All you need to know about linking Aadhaar to PAN

The government has relaxed provisions of <keyword id="19948097" type="General" weightage="20" keywordseo="tds" source="keywords">TDS</keyword>/<keyword id="19950203" type="General" weightage="20" keywordseo="tcs" source="keywords">TCS</keyword> in the event of the death of the deductee/collectee before the linkage of PAN and <keyword id="19898107" type="General" weightage="20" keywordseo="aadhaar" source="keywords">Aadhaar</keyword> card. TDS is Tax Deducted at Source and TCS is Tax Collected at Source in India. The Central Board of Direct Taxes (CBDT), has issued a circular dated August 5, in view of genuine difficulties being faced by taxpayers. Through the circular, the government said it has relaxed the provisions of TDS/TCS, as per the Income-tax Act, in the event of death of deductee/collectee before linking of PAN and Aadhaar. In order to redress the grievances of the taxpayers wherein instances have been cited, of demise of the deductee/collectee on or before May 31, 2024 and before the option to link PAN and Aadhaar could have been exercised, the circular provides that there shall be no liability on the deductor/collector to deduct/collect the tax under the relevant section of <keyword id="19936187" type="General" weightage="20" keywordseo="income-tax-act" source="keywords">income tax act</keyword>, pertaining to the transactions entered into up to March 31, 2024. On April 23, 2024, CBDT extended the date for linking of PAN and Aadhaar May for the taxpayers (for the transactions entered into up to March 2024) to avoid higher TDS/ TCS, as per the income tax act. Under the provisions of the Income-tax Act, 1961, every person who has been allotted a PAN as on July 1, 2017 and is eligible to obtain <keyword id="20030312" type="General" weightage="20" keywordseo="Aadhaar-Number" source="keywords">Aadhaar Number</keyword>, is required to intimate his Aadhaar to the prescribed authority, on payment of a prescribed fee. Failure to do so shall attract certain repercussions under the income tax act. As per government, the PAN of taxpayers who have failed to intimate their Aadhaar, as required, shall become inoperative and the consequences during the period that PAN remains inoperative will be as follows: 1. No refund shall be made against such PANs 2. Interest shall not be payable on such refund for the period during which PAN remains inoperative 3. TDS and TCS shall be deducted /collected at higher rate, as provided in the income tax act.

Also, as per Section 272B of the Income Tax Act, if an individual fails to quote or furnish her PAN as required by the Income Tax Law, a penalty of ₹10,000 can be levied. The tweet also highlights an additional measure taken to facilitate the linking process: the introduction of biometric-based authentication, which can be accessed at dedicated centres of PAN Service Providers (Protean &amp; UTIITSL). According to the Unique Identification Authority of India (UIDAI), updating address details on Aadhaar can be done online through the Self Service Update Portal (SSUP). However, for updating other details such as demographic information (name, address, date of birth, gender, mobile number, email) and biometrics (fingerprints, iris and photograph) in Aadhaar, it is necessary to visit a Permanent Enrolment Centre. The Finance Minister Nirmala Sitharaman has announced today (24th March) in a press conference, held via video conferencing that the deadline to link Aadhar card with the PAN card will be extended to 30th June 2020 due to Coronavirus Pandemic. The earlier deadline for the same was 31st March 2020. The deadline to file the ITR, for the financial year 2018-18, has also been extended to 30th June 2020. The interest on delayed payment has also been reduced to 9 percent from 12 percent earlier. The deadline to link Aadhar card with PAN has been extended 7-8 times already in the last 18 months and amid coronavirus scare, it has been extended again to give relief to the public at large. The coronavirus cases are on the rise in the country with more than 500 cases registerd until mid-day tuesday with 10 deaths. The pandemic has resulted in more than 300,000 cases globally with more than 16000 deaths.

If you have missed the previous deadlines, you still have the option to link your PAN with Aadhaar, but now you will have to pay a fine of ₹1,000. This can be done on the NSDL portal. It's important to note that the Income Tax department will not process tax returns until PAN and Aadhaar are linked. Update Aadhaar for free The Unique Identification Authority of <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword> (UIDAI) announced free updates for Aadhaar documents in March so that individuals could update any information on their Aadhaar card, e.g address, etc. However, this free service is only available till June 14. Subscribers to the Employee Provident Fund (EPF) can now contribute more towards their pension beyond the salary limit of ₹15,000 per month. Both the employee and the employer can jointly request the EPFO to deduct 8.33% of the higher monthly basic salary. This allows for a larger accumulation towards the pension fund over the course of their working years. Bank locker agreement The <keyword id="6354335" type="General" weightage="50" keywordseo="reserve-bank-of-india" source="Orion">Reserve Bank of India</keyword> (RBI) has set a new deadline for banks to update their locker agreements. It is required for banks to prepare the locker agreement on stamp paper, with the banks being responsible for providing the stamp paper at no cost to the customers. The revised agreement is designed to protect the interests of locker holders, by promoting transparency and providing clear information on the terms and conditions governing the use of the locker facility. By December 31, 2023, banks are mandated to complete the phased renewal of these agreements. The RBI expects banks to achieve 50% enrollment by June 30, and 75% enrollment by September 30. If you have received a message from your bank, you need to complete the formalities as soon as possible. Payment of advance tax In India, salaried individuals, self-employed professionals and businesses whose estimated tax liability for the financial year exceeds ₹10,000 are required to pay advance tax in installments during the year. If you are a salaried employee, the employer will deduct the required taxes and you do not need to pay advance tax if you do not have any other source of income. Advance tax has to be paid in four installments, the first installment of 15%, needs to be paid by June 15. Mutual fund, trading and demat account nomination deadline This is not in June. As per regulatory guidelines, investors are required to mention nominees for their fund folios or notify the fund house of their decision to opt out of nominations by September 30. This ensures that appropriate arrangements are in place for the transfer of assets in case of the investor's demise, and thus it is important. The earlier deadline was 31 March. The deadline for mentioning nominees for trading and demat accounts is also September 30. The earlier deadline was Tuesday, December 31. "The due date for linking of PAN with Aadhaar as specified under sub-section 2 of section 139AA of the Income-tax Act, 1961 has been extended from December 31, 2019 to March 31, 2020," the department said on its official Twitter handle. This is the eighth time that the Central Board of Direct Taxes (CBDT) has extended the deadline for individuals to link their PAN with Aadhaar. The Supreme Court, in September last year, had declared the Centre's flagship Aadhaar scheme as constitutionally valid and held that the biometric ID would remain mandatory for the filing of I-T returns and allotment of the PAN. Section 139 AA (2) of the Income Tax Act says that every person having PAN as on July 1, 2017, and is eligible to obtain Aadhaar, must intimate his Aadhaar number to tax authorities. Aadhaar is issued by the Unique Identification Authority of India (UIDAI) to a resident of India and PAN is a 10-digit alphanumeric number allotted by the I-T department to a person, firm or entity. Also while issuing a verdict that upheld the constitutional validity of Aadhaar in September 2018, the Supreme Court of India said Aadhaar cannot be made mandatory for opening a bank account or to get mobile connection. However, linking Aadhaar with PAN is mandatory. The apex court also said Aadhaar is mandatory for filing Income Tax Return (ITR). Earlier deadlines to link Aadhaar and PAN The Income Tax Department has said that PAN will go inactive if not linked with Aadhaar by March 31, 2020. The deadline to link Aadhaar with PAN was extended quite a few times during last year. Earlier, the deadline to link Aadhaar with PAN was September 30, 2019. In a notification issued on September 28, 2019, the government extended this deadline to December 31, 2019. Subsequently, the deadline was further pushed to March 31, 2020. These extensions come as a relief to those who have not still linked their Aadhaar with PAN. What the CBDT says Issuing a statement connected to linking Aadhaar with PAN, the Central Board of Direct Taxes (CBDT) said, “Whether a person, who has been allotted the permanent account number as on July 1, 2017 and is required to intimate his Aadhaar number under sub-section (2) of Section 139AA, has failed to intimate the same on or before March 31, 2020, the permanent account number of such person shall become inoperative immediately after the said date for the purpose of furnishing, intimating or quoting under the Act”. Also through a notification, the CBDT has amended the Income Tax Rules and has inserted Rule 114AAA, which detailed the “manner of making permanent account number inoperative”. What are implications of PAN becoming inactive Section 133 AA (2) of the Income Tax Act states that every individual having PAN as on July 2017 and eligible to obtain Aadhaar, must intimate his Aadhaar number to the tax authorities. The notification has also mentioned that individuals, whose PANs will become inactive will be held liable for all the consequences under the IT Act for not furnishing, intimating or quoting the permanent account number. Technology development body Centre for Department of Telematics (CDoT) has been running the pilot of the CEIR system in some of the telecom circles, including Delhi, Maharashtra, Karnataka, and North East region, and the system is now ready for pan-India deployment, a DoT official, who did not wish to be identified, told PTI. "CEIR system is scheduled for pan-India launch on May 17," the official said. When contacted, Chief Executive Officer and Chairman Project Board at CDoT Rajkumar Upadhyay did not confirm the date but confirmed that the technology is ready for pan-India deployment. "The system is ready and now it will be deployed across India in this quarter. This will enable people to block and track their lost mobile phones," Upadhyay said. CDoT has been able to add features to check the use of cloned mobile phones across all telecom networks. The government has made it mandatory to disclose IMEI -- a 15-digit unique numeric identifier -- of mobile devices before their sale in India. The mobile networks will have access to the list of approved IMEI numbers which will check the entry of any unauthorised mobile phones on their network. Telecom operators and CEIR system will have visibility into IMEI number of the device and mobile number linked to it, and the information is being used in some states to track your lost or stolen mobiles through CEIR. "One of the common practices is that miscreants change IMEI number of stolen mobile phones which prevents tracking and blocking of such handsets. It was a national security issue. The CEIR will be able to block any cloned mobile phones on the network with the help of various databases," Upadhyay said. The basic purpose of CEIR is to ease reporting of stolen and lost mobiles and block the use of mobiles all over the country. This will discourage the theft of mobile phones, enable the tracing of the stolen and lost mobiles to the police, detection of cloned or counterfeit mobiles, restrict the use of such cloned mobiles, as well as protect the interest of the consumers by making them aware of the information related to fake and cloned mobile phones. Recently, Karnataka Police recovered and handed over more than 2,500 lost mobile phones to their owners using the CEIR system. Apple already has a system to track lost mobile phones with the help of Apple ID but major issues have been around Android mobile phones. With the new system in place, it will be futile to use stolen mobile phones. "The system has an in-built mechanism which will also check the smuggling of phones and help the government from revenue loss to the exchequer as well," Upadhyay added.
