Expanding the scope of its hearing in the <keyword id="19980518" type="General" weightage="20" keywordseo="Patanjali" source="keywords">Patanjali</keyword> Ayurved case, the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="266" meta.entityid="Supreme Court">Supreme Court</keyword> on Tuesday took a stern view of <keyword id="20610549" type="General" weightage="20" keywordseo="misleading-advertisements" source="keywords">misleading advertisements</keyword> by FMCG firms and asked three Union ministries to inform it about the steps they have taken to curb the practice which takes "public for a ride" and adversely affects their health. The court passed the order after Yoga guru Ramdev and his aide Balkrishna of Patanjali Ayurved Ltd. told a bench of Justices Hima Kohli and Ahsanuddin Amanullah that they have issued unqualified public apology in as many as 67 newspapers over misleading advertisements and are willing to issue additional advertisements expressing their contrition. The bench said the public apology published in newspapers were not on record and asked those to be filed within two days. It posted the matter for April 30 for further consideration. While hearing the Patanjali case, the apex court said the implementation of the relevant provisions of the Drugs and Magic Remedies (Objectionable Advertisements) Act, the Drugs and Cosmetics Act and the Consumer Protection Act and the related rules also needed a closer examination. It said the issue was not limited to Patanjali but extended to all Fast-Moving Consumer Goods (FMCG) firms which have been issuing "misleading advertisements and taking the public for a ride, in particular affecting the health of babies, school-going children and senior citizens who have been consuming products on the basis of the said misrepresentation". "We must clarify that we are not here to gun for a particular party or a particular agency or a particular authority. This is a PIL, and in the larger interest of the consumers, public should know which way they are going and how and why they can be misled, and how authorities are acting to prevent it," the bench said. The court asked the Union ministries of consumer affairs, information and broadcasting, and information technology to explain what action they have taken to prevent the misuse of consumer laws. It also sought an explanation from the Centre over an August 2023 letter issued by the Ministry of Ayush to the licencing authorities of all states and Union Territories and drug controllers of Ayush asking them to not initiate any action under rule 170 of Drugs and Cosmetics Rules, 1945. The bench also asked the <keyword id="20083252" type="General" weightage="20" keywordseo="Indian-Medical-Association" source="keywords" meta.keywordsubtype="org" meta.entityname="Indian Medical Association" meta.hostid="266" meta.entityid="Indian Medical Association">Indian Medical Association</keyword> (IMA), the petitioner in the Patanjali advertisements case, to "put its house in order". It said several complaints have been made about alleged unethical acts by members of the IMA who prescribe highly expensive medicines and line of treatment. The bench also ordered impleading the National Medical Commission (NMC) as a respondent in the matter for effective assistance to the court. At the outset, senior advocate Mukul Rohatgi, appearing for Ramdev and Patanjali Ayurved Ltd managing director Balkrishna, told the bench they have issued on Monday unqualified apology for the "lapses" on their part. "Where? Why it is not filed?" the bench asked. Rohatgi said it was issued on Monday in 67 newspapers across the country. When the court asked the senior advocate why did the respondents wait for a whole week before publishing the public apology, Rohatgi said, "Its language had to be changed". The court also quizzed him about the size of advertisements. "Is it the same size of advertisements that you normally issue in newspapers?" it asked Rohatgi, who submitted "It costs tens of lakhs (of rupees)". The bench ordered that the apology published be filed on record and added it wanted to see the actual advertisement published in newspapers. "The said advertisements are not on record. It is submitted that the same have been collated and shall be filed in the course of the day with copies to counsel for the parties. Needful shall be done within two days with copies to counsel for the parties," it said. The counsel said additional advertisement shall be issued by Ramdev and Balkrishna tendering unqualified apology for the lapses on their part. The bench said it was necessary to implead the three central ministries in order to examine the steps taken to prevent the abuse of the Drugs and Magic Remedies (Objectionable Advertisements) Act and rules, the Drugs and Cosmetics Act and the Consumer Protection Act. It said these ministries shall file affidavits enunciating the action they have taken to prevent the misuse/abuse of these statutes along with the relevant data since 2018. The bench said licencing authorities of all states and UTs shall also be impleaded as co-respondents in the matter. The bench told the IMA's counsel that while they are pointing fingers at Patanjali, "the other four fingers are also pointing at you (IMA)". On April 16, the apex court had warned Ramdev and Balkrishna against any attempt to "degrade allopathy" and permitted them to tender a "public apology and show contrition" within a week in the contempt proceedings in the misleading advertisements case against Patanjali Ayurved Ltd. The apex court is hearing a plea filed in 2022 by the IMA alleging a smear campaign against the Covid vaccination drive and modern systems of medicine. Ramdev and Balkrishna had earlier tendered an "unconditional and unqualified apology" before the top court over advertisements issued by the firm making tall claims about the medicinal efficacy of its products. Supreme Court expands Patanjali misleading ads hearing to include FMCG companies

<ul class="summary-list"><li>French media and ad groups are calling on Apple to suspend its new "Distraction Control" feature, Business Insider is exclusively reporting.</li><li>They argue the new iPhone tool could hamper websites and advertising.</li></ul>A group of French trade associations representing around 800 companies in the advertising and media sectors has sent an open letter to Apple CEO Tim Cook, calling for the tech giant to suspend the rollout of the iPhone's new "Distraction Control" feature.Distraction Control, which became <a target="_blank" class="" href="https://www.businessinsider.com/best-apple-ios-18-features-2024-6">available with iOS 18</a> this fall, allows users of the iPhone's Safari browser to hide elements on webpages like images, pop-ups, or ads. It'll then remember those requests when the user revisits the page — though Apple says it doesn't permanently hide elements of websites that frequently change, such as ads.In the letter sent Thursday, a copy of which was seen by Business Insider, the French trade groups list three main concerns with the feature, having tested the beta and publicly released versions.Apple didn't respond to requests for comment.In the letter, the groups raise concerns that users could hide websites' consent management platforms — the tech that powers cookie consent pop-ups — which could put site owners at risk of noncompliance with Europe's General Data Protection Regulation.This could also hamper publisher revenue, they say in the letter. European media companies are <a target="_blank" class="" href="https://pressgazette.co.uk/marketing/consent-or-pay-news-websites-uk/#:~:text=Sara%20Vincent%2C%20managing%20director%2C%20UK,of%20monetisation%20for%20the%20publisher.">increasingly asking users to consent to being served personalized advertising</a> — which is generally more lucrative than non-targeted ads — or else pay to access their content.The French trade groups also say in the letter that they found in testing that — on some occasions — all ads on certain websites were hidden after the user chose to hide ads on one page on the site.The letter says this poses "an existential threat to the online advertising model, which underpins a significant portion of the internet's economy."Lastly, the letter says that by allowing users to hide any content on a webpage — and in particular, the editorial content produced by media outlets — Distraction Control could fuel the "manipulation of information" and its spread across the internet. While it's possible to manipulate web pages using image-editing tools, Distraction Control makes it very easy to zap away certain content with a tap, take a screenshot, and share it, said Pierre Devoize, deputy managing director of digital marketing organization Alliance Digitale, one of the trade associations that co-signed the letter.The letter was co-signed by Alliance Digitale, press organization Alliance de la Presse d'Information Générale, online publishing association Geste, ad agency body Syndicat des Régies Internet, advertising group Union des Marques, and UDECAM, the union of media buying and planning agencies.The letter urges Apple to suspend the rollout of Distraction Control and to provide technical documentation about its functionalities and any planned updates.The groups say in the letter that they are "actively considering all available legal resources" related to data protection, freedom of the press, intellectual property rights, copyright and trademark law, and competition regulation.The letter was also copied to several French ministers, the French competition authority, and the European Commission.<h2 id="ceb5ec9d-7e4e-49f3-90c8-cbe55694c8fe">Publishers and ad companies have been hit by Apple software updates in the past</h2>Earlier this year, the same French groups raised concerns to Apple about reports about an anticipated feature called "<a target="_blank" class="" href="https://www.businessinsider.com/publishers-advertisers-ask-tim-cook-halt-apple-web-eraser-tool-2024-5">Web Eraser</a>," which they worried could hobble their ad revenue.That letter was in response to reporting from <a target="_blank" rel=" nofollow" href="https://appleinsider.com/articles/24/04/30/apple-to-unveil-ai-enabled-safari-browser-alongside-new-operating-systems">AppleInsider</a> that, citing people familiar with the matter, described the planned feature as allowing Safari users to remove content and have the browser recognize those choices — a description that bears a striking resemblance to Distraction Control. The UK publishing group <a target="_blank" href="https://www.ft.com/content/c6dcbe7b-eaf0-41d1-adb4-f9a68542e2cb">News Media Association</a> also sent a letter to Apple warning that such a tool would threaten the financial sustainability of journalism.AppleInsider later reported Apple had changed the name of the feature from Web Eraser to Distraction Control and updated it to include a popup explaining that it would "not permanently remove ads."Publishers and ad companies have been hit by Apple software updates before. Its 2021 App Tracking Transparency update forced app owners to get explicit permission from users before tracking them across other apps and websites. Victims are then asked to share their Aadhaar number, PAN, or other personal details via a fraudulent link or over a call. In some cases, they also ask users to complete the process through UPI apps, stealing money from their accounts during the process. Hosting two <keyword id="22177" type="General" weightage="50" keywordseo="world-cup" source="Orion">World Cup</keyword> games in as many days is not ideal for organisational as well as security reasons and hope a one day breather is provided, said a <keyword id="66464" type="General" weightage="50" keywordseo="hyderabad-cricket-association" source="Orion">Hyderabad Cricket Association</keyword> (<keyword id="6374916" type="General" weightage="80" keywordseo="hca" source="Orion">HCA</keyword>) official on Sunday, signalling another change in schedule for the ODI showpiece beginning in <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword> on October 5. After a much-delayed schedule announcement in June, the <keyword id="6354756" type="General" weightage="80" keywordseo="bcci" source="Orion">BCCI</keyword> and ICC rescheduled as many as nine games earlier this month, including the marquee clash between India and Pakistan. With the Indo-Pak fixture in Ahmedabad advanced by a day on October 15, Pakistan's game against Sri Lanka in <keyword id="6354552" type="General" weightage="50" keywordseo="hyderabad" source="Orion">Hyderabad</keyword> was moved to October 10 from October 12. The HCA is also hosting New Zealand versus Netherlands on October 9. Now, with Hyderabad police expressing its reservations on providing security for back-to-back games, another change is on the cards. "I can't say it would be changed for sure but back to back games are not ideal. I mean if they (BCCI) are reconsidering that will be well in good. We will have to work with security agencies. "Anyone would want a day in between two World Cup games. We are still engaging with security agencies to see if it is possible or not. At the same time we are also keeping BCCI in the loop. The BCCI is completely aware of what we are trying to do," said an HCA official on condition of anonymity. For an international game, the Hyderabad Police deploys between 2000-2500 personnel. "Deployment also depends on nature of the game and how many people turn up. Police makes those assessments and deploys accordingly," the official added. Considering Pakistan's involvement in one of those games, the security is expected to be heightened. Pakistan, who will play in India for the first time since T20 World Cup 2016, will have a lengthy stay in Hyderabad as they play two warm-up games before featuring in as many tournament proper matches at the venue. Their opening fixture is against Netherlands at the Rajiv Gandhi International Stadium on October 6. The ticket sales for the ODI mega event start on August 25, not providing enough time to the average cricket fan to plan his or her travel. <ul><li><keyword id="248051" type="PERSON" weightage="20" keywordseo="Ashish-Bhasin">Ashish Bhasin</keyword>, President of AAAI has sent a detailed set of recommendations on behalf of the members of AAAI, to the Union Minister of Information &amp; Broadcasting <keyword id="119642" type="PERSON" weightage="20" keywordseo="Prakash-Javadekar">Prakash Javadekar</keyword>. </li><li>AAAI has asked by way of IT &amp; GST refunds from Government &amp; PSUs for their advertising bills to be settled immediately.</li><li>The recommendation has also asked for a direction to banks and the industry's debtors to provide the much needed cashflow to pay salaries and meet other essential expenses.</li></ul>Everyone has been witnessing with growing alarm the spread of the <keyword id="1754604" type="PERSON" weightage="20" keywordseo="coronavirus">coronavirus</keyword> across the globe and in India. Our country has been on a lockdown for a few weeks now and governments, both Central and the States, have taken many effective steps to reduce the impact of this pandemic. But all this is coming at a huge economic cost. The Advertising Agency business, like many other businesses have been seriously affected. The bulk of the agency’s costs are fixed in nature, be it salaries, rent, electricity, communication, upkeep, media audience measurement reports, etc. The income and cash flow has been in serious stress in the last month and unless there is some intervention, many businesses will either file for bankruptcy or will have to undersize considerably. INS and IBF, the media associations representing the interest of Print and TV respectively, have been kind enough to permit AAAI members to pay monies they have collected from their clients and not insist on what is due to them on the due dates. But the continuity of the Agencies business cannot be for long without the help of the Government of India. In this regard, Ashish Bhasin, President of AAAI has sent a detailed set of recommendations on behalf of the members of AAAI, to the Union Minister of Information &amp; Broadcasting Prakash Javadekar. In this he has stressed the importance of advertising industry for the accelerated revival of the economy. “What we have asked the Government is very reasonable. We want principally money that is owed to us by way of IT &amp; GST refunds, and dues from Government &amp; PSUs for our advertising bills to be settled immediately. We have also said that any payment made to us should not suffer any TDS deduction going forward, since there is unlikely to be any significant profit for the year. Further we have sought a direction to banks and our debtors that they provide the much needed cashflow to pay salaries and meet other essential expenses, etc,” said Bhasin. “These do not lead to any revenue loss to the Government. They just need to show a kind heart. The timely help they will provide actually is the help they are providing to the people of India, since advertising is a critical input that can provide a ripple effect in reviving many sectors of the economy,” added Bhasin. One other recommendation made is to treat advertising expenses as an investment and have this cost amortised over the next three years. AAAI believes this will encourage larger advertising outlay which will help revive the economy faster. In the same vein, AAAI also suggested that advertising expenses could be given weighted deduction while computing taxes. The suggestion was that every Rs 100 spent on advertising, should be treated as Rs 200, while computing the taxable income. Here is the complete list of recommendations: 1.0 Advertising is an investment: 1.1 Advertising or brand-building expenses should be treated as an asset and be allowed to be amortized over the next three years. Many companies recognize the enduring benefits of advertising and this will encourage them to invest without fear of considerable decline in profits. This will no doubt spur enhanced consumption thereby accelerating the economic activity. 1.2 The advertisers can also be given an option to account the expenditure on a weighted scale. A Rs 100 expense could be allowed to claim an expenditure of say twice that amount (Rs 200), while computing income tax. This may encourage a higher level of expenditure by profitable companies, which again will accelerate the revival of the economic activity. 2.0 Government dues to be paid 2.1 The TDS on advertising agencies have always been significantly more than the profits they make. Several Crores of Rupees of IT refunds are due to each one of the agencies. Can this be immediately refunded for the past years, including for the Assessment Year 2019-2020? 2.2 Many of the advertising agencies have substantial dues from Government of India, as well as from the Central Government controlled PSUs. Can these be ordered to be released within the next few days? 3.0 Income Tax and GST 3.1 Since profitability and cash flow is going to be poor this financial year, TDS should not be deducted when agencies bills are being paid by advertisers. In any event, Advance Taxes will be payable if applicable as per Income Tax deadlines. 3.2 GST should be allowed to be paid on collection of bills by agencies, as against by 20th after the month of billing. If a firm date is indeed needed, this should be after 60 days from the current due date. 3.3 Government should not block the utilization of GST credit and release all credits blocked so far immediately. 3.4 Government should stall all e-invoicing programs till further notice. This could add to the disruption of the economic revival. 3.5 Transfer of accumulated GST input credit - allow establishments for utilization of accumulated ITC having the same PAN across all the registrations in different States. This will result in free flow of working capital and ease of doing business. 3.6 Speed up all the refund of GST applications within 2-4 weeks. 4.0 Business Credit related 4.1 Our industry is unique in that our credit terms with media owners are pre-fixed, while advertisers are under no legal pressure to pay us on the due date. May we request that the Advertising Service be categorised as an essential service, given the potential it has to revive the economy? And consequently, direct the advertisers to settle agencies’ bill within 45 days of receipt? 4.2 Media houses are much larger entities and therefore there should be a directive to provide additional credit to agencies, should the contra-payment be not available from advertisers. The agency cashflow is fragile and the business could come crumbling down in the absence of such a protection, at this time of economic revival. 4.2 Advertising Agencies, after significant drop in revenue, are struggling to match the cashflows. We would request you to get the banking sector to allow an additional 33% cash credit limit for at least one year, at prime lending rates, without any additional security. The additional cashflow will permit them to steady their business.
