Twenty one year old <keyword id="1670338" type="PERSON" weightage="20" keywordseo="Ritesh-Agarwal">Ritesh Agarwal</keyword> is on cloud nine. His company, <keyword id="2550719" type="UNKNOWN" weightage="20" keywordseo="OYO-Rooms">OYO Rooms</keyword> has recently raised Rs 150 crore funding from its investors, Lightspeed, Sequoia, Greenoaks Capital and DSG Consumer Partners. 
	 
	“This would be one of our largest capital raises for us,” said Agarwal. 
	 Founded in 2013, OYO Rooms revolves around the concept of making budget hotel experience customer friendly. This segment has remained fragmented and disorganized for long time. “When I was 18, I travelled across the country and stayed at more than 100 <keyword id="507551" type="UNKNOWN" weightage="20" keywordseo="budget-hotels">budget hotels</keyword>. This journey led me to realize how difficult it was to get a pleasant and reliable consumer experience in these hotels. So, in a quest to make affordable ‘real’, I started OYO Rooms. Our vision is to offer the ‘OYO Rooms experience’ to every business, leisure and pilgrim traveler across 100 cities through a network of 10,000 hotels,” he averred. 
	 He further added, “We act like the Ola (<keyword id="6362049" type="UNKNOWN" weightage="20" keywordseo="Ola-Cabs">Ola cabs</keyword>) for hotels where we go to fragmented segment of private hotels. We tie up with them and brand them as OYO Rooms. Thus, these budget hotels can deliver the customers a much better experience. We call ourselves a branded budget hotel website.” 
	 
	Explaining the business model of the company, Agarwal noted that company facilitates technology enabled hotels in the country. “We have built a very high quality, compatibility playbook wherein by entering information about the hotel, the owner’s background and other such details, we can check our compatibility with these hotels. This process helps us select only those hotels that we feel are best for our consumers in terms of location, customer experience, infrastructure among others,” he stated. 
	 
	The company has a robust technology system in place. OYO Rooms have an hotel manager application which allows the company to know about a customer’s check-ins and check outs of the hotel. “So, we have an app through which I can know what time did a customer check-in and what time he ordered for room service. Besides, we also ensure that the entire process of check-outs is simplified as our technology enables us to send the invoice directly to the customer’s mobile. All this has helped us increase the occupancy rate of the hotel to nearly 85%,” elaborated Agarwal. 
	 
	The company also carries out audits of its properties on regular basis through another application to ensure that the standard of customer experience is maintained. The application enables the firm to see the condition of a room in real time. And if there are more than three negative customer feedbacks about a hotel, the firm shuts it down temporarily. 
	 
	Talking about the challenges in this business, Agarwal recalled that the biggest difficulty was getting hotels onboard. “We realized that the key things that hotel owners really care about are – occupancy, pilferage and customer experience. A woman says the lush Bali Airbnb villa she booked ended up looking more like a 'prison cell'

<div class="KonaFilter image-container float_right"><div class="image">Air BnB</div></div>New York State Senator Liz Krueger issued a statement saying <a href="http://nypost.com/2014/04/14/hookers-using-airbnb-to-use-apartments-for-sex-sessions/">a New York Post report published Monday</a> that described escort services using AirBnB shows how the startup dedicated to letting people rent their homes and apartments to guests could fuel illicit activities.
In addition to prostitution, Krueger claimed Air BnB could also lead to gambling and drugs.
"The outcome of this, predictably, has been constant streams of tourists disrupting residential buildings, and other inappropriate, even illegal activity floating from building to building," said Krueger of the company's services. "Today it's a prostitution ring, tomorrow it could be an illegal gambling ring, and maybe next week it could be a drug operation. There's really no way to know."
The Post report included <a href="http://nypost.com/2014/04/14/hookers-using-airbnb-to-use-apartments-for-sex-sessions/">an interview with a prostitute</a> who said her escort service generally uses Air BnB rooms rather than hotels to "save $200 to $300 a night." The Post also told the story of a woman who said she rented her apartment via Air BnB only to receive a call from police when an alleged prostitute got slashed there after getting into an argument over the price of their services. According to the woman, when she returned to the apartment, she found "baby wipes and 'at least 10 condoms'" inside. Air BnB subsequently paid for the woman to temporarily stay in a hotel, cleaned her apartment, and replaced some of her belongings.
Krueger, a Manhattan Democrat who has sponsored legislation in 2010 aimed at helping New York City take action against illegal short term renters, said prostitution was an "obvious" consequence of Air BnB's business.
"When residential housing ceases to be residential-via online businesses, like Airbnb, turning residential apartments into illegal, unregulated hotel rooms-all kinds of undesirable and illegal activity can be brought into a residential building," said Krueger. "Prostitution wasn't really at the top of our minds when we passed the 2010 law helping NYC enforce against illegal short-term rentals, but in hindsight it seems kind of obvious."
She also argued Air BnB needs to do more than "textbook PR" to help people avoid "disasters" like finding escort services in their home. 
"What we do know is that Airbnb continues to demand we legalize its illegal conversion of apartments into short-term hotel rooms," Krueger said. "And while it's nice that Airbnb spares no expense in compensating hosts who experience disasters like the use of their apartment as a headquarters for a floating brothel, that's a textbook PR tactic and shouldn't be mistaken for actual responsibility. Because if Airbnb were truly responsible, they would stop openly violating our local laws, or at least stop enthusiastically encouraging New Yorkers to rent out their apartments <a href="http://valleywag.gawker.com/airbnb-hides-warning-that-users-are-breaking-the-law-in-1561938121" target="_blank">without giving them fair warning</a> that it's probably illegal, almost certainly violates their rental lease or coop/condo rules, and could get them evicted."
Kruger also said Air BnB doesn't isn't concerned about the consequences of its actions because its executives don't live in the buildings where it rents rooms.
"There's a reason that we zone certain areas, buildings, and neighborhoods to be residential -- both because we need to protect the limited housing stock we have from being arbitraged into other uses, and because residents living side-by-side and on top of one another in apartment buildings deserve some ground rules and guarantees about what they have to put up with," said Krueger. "Companies like Airbnb have decided to ignore all that, so they can pull in revenue from the estimated <a href="http://skift.com/2014/02/13/airbnb-in-nyc-the-real-numbers-behind-the-sharing-story/" target="_blank">two thirds of their New York City business that's illegal</a>. What do they care? They don't live in these buildings."
Last year, a New York City man said his department was severely damaged after Air BnB renters <a href="http://www.businessinsider.com/airbnb-freak-fest-2014-3">used it for an event marketed as an "XXX Freak Fest."</a> Air BnB customers have also reportedly used rentals for prostitution in Washington D.C. The company <a href="http://nypost.com/2014/04/14/hookers-using-airbnb-to-use-apartments-for-sex-sessions/">responded to the Post story</a> by noting it is cooperating with the police. 
"The entire hospitality industry deals with issues like this, and we have zero tolerance for this activity," the company said.

New York Lawmaker Warns That AirBNB Could Be Used For Gambling And Drugs Next

<div class="KonaFilter image-container display-table float_right"><div><div class="image">Reuters/ Brendan McDermid</div></div></div>The biggest news to come out of the biggest investment conference of the year on Monday was that David Einhorn is shorting athenahealth, a company that helps small, non-hospital healthcare firms do things like collect bills, process claims, and manage patient records.
To David Einhorn this looks like a business process outsourcing company (BPO) - a company that helps other companies. Cool solid business but nothing eathshattering.
To athenahealth's CEO Jonathan Bush, this is a radical company changing the face of healthcare through technology.
We published <a href="http://www.businessinsider.com/einhorn-at-sohn-investment-conference-2014-5#!K81Mb">Einhorn's main presentation here</a>, but we also get that some people don't want to click trough 67 slides filled with discounted cash flow projections and what not.
So we'll keep it nice and simple for you. There are really three big reasons why Einhorn thinks this company's stock is ridiculously overvalued.

<li>It simply hasn't met analyst expectations,</li>
<li>it's narrative about itself is all out of whack,</li>
<li>and because of that narrative Wall Street makes wild assumptions about how well the business can do in the future.</li>
</ol>
Before we break all that down, though, here's a recap of the action this week:
Since Einhorn spoke the athena's stock has fallen over 15% to around $108. His best case scenario is that it will go down to $50 - worst is that it will sink to $14.
Meanwhile, Jonathan Bush, athenahealth's CEO is making the rounds doing damage control, and has said that he <a href="http://www.businessinsider.com/jonathan-bush-squawkbox-2014-5">still believes the stock is worth $1,000, </a>though he's not sure how anyone comes up with valuations.
"I don't know what we're worth," he said on Bloomberg TV. "What I do - I know we're worth $1,000 a share, no problem, at some point in the future. And it's up to David and others to decide when by discounting back what they think… I pulled [the valuation] out of my ear."
This is probably not the best thing for a CEO to say, especially since (per our first reason why Einhorn doesn't like this stock) his company hasn't met the expectations that analyst set for it over the past several quarters.
The stock started going bonkers back in 2012 when it shot up from $60 to $204 in 16 months. Now, for an explosion like Einhorn says you'd need organic revenue growth of 30%, but athena hasn't come close. In fact, its targets have been lowered for 2014 and 2015. The same thing goes for gross and operating margins.
So why are analysts ignoring the fact that this company isn't performing in line with its stock price? Einhorn argues that it is, in part, because of the company's narrative. Bush says that athena is a revolutionary "cloud based software" solution. He compares it to companies like Salesforce, Facebook, Air BnB, Opentable....
"Saying cloud over and over doesn't make it rain," Einhorn wrote in his slide deck.
His point is that athena is a BPO, period. That means it's in a peer group with margins averaging around 10% before stock based compensation.
Meanwhile, expectations of athenahealth's margins with stock based compensation have been lowered to somewhere around 5% going into 2015.
But analysts keep on plugging in numbers based on this anthena-as-Amazon narrative, which means the assumptions (in Einhorn's opinion) get pretty wild. In his presentation he really ripped into Morgan Stanley for doing this in a variety of ways.
Einhorn says the Morgan doesn't just confuse athena with Facebook, it confuses it with a bigger company that services bigger, wealthier doctors, but it doesn't do that.
From the presentation:
"Morgan Stanley says the average doctor currently collects $636,000 annually, on the way to $1.3 million in 2030. Currently, athena's doctors collect only $370,000 of which athena keeps about 4.4% or $16,000. Athena's doctors get much less than the national average because athena has a concentration in low-earning primary care physicians. Even if athena were to win higher-billing physicians, athena would adjust its billing rate downward because it prices its business to earn a certain amount per physician, and uses a sliding scale so higher-billing doctors pay a lower percentage... Morgan Stanley assumes athena will recognize $63,000 in revenues per doctor by 2030 from $16,000 today. We think it is more reasonable to assume that revenue per doctor grows with Ambulatory spending. On that basis, Athena's revenue per doctor would still more than double to $36,600 in 2030."
More than that, if athena wants to get into that bigger doctor, hospital space it has to contend with the leader in that world, Epic Systems, a company with 100% retention rate among its big healthcare customers.
Meanwhile, as those big healthcare customers swallow up little doctors and hospitals (as is all the rage right now), they're switching the little guys into the big guys' system. Einhorn thinks this means that athena could lose customers like Integris, CaroMont, Vanguard and more.
Simple stuff, really.

Here's A Guide To David Einhorn's Battle Against A Company That Thinks It's Revolutionizing The Healthcare Industry

<div class="KonaFilter image-container float_right"><div class="image">Air BnB</div></div>On Monday, the office of New York State Attorney General Eric Schneiderman released a list of the top Airbnb users with at least one "illegal" listing on the site. Business Insider reached out to the top five alleged Airbnb lawbreakers Tuesday in an attempt to get their side of the story. 
Schneiderman has been investigating Airbnb last year in an attempt to stop users from violating a New York law that prohibits renters from subletting entire apartments for less than 30 days at a time in buildings with three apartments or more. As part of that investigation, Schneiderman <a href="http://www.businessinsider.com/airbnb-purging-thousands-of-illegal-listings-2014-4">subpoenaed the company</a> for information about more than 16,000 users who rent rooms on the site. Airbnb has attempted to quash that subpoena. Schneiderman filed an affidavit in support of the subpoena Monday including research from his office alleging <a href="http://www.businessinsider.com/airbnb-purging-thousands-of-illegal-listings-2014-4">two thirds of the site's users in New York appeared to be violating the law</a>. 
The top five users on Schneiderman's list come from a variety of backgrounds. Business Insider found a company with over 100 listings on the site, a real estate agent who said he had no idea he was being targeted by the Attorney General, an international entrepreneur, a boutique hotel, and a Brooklyn man who said he just wants to rent spare rooms in his apartment.

The user with the most Airbnb listings on Schneiderman's list is Metro Inc. According to the Attorney General's office, as of October, Metro Inc. offered 134 listings, 123 of which seemed to violate the law.
Airbnb released a statement Monday saying it <a href="http://www.businessinsider.com/airbnb-purging-thousands-of-illegal-listings-2014-4">removed over 2,000 listings</a> posted on the site by "bad actors." In a separate statement to Business Insider Monday, Airbnb spokesman Nick Papas said the effort to purge those listings had been underway for "months." Because of this, Metro Inc.'s page on the site is no longer active, but Google cached pages show its <a href="http://webcache.googleusercontent.com/search?q=cache:vS6a-a-r35kJ:https://www.airbnb.com/users/show/1936159+&amp;cd=1&amp;hl=en&amp;ct=clnk&amp;gl=us">profile was still there Monday</a> and some of its <a href="http://webcache.googleusercontent.com/search?q=cache:yHyYD7ALUDQJ:https://www.airbnb.com/rooms/920109+&amp;cd=1&amp;hl=en&amp;ct=clnk&amp;gl=us">listings were visible as recently as Sunday</a>. 
Metro Inc.'s profile and listings described it as a "registered company in NYS" that offered "ONLY LEGAL" listings. An advertisement for one of its listings on West 46th Street in Manhattan said Metro Inc. had multiple properties available in the same building. 
"NO WORRY ABOUT LEGAL ISSUE IN NYC HOUSING LAW. OUR property is in zoning C6 (commercial). So it is not illegal to do short term. IT IS LEGAL TO RENT YOU OUT THE APARTMENT," the advertisement said. "WE ARE DOING ONLY LEGAL."
Metro Inc. could not be reached for comment Monday. In spite of what its ads say, Metro Inc. does not appear to be listed in the New York Corporation and Business Entity Database and seems to be using <a href="http://www.metrohotels.com.au/">the logo of an Australian hotel chain</a>.

According to Schneiderman's office, as of October, Eran Haviv had 42 listings on Airbnb, 12 of which seemed to violate the law. Haviv's profile is no longer on the site, but a cached version captured April 16 described him as a "top-producing broker in luxury rentals and sales" and the founder of the "boutique real estate firm, Essence-Realty." 
"To Eran, relationships are the key to any service business, especially real estate. Deals will happen if you're good at what you do, conduct yourself honorably and professionally, properly educate clients on the market, and know how to find the right people-property fit," the profile said.
A website for Essence Realty describes it as a four-person firm that offers both rentals and "guest suites." Business Insider spoke to Haviv Tuesday and he said the company "called" him last week and said it would be removing his listings. Haviv claimed he was unaware of Schneiderman's list, but he said none of his apartments on Airbnb were being rented for periods of less than 30 days. 
"I had Airbnb listings, but I didn't do any of the daily that they are talking about, so I don't have any problem with them putting me on the list," Haviv explained. 
Haviv also said most of his listings actually belonged to other people. 
"I had a lot of listings there, you know, most of them are not mine. I'm advertising other peoples' listings to help them rent apartments," said Haviv, adding, "But nothing for daily, nothing less than 30 days."
Haviv subsequently admitted he had "one" listing that was offered for a period of less than 30 days, but he said he never found anyone who wanted it. According to Haviv, he attempted to rent the property as a favor to a friend who went on a trip. 
"I had one but it was never rented," Haviv said. "It was just there because, you know, it was a temporary vacation, somebody went for vacation."
Haviv would not say how much he made on the site.
"I'm not able to answer any of those questions," Haviv said. "I'm sorry my friend."

Peter Chen describes himself as a "regular host" on Airbnb who also works as a bartender. He said Airbnb removed his listings on the site yesterday. According to Schneiderman's office, as of October, Chen had 38 listings, eight of which seemed to violate the law. 
Chen told Business Insider he rented rooms in his four-bedroom apartment on the site as well as rooms for friends, who gave him managing fees. He said he "predominantly" rents rooms within apartments, but has rented entire apartments "on occasion."
"I'm a regular host that basically has - I have my place that I rent out just like anyone else and I've been doing that for, I'd say two-and-a-half years now," Chen said. "Over time, I've had friends that basically have their places and they just wanted me to list their place, essentially piggybacking off of my reviews. ... I started doing a business on my own where I would manage properties and take a percentage for the booking."
In total, Chen said he made "probably like $45,000 or $50,000" using Airbnb last year, which he paid taxes on. Chen said he did not realize he was breaking the law and would like to keep his profile on the site offering only lawful listings. He also said he has "been calling" Airbnb in an attempt to keep the <a href="http://webcache.googleusercontent.com/search?q=cache:AHnIF9WAAP8J:https://www.airbnb.com/users/show/2110857+&amp;cd=1&amp;hl=en&amp;ct=clnk&amp;gl=us">more than 300 reviews</a> he accumulated on the site since 2012. 
"I've been working a couple of years to have these good reviews and, right now, I'm just trying to salvage my own profile and be able to at least host out of my own place," Chen said.

According to Schneiderman's office, as of October, "Jay" had 33 Airbnb listings, 25 of which were illegal. "Jay's" profile is no longer on the site, but a cached version of his profile and listings show he offered properties in both Manhattan and the tony Gangnam District in Seoul, South Korea. "Jay's" profile described him as a travel professional. 
"I have more than 10 years of experience as a NYC tour guide and have been running a travel agency based in NYC for the past 5 years. I enjoy meeting people from all over the world. I hope to help you make your trip to NYC a pleasant one," he wrote. "Currently I have 18 properties in the Midtown, Manhattan area. You have a variety of properties to choose, from cozy studios to 3 bedroom apartments."
"Jay" could not be reached for comment.

According to Schneiderman's office, "Dana" has 28 listings on Airbnb, 28 of which seem to be violating the law. However, Dana's profile, <a href="https://www.airbnb.com/users/show/417504">which is still on the site</a>, identifies him as the "Box House Hotel."
Business Insider tracked him down Tuesday, and he said his full name is Dana Schneider and he is director of the hotel. Schneider said all of his listings on Airbnb are rooms at the hotel, which advertises rooms using the site. In addition to private roomsharing, Airbnb does indeed allow some small hotels to book rooms on the site. 
According to its website, the Box House Hotel is a <a href="http://theboxhousehotel-px.trvlclick.com/about/">"loft-style" hotel</a> in Greenpoint, Brooklyn. Records from New York City's Department of Buildings show it is <a href="http://a810-bisweb.nyc.gov/bisweb/PropertyProfileOverviewServlet?boro=3&amp;houseno=77&amp;street=box+street&amp;go2=+GO+&amp;requestid=0">classified as a legal hotel</a> by the city's Department of Finance.
