And in the second blow, the judge threw out the only defense offered in the case: a claim that Trump had made "fair use" of the song."It's everything we asked for," Grant attorney Brett Van Benthysen told Business Insider. Koeltl revealed that it was Scavino — Trump's director of social media and deputy chief of staff for communications at the time — who uploaded the video to Trump's personal Twitter account on August 12, 2020."Scavino testified that he saw the video on a Trump supporter's social media page either on the same day or the day before he posted the tweet," the judge wrote Friday."Scavino also testified that he spoke with former President Trump before posting the tweet and that former President Trump 'let [him] go with [his] instinct on it and post it,'" the judge wrote.The video was viewed more than 13.7 million times, was liked more than 350,000 times, and was retweeted more than 139,000 times, the judge wrote.Grant's lawyers immediately sent Trump's lawyers a cease and desist letter, but it wasn't until Grant sued on September 1, 2020 that the video was taken down.In rejecting Trump's claim that Grant had never properly secured a copyright for the Electric Avenue sound recording, the judge said it was enough that Grant held the copyright for a compilation record that included the song.Decisions in multiple prior legal cases support that finding, the judge said. Trump, meanwhile, was unable to cite a single supporting case, the judge said.And in rejecting Trump's claim that the animation was a "fair use" of the song, the judge went methodically in his decision through the four-factor standard for fair-use exemptions to copyright.The first factor looks at how the copyrighted work was used. In Trump's case, Electric Avenue was used for a commercial purpose, not for an allowable non-profit, research, or educational purpose, the judge wrote.The second factor looks at whether the copyrighted work was "creative" or "factual." "It is clear that "Electric Avenue is a creative work and therefore is closer to the core of copyright protection," the judge wrote.The third factor weighs how much of the copyrighted work was taken for an unauthorized use. Here the judge found that "the song plays for the majority of the animation; the excerpt is of central importance."The final factor asks "whether, if the challenged use becomes widespread, it will adversely affect the potential market for the copyrighted work," the judge wrote."In this case, there is no public benefit as a result of the defendants' use of 'Electric Avenue'" the judge wrote."As the plaintiffs correctly argue, the defendants 'could have used any song, created a new song, or used no song at all, to convey the same political message in the Infringing video.'"But the damage to Grant could be significant if the copyright to his songs was not strictly enforced, the judge noted."Widespread, uncompensated use of Grant's music in promotional videos — political or otherwise — would embolden would-be infringers and undermine Grant's ability to obtain compensation in exchange for licensing his music," the judge wrote.An attorney for Trump did not immediately return a request for comment.

The UK's Competition and Markets Authority (CMA) <a target="_blank" class="" href="https://www.gov.uk/government/news/cma-launches-investigation-into-ticketmaster-over-oasis-concert-sales">announced on Thursday</a> that it's investigating whether Ticketmaster wronged the band's fans with its "dynamic pricing" pricing model during ticket sales for Oasis's reunion tour in the UK.Fans of Oasis — one of the most popular bands at the end of the 20th century — were thrilled when brothers Noel and Liam Gallagher announced they were getting the band back together for the first time in 15 years. But that <a target="_blank" class="" href="https://www.businessinsider.com/oasis-tour-ticket-prices-fans-upset-dynamic-pricing-2024-9">excitement quickly soured</a> once fans realized how <a target="_blank" class="" href="https://www.businessinsider.com/oasis-tickets-ticketmaster-surge-pricing-2024-9">difficult and expensive it would be to secure tickets to the shows</a>. Ticketmaster used its "in-demand" pricing model, which increases prices when demand rises. Fans complained of long online queues to buy tickets. When they finally had the chance to buy tickets, fans said prices had surged unexpectedly.As one fan, Helen Barnett, wrote about her experience <a target="_blank" class="" href="https://x.com/HelenFBarnett/status/1829838603414896855">on X</a>: "That feeling when you wait in a queue for four hours only to be told the price of the ticket has risen from £148 to... £355??? Because they're 'in demand.' How is this not illegal?"The UK anti-trust agency said in a press release that it's "scrutinizing whether the sale of Oasis tickets by Ticketmaster may have breached consumer protection law," which mandates that "ticket sales sites must be transparent in their dealings with consumers and give clear and accurate information about the price people have to pay."Specifically, the CMA is looking into whether Ticketmaster engaged in unfair commercial practices, whether ticket buyers were notified of dynamic pricing and the amount they would actually be paying, and whether buyers were pressured to buy tickets within a short amount of time and at a higher price than they expected."It's important that fans are treated fairly when they buy tickets, which is why we've launched this investigation. It's clear that many people felt they had a bad experience and were surprised by the price of their tickets at check-out," Sarah Cardell, the CMA's chief executive, said in the press release, adding that fans should reach out to the agency detailing their Oasis ticket-buying experience.The CMA noted that its investigation is still in the initial stage, and it should not be assumed that Ticketmaster broke the law.In a statement to Business Insider, a Ticketmaster spokesperson said, "We are committed to cooperating with the CMA and look forward to sharing more facts about the ticket sale with them."On its website, the ticket seller explained its policies."Promoters and artists set ticket prices. Prices can be either fixed or market-based. <keyword id="19895063" type="General" weightage="20" keywordseo="India" source="keywords">India</keyword> requires an investment support of USD 1.4 trillion — an average of USD 28 billion per year — to become a net-zero economy by 2070 and raising <keyword id="20260327" type="General" weightage="20" keywordseo="financial-resources" source="keywords">financial resources</keyword> for adaptation and mitigation action of this scale is an "unprecedented challenge", according to the <keyword id="20613906" type="General" weightage="20" keywordseo="Economic-Survey" source="keywords">Economic Survey</keyword> 2023-24 tabled in Parliament on Monday. Reaching net zero means achieving a balance between greenhouse gas emissions and the amount of these gases removed from the atmosphere by either natural processes, such as photosynthesis, or by other methods of carbon capture and storage. The consolidated report on the state of the economy in the previous year said India's climate action has been largely financed through domestic resources and the flow of international finance has been "very limited". Citing the Reserve Bank of India's (RBI) data, the report said bridging the "substantial funding gap" necessitates allocating 2.5 per cent of India's annual Gross Domestic Product (GDP) to <keyword id="20018880" type="General" weightage="20" keywordseo="green-finance" source="keywords">green finance</keyword>. "Preliminary estimates indicate that the aggregate investment support required by India to achieve its 2070 net-zero target will be USD 1.4 trillion at an average of USD 28 billion per year. Raising financial resources for <keyword id="19907392" type="General" weightage="20" keywordseo="climate-change" source="keywords">climate change</keyword> adaptation and mitigation actions of this scale is an unprecedented challenge," the document read. A 2022 report by the Climate Policy Initiative found that domestic sources accounted for the majority of green finance in India, at 87 per cent and 83 per cent in financial years 2019 and 2020 respectively. While international sources are increasing (from 13 per cent in FY 2019 to 17 per cent in FY 2020), the economic survey said they are still insufficient to meet India's net-zero target. "Mobilising substantial capital from traditional sources presents multifaceted challenges in emerging economies like India. The perceived sovereign risks associated with emerging market and developing economies (EMDEs) and the capital-intensive nature of such projects, coupled with lengthy gestation periods and evolving regulatory frameworks, can create misalignment between investor expectations and project timelines," the government said. The economic survey also noted that the flows of global capital to <keyword id="20200084" type="General" weightage="20" keywordseo="developing-countries" source="keywords">developing countries</keyword> have been impeded by high costs of capital. Despite securing a good rating on its green-bond framework, Indian sovereign <keyword id="20177085" type="General" weightage="20" keywordseo="green-bonds" source="keywords">green bonds</keyword> have hardly received any "greenium" from private investors. It is more a "wall of capital" than a "flood of capital" that is waiting to fund energy transition in EMDEs. It is just not mobile. All of these together have severely hampered the flow of finance for green-transition projects, the survey said. "Greenium" or green premium refers to the savings an issuer of a green bond realises on the associated coupon payment because the bond is green. Financial support to help middle-income and poor countries fight climate change will be at the centre of this year's UN climate conference in Baku, Azerbaijan, where the world will reach the deadline to agree on the New Collective Quantified Goal (NCQG) -- the new amount developed nations must mobilise every year starting 2025 to support climate action in developing countries. But achieving consensus will not be easy, given the disappointing progress made on major conflict points at the mid-year UN climate talks in Bonn, Germany. At the 2009 UN climate conference in Copenhagen, rich nations pledged to provide USD 100 billion annually from 2020 to help developing countries mitigate and adapt to climate change. However, delays in achieving this goal have eroded trust between developed and developing nations and have been a continual source of contention during annual climate negotiations. In May, the Organisation for Economic Cooperation and Development (OECD) claimed that developed countries had met the long-standing USD 100 billion-a-year promise by providing nearly USD 116 billion in <keyword id="20000757" type="General" weightage="20" keywordseo="climate-finance" source="keywords">climate finance</keyword> to developing countries in 2022, with nearly 70 per cent of the money given in the form of loans. However, international non-profit organisation Oxfam last week said climate finance provided by rich countries in 2022 totalled no more than USD 35 billion. Developing nations argue that they cannot be expected to reduce carbon dioxide (CO2) emissions faster if developed countries -- historically responsible for climate change -- do not provide enhanced financial support.
