The Amarnath Yatra is an annual pilgrimage to the holy Amarnath cave, a shrine for the Hindu God Shiva, in the mountains of south Kashmir in the months of July and August. As of 30 July, <a href="https://www.indiatoday.in/india/story/over-3-lakh-perform-amarnath-yatra-29-days-1575125-2019-07-30">Over 320, 000 pilgrims have performed</a> the annual Amarnath yatra. The India-Pakistan border in Kashmir is simmering again —  thousands of Amarnath pilgrims have been sent back due to terror threat

<ul><li>A few days ago a fake order was doing the rounds about the government scrapping Article 35A. </li><li>The governor Satya Pal Malik had denied any such order, and has asked people to not believe any such rumours. </li><li>Fake WhatsApp messages have also been doing the rounds, which should not be believed without any confirmation.</li></ul>Tension has gripped Kashmir as thousands of <keyword id="44352" type="PERSON" weightage="20" keywordseo="Amarnath-Yatra">Amarnath Yatra</keyword> pilgrims were asked to clear out of the state citing a terror threat. What is making the matter worse is <keyword id="2479020" type="PERSON" weightage="20" keywordseo="Fake-news">fake news</keyword> is spreading at a rapid pace along the India Pakistan border. The state's governor Satya Pal Malik requested citizens to not believe any news that comes their way, adding that fake news in Kashmir snowballs quickly. “Lot of rumours spread here. Don’t pay heed to this. Everything is normal. Everything is fine,” Malik <a href="https://economictimes.indiatimes.com/news/politics-and-nation/jk-governor-rejects-speculation-on-article-35-a-says-its-fake-news/articleshow/70458937.cms">had said on Tuesday </a>on the sidelines of an event. The state rumours The worst of such rumours is one claiming that the state will scrap Article 35A, which gives the state of <keyword id="23412" type="CITY" weightage="20" keywordseo="Jammu-Kashmir">Jammu &amp; Kashmir</keyword> special status. Another rumour says that the state will deploy troops to control law &amp; order once the order is passed. Yet another fake news says that Article 35A has been scrapped, that Jammu is a separate state. And also that Kashmir and Ladakh have turned as union territories. The governor has <a href="https://economictimes.indiatimes.com/news/politics-and-nation/jk-governor-rejects-speculation-on-article-35-a-says-its-fake-news/articleshow/70458937.cms">denied these rumours</a> saying that there are no plans to scrap Article 35A. He added that there was no such order came from the government. Meanwhile, ANI reported that the Divisional Commissioner of Kashmir, Baseer Ahmed Khan has said, “No schools in the district have been closed. I appeal to people to not believe any rumours. People should contact their concerned deputy commissioners for reliable information.” Fake orders too? After the clarification from the governor, former Chief Minister of J&amp;K Omar Abdullah took to Twitter to express his concern on the necessity to crackdown on fake orders that are circulating in the state. “This is a very serious matter raised by the Governor. Fake orders were circulated under the signature of senior government officers. This is not something that can be dismissed with a simple sound byte. The CBI must be asked to investigate these fake orders and their origin,” Abdullah said.

Fake news is adding to the anxiety around tensions on the India-Pakistan border

Article 370 of the Indian Constitution is a temporary provision that grants a special status of autonomy to the state of Jammu and Kashmir. Article 370 was enacted under part XXI of the constitution that pertains to "Temporary, Transitional and Special provisions". Article 370 accords special status to the state of Jammu and Kashmir. As per this article, all the different provisions of the constitution that are applicable to other states of India are not to be extended to Jammu and Kashmir. How and when Article 370 came about? The provision of Article 370 was drafted in the year 1947 by Sheikh Abdullah, who was appointed as the Prime Minister of Jammu and Kashmir together by Jawaharlal Nehru and Maharaja Hari Singh. During a discussion in the Parliament, Sheikh Abdullah argued that Article 370 must never be kept under the temporary provisions of the Constitution. He insisted that Jammu and Kashmir must be granted what he described as ‘iron clad autonomy’. However, the center did not comply with this demand. The provisions contained in Article 370 Article 370 exempts the state of Jammu and Kashmir from the Indian Constitution excepting in cases of Article 1 and Article 370 itself. The provisions of article 370 permit the state to draft its own constitution. Ultimately this means that the Parliament’s legislative powers are restricted with regard to Jammu and Kashmir. Article 370 states that the parliament will need the concurrence of the state government of Jammu and Kashmir for applying any law in the state other than those related to defense, foreign affairs, communications and finance. This will mean that the residents of the state of Jammu and Kashmir are governed by a separate set of laws in matters of property ownership, fundamental rights, citizenship and some others when compared to the Indians living in other states. As per the provisions contained in Article 370, the citizens of India from the other states of the country cannot purchase any property or land in Jammu and Kashmir. Also, this article says the central government has no powers to declare any financial emergency in the state as per Article 360. Emergencies in Jammu and Kashmir can be declared only during the times of external aggression or wars. If there are any internal disturbances within the state or there are any instances of imminent dangers, the central government cannot declare an emergency in the state unless the state government concedes to the moves of the union government. Under Article 370, the Union government cannot increase or decrease the borders of Jammu and Kashmir. Is it possible to delete Article 370? Article 370 permits deletion through a presidential order. Such an order must be however preceded by the concurrence of the constituent assembly of Jammu and Kashmir. One view says that this article cannot be deleted since such an assembly was dissolved in 1957. Another view says that it can be deleted if the state assembly concedes to deleting it.

<ul><li>The government of Jammu and Kashmir just asked pilgrims visiting the state on the Amarnath Yatra to leave as soon as possible because of ‘terrorist threats’.</li><li>Over the past week, the Indian government has deployed a total of 38,000 additional troops in the state.</li><li>Indian Air Force (IAF) planes have been seen flying overhead, including the C-17 heavy lift aircraft normally used to transport troops from one location to another.</li></ul> <keyword id="2945985" type="PERSON" weightage="20" keywordseo="Article-35A">Article 35A</keyword> of the Indian constitution contains a provision that sanctions the Legislature of Jammu and Kashmir the complete freedom to decide who will be the permanent residents of the state. As per the powers conferred by Article 35A, the state legislature can confer exclusive rights on these permanent residents in matters of property ownership, jobs in the public and private sector, scholarships, aids and other government grants and benefits. The provision contained in this article mandates that the laws made under this article by the state cannot be questioned for violating the constitution or any other laws of the land. History of Article 35A In response to the advice from the Jawaharlal cabinet, Article 35A got included into the Constitution of India in 1954 through an order issued by the then President Rajendra Prasad. The controversial Constitution included in 1954 came about after the Delhi Agreement signed in 1952 between Jawaharlal Nehru and the then Prime Minister of Jammu and Kashmir Sheikh Abdullah. This agreement extended the Indian citizenship to Jammu and Kashmir’s state subjects. Background of Article 35A The Presidential Order that brought about Article 35A was enacted under Article 370 (1) (d) of the Indian Constitution. As per this provision, the President has the powers to make some “exceptions and modifications” to the Constitution to ensure the welfare of ‘State subjects’ of Jammu and Kashmir. Hence, Article 35A was incorporated into the Constitution of India as a proof of the special attention the Indian government rendered to the ‘permanent residents’ of the state of Jammu and Kashmir. Why the Article 35A in news? While the government of India is taking serious steps to bring about permanent peace in Kashmir, it has been said that the parliamentary route to making laws was found to be bypassed when the President ordered for the inclusion of Article 35A in the Indian constitution. The Nehru government did not take steps to place it for discussion in the Lok Sabha and Rajya Sabha. In March 1961, a five member bench of the Supreme Court discussed the powers of the President under Article 370 to modify the Constitution. Though the court accepted that the President has powers to modify a provision that exists in the constitution, the judges did not comment anything about whether the President can introduce a new article without the knowledge of the Parliament. Challenging the validity of Article 35A ‘We The Citizens’, an NGO has filed a petition challenging the validity of Articles 35A and 370. They argued that while four representatives from Kashmir were present in the constituent assembly that oversaw the drafting of Constitution, no special status was given to the state of Jammu and Kashmir. Article 370 was intended only as a temporary measure to bring about normalcy in Jammu and Kashmir and empower the democracy in the state. Hence Article 370 cannot be used to make a new Article 35A. Restricting the citizens from other states of India to seek employment in the state or buy property in Jammu and Kashmir is a clear violation of the fundamental rights sanctioned by the articles 14, 19 and 21 of the Constitution of India. The Supreme Court bench led by Justice Deepak Mishra has said that the validity of Article 35A and Article 370 can be decided by a Constitution Bench.

Since then, the state has been in confusion and chaos. Making matters worse is a series of speculation by both <a href="https://twitter.com/SankarshanT/status/1157987037938511872">news outfits as well as on social media </a>that has led to people fearing the worst and hoarding food and necessities. The radio silence from New Delhi, while building up troops in the valley, in the face of rampant speculation has added to the unease, particularly in the Kashmir valley. The speculations range from the abrogation of <a href="https://www.businessinsider.in/what-is-article-35a-of-the-indian-constitution-all-you-need-to-know/articleshow/69684605.cms">Article 35A</a> and <a href="https://www.businessinsider.in/what-is-article-370-of-the-indian-constitution-all-you-need-to-know/articleshow/69684790.cms">Section 370</a> of the Indian Constitution to the splitting up of the state into 3 parts – Jammu, Kashmir, and Ladakh. However, there has been no clear evidence to suggest any of the above. Let us look at all that has happened over the last three days that have intensified tensions in Kashmir leading to warnings from Pakistan too. Security beefed up The state of <keyword id="23412" type="CITY" weightage="20" keywordseo="Jammu-Kashmir">Jammu &amp; Kashmir</keyword> has been under President’s rule since December 2018 and now, section 144, which prohibits an assembly of more than 4 people in an area, has been imposed. "As per the order, there shall be no movement of public and all educational institutions shall also remain closed. There will be a complete bar on holding any kind of public meetings or rallies during the period of operation of this order. Identity cards of essential services officials will be treated as movement passes wherever required. However, there is no curfew in place as reported in a section of media," an official statement said as reported by IANS. The government had already deployed an additional paramilitary personnel of 10,000 in the state. According to <a href="https://timesofindia.indiatimes.com/india/security-deployment-at-vital-installations-in-kashmir-increased-political-parties-hold-meeting-top-developments/articleshow/70524096.cms">reports</a>, riot control vehicles too have been deployed in the state. <keyword id="7948376" type="UNKNOWN" weightage="20" keywordseo="leaders-under-house-arrest">Leaders under house arrest</keyword> The state’s top political leaders were placed under house arrest late Sunday night. Former Chief Minister Omar Abdullah took to Twitter to write about the imminent house arrest. “I believe I’m being placed under house arrest from midnight tonight &amp; the process has already started for other mainstream leaders. No way of knowing if this is true but if it is then I’ll see all of you on the other side of whatever is in store. Allah save us,” he wrote on Twitter. His rival, and a former Chief Minister, Mehbooba Mufti wrote, “How ironic that elected representatives like us who fought for peace are under house arrest. The world watches as people &amp; their voices are being muzzled in J&amp;K. The same Kashmir that chose a secular democratic India is facing oppression of unimaginable magnitude. Wake up India.” Life comes to a standstill Internet services have been suspended since Sunday night in the state. Meanwhile, education institutions in the state too have been asked to remain shut from today until further orders. Kashmir university exams which were supposed to take place from August 5 to 10 have been postponed, according to IANS. BSNL will be giving satellite phones to media persons at the steep price of ₹1 lakh a piece to file stories from the Valley, said an IANS report. However, according to ANI, schools and colleges will reopen today in Ladakh as restrictions under Section 144 CrPC have not been imposed in the region. Security meeting in Pakistan In Pakistan, Prime Minister Imran Khan called for a <a href="https://www.dawn.com/news/1498058/nsc-meeting-pakistan-to-respond-to-any-misadventure-aggression-by-indian-forces">meeting</a> of the National Security Committee to discuss the developments along the border and reportedly, react to any steps taken by the Indian military. While Pakistan alleged that the Indian army used cluster bombs along the Line Of Control, the Indian army has said it was to foil an attempt by Pakistan’s Border Action Team (BAT) to cross over to the Indian side of the border. "Pakistan army regularly attempts to push terrorists through infiltration and opens up with multitude of weapons to assist them. India, during numerous Directorate of Military Operations-level talks, has maintained the right to respond. Such responses are only against military targets and infiltrating terrorists who are aided by Pakistan Army. Allegations of firing of cluster bombs by India is yet another Pakistan's lie and deception," <a href="https://www.indiatoday.in/india/story/indian-army-pakistan-cluster-bombs-ammunition-loc-kashmir-1576890-2019-08-03">the Indian army said in a statement.</a> Cabinet meeting in India Meanwhile, in Delhi, Union Minister Amit Shah is said to have held a security meeting including National Security Adviser Ajit Doval to discuss the situation in Kashmir. Other senior officials at the meeting included, Home Secretary Rajiv Gauba, Intelligence Bureau chief Arvind Kumar, Research and Analysis Wing (RAW) chief Samant Kumar Goel. Throughout various Telegram channels reviewed by Insider, people voiced their desire for further violence and real-world action ahead of Biden's inauguration.Despite an <a href="https://www.businessinsider.com/fbi-bulletin-warns-pro-trump-armed-protests-capitol-inauguration-day-2021-1">FBI warning</a> about potential violence organized online, it seems that for now, extremists and the far-right have found a new home.A Telegram representative did not immediately respond to a request for comment. <h2>The far-right has gradually been moving to other platforms</h2><div type="image" title="Parler logo" height="1020" width="1363" msid="80293038" hostid="261"></div>Those on the far-right have been gradually leaving mainstream platforms for years in favor of places where less content moderation often allows for the spread of misinformation, conspiracy theories, and violent <keyword id="139533" type="PERSON" weightage="60" keywordseo="extremism">extremism</keyword>.Fringe right-wing users have migrated to platforms that are either explicitly used to host conversations that would be moderated elsewhere, such as Gab, or are simply profiting off of inaction, such as Telegram, which has seen <a href="https://www.chicagotribune.com/business/ct-biz-trump-signal-telegram-whatsapp-20210114-k2qwdfook5clvc6qoiujnwtehi-story.html">skyrocketing download rates</a> after Trump was banned from his mainstream social media profiles.<a href="https://www.businessinsider.com/how-parler-rose-from-obscurity-conservative-alternative-twitter-platform-2020-11">Parler</a>, a Twitter copycat beloved by the far right since its conception in 2018, emerged as a favorite for those fleeing (or banned from) mainstream social media. Last fall, as COVID-19 and election misinformation was being moderated more heavily on mainstream platforms, many <a href="https://www.wsj.com/articles/parler-backed-by-mercer-family-makes-play-for-conservatives-mad-at-facebook-twitter-11605382430">conservatives posted on Facebook telling their friends to join them on Parler</a>. But after <a href="https://www.businessinsider.com/how-parler-rose-from-obscurity-conservative-alternative-twitter-platform-2020-11">Amazon Web Services cut ties with the platform on Sunday</a>, citing violent content related to the Capitol riots, the website has been offline for days. The company has said the platform may never return.Parler has since registered its domain with Epik, a domain registrar that the <a href="https://www.splcenter.org/hatewatch/2019/01/11/problem-epik-proportions">Southern Poverty Law Center</a> said in 2019 was "cornering the market on websites where hate speech is thriving," giving it another chance at life online. Gab, a Facebook copycat, is also registered with Epik. But in the interim, Trump's most ardent supporters and those seeking to organize more real-world action ahead of the inauguration are finding new places to gather. <h2>Telegram has emerged as a gathering place for the far-right, despite the platform's stated intent to ramp up moderation</h2><div type="image" title="FILE PHOTO: The Telegram messaging app logo is seen on a website in Singapore November 19, 2015. Its search function makes it easy to find like-minded individuals. In addition to right-wing extremists joining the app, the platform's recent rise is also due to <a href="https://www.businessinsider.com/whatsapp-facebook-data-signal-download-telegram-encrypted-messaging-2021-1">a change in WhatsApp policies</a>. Facebook, which owns WhatsApp, said that users would have to share their data with the parent company starting February 8. That helped spike downloads for Telegram, which has similar functionality to WhatsApp. Telegram founder Pavel Durov said in a blog post on Thursday that the movement was "the largest digital migration in human history." Conservatives and the far-right are a major part of this migration, having been moderated off of other platforms.Telegram has said that it's taking steps to increased moderation to address some extremist content. In the past, they've "generally opted to not do anything about it," as Ali Breland of Mother Jones<a href="https://www.motherjones.com/politics/2021/01/telegram-nazi-ban/"> reported</a>, but Telegram recently said it would crack down on neo-Nazi and white nationalist channels that had participated in "calls for violence." Despite Telegram's claims, it still currently hosts large groups with thousands of people for organizations that have been linked to or perpetrated violence, including the Boogaloo Bois, the Proud Boys, and Stop the Steal. A review of messages in these groups found daily messages with incendiary and violent language that often targets racial or ethnic groups.Of course, the violent tone of many far-right extremists doesn't apply to all Trump supporters headed to Telegram. In a channel called Trump Supporters Channel, which has over 140,000 subscribers, some members still <a href="https://www.buzzfeednews.com/article/craigsilverman/fbi-no-antifa-capitol-mob">baselessly</a> claim that the insurrection was a <a href="https://www.insider.com/antifa-capitol-riot-protest-false-washington-facial-recognition-found-report-2021-1">"false flag" from antifascists</a> or others pretending to be Trump supporters. In another channel, one member suggested Trump supporters boycott watching TV coverage of Biden's inauguration.In a Telegram group for followers of the Boogaloo Bois movement, the channel's owner actually made fun of Trump for "talking about 'the next administration.'" But many are having trouble agreeing on their next steps following the Capitol riot. While some people say they want to riot again on Inauguration Day, others have suggested different dates, as <a href="https://www.nytimes.com/2021/01/11/technology/fringe-groups-splinter-online-after-facebook-and-twitter-bans.html">The New York Times' Sheera Frankel reported</a>, which has caused confusion and disagreements.<h2>Banning extremists from mainstream platforms can make tracking their moves difficult</h2><div type="image" title="QAnon protester" height="1119" width="1492" msid="80293053" hostid="261"></div>While some of these more private groups may be harder for people to find, away from the recommendation algorithms on Facebook and YouTube, many have had time to prepare and warn their followers to find them elsewhere."Because platforms are only now taking decisive action, the alt-platforms are allowing an almost seamless transition so conversations and groups are not necessarily disrupted - only moved," Joe Ondrak, a disinformation researcher at Logically, a fact-checking website that uses artificial intelligence to analyze misinformation and disinformation, told Insider in an email.As<a href="https://www.axios.com/the-online-far-right-is-moving-underground-e429d45d-1b30-46e0-82a3-6e240bf44fef.html"> Axios reported</a>, citing Apptopia data, downloads of the app versions of Rumble, MeWe, CloutHub, and Telegram, all of which have become popular for the far-right, each more than doubled in recent weeks. Dipayan Ghosh, a senior fellow at the Harvard Kennedy School, told Axios that extremists moving to more private or, in some cases, encrypted platforms, is "absolutely concerning." There's also evidence that some extremists are spreading their beliefs through even more private means. Ben Collins of <a href="https://www.nbcnews.com/tech/internet/qanon-falsehoods-move-text-message-chains-n1253962">NBC News reported</a> that followers of QAnon had taken their organizing and spread of conspiracy theories to text chains. QAnon, a baseless far-right conspiracy theory alleging Trump is fighting to take down a "deep state" cabal of pedophiles and human traffickers, has thrived through believers spreading anti-mask rhetoric and other medical misinformation related to the pandemic. Since the election, the movement has shifted its efforts to <a href="https://www.insider.com/capitol-riots-qanon-protest-conspiracy-theory-washington-dc-protests-2021-1">focusing on voter-fraud conspiracy theories</a>, which played a huge role in the insurrection. Twitter <a href="https://www.nytimes.com/2021/01/11/technology/twitter-removes-70000-qanon-accounts.html">announced</a> that it removed more than 70,000 QAnon-linked accounts after the Capitol riot. Research tracking how terrorist groups responded to bans from mainstream platforms might offer some insight into how far-right extremists will fare. <a href="https://twitter.com/AmarAmarasingam/status/1348147867739975681">Amarnath Amarasingam</a>, an associate fellow at the International Centre for the Study of Radicalisation, <a href="https://www.cnn.com/2021/01/12/tech/deplatforming-trump-parler-effects/index.html">told CNN</a> that de-platforming ISIS content "protects against" users discovering and becoming radicalized by that content. Removing "violent extremists" from mainstream platforms "will make them harder to be found and, even more importantly, to stumble upon casually," Amarasingam said. Still, this migration poses a challenge for researchers and law enforcement officials trying to track threats of violence. Nick Backovic, a contributing editor at Logically, told Insider that "disinformation researchers already know where the true extremist content lives." But, he warned, "if these platforms grow, it becomes a numbers game because we have far fewer pairs of eyes on these platforms than we do on the bigger ones." Backovic also warned that extremists could find their ways back to mainstream platforms eventually. "If the mainstream social media platforms aren't committed to this deplatforming long term, many of these accounts might eventually just make their way back anyway," he said, "but if they are, it'll change a few things in the way we monitor extremist content."
