He has said that he will not sit on the CM chair until the people ask again but the chair belongs to Arvind Kejriwal for these and the next 5 years... AAP to announce New Delhi CM's name at 12 noon today

A bench of Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala rejected the <keyword id="19925995" type="General" weightage="20" keywordseo="Delhi-government" source="keywords">Delhi government</keyword>'s plea challenging the LG's power to nominate 10 aldermen in the <keyword id="19907640" type="General" weightage="20" keywordseo="Municipal-Corporation-of-Delhi" source="keywords" meta.keywordsubtype="org" meta.entityname="Municipal Corporation of Delhi" meta.hostid="345" meta.entityid="Municipal Corporation of Delhi">Municipal Corporation of Delhi</keyword> without the aid and advice of the council of ministers. The apex court pronounced its verdict on the Delhi government's plea after reserving it for nearly 15 months. In its ruling impacting the fraught relationship between the LG's office and the AAP-led Delhi government, the bench said the Delhi Municipal Corporation Act as amended in 1993 "expressly enables the LG to nominate persons having special knowledge to the corporation". It said the power expressed by the statute in the name of the LG, also seen in the context of other provisions, demonstrates the statutory scheme in which the powers and duties are distributed among authorities under the Act. "The context in which the power is located confirms that the LG is intended to act as per the mandate of the statute and not guided by the aid and advice of the council of ministers. The power to be exercised is the statutory duty of the LG and not the executive power of the state. This is how we analysed the constitutional provisions," Justice Narasimha said while pronouncing the verdict on behalf of the bench. The bench said the statutory power under provision 3(3)(b)(1) which deals with nomination of persons having special knowledge was vested with the LG for the first time by the 1993 amendment of the DMC Act of 1957. The bench said the DMC Act as amended in 1993 recognises five authorities exercising the state's power and duties under the Act -- these are the Central government, the government of NCT, administrator, corporation and the commissioner. It said the amendment Act of 1993 carries out several amendments to the original DMC Act of 1957 by which the power, duties were allocated to the authorities depending on the function they perform under the law. The bench said by way of the amendment the power of nomination of aldermen was given to LG under the provision just like the power of nomination of MLAs was given to the speaker of the House. On May 17 last year, the top court had said that giving the LG the power to nominate aldermen to the MCD will mean he can destabilise an elected civic body. The MCD has 250 elected and 10 nominated members. In December 2022, the Aam Aadmi Party defeated the <keyword id="19894848" type="General" weightage="20" keywordseo="BJP" source="keywords" meta.keywordsubtype="org" meta.entityname="BJP" meta.hostid="345" meta.entityid="BJP">BJP</keyword> in the civic elections, winning 134 wards and ending the saffron party's 15-year run at the helm of the MCD. The BJP won 104 seats and the Congress finished a distant third with nine. Senior advocate Abhishek Singhvi, appearing for the Delhi government, had contended during the hearing that no separate powers have been accorded to the state government to nominate people to the MCD. For the past 30 years, the practice of the LG nominating aldermen on the aid and advice of the city government has been followed, he said. Additional Solicitor General Sanjay Jain, appearing for the LG's office, submitted that just because a practice has been followed for 30 years does not mean it is correct. The top court had observed that giving the LG the power to nominate aldermen will effectively mean that he can destabilise a democratically elected MCD because these aldermen get appointed to the standing committees and have voting power. Earlier, the top court had questioned the "source of power" of the LG under the Constitution and the law to nominate aldermen to the MCD without the aid and advice of the elected government. On May 12 last year, the top court observed that LG has to act on the "aid and advice" of the council of ministers of the Delhi government in nominating 10 aldermen to the MCD.

Targeting the BJP, he also said these people are not more powerful than the Constitution. He claimed that while in jail, he was not worried about getting bail but was pained seeing businessmen being put in prison in "fake cases just because they did not donate money to the BJP". Conspiracies are being hatched to defame Kejriwal's work, he said and added that if opposition leaders unite against the "dictatorship", Kejriwal will come out of jail in 24 hours. Sisodia told AAP workers that "we are just horses of a chariot but our real 'saarthi' (charioteer) is in jail, he will come out soon". On his bail verdict, Sisodia said the Supreme Court used the power of the Constitution to "trample dictatorship" yesterday. He said he was hoping to get justice in seven-to-eight months but it took 17 months. But at the end truth triumphed, Sisodia said. Seeking to target the BJP over the Vinesh Phogat issue, Sisodia, without taking the wrestler's name, said she protested against its leader and people saw what happened at the Olympics. Phogat, who was disqualified from the Paris Olympics for being found 100 grams overweight ahead of her women's 50kg final, was at the forefront of a lengthy protest alleging government inaction against former Wrestling Federation of India head Brij Bhushan Sharan Singh, who was accused of sexual harassment by women wrestlers.

Kejriwal was given interim bail by the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> to campaign for the Lok Sabha elections on May 10 and was asked to surrender to Tihar jail on June 2. The Delhi CM had earlier moved the Supreme Court for an extension of interim bail. On Wednesday, the Supreme Court rejected his plea, stating that since he was given liberty to move the trial court for regular bail, the plea here is not maintainable. Meanwhile, Delhi's Rouse Avenue Court on Saturday reserved the order on the interim bail plea moved by Kejriwal, citing medical reasons in a money laundering case related to the alleged excise policy scam. The court fixed June 5 for the pronouncement of the order on the plea seeking 7-day bail, while refused to pass the order today itself as requested by Kejriwal's Lawyer. Senior Advocate N Hariharan, who appeared for Kejriwal, submitted that the interim bail was to campaign for his party (the Am Aadmi Party), which is a national party. "I am out for 20 days and had I not done it, you would've said see he didn't campaign and fell ill. It was a lot of stress due to the campaigning and you know that stress is a aggrevator of diabetes. What was alarming was that keto levels rose in the urine. The aspect of concern is the high level of sugar and the keto numbers," Kejriwal's advocate submitted in the plea. Appearing for the Directorate of Enforcement (ED), Solicitor General Tushar Mehta and Additional Solicitor General SV Raju submitted that Arvind Kejriwal suppressed facts including about his health conditions. During preliminary arguments, ED lawyers stated that they have objections to filing interim bail as well. This court cannot modify the Supreme Court order. He's on interim bail because the SC granted it, what he is asking here is an extension of the Supreme Court order," the ED lawyers submitted. "This interim bail plea is required to be dismissed as it is full of suppression of facts. The Supreme Court had granted Liberty to him that he can file regular bail but the liberty to seek an extension of interim bail was not granted to him. He has said that these tests require 7 days, but the nature of the test has been suppressed," they further stated. ED also raised maintainability issues on interim bail plea and submitted that instead of getting a medical test done, he was travelling across. Medical tests would take more than one hour. ED further submitted that the applicant in fact has gained 1 kg weight and falsely claimed that he has lost 7 kg weight. The Registrar of the Supreme Court has passed a speaking order and the same has been suppressed by them. There is a reason for suppression and it is because he had been travelling for campaigning purposes, but he didn't get the tests done then, ED said. Recently Kejriwal through his legal team filed two different bail applications before the concerned court. His regular bail plea is listed for a hearing on June 7, 2024. Earlier, Arvind Kejriwal posted an emotional message on Friday and said that he is proud that he is going to jail to save the country from dictatorship. In his video message, Kejriwal said, "Tomorrow the 21 days are getting over, the day after tomorrow I have to surrender. I don't know how long they will keep me in jail this time. But my spirits are high. I am going to jail to save the country from dictatorship. I am proud of this. They tried to break me many times, tried to make me bow down but I didn't." Kejriwal was arrested by the ED on March 21 in connection with a money laundering probe relating to alleged irregularities in the now-cancelled <keyword id="20106989" type="General" weightage="20" keywordseo="Delhi-Excise-Policy" source="keywords">Delhi excise policy</keyword> 2021-22.

Bhopal, The <keyword id="21082883" type="General" weightage="20" keywordseo="scindias" source="keywords">Scindias</keyword>, the influential members of the erstwhile royal family of Gwalior, have moved effortlessly between different political parties when it comes to fighting electoral battles on their home turf and Union minister Jyotiraditya <keyword id="19905342" type="General" weightage="20" keywordseo="scindia" source="keywords">Scindia</keyword> will carry forward this tradition when he files his nomination as the BJP candidate from the Guna <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> seat in Madhya Pradesh. Five years after losing unexpectedly from Guna as the Congress candidate, Jyotiraditya Scindia, representing the current generation of the family in MP's politics, is back in the fray in his backyard, but this time as the nominee of his erstwhile political rival and with a different election symbol against his name on the EVM. The 53-year-old politician is the grandson of one of the BJP founders, Vijaya Raje Scindia, and son of former Union minister the late Madhavrao Scindia. The Guna Lok Sabha seat, part of the Scindias' home turf which also includes Gwalior, is spread across eight assembly seats in Guna, Shivpuri and Ashok Nagar districts. The Congress, looking to settle scores with Jyotiraditya Scindia in the poll fray after it lost its government in Madhya Pradesh following his exit exactly four years ago, is yet to name its candidate from Guna. It was a rare electoral shock for former Gwalior royals when the Union Minister for Civil Aviation faced defeat in 2019 at the hands of the BJP candidate and his old loyalist, KP Yadav, by a margin of around 1.26 Lakh votes. In 2024, Scindia is again testing electoral waters, but under the banner of a different party - the Bharatiya Janata Party (BJP) - the political home to his parental aunts - former Rajasthan Chief Minister <keyword id="21082885" type="General" weightage="20" keywordseo="vasundhara-raje-scindia" source="keywords">Vasundhara Raje Scindia</keyword> and ex-MP minister <keyword id="21082884" type="General" weightage="20" keywordseo="yashodhara-raje" source="keywords">Yashodhara Raje</keyword>. But the Guna Lok Sabha constituency's history suggested the Scindias have never fought their first and last elections from the same party. The Union minister's grandmother, <keyword id="21082886" type="General" weightage="20" keywordseo="rajmata-vijaya-raje-scindia" source="keywords">Rajmata Vijaya Raje Scindia</keyword>, contested her first election from the seat in 1957 on a Congress ticket and won. She contested as the Swatantra Party nominee in 1967 then from the BJP in 1989. His father Madhavrao Scindia contested his first election from Guna on a Bharatiya Jan Sangh (BJS) ticket in 1971 and fought his last poll in 1999 as the Congress nominee before his death in a plane crash near New Delhi in 2001. The BJS is considered the forerunner of the BJP. Senior journalist, author and political analyst <keyword id="20445085" type="General" weightage="20" keywordseo="rasheed-kidwai" source="keywords">Rasheed Kidwai</keyword> says the Scindias' political leanings seem to be settling down now. "After decades of consciously choosing divergent political parties, the house of Scindias is finally settling down as per their past and ideological leanings. The Sangh, Hindutva and right-wing has always been Scindia flavour in the monarchical era," Kidwai noted. The Guna parliamentary seat was represented by Rajmata Scindia for 6 times, while her son Madhavrao Scindia won it on four occasions. Besides Guna, Rajmata Scindia represented the Gwalior Lok Sabha seat, part of the family turf, once. Madhavrao Scindia was elected five times from Gwalior, once as the candidate of the Madhya Pradesh Vikas Congress, an outfit floated by him. Rajmata Scindia's daughter Yashodhara Raje also represented the Gwalior seat in the Lok Sabha twice for the BJP. Jyotiraditya Scindia has represented the Guna seat four times between 2002 and 2014, including after winning in a bypoll. A year after his defeat, he joined the BJP in March 2020 along with 22 Congress MLAs, leading to the collapse of the Kamal Nath-led government in Madhya Pradesh. The defeat of Jyotiraditya Scindia in 2019 was the second setback for the Scindias in the Lok Sabha elections. In 1984, the Union minister's aunt and former Rajasthan CM <keyword id="20004780" type="General" weightage="20" keywordseo="vasundhara-raje" source="keywords">Vasundhara Raje</keyword> had faced defeat as the BJP candidate from the Bhind Lok Sabha seat. She was defeated by Congress candidate <keyword id="21082887" type="General" weightage="20" keywordseo="krishna-singh-judeo" source="keywords">Krishna Singh Judeo</keyword>, who belongs to the erstwhile royal family of Datia. The Guna Lok Sabha constituency has more than 18.80 lakh voters and it will go to polls in the third phase on May 7.
