appropriate penalties against the non-compliant organizations, stated BCI. All portals, <keyword id="19984289" type="General" weightage="20" keywordseo="online-platforms" source="keywords">online platforms</keyword>, and advocates found in violation of Rule-36 of the Bar Council of India Rules are hereby issued a public notice to ensure strict compliance with these Rules immediately. Any advertisements contravening the aforementioned Rule must be withdrawn forthwith, stated BCI. Practices of online platforms offering lawyer services were examined and found to be in violation of the <keyword id="22332742" type="General" weightage="20" keywordseo="BCI-Rules" source="keywords">BCI Rules</keyword>. The permissibility of <keyword id="22332740" type="General" weightage="100" keywordseo="lawyers-advertising" source="keywords">lawyers advertising</keyword> and soliciting work was scrutinized and deemed inappropriate. The involvement of online intermediaries in facilitating lawyer services was assessed and found to be in breach of professional conduct standards. The court ruled that online platforms cannot seek protection under Section 79 of the Information Technology Act for activities illegal under the Advocates Act and BCI Rules, added Bar Council of India's statement. Recently Madras High Court directed BCI to issue Circulars/Instructions/Guidelines to the State Bar Councils to initiate disciplinary proceedings for misconduct against the Advocate's advertising, soliciting works directly or indirectly, whether by circulars, advertisements, touts, personal communication, interviews not warranted by personal relations, furnishing or inspiring newspaper comments or producing his photographs to be published in connection with the case where he is engaged or concerned.

<ul><li><keyword id="470781" type="COMPANY" weightage="20" keywordseo="The-Bar-Council-of-India">The Bar Council of India</keyword> (BCI) said all <keyword id="6418036" type="UNKNOWN" weightage="20" keywordseo="law-students">law students</keyword>, except those in final year, will be promoted on the basis of their previous year's marks and marks obtained in the <keyword id="4234762" type="PERSON" weightage="20" keywordseo="internal-examination">internal examination</keyword> of the current year. </li><li>However, it clarified that after reopening of colleges/universities, the institutions may conduct the end semester examination with respect to the year from which the students have been promoted.</li><li>The lawyers' body clarified that for final year LL.B students, the universities may adopt any other appropriate method which they feel is adequate to satisfy the requirements of a regular examination. </li></ul>The Bar Council of India (BCI) said all law students, except those in final year, will be promoted on the basis of their previous year's marks and marks obtained in the internal examination of the current year. The BCI has issued fresh guidelines for the promotion of law students to the next year and the criteria for law exams amid the Covid-19 crisis. However, it clarified that after reopening of colleges/universities, the institutions may conduct the end semester examination with respect to the year from which the students have been promoted, within a reasonable period of time, though such promoted students shall continue to study in the year to which they have been promoted. "And in case, they are unable to pass/clear any such paper of such end semester exam of the year from which they have been promoted, they shall have to clear the same, before they are granted the degree. In the case of students who have been promoted to the final year as LL.B students, they shall have to pass all papers in order to obtain their degree/s," said the lawyers' body. It allowed the <keyword id="6411073" type="UNKNOWN" weightage="20" keywordseo="final-year-students">final year students</keyword> of the three and five years LL.B courses to appear for online examinations. "In case of Final Year LL.B students, who have not cleared all papers of previous years and are required to sit in the supplementary examination, but, who have been promoted to final year, such Final year LL.B students may be allowed to write a project report or appear in online examination with regard to the pending/supplementary papers, so that they could also pass within time," said the BCI in a statement. The lawyers' body clarified that for final year LL.B students, the universities may adopt any other appropriate method which they feel is adequate to satisfy the requirements of a regular examination. "Under this system, the University may allow students to write a project report/research paper for each paper of the final year or they may adopt a foolproof method to double the internal marks of the semester exams already held for such year," said a senior official of the lawyers' body. The BCI insisted that the universities must adhere to Covid-19 protocol and ensure that the norm of social distancing is followed in the campus and all classrooms and examination halls are properly sanitised from time to time. "The safety and health of the students should not be compromised at any cost. Universities are instructed to maintain the highest academic standards while conducting the examinations," the statement said.

"Thailand staged the most impressive rally, more than doubling from year-earlier levels," the report said of the surge in Thailand's investment demand for gold. Gold demand was boosted by concerns that the Thai baht might be devalued.
"The prospect of a devaluation of the Thai baht boosted demand among domestic investors as a means of storing wealth. The increasing prevalence of small gold bars within jewelery retailers across the Asian region supported demand."
But this wasn't the only reason. "This was in no small part due to Thailand being used as a route to channel gold into other markets, notably India and Vietnam."
Earlier this year India moved to suspend <a href="http://www.telegraphindia.com/1130221/jsp/business/story_16587226.jsp#.UoUBQo38Vz8">gold imports from Thailand</a>. India had a 1% duty on the import of gold jewelry from Thailand at the time, compared with 10% on other countries. 
Indian officials believed gold imports from Thailand originated elsewhere and that Thailand was taking advantage of the bilateral free trade agreement between the two nations.
Thailand's consumer demand for gold was 35.6 tonnes and paled in comparison to 148.2 tonnes in India, and 209.6 tones in mainland China. But the year-over-year-growth demand has been huge.

Thailand Has Become A Major Hub For Gold

"The recent dynamics of the gold market have worked to ensure that lower prices (caused, in part, by ETF outflows) boosted Asian demand to an extent sufficient to absorb the gold flowing from western markets," according to the report.
Here's how it works:
Gold continued to work its way through the supply chain, to be converted from London Good Delivery bar-form, via the refiners, into smaller, Asian consumer-friendly denominations of kilo-bars and below. This process is borne out by recent trade statistics. Data from Eurostat show exports of gold from the UK to Switzerland for the January - August period grew more than tenfold, to 1,016.3 t.

<ul class="summary-list"><li>With euros and dollars in short supply, Russians are saving their money in gold.</li><li>Demand for gold bars and coins in Russia jumped nearly fivefold last year from 2021.</li></ul>Moscow's war on Ukraine sent Russians lining up to buy gold bars and coins as they sought a safe haven for their savings, causing the country's appetite for the metal to almost quintuple.The bullion rush was spurred by President Vladimir Putin's move to remove the 20% VAT on gold bars, as well as a central bank decision to restrict foreign-currency transactions. However, the country's half-baked framework for retail investment in the yellow metal may make the trend trickier than it seems, the Financial Times reported."Not everyone understands they cannot keep bars in a shoebox," financial advisor Natalia Smirnova <a href="https://www.ft.com/content/57ecdd80-82a0-4c12-9803-0ce016afdf11" target="_blank" rel="noopener">told the FT.</a> Even a scratch can put a dent in their value, she said. Russian demand for gold bars and coins rose nearly fivefold in 2022 from the previous year, data from the World Gold Council show.At one point, Sberbank, a large Moscow-based state-owned bank, cautioned clients about a possible shortage of smaller-size gold bars, the preferred size for many buyers, according to the FT. Even the central bank was forced to step in to cool the market, by suspending its own gold purchases for a fortnight in March. "Private citizens are looking for a way to save money, and euros and dollars are in short supply, so the popularity of gold has surged," Vitaly Nesis, chief executive of Polymetal, an Anglo-Russian gold producer, told the FT."As long as we experience geopolitical instability, the demand for gold may be significant," Nesis said. The rush for gold is also tied to a larger push from countries trying to move away from the U.S. dollar's dominance of international trade and capital flows. The yellow metal's price surged about 20% from its November lows through January, thanks in part to demand from China and Russia, Bernard Dahdah, a commodities analyst at Natixis, told the FT. "There is a lot of effort by Russia and China to make the dollar [less influential] — to stop it from being the petrodollar," he said. But Russia isn't the biggest gold buyer as its demand made up only 2% of the global total last year, World Gold Council data show. China took the lead at 19%, followed by Germany and India.

Indeed, the dumping by the investor/trader class was blamed for the <a href="http://www.businessinsider.com/cross-asset-returns-in-2013-12">nearly 30% price decline</a> in the yellow metal.
"Chinese consumers set a new annual record, while India was resilient in the face of import restrictions," the WGC added. "The sharp fall in the gold price in the second quarter elicited a strong and swift response from consumers in Asia and the Middle East, an effect that extended out to western markets in the final quarter of the year."

The aggressive gold buying by the Reserve Bank of India (<keyword id="19899808" type="General" weightage="20" keywordseo="RBI" source="keywords">RBI</keyword>) also contributed to the rise in demand. India's gold demand in value terms rose 20 per cent on an annual basis to Rs 75,470 crore during the January-March period of this year on volume growth as well as a rise in quarterly average prices by 11 per cent. On Tuesday, the World Gold Council (WGC) released its global report 'Gold Demand Trends Q1 2024', showing that India's total gold demand, including both jewellery and investment, increased to 136.6 tonne in January-March this year from 126.3 tonne in the year-ago period. Out of the total gold demand, the jewellery demand in India increased 4 per cent to 95.5 tonne from 91.9 tonne. The total investment demand (in the form of bar, coin among others) grew 19 per cent to 41.1 tonne from 34.4 tonne. Sachin Jain, Regional CEO, India, WGC, said the rise in gold demand reaffirms Indians' enduring relationship with gold. "India's continued strong macroeconomic environment was supportive for gold jewellery consumption even though prices reached a historic high in March leading to a slowdown in sales as the quarter ended," he added. Jain expects the gold demand in India to be in the range of 700-800 tonne during this year. If the price rally continues, he said the demand could be at the lower end of this range. In 2023, the country's gold demand was 747.5 tonne. Asked about the factors driving demand growth in January-March, Jain told PTI, " Historically, eastern markets of the world including India and China respond when the prices are going down and there is a fluctuation, whereas western markets respond when the prices are going up." "For the first time we have seen a complete reversal where Indian and Chinese markets have responded to an increase in prices of gold," he said. Jain said the demand for jewellery as well as investment products like bar, coin and ETF has gone up. "The second reason for the increase in demand has been the buying by the central bank RBI," he said. While the RBI bought 16 tonne of gold in the full 2023, it has already purchased 19 tonne in the first quarter of this calendar year, Jain highlighted. He mentioned that the RBI has indicated that it would continue buying. Asked about the outlook for the April-June quarter, Jain said the demand might slow down due to a sharp rally in gold prices and the ongoing election process. As per the WGC data, India's gold demand in value terms rose 20 per cent to Rs 75,470 crore from Rs 63,090 crore. Out of this, the jewellery demand grew 15 per cent to Rs 52,750 crore from Rs 45,890 crore, while gold investment demand went up 32 per cent to Rs 22,720 crore from Rs 17,200 crore. The WGC also mentioned that the total gold recycled in India stood at 38.3 tonne in January-March, up 10 per cent from 34.8 tonne in Q1 2023. "Total gold imports in India in Q1 2024 was 179.4 tonne, up by 25 per cent compared to 143.4 tonne in Q1 2023," the Council said. The average quarterly price in Q1 2024 was Rs 55,247.20 per 10 gm of gold as against Rs 49,943.80 per 10 gm in Q1 2023 (without import duty and GST) "Q1'24 also saw healthy levels of gold bar and coin demand in India, up 19 per cent year-on-year at 41 tonne. This was on a par with Q1'22, which was itself the strongest first quarter since 2014," Jain said. The price correction in February sparked investors' interest, with anticipation of a rebound driving purchases, he added. "As the price rallied to successive record highs, investors remained bullish, contributing to the robust demand," Jain said. Investments into gold ETF too saw positive inflows of over 2 tonne. "Although Indian recycling volumes increased 10 per cent to 38.3 tonne in Q1'24, there were very few reports of distress selling. With a strong economy and expectations of a normal-to-good monsoon, there seems little desire to cash in on high gold prices at the moment," Jain said. The current high gold prices might temporarily put a strain on demand, he said. However, Jain said, "strong cultural and seasonal factors such as festivals, weddings helped by an expectation for a better monsoon and solid economic growth would support demand." India's gold demand up 8% in Jan-Mar to 136.6 tonne despite high rate

Chinese consumer demand for gold was up 32% on the year in 2013, to 1,065.8 tonnes, according to the latest <a href="http://www.gold.org/download/pub_archive/pdf/GDT_Q4_2013.pdf">World Gold Council report</a>. The value demand for gold in China was $51.6 billion.
There was a surge in both jewelry and total bar and coin investment demand. This was the first time China bought over a thousand tonnes of gold and saw it oust India from its position of top gold consumer.
This compares with 974.8 tonnes of consumer gold demand in India, which was up 13% from a year ago.

But it still hasn't recovered to pre-pandemic levels, as first-half demand came in at 873 tons, considerably lower than for the period in years before the outbreak of COVID-19, the council said.For the entire year, jewellery demand is expected to total between 1,600 to 1,800 tons, which would be above 2020 levels but well below pre-pandemic levels. New Delhi, Mar 5 () Capital market regulator Securities and Exchange Board of India (Sebi) has invited applications for an internship programme in its legal department. The heads of the department or the course coordinators of the respective law schools or universities in-charge of the internship program need to submit applications recommending not more than three applicants from their law school in a given quarter, Sebi said.No individual applications will be accepted, it added."Applications shall be e-mailed to Sebi within the first week (1st-7th) of every quarter for internship commencing in the next quarter," Sebi said.The application for internship for the April 2020 quarter is open till March 20, 2020, it added.Laying down the eligibility criteria, Sebi said, the applicant should be student of a law school or university which is recognised by the Bar Council of India and should have completed at least three years of the five-year LLB course or two years of the three-year LLB course. Besides, students pursuing LLM are also eligible. Among other criteria, the applicant should have secured minimum of 60 per cent aggregate marks or equivalent cumulative grade points average in the previous semester results."A stipend of Rs 10,000 shall be provided upon satisfactory and successful completion of the internship," the regulator said.
