The Central Board of Secondary Education (<keyword id="6356155" type="General" weightage="80" keywordseo="cbse" source="Orion">CBSE</keyword>) has opposed a petition challenging certain provisions of the Right to Education Act, 2009 for being "arbitrary, irrational, and violative" and seeking direction to the Centre to implement common syllabus and curriculum for the students of Class 1 to 8 standard throughout the country. In its reply to a <keyword id="6355791" type="General" weightage="20" keywordseo="PIL" source="Orion">PIL</keyword> filed by lawyer and BJP leader Ashwini Upadhyay, the CBSE clarified that education falls under the 'Concurrent List' of the Indian Constitution, and the majority of schools are under the jurisdiction of state governments. As a result, it is the responsibility of the respective state and Union territory governments to formulate syllabi, curricula, and conduct examinations for schools in their regions. The CBSE further pointed out that the National Curriculum Framework (NCF), developed by the National Council of Educational Research and Training (<keyword id="48505" type="General" weightage="20" keywordseo="ncert" source="Orion">NCERT</keyword>) in accordance with the National Policy on Education, provides guidelines and direction for syllabus and textbook development across all school stages. In line with the NCF, the NCERT develops curriculum, syllabi, textbooks, and supplementary materials, it said. The Board said that the State Councils of Educational Research and Training (SCERTs) and State Education Boards either adopt or adapt the NCERT's model syllabi and textbooks or create their own based on the NCF. The CBSE also said that a uniform curriculum across India may not adequately consider local context, culture, and language. It further highlighted the importance of a national framework with flexibility that allows for the incorporation of local resources, culture, and ethos. The CBSE's response underscored that a curriculum closely related to a student's life outside of school is more relatable and effective. Therefore, they expressed support for a diversity of curricula and educational resources, in addition to a common core element. A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad had earlier sought the Delhi government, the CBSE and the NHRC's response on the petition. The plea also challenges the provisions under the RTE Act which excludes madrasas, Vedic pathshalas and educational institutions imparting religious knowledge. Upadhyay had argued that all competitive examinations be it engineering, law and the Common University Entrance Test (CUET) should have a common syllabus. "But we have multiple syllabus at school level, how will it provide an equal opportunity for students? In Kendra Vidyalayas across the country, we have a common syllabus. Every developed country has a common syllabus in schools. It is unfortunate we are under pressure from the coaching mafia." He had contended that as per the Articles of the Constitution, students do not get equal opportunities. Upadhyay, in his plea, alleges that "education mafias are very powerful and have a very strong syndicate. They influence rules, regulations, policies and examinations. The bitter truth is that school mafias do not want one nation-one education board, coaching mafias do not want one nation-one syllabus, and book mafias do not want NCERT books in all schools. That is why the <keyword id="97896" type="General" weightage="50" keywordseo="uniform-education-system" source="Orion">uniform education system</keyword> up to the 12th standard has not been implemented yet." "It is necessary to state that the purposive and harmonious construction of Articles 14, 15, 16, 21, 21A with Articles 38, 39, 46 confirms that education is a basic right of every child and the state cannot discriminate against this most important right. Right of a child should not be restricted only to free education, but must be extended to have equal quality education without discrimination on the ground of the child's social, economic and cultural background," the plea reads.

CBSE opposes PIL in Delhi HC seeking common syllabus across India

The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday issued a slew of directions for speedy disposal of criminal cases against Members of Parliament and Members of Legislative Assembly (MPs/MLAs) and asked High Courts to register a Suo Motu case for effective monitoring and speedy disposal of such cases. A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra said it was difficult for it to form a uniform guideline for trial courts across the country relating to speedy disposal of <keyword id="16453350" type="General" weightage="40" keywordseo="cases-against-mps" source="Orion">cases against MPs</keyword> and MLAs. The top court left it to the high courts to evolve such measures for effective monitoring of such cases. The bench directed that High Court Chief Justices shall register a suo motu case titled "In Re Designated Courts for MPs and MLAs" to monitor the early disposal of pending criminal cases against lawmakers. It directed that the suo motu case be heard by a special bench headed by the Chief Justice or a bench assigned by him or her. It was further directed that the Special Bench of the High Court may list the matter at regular intervals as felt necessary. The top court said the High Court may issue such orders and directions as necessary for expeditious and effective disposal of the cases. The bench further ordered that the Special Bench of the High Court may consider taking the assistance of the Advocate General or prosecutor to assist it. The apex court also directed that cases against MPs and MLAs that are punishable by death should be prioritised over other cases. Then cases punishable with imprisonment for five years or more will be given priority. It further said that the cases would not be adjourned by the trial court except for rare and compelling reasons. The top court said that the High Court may require a Principal District and Sessions judge to bear the responsibility of allocating the subject cases to such courts. The High Court may call upon the Principal District and Sessions judge to send reports on such intervals, it added. The concerned principal and session judge should ensure sufficient infrastructural facilities are available for the trial of such cases, as directed by the top court. The directions of the top court came on a PIL filed by advocate Ashwini Upadhyay seeking speedy disposal of criminal cases pending against MPs and MLAs. Earlier, the Enforcement Directorate (ED) filed a status report stating that there are 51 MPs and 71 MLAs, sitting and former, who stand accused by the agency of offence under the Prevention of Money Laundering Act (PMLA). The report did not specify exactly how many of those are sitting MPs or MLAs and how many are former MPs or MLAs. The Central Bureau of Investigation (CBI) had also submitted a similar report stating that a total of 121 cases are pending trial against sitting and former MPs and MLAs. The number of MPs involved in those cases is 51, out of which 14 are sitting, 37 are former and 5 are deceased. The report further stated that 112 MLAs are involved in CBI cases, out of which 34 are sitting, 78 are former and 9 are deceased. The number of cases pending investigation against MPs and MLAs by the CBI is 37, according to the report the CBI submitted. Senior advocate Vijay Hansari, who was assisting the apex court in the case as amicus curiae, had highlighted a "glaring case of inordinate delay" in the trial of cases against lawmakers, submitting that many cases were pending for over five years. The apex court had sought a status report from Hansaria relating to the pendency and grant of sanctions for prosecution, the expected time for completion of the investigation and reasons for delay in the same. Hansaria had sought directions to ensure that courts dealing with cases against lawmakers should exclusively try such issues. The plea sought speedy disposal of cases against them and pointed out that while judges and babus were suspended for such activities, politicians were condoned by the law. As of now, convicted politicians have been banned from the polls for six years.

New Delhi, India is witnessing a <keyword id="10102846" type="UNKNOWN" weightage="20" keywordseo="constant-decline">constant decline</keyword> in the Total Fertility Rate (TFR), and as per <keyword id="6372870" type="COMPANY" weightage="20" keywordseo="census">Census</keyword> 2001-2011, the sharpest decline in population has been recorded in this decade, in the last 100 years, the Centre has informed the Supreme Court. "Furthermore, as per the Census, 2001-2011 is the first decade in the last 100 years which has not only added lesser population as compared to the previous one, but also registered the sharpest decline in the decadal growth rate from 21.54 percent in 1991-2001 to 17.64 percent in 2001-2011," said the affidavit filed by <keyword id="4585792" type="COMPANY" weightage="20" keywordseo="the-ministry-of-health-and-family-welfare">the Ministry of Health and Family Welfare</keyword>. The Centre pointed out the wanted fertility in India as per <keyword id="121300" type="COMPANY" weightage="20" keywordseo="National-Family-Health-Survey">National Family Health Survey</keyword> (NFHS) IV is only 1.8 as against the actual fertility of 2.2 prevailing at that time, indicating couples on an average do not want more than 2 children. In a significant judgement, the Supreme Court on Thursday directed political <keyword id="15047" type="PERSON" weightage="20" keywordseo="Parties">parties</keyword> to upload on their respective websites the details of all pending criminal cases against candidates contesting polls, citing the alarming increase in criminalisation of politics in past four general elections. A bench headed by Justice R.F. Nariman said the parties would have to clarify on reasons for selecting candidates with pending criminal cases and upload this information on their websites. The top court also observed that political parties will have to submit a compliance report within 72 hours, to the Election Commission, after selecting candidates having pending criminal cases. The order from the top court came on a contempt plea filed by Advocate Ashwini Upadhyay, raising critical issues due to increase in criminalisation of politics. The plea claimed the directions given by the apex court in its September 2018 verdict, which specified guidelines to disclosure of criminal antecedents by candidates, is not being followed in letter and spirit. The top court also directed that political parties would have to publish this information on their social media platforms like <keyword id="6354576" type="COMPANY" weightage="20" keywordseo="facebook">Facebook</keyword> and <keyword id="6354616" type="COMPANY" weightage="20" keywordseo="Twitter">Twitter</keyword> besides publishing this information in one local vernacular and one national newspaper. The Delhi High Court Monday declined to order linking of social media accounts with Aadhaar, PAN or voter ID card for weeding out fake accounts, saying it would lead to data of genuine account holders, who are much more in number, going "unnecessarily" to foreign countries. A bench of Chief Justice D N Patel and Justice C Hari Shankar said linking of accounts with social media platforms like Twitter, Facebook and WhatsApp, with Aadhaar, PAN or any other identity document requires framing of policies or amendment in existing laws by the central government and this exercise cannot be done by the court. "Role of courts is to interpret the law as it is. We are not concerned with what the law ought to be," it said, adding that in exceptional cases where there is a gap in the law, the courts can step in. It said that in the instant case, linking of social media accounts with identity data like Aadhaar or PAN was a "crucial matter" which has to be appreciated by the central government and it cannot be treated as a "gap" which needs to be plugged by the court as it "would have far reaching consequences regarding data of genuine account holders". The bench said it was not inclined to issue any direction to the government as it is already deliberating on the Law Commission reports on the issue and disposed of the PIL seeking directions to the Centre to take steps for linking social media accounts with Aadhaar, PAN or voter ID card to weed out fake accounts. It however told the government to keep in mind that identity data of genuine account holders was also at stake and a "proper balance" has to be struck by it while taking a decision on the issue. In its order, the bench noted that according to BJP leader Ashwini Kumar Upadhyay, who had moved the plea, 20 per cent of the social media accounts were "fake, ghost or duplicate". "To weed out 20 per cent fake accounts all the data, including that of genuine account holders, will go to a foreign country. Majority of account holders are genuine. Therefore, if linkage is ordered by this court, there maybe a situation where data of genuine account holders will also go to foreign country, maybe unnecessarily," the court said. During the hearing, Upadhyay said something has to be done as anyone can create a fake account on social media of any person, including the judges, and through that medium wrong or controversial information can be spread. New Delhi, Jul 1 () A PIL seeking ban on consumption of liquor and other intoxicating drinks in view of rapidly spreading COVID-19 pandemic was filed in the Supreme Court on Wednesday. The plea, filed by BJP leader and advocate Ashwini Kumar Upadhyay, contended that liquor consumption during the coronavirus pandemic is exacerbating health vulnerability, risk-taking behaviour, mental health issues and violence. "Liquor consumption is associated with a range of communicable and non-communicable diseases and mental health disorders, which make a person more vulnerable to COVID. "Consumption of Liquor and intoxicating drinks weakens the immune system, increases risk of adverse health outcomes. It has devastating effects on right to health guaranteed under the Constitution," the plea said. The petition, filed through advocate Ashwani Kumar Dubey, said there should be an effective health warning that covers at least 50 per cent of liquor bottles and containers on both sides, highlighting health hazards. "Consumption of liquor and intoxicating drinks increase the risk of injury, domestic violence, crime against women. Besides, it would exacerbate health vulnerability, risk-taking behaviour and mental issues during Covid-19 pandemic," it said. The plea has sought directions to frame an effective policy to prohibit the consumption of liquor and intoxicating drinks, except for medicinal purposes. It has sought introduction of an effective health warning that covers at least 50 per cent of liquor bottles/ containers on both sides and print intoxicating drinks related health hazards on it in Hindi and English languages) Besides, it has sought a ban on advertisement of intoxicating drinks and starting of a campaign to educate people about the health hazards due to consumption of intoxicating drinks through electronic, print and social media. "Insert a chapter on health hazards of intoxicating drinks in syllabus of primary classes in spirit of right to health &amp; education guaranteed under the Constitution," the plea said. Quoting World Health Organisation, the plea said that alcohol consumption is associated with a range of communicable and non-communicable diseases and mental health disorders, which can make a person more vulnerable to COVID-19.
