Tuesday, April 2: Exaggerated claims of unbelievable results with the use of consumer products are not new in the Indian advertisement industry. But, the law of the land does explicitly prohibit and punish misleading advertisements from time to time. One such case is grabbing headlines of late. <keyword id="20083249" type="General" weightage="20" keywordseo="baba-ramdev" source="keywords">Baba Ramdev</keyword> and <keyword id="20752072" type="General" weightage="20" keywordseo="acharya-balkrishna" source="keywords">Acharya Balkrishna</keyword>, co-founder and managing director of <keyword id="19980518" type="General" weightage="100" keywordseo="patanjali" source="keywords">Patanjali</keyword>, respectively, appeared before the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> today for a hearing regarding a case involving misleading advertisements. So, what exactly happened? <cmsannotation type="cmsannotation" annotationid="A case of false and misleading advertisements" comment="subhead" text="A case of false and misleading advertisements">A case of false and misleading advertisements</cmsannotation> The case began in November last year when the Supreme Court, responding to a petition by the Indian Medical Association (IMA), cautioned <keyword id="6406649" type="General" weightage="20" keywordseo="patanjali-ayurved" source="Orion">Patanjali Ayurved</keyword> against airing "false" and "misleading" claims in its advertisements about medicinal products. The IMA cited several ads that allegedly portrayed allopathic medicine and doctors negatively, claiming that companies producing ayurvedic medicines made disparaging remarks to deceive the public. Despite the Supreme Court's cautionary stance and prohibition on advertising products claiming to treat specific ailments under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, Ramdev and Balkrishna reportedly conducted a press conference, once again making misleading claims about Patanjali's ability to cure various conditions permanently. Subsequently, on February 27, the Supreme Court expressed dissatisfaction with Patanjali's continuous dissemination of false advertisements regarding medicinal cures and issued notices to the company, questioning why contempt proceedings should not be initiated. It also chastised the government for not taking action and “sitting with their eyes shut”. On March 21, the Court summoned Baba Ramdev and Balkrishna to personally appear before it on April 2 to address their failure to respond to the contempt notice regarding misleading advertisements about medicinal cures. <cmsannotation type="cmsannotation" annotationid="What’s the latest update?" comment="subhead" text="What’s the latest update?">What’s the latest update?</cmsannotation> In today's hearing, the Supreme Court criticised Ramdev and Balkrishna for their "absolute defiance" in failing to submit proper affidavits of compliance and for disregarding legal directives. The Court also rebuked Patanjali's MD for describing the Drugs and Cosmetics (Magic Remedies) Act as "archaic". Noting that Patanjali's advertisements are in the "teeth of law" of the land, the Court warned Ramdev to prepare for potential consequences. Justices Hima Kohli and Ahsanuddin Amanullah, presiding over the bench, declined to acknowledge the apology extended by Patanjali last month. Subsequently, Ramdev's attorney, reportedly with folded hands, reiterated that both Ramdev and Balakrishna were extending a personal and unconditional apology before the court. Finally, the Court has granted Ramdev and Balkrishna a final opportunity to file affidavits in one week and mandated their presence at the next hearing on April 10.

At his press conference in Haridwar, Ramdev lashed out over the flak he received after the launch of the drug, saying some people are hurt by the "rise of Indian culture". "I want to tell people who want to try these medicines that there is no restriction on their sale now and they will be available in a kit everywhere in the country from today," Ramdev said, referring to Coronil and the two other products Patanjali is promoting together. The company claimed that the AYUSH Ministry has "categorically agreed" that Patanjali had "appropriately worked on COVID-19 management". "Now there is no difference of opinion between AYUSH Ministry and Patanjali," it added in a statement. The ministry confirmed that Patanjali can sell the product but not as a cure for the disease."AYUSH Ministry has only given permission to sell this particular formulation as immunity booster and not as a medicinal cure for COVID-19," it said. Ramdev claimed that the ministry had asked him to use the term "Covid management" in place of "Covid treatment" and he is following the instruction. Even while backtracking on describing Coronil as a "treatment" for COVID-19, the company stuck to its claim that its trial on mild to moderately ill patients was successful. The company's statement said the trial, conducted after the necessary approvals, showed 100 per cent recovery of patients within seven days. "Some people feel research is a monopoly of those who wear a suit and tie. They think a saffron-wearing sanyasi has no right to do any research. What sort of untouchability and intolerance is this?" he said. "As per the ministry, Patanjali is allowed to manufacture and distribute its Divya Coronil tablet, Divya Swasarivati and <keyword id="9498137" type="PERSON" weightage="20" keywordseo="divya-anu-talia">Divya Anu Talia</keyword> across India, as per the manufacturing licences granted by State Licensing Authority, Ayurvedic and Unani Services, Govt of Uttarakhand," the company said. The Uttarakhand department was among the agencies which had questioned Patanjali's claim to have developed a drug to cure COVID-19. The department had said Patanjali had only been given a licence to manufacture an immunity booster. Ramdev said the rise of Indian culture hurts a section of people, particularly the allopathic drug manufacturing multinational corporations which feel threatened every time an ayurvedic medicine launched by Patanjali comes into the market. He claimed there are at least two allopathic drugs in the market, selling for Rs 500 and Rs 5,000, in the name of <keyword id="1754604" type="PERSON" weightage="20" keywordseo="coronavirus">coronavirus</keyword> cures, but nobody is talking about them. "I and <keyword id="669583" type="PERSON" weightage="20" keywordseo="Acharya-Balkrishna">Acharya Balkrishna</keyword> are from humble families,' he said, referring to the head of the company. "We have been working for the past 35 years to enhance the prestige of yoga and ayurveda. Building a disease-free India is our mission and it will continue," he said. Patanjali said ayurvedic drug licences and controlled clinical trials "are two different streams." The company got the approval for Coronil and Swasarivati on the basis of their "traditional reported usages" and has now connected them with "modern research-based clinical findings", it said. Patanjali can sell Coronil but not as 'cure' to COVID-19 says AYUSH Ministry

Muzaffarpur, Jun 24 () A criminal complaint has been filed in a Bihar court against yoga guru Ramdev and Patanjali Ayurved MD Acharya Balkrishna, alleging that they have misled and put at risk the lives of lakhs of people by claiming to have developed a medicine to treat COVID-19. The complaint seeking registration of an FIR on cheating, criminal conspiracy and other charges was filed in the court of Chief Judicial Magistrate Mukesh Kumar here on Tuesday by Tamanna Hashmi, who identifies himself as a social worker and is often in news for his numerous court complaints against politicians over various issues. The court posted the matter for hearing on June 30. The complainant has named Ramdev, the convenor of the Patanjali Research Institute, and his aide Balkrishna, the organisation's chairman, as accused. Hashmi submitted that Ramdev and Balkrishna claimed to have prepared "Coronil tablet" to cure COVID-19, which is nothing but misleading. The complainant submitted that the Ayush Ministry has asked Patanjali Ayurved to stop advertising and publicising its claims about the medicine. The Ayush Ministry has said that they have not been provided any information with regard to the details of the composition of the ayurvedic medicine, Hashmi said. The complainant has sought registration of a case under IPC sections 420 (cheating and dishonesty inducing delivery of property), 120B (criminal conspiracy) and 270 (malignant act likely to spread infection of disease dangerous to life), among others. Ramdev's herbal medicine company Patanjali Ayurved has launched 'Coronil tablet and Swasari vati' medicines claiming they can cure the highly contagious disease within seven days. It has also claimed that the two Ayurveda-based medicines have shown 100 per cent favourable results during clinical trials on COVID-19 infected patients except those on a life support system. However, the AYUSH ministry said that the facts of the claim and details of the stated scientific study are not known to it. It has sought from the company a detailed report on composition, testing and other data of the drugs. The ministry also used powers under a 1954 law to ask the firm to "stop advertising/publicizing" claims of corona cure drug until the issue is examined by it. A government notification bars companies from advertising a cure without government approval. But it wasn't immediately clear if the drug can still be sold. Ramdev said the medicines have been developed by Patanjali Research Center, Haridwar and privately-owned National Institute of Medical Science, Jaipur following all protocols with clinically controlled trial-based evidence. Patanjali group has an estimated turnover of around Rs 10,500 crore.

"Denim jeans that people wear these days come from abroad or are manufactured here by western companies. They are all based on designs and cultural patterns of foreign countries. These are not suited to Indian culture. Our jeans will be similar to many Indian clothes. This will make Indian women feel comfortable too," he told ET. 
 
"We got this idea to manufacture swadeshi jeans because every year there is a lot that Indians spend on buying jeans that largely come from big companies. We want to make sure all the jeans we wear are home made," he said. 
 
Patanjali is already manufacturing more than 500 <a href="http://www.businessinsider.in/searchresult.cms?query=FMCG&amp;sortorder=effectivedate">FMCG</a> products and is now deciding to step into the fashion business. 
 
Ramdev had announced his company will soon venture into the apparel market, making both traditional and modern clothes for men and women as part of an ambitious expansion plan. 
 
He further added Patanjali is committed to produce quality products and has sup research and development units where about 200 scientists work, which has forced multinational companies to come out with their R&amp;D plans.
