By Fakir Hassen Johannesburg, Apr 25 () A century-old South African residential care facility for the aged which is strongly supported by screen legend Amitabh Bachchan is at the centre of a controversy over alleged contravention of regulations during the current nationwide lockdown due to the COVID-19 pandemic. Aryan Benevolent Home (ABH) chief executive Naren Pattundeen and building contractor Roshan Lutchman, who were busy preparing a COVID-19 isolation ward at the Chatsworth home for the elderly, were arrested by police for not having in order the required permits. The ABH was constructing a 24-bed ward as part of the facility's disaster management plan to prepare for a possible outbreak at the home, which caters for scores of senior citizens, when police arrived at the site. Lutchman told the website Independent Online (IOL) that he and Pattundeen were in possession of valid permits to operate during the lockdown, which the police refused to accept as valid. "Then they said they were locking everyone up. I had 38 workers on site and we asked how they planned to take us. We said the ABH had buses which could be used to transport us to the station," Lutchman said. "However, they packed us in batches of 12 into a police van and escorted us to Chatsworth police station," Lutchman said. He said social distancing was not possible at the police station and everyone was packed into a courtyard until police allowed his workers to leave with a warning. Lutchman and Pattundeen were held in a cell and only released later that evening after their attorney secured bail of Rand 500 each for them. "We have engaged our attorneys to challenge our unlawful arrest. It was disrespectful and demoralising - the way they handled us was as if we were selling drugs or alcohol," he said."Their conduct was really shocking. The ABH staff watched a senior member being arrested like a crook, while my staff watched me being arrested," he added. Lutchman said he would also lodge a complaint with the Independent Police Investigative Directorate, which is already investigating several cases of alleged abuse by the police, including one killing, as the police and army patrol streets to ensure that people stay indoors as per the national lockdown regulations. Pattundeen told IOL that all of his documents were in order to provide essential services and it had not been unlawful for him to employ the contractor. Bachchan has been very supportive of the ABH for many years after he first went there during his visit in 2002 for the South African leg of the megastar Bollywood show 'Now or Never'. In October last year, Bachchan joined President Cyril Ramaphosa in endorsing a fundraising campaign for the ABH, which was started more than a century ago to care for indigent Indian-origin senior citizens who were neglected by the community. Celebrities who appear in misleading advertisements might escape jail sentence, but end up paying hefty monetary fines in case the products endorsed by them fail to live up to the claims. 
 
The decision will most likely be taken in a meeting of ministers led by Finance Minister Arun Jaitley. 
 
Even though the consumer affairs ministry asked for jail time as recommended by a parliamentary committee, some senior ministers were of the view that this would be too harsh a punishment, given that it would be difficult for celebrities to know the realities behind the claims. 
 
"There was an alternative view against jail term in the first instance," one of the <a href="http://economictimes.indiatimes.com/industry/services/advertising/celebrities-likely-to-face-fines-not-jail-for-misleading-advertisements/articleshow/53936309.cms">ET</a> sources said. "It was suggested that a more desirable provision could be imposition of exemplary monetary penalty for misleading endorsements." 
 
The monetary fine could be as high as Rs 1 crore, which would, as per the meeting, be an exemplary penalty. 
 
The meeting also saw recommendations being made for dividing products into three broad categories - general, food and medicine, and deciding penalties accordingly. It also discussed that celebrities should not blindly announce what’s told to them, and should observe due diligence. 
 
The debate regarding these ads started last year when celebrities endorsing Maggi noodles, which was <a href="http://www.businessinsider.in/If-you-thought-Maggi-ban-affected-the-brand-the-most-you-have-no-idea-what-1100-Maggi-plant-workers-went-through/articleshow/48651139.cms">banned for some time</a> for containing excessive lead, faced wrath for misleading their fans into consuming something hazardous.

No jail sentence, only monetary fine for celebrities for misleading ads

A district court in Bihar’s Muzaffarpur has directed the cops to file a complaint against <keyword id="2878870" type="UNKNOWN" weightage="20" keywordseo="Maggi-brand-ambassadors">Maggi brand ambassadors</keyword> counting <keyword id="6357912" type="PERSON" weightage="20" keywordseo="amitabh-bachchan">Amitabh Bachchan</keyword>, Madhuri Dixit and <keyword id="8145" type="PERSON" weightage="20" keywordseo="Preity-zinta">Preity Zinta</keyword>. 
 
Celebrities refused to make any comment on the matter after ET tried to reach out to them just after the news came out. In fact, what we heard those saying is that they have become a soft target in a fiasco. 
 Bollywood actor and singer <keyword id="6354535" type="PERSON" weightage="20" keywordseo="Ayushmann-Khurrana">Ayushmann Khurrana</keyword> said that "Fame is a double-edged sword". <keyword id="289" type="PERSON" weightage="20" keywordseo="madhuri-dixit-nene">Madhuri Dixit Nene</keyword>’s lawyer <keyword id="166222" type="PERSON" weightage="20" keywordseo="Anand-Desai">Anand Desai</keyword> on the other hand, turns down the reports saying that the actor did not received any <keyword id="54048" type="ORGANIZATION" weightage="20" keywordseo="Food-and-Drug-Administration">Food and Drug Administration</keyword> (FDA) notice. 
 
Not just this, but Big B also declined the reports saying "I have not received any notice yet. So I cannot make any comment. If it (notice) is received, my lawyers shall attend to it. It would be inappropriate to comment on a matter that is subjudice." 
 "It's sad and true that known faces get targeted for the wrong reasons and agendas just to seek attention. It's unfortunate because it becomes like a cry wolf syndrome; the day there will actually be someone with a justified reason and cause, it will not be given the importance it possibly deserves," said actor <keyword id="114453" type="PERSON" weightage="20" keywordseo="Arjun-Kapoor">Arjun Kapoor</keyword>, who recently faced public ire over his participation in the AIB Roast. 
 According to social commentator <keyword id="115728" type="PERSON" weightage="20" keywordseo="Santosh-Desai">Santosh Desai</keyword>, the primary responsibility lies with the FDA and they have yet to figure out that what actually is wrong. Then how do you expect the stars to do it? 
 
"If a product has been passed by the FDA, why would a celebrity not believe that all is in place? Yes, it merits an investigation but in the case of anything being amiss, the primary responsibility lies with the FDA not the stars. It is a completely irrelevant fact, it is just that everyone feels important by association with the stars," he added.

What have been your midnight saviour during those hunger laden exam days in college hostels are now posing serious threats to the top notch Bollywood celebrities right from Amitabh Bachchan, Madhuri Dix it and Preity Zinta. 
 
Since last month, Nestle’s flagship product of instant noodles, Maggi is in soup for alleged use of lead. 
 
As per a news report by the Press Trust of India (PTI), district court at Muzzafarpur in Uttar Pradesh has directed police to register an FIR against two Nestle officials and film stars Amitabh Bachchan, Madhuri Dix it and Preity Zinta, who have featured in the Maggi advertisements and arrest them if required. 
 
Additional Chief Judicial Magistrate Ramchandra Prasad directed Kazi Mohammadpur Police Station to register the FIR against the five and investigate the complaint. 
 
The court also directed the police to go for arrest if required in the course of investigation. 
 
The order came during the hearing of a case filed by lawyer Sudhir Kumar Ojha yesterday. 
 
The petition had named Managing Director of Nestle Mohan Gupta, its Joint Director Sabab Alam and the three film stars Amitabh, Madhuri and Preity, who have featured in Maggi ads at different times. 
 
As per the news report, the complainant claimed that he purchased Maggi from a shop at Lenin chowk of Muzaffarpur on May 30 and that he was taken ill after he ate it. This prompted him to file a case against Nestle, the maker of the noodles and the film stars who are the product's brand ambassadors. 
 
Lenin Chowk falls under Kazi Mohammadpur police station. The case has been filed under IPC sections 270 (malignant act likely to spread infection of disease dangerous to life), 273 (sale of noxious food or drink), 276 (sale of drug as a different drug or preparation) and 420 (cheating and dishonesty), confirmed the PTI news report.

A question on quiz show <keyword id="17940" type="ENTERTAINMENT" weightage="20" keywordseo="Kaun-Banega-Crorepati">Kaun Banega Crorepati</keyword> (KBC) on Sony TV, which had a reference to <keyword id="8860" type="CITY" weightage="20" keywordseo="Chhatrapati">Chhatrapati</keyword> Shivaji Maharaj, has triggered a controversy and invited the charge that it showed "disrespect" to the 17th century Maratha warrior. <keyword id="13126" type="LOCATION" weightage="20" keywordseo="Maharashtra">Maharashtra</keyword> BJP MLA Nitesh Rane on Friday demanded an apology from the entertainment giant for "disrespectful" reference to Shivaji Maharaj. Rane said, @sonykbc10 has insulted (Shivaji Maharaj) by referring him in first person singular form. It should tender apology at the earliest. Issuing a warning, he said, If they delay it (apology) further, the show will not have any life line to continue further. The controversy erupted when a question was asked in the show, hosted by megastar <keyword id="6357912" type="PERSON" weightage="20" keywordseo="amitabh-bachchan">Amitabh Bachchan</keyword>, about the contemporaries of Aurangazeb, a Mughal emperor who ruled major parts of India in the 17th century. Bachchan is also the brand ambassador of Gujarat tourism. 
 "Amitabh Bachchan will be the first choice of the ministry for the job," a Tourism Ministry source told PTI, adding actors <keyword id="2823" type="PERSON" weightage="100" keywordseo="Akshay-Kumar">Akshay Kumar</keyword>, <keyword id="598" type="PERSON" weightage="100" keywordseo="Deepika-Padukone">Deepika Padukone</keyword> and <keyword id="1655" type="PERSON" weightage="100" keywordseo="Priyanka-Chopra">Priyanka Chopra</keyword> are among those under consideration. 
 
 
He described the veteran actor as a "non-controversial" figure and noted that Bachchan was the key face for promotion of tourism in Gujarat which has seen an "upsurge" after he was hired by the state. 
 
Khan, whose comments on perceived intolerance in the country had invited flak from BJP, ceased to be the mascot for the campaign as the contract for it expired. 
 
"It was the (private) agency which has hired him. Since the contract with the agency is no more, automatically the arrangement with the actor no longer exists," Tourism Minister Mahesh Sharma had said yesterday. 
 
Khan today said he respected the government's decision to "discontinue" with his services while making it clear that he never charged anything for the 'Atithi Devo Bhava' campaign. 
 
"It is the prerogative of the government to decide whether they need a brand ambassador for any campaign, and if so, who that ambassador should be," he said in a statement.

It’s not the first time that there has been a huge recent outcry over brand ambassadors and the ‘increased reasonability’ they should take up. The latest has been about the overt lead and MSG content found in Nestlé’s Maggi noodles and the stars involved in its advertisements. 
 
Bollywood biggies Amitabh Bachchan, Madhuri Dixit and Preiti Zinta have cases filed against them under Indian Penal Code Sections 270 (act likely to spread dangerous disease), 273 (sale of toxic food or drinks), 276 (sale of drug as a different mixture) and 420 (cheating).

Would this scare celebrities off liquor ads passed off as soda, pan masala, or anything that might get them into trouble? 
 
“It actually varies person to person. These brands are sold legally and allowed to advertise. It may be a beverage to someone, and it’s their choice. Any tobacco advertising and direct alcohol advertising are not allowed anyway. After this, if anyone declines to star in a fairness cream ad saying they have moral issues, we should respect that,” Piyush Pandey, Executive Chairman and Creative Director, Ogilvy &amp; Mather India and South Asia says. 
 
Maggi noodles has been hauled for higher Lead and MSG content. Lead concentration above the prescribed limit of 2.5 ppm may lead to anemia, abdominal ache and heart palpitation. Long term effects include permanent damage to organs.

The latest outrage has come after the first trailer for the <keyword id="19982503" type="General" weightage="20" keywordseo="Nag-Ashwin" source="keywords">Nag Ashwin</keyword> sci-fi action film, <keyword id="19982502" type="General" weightage="100" keywordseo="Kalki-2898-AD" source="keywords">Kalki 2898 AD</keyword>, was released this week. While the film has already received flak from some for not delivering a trailer worthy of its astounding Rs 600 crore budget, the criticism reached an unexpected crescendo after a South Korean artist claimed that the movie blatantly copied some original elements from his artwork from a decade ago. Kalki 2898 AD is a forthcoming epic science fiction film that promises to be one of India's most monumental cinematic endeavours. Headlined by Prabhas as Bhairava, an avatar of the Hindu god Vishnu, and Amitabh Bachchan portraying the ageless Ashwatthama, the film combines mythological themes with futuristic storytelling. It is one of the most expensive productions in Indian cinema. The artist, <keyword id="22038036" type="General" weightage="20" keywordseo="Sung-Choi" source="keywords">Sung Choi</keyword>, has worked as a concept illustrator for Marvel Studios, Disney, Warner Bros, and Netflix, among a host of other production houses. Two years earlier, a song titled ‘Baby Won’t You Tell Me’ from the Prabhas-starred Saaho garnered controversy for using backgrounds that looked eerily similar to installations made by Bengaluru-based contemporary artist Shilo Shiv Suleman at the Burning Man Art festival in 2017. Many were already disgruntled that Kalki 2898 AD drew excessive inspiration from many well-known franchises such as Dune and Mad Max, to the point that it almost seems like a sequel. After the fresh allegations, many netizens have urged Choi to pursue legal action against the production house. It remains to be seen if and how Vyjayanthi Movies will respond.

The March footfalls made up for half of the Jan-March quarters footfalls in theaters. But both these companies need more than a good month to turn things around. A strong recovery in footfalls and sales of these listed theatre companies will be driven by ‘strong content slate lines’, as per ICICI Direct. If all goes well, it estimates that both these companies can cross their pre-covid earnings in the current financial year. These companies are in desperate need of a ‘recovery worthy’ movie releases. INOX CEO Alok Tandon spoke of an influx of good releases in FY23, in a conversation with Business Insider India. “2022 or financial year 2023 will be one of the best for the Indian film industry… I feel like we have some very, very strong lineup,” Tandon said. However, it disappointed movie distributors as it was declared a theatrical flop. Singh’s Jayeshbhai Jordaar too did not live up to its expectations. Kangana Ranaut’s Dhakkad, Akshay Kumar’s Bachchan Pandey, Prabhas’ Radhe Shyam too failed to impress the audiences. Apart from 83, all the other movies were released after India had overcome the third Covid-19 wave. Pushpa and Spider Man in the Hindi belt — both released in December along with 83 — were among the few movies that managed to do well despite Omicron fears. Khan’s one-year contract with the e-commerce giant is coming to an end later this month. 
 
"It was extendable by a year but the company decided against it," one of the persons aware of the matter told ET. Sources also hint that Khan might not even be replaced by another celebrity because the company is looking forward to rationalise ad expenditure and focus instead on repeat customers and enhancing shopping categories. It also aims to try and encourage its buyers to shop through its FreeCharge wallet. 
 
The move has come after Khan was in controversy regarding <a href="http://www.businessinsider.in/Aamir-Khan-says-India-is-unlivable-increasingly-intolerant-His-wife-suggested-moving-out-of-India/articleshow/49904391.cms">some comments</a> he made about the growing intolerance in the country. These comments had led to a storm of protest against the popular actor. 
 
The controversy had made <a href="http://www.businessinsider.in/Aamir-Khans-intolerance-remark-Flipkarts-Sachin-Bansal-comes-to-Snapdeals-rescue/articleshow/49926701.cms">Snapdeal stop using Khan</a> in its TVCs and other advertising media, as compared to the abundance of ads he did before the controversy, featuring in the '<keyword id="3153272" type="UNKNOWN" weightage="100" keywordseo="Dil-ki-Deal">Dil Ki Deal</keyword>' campaign. 
 
Some protestors who were angry with the actor’s remarks had also uninstalled Snapdeal's app, which could have led the company to distance itself from him.

 Talking of the controversy, the actor had said that his wife <keyword id="6371156" type="PERSON" weightage="100" keywordseo="kiran-rao">Kiran Rao</keyword> was feeling insecure about the growing intolerance in the country and had suggested moving out for the safety of their son Azad Rao Khan.
