Mumbai (Maharashtra) [India], June 22 (ANI): Sylvester daCunha, the creator of <keyword id="26280" type="General" weightage="100" keywordseo="amul" source="Orion">Amul</keyword>'s enduring '<keyword id="112355" type="General" weightage="50" keywordseo="utterly-butterly" source="Orion">Utterly Butterly</keyword>' girl, passed away in Mumbai. Amul's managing director Jayen Mehta expressed grief over daCunha's demise on Twitter, saying, "Very sorry to inform about the sad demise of <keyword id="17776156" type="General" weightage="50" keywordseo="shri-sylvester-dacunha" source="Orion">Shri Sylvester daCunha</keyword>, Chairman of daCunha Communications last night at Mumbai A doyen of Indian advertising industry who was associated with Amul since the 1960s. The Amul family joins in mourning this sad loss@RahuldaCunha." After coming across Mehta's post, many took to Twitter, mourning daCunha's loss. A social media user wrote, "Truly the doyen of Indian advertising industry and brand builder of many brands, closest we know personally is Amul !His immense contribution is worth many a salutes ... our prayers with the Da Cunhas and wishes for his legacy to continue and grow..!Om Shanti" Another said, "Shri Sylvester Dacunha will be remembered for his creative and out-of-the-box contributions to Amul. My heartfelt condolence to the family!" The Amul mascot has become a rage across the country with her witty one-liners on current issues, both political and otherwise. Sylvester daCunha, man behind Amul's 'Utterly Butterly' girl, passes away

<keyword id="1204125" type="COMPANY" weightage="20" keywordseo="The-Delhi-High-Court">The Delhi High Court</keyword> has sought the response of Google and Facebook on a plea moved by <keyword id="10426237" type="COMPANY" weightage="20" keywordseo="the-gujarat-cooperative-milk-marketing-federation">the Gujarat Cooperative Milk Marketing Federation</keyword> (GCMMF) Limited, which sells milk and dairy products under the <keyword id="10426238" type="UNKNOWN" weightage="20" keywordseo="amul-trademark">Amul trademark</keyword>, seeking removal of certain videos alleging that those are cruel to cows. Issuing notice to the two social media platforms and the person who uploaded the videos and seeking their replies to the GCMMF's suit, Justice <keyword id="221693" type="PERSON" weightage="20" keywordseo="Mukta-Gupta">Mukta Gupta</keyword> refrained from passing any <keyword id="449209" type="PERSON" weightage="20" keywordseo="interim-order">interim order</keyword> directing removal of the videos, titled "Unholy Cattle of India: Exposing Cruelty in the Indian Dairy Industry", from YouTube and Facebook. The court asked the person, who uploaded the video, to indicate in his reply how the GCMMF or its members were indulging in cruelty to cows and why Amul's mascot was used in the video. With the direction, the court listed the matter for hearing on January 15, 2021. The GCMMF, in its suit, has sought the removal of the videos from YouTube and Facebook, claiming that the person who has uploaded those is targeting it. The suit has contended that the videos uploaded by defendant Nitin Jain "were slanderous and disparaged and denigrated the Amul brand and trademark". Jain's lawyers -- senior advocate Raj Panjwani and advocates Supriya Juneja and Priyanka Bangari -- told the court that the Amul trademark was not being used by their client for commercial purposes. Taking note of the defendant's stand and the fact that the videos were in public domain since 2018, the court said it was not passing any ad interim injunction and was giving Jain an opportunity to file his reply. "Along with the reply affidavit, the defendant 1 (Jain) will also state whether it obtains any profits out of the videos uploaded and if yes, the statement of accounts thereof," the court said. <img class="gwt-Image" src="/photo/48621367.cms" /> Owner of India's biggest and most profitable carrier <keyword id="6354706" type="CITY" weightage="100" keywordseo="Indigo">IndiGo</keyword> is embroiled in a trademark dispute over its name with <keyword id="42747" type="CITY" weightage="100" keywordseo="Tata-Motors">Tata Motors</keyword>, which sells its flagship sedans under the same brand. This comes at a time when the airline is preparing to launch its initial public offering (IPO) on Dalal Street. 

	The airline's parent Interglobe Aviation faces an ownership title risk as Tata Motors has claimed that the carrier's use of the IndiGo name is an infringement of its trademark. India's biggest automaker by revenue forayed into sedans under the Indigo brand in 2002 while Interglobe commenced operations in August 2006.
 

	Tata Motors issued notices on the Indigo name infringement in 2005 but Interglobe subsequently registered the trademark. The matter is currently pending in the court with Tata Motors opposing Interglobe's four trade names — IndiGo, IndiGo Airways, IndiGo Airlines, and IndiGo Air.
 

	An Interglobe spokesperson refused to comment citing Sebi's pre-IPO publicity guidelines. The company in its IPO prospectus states that in the event of a failure to register the trademarks, its business may be adversely impacted.
 

	Interestingly, IndiGo is a rival to Tata Motors' sister companies — Tata Singapore Airlines (operator of Vistara) and AirAsia India — which are trying to make a mark in the highly competitive skies.
 From a single aircraft, Interglobe, founded by travel entrepreneur Rahul Bhatia and former <keyword id="64086" type="COMPANY" weightage="100" keywordseo="US-Airways">US Airways</keyword> chief executive Rakesh Gangwal, had a fleet of 96 aircraft as of April 30, 2015. Its upcoming IPO, expected to value IndiGo airline at $4 billion, is more than five times the current market capitalization of its closest rival, <keyword id="6358200" type="CITY" weightage="100" keywordseo="Jet-Airways">Jet Airways</keyword>. Tata Motors' sales of Indigo, which is derived from 'India on the go', have been on a decline with the latest figures showing a 28% dip on a month-on-month basis. 

	In the past too, different companies have used similar names to sell their wares. For instance, Gujarat Cooperative Milk Marketing Federation sells its dairy under the Amul brand while JG Hosiery markets Amul innerwear, which is among the top three brands in its category.
 

	"The legal loophole available to most imitators is that a trademark ownership is only valid per category.
 

	So if a new firm wants to lift your name in a totally unrelated category in which you are not registered, it does not constitute infringement," Ramesh Jude Thomas, president, Equitor, a brand consultancy firm, told TNN.
