<keyword id="6354427" type="COMPANY" weightage="20" keywordseo="apple">Apple</keyword> on Saturday placed <keyword id="3148447" type="COMPANY" weightage="20" keywordseo="Wistron-Corporation">Wistron Corporation</keyword> on probation after finding fault with the company over payment delays in October and November to workers at the Taiwanese contract manufacturer's <keyword id="10433337" type="UNKNOWN" weightage="20" keywordseo="narasapura-facility">Narasapura facility</keyword> near the Karnataka capital. The development comes one week after violence broke out at the Wistron's Narasapura facility as a large number of workers went on a rampage last Saturday over issues related to payment of salary. A Karnataka government report also found lapses in the way Wistron tried to scale up production in the factory. The investigation found that the practices put in place at the plant with regard to payment of wages and overtime work were not in line with the provisions of law. "Apple employees and independent auditors hired by Apple have been working around the clock to investigate the issues which occurred at Wistron's Narasapura facility," Apple said in a statement. "While these investigations are ongoing, our preliminary findings indicate violations of our Supplier Code of Conduct by failing to implement proper working hour management processes. This led to payment delays for some workers in October and November," the company said. Apple said Wistron will not receive any new business from Apple before they complete corrective actions, dealing a blow to its plans to scale up production at the India facility. "As always, our focus is on making sure everyone in our supply chain is protected and treated with dignity and respect. We are very disappointed and taking immediate steps to address these issues," Apple said. "We have placed Wistron on probation and they will not receive any new business from Apple before they complete corrective actions. Apple employees, along with independent auditors, will monitor their progress. Our main objective is to make sure all the workers are treated with dignity and respect, and fully compensated promptly." Wistron on Saturday admitted mistakes and apologised to all workers and also said that it will remove the Vice President who oversees the company's business in India. "Since the unfortunate events at our Narasapura facility we have been investigating and have found that some workers were not paid correctly, or on time. We deeply regret this and apologize to all of our workers," Wistron said. "This is a new facility and we recognise that we made mistakes as we expanded. Some of the processes we put in place to manage labour agencies and payments need to be strengthened and upgraded," it added. The company said that it is "working hard" to ensure all workers are fully compensated immediately. "We have established an employee assistance program for workers at the facility. We also set up a 24-hour grievance hotline in Kannada, Telugu, Tamil, Hindi and English to ensure all workers can voice any concerns they may have anonymously," Wistron said. Apple is reportedly planning to assemble its new iPhone SE in India. The iPhone maker has already asked one of its suppliers in <keyword id="1334" type="LOCATION" weightage="20" keywordseo="China">China</keyword> to start shipping components for the iPhone SE 2020 to its manufacturing partner Wistron in India, reports AppleInsider. Assembling the iPhone SE 2020 under the 'Make in India' initiative will help the company in avoiding the 20 per cent tax on its imported phones and reducing the price of the device in India. This news comes at a time when the Indian government has also started an initiative to increase manufacturing in the country. Apple is reportedly seeking to shift roughly a fifth of existing China-based output to India, which could equate to $40 billion in local manufacturing revenues over the next five years. Apple has been assembling some of its phones in India for a while via its two <keyword id="9441071" type="COMPANY" weightage="20" keywordseo="manufacturers-foxconn">manufacturers - Foxconn</keyword> and Wistron. Wistron also assembled the original iPhone SE in the country until 2019. Foxconn makes iPhone XR in India. Apple is reportedly planning to assemble iPhone SE in India

<ul><li><keyword id="1930805" type="PERSON" weightage="20" keywordseo="Wistron">Wistron</keyword>, one of <keyword id="6354427" type="ORGANIZATION" weightage="20" keywordseo="apple">Apple</keyword>’s manufacturers for the iPhone in India, is facing trouble with the Indian government over the non-payment and delay in payment of wages. </li><li>According to lawyers, allegations against the company are in violation of three Indian labour laws — the <keyword id="695544" type="PERSON" weightage="20" keywordseo="Payment-of-Wages-Act">Payment of Wages Act</keyword> (PWA) of 1936, the Factories Act (FA) of 1948 and the Contract Labour, <keyword id="3938435" type="PERSON" weightage="20" keywordseo="Regulation-and-Abolition-Act">Regulation and Abolition Act</keyword> (CLRA) of 1970.</li><li>Wistron blames the issue of the payment of salaries to a software ‘glitch’ on its system, which could cushion the blow.</li></ul>Supplier of Apple iPhones in India, Wistron, claims a software ‘glitch’ is the reason why its contract employees’ salaries were being unfairly deducted and payments were four days late. A dispute that led to a violent reaction from the workers at the Narasapur (Karnataka) factory who threw stones, damaged some vehicles and looted some of the iPhones kept for export, according to the FIR filed by Wistron against 7,000 people. <div type="image" title="wistron factory damage1_edited" msid="79790340" hostid="261" caption="&amp;lt;p&amp;gt;Damage to Wistron&amp;#39;s factory in Karnataka after employee protests turned violent&amp;lt;/p&amp;gt;"></div> While that argument may help Wistron cushion the blow, lawyers believe that the current allegations against the company are in violation of three Indian labour laws — the Payment of Wages Act (PWA) of 1936, the Factories Act (FA) of 1948 and the Contract Labour, Regulation and Abolition Act (CLRA) of 1970. The company, which also manufactures IT products for Microsoft and Lenovo, is currently being investigated by Apple, the Karnataka government’s Department of Factories, Boilers, Industrial Safety &amp; Health and the Karnataka Police. “Software glitch can be a reason but that is not of any consequence under the law. That is for Wistron to take care and deal with its software provider,” Neeraj Dubey, a corporate law partner at Singh &amp; Associates told Business Insider. Minimum wage and timely payment of wages The state’s labour department preliminary enquiry has deduced that the hiring agencies were not at fault. Things boiled over after the November wages were delayed by four days. “The law mandates salaries to be disbursed by the 7th of every month. Wistron paid contractors on December 10 and those agencies paid workers the next day. The company has said that the delay was because they were trying to fix the technical snag that had led to the deduction of salaries in the previous months,” the labour commissioner told the press. Under the Payment of Wages Act (PWA) of 1936, not paying wages on time is a punishable offence within stipulates a fine at least ₹1,500 for every violation, but could extend to up to ₹7,000 for first offenders. “Although the agency or the contractor is responsible for payment of wages - if they fail to pay the workers, the liability under the Contract Labour Regulation Act is that of the principal employer’s i.e. Wistron in the present scenario,” Avik Biswas, a partner at IndusLaw, told Business Insider. Dubey adds that there is also scope for an additional fine of ₹10,000 for non-maintenance of proper records pressed against Wistron. Laws to specifically protect contract workers Wistron had hired 9,800 employees through six contractors — Creative Engineers, Quess Corp, Innovsource, Adecco Group, Needs Manpower Support Services and Randstad. While 1,343 were permanent employees, the <a href="https://theprint.in/india/missing-contractors-key-to-solving-mystery-of-wistron-iphone-plant-attack-police-begin-hunt/569016/">other 8,490 were hired on a contract basis</a>. The latter are protected by the Contract Labour - Regulation and Abolition Act (CLRA) of 1970. Under this law, if the investigators find Wistron’s management guilty of non-payment of wages, they could end up in jail for up to three months, be fined up to ₹1,000, or both. Location, location, location Biswa adds that since this incident took place at a factory, the Factories Act (FA) of 1948 will also apply. This dictates that if any worker — including those working on contract — works on the premises for more than nine hours in a day, they’re entitled to overtime wages. These overtime wages have to be at least double the ordinary rate of wages. A preliminary report submitted by the Department of Factories Boilers and Industrial Safety dated 13 December, found that Wistron had increased overtime work hours for employees without informing the Labour Department. It added the difference in pay was not credited along with the salary for the month of November 2020. “The salary of the housekeeping contract workers are not paid till date, and are required to work for 12 hours a day for six days a week, and are being paid the same salary which they were being paid when they were working for 8 hours a day,” said the report. If the allegations hold true, the penalty for not paying or overtime would leave both the occupier and manager of the factory includes imprisonment of up to two years, a fine not exceeding ₹1 lakh or both. “If the contravention is continued after conviction, with a further fine which may extend to ₹1,000 for each day on which the contravention is so continued” explained Biswas. How much protection does the ‘glitch’ offer? According to the law, the company is accountable to be prosecuted. “The reason for non-payment of actual dues is immaterial as making the payment is of paramount significance under the laws,” said Dubey. However, if Wistron can prove that the offence was committed without the knowledge of its employees and Wistron could have done nothing about the software glitch, then Wistron may not be accountable under CLRA. “Similarly, under PWA, there may be no penalty if Wistron can satisfy the law only broken due to a bona fide error — like a software glitch — as to the amount payable to the employed person,” explained Biswas. And, finally, under FA, if the management at Wistron can prove to the satisfaction of the court that they followed due diligence to enforce the law and that the non-payment of wages occurred due to a specific person committing the offence on their own, then the liability of the Company can be significantly limited. Optiemus and Wistron join hands to invest $200mn to set up telecom manufacturing facilities in India

Bigger cities leaned heavily towards online channels, with 57% online share in the top 5 metros. "But supply constraints remained, impacting offline channel sales as a result of fewer retail walk-ins". While Xiaomi led in 34 of the major 50 cities within the online channel, Vivo led in 44 of the major 50 cities within the offline channel. Half a million 5G devices were sold, with almost 80% from the top 10 cities of India. "Though 5G is a driver from a technological advancement standpoint, uncertainties on spectrum availability, clear use cases and high prices might restrict its uptake to few bigger cities initially," said Sachin Mehta, Market Analyst, Client Devices, IDC India. Hyderabad, Amid the gloom caused by COVID-19, one sector which provided a ray of hope was life sciences and turning the challenge into an opportunity, Hyderabad fortified its position as a global force in the world of pharmaceuticals. This southern city, already recognised as a global information technology destination, proved its prowess in the field of pharmaceuticals and biotechnology and emerged as the vaccine capital of the world. Already known as the bulk drug capital of India, Hyderabad witnessed manufacturing of lifesaving COVID-19 drugs like Remdesivir, Hydroxychloroquine and Favipiravir by some of the top pharma companies based here. This was followed by hectic efforts in the city to develop COVID-19 vaccine. In fact, Hyderabad has emerged as the nerve centre of all research and development activities in the country for COVID-19 vaccines and has even attracted international attention. Today, almost all the vaccines being developed in the country for the pandemic have a Hyderabad connect. Four of the six companies developing COVID vaccines in India are based in Hyderabad. <keyword id="149108" type="COMPANY" weightage="20" keywordseo="Bharat-Biotech">Bharat Biotech</keyword> is currently conducting Phase III clinical trials of India's first indigenous COVID-19 vaccine Covaxin. Covaxin is being developed in collaboration with <keyword id="1256547" type="COMPANY" weightage="20" keywordseo="The-Indian-Council-of-Medical-Research">the Indian Council of Medical Research</keyword> (ICMR) - National Institute of Virology (NIV). This indigenous, inactivated vaccine is being developed and manufactured in Bharat Biotech's BSL-3 (Bio-Safety Level 3) bio-containment facility at Genome Valley here. According to Bharat Biotech, Covaxin has been evaluated in approximately 1,000 subjects in Phase I and Phase II clinical trials, with promising safety and immunogenicity results. The Phase III human clinical trials of the vaccine began in November, involving 26,000 volunteers across India. This is India's first and only Phase III efficacy study for a COVID-19 vaccine, and the largest phase III efficacy trial ever conducted for any vaccine in India. "Covaxin has garnered interest from several countries worldwide for supplies and introduction," said Suchitra Ella, Joint Managing Director of Bharat Biotech. In April, Bharat Biotech announced development of CoroFlu, an intranasal vaccine for <keyword id="8698690" type="COMPANY" weightage="20" keywordseo="coronavirus-">Coronavirus.</keyword> University of Wisconsin–Madison and vaccine company FluGen along with Bharat Biotech began the development and testing of CoroFlu. The Hyderabad based company will produce almost 300 million doses of vaccine for global distribution. In May, Bharat Biotech and Thomas Jefferson University of Philadelphia signed an exclusive deal to develop a new vaccine candidate for COVID-19 invented at Jefferson. The novel vaccine was developed using an existing deactivated rabies vaccine as a vehicle for coronavirus proteins. Bharat Biotech claimed to have excellent track record of innovation with more than 140 global patents, a wide product portfolio of more than 16 vaccines, 4 bio-therapeutics, registrations in more than 116 countries and WHO Pre-qualifications. The company has so far developed vaccines for H1N1, Rotavirus, Japanese Encephalitis, Rabies, Chikungunya, Zika and the world's first conjugated vaccine for Typhoid. It has delivered more than four billion doses of vaccines worldwide. It is also the largest Rabies vaccine manufacturer in the world. Another city-based firm Biological E last month initiated clinical trial of its COVID-19 subunit vaccine candidate in India following approval from the Drugs Controller General of India (DCGI). BE is making the vaccine in collaboration with <keyword id="5289395" type="COMPANY" weightage="20" keywordseo="dynavax-technologies-corporation">Dynavax Technologies Corporation</keyword> (Dynavax), a US-based vaccine focused biopharmaceutical company, and <keyword id="503459" type="COMPANY" weightage="20" keywordseo="Baylor-College-of-Medicine">Baylor College of Medicine</keyword>, a health sciences university in Houston. Biological E has also signed an agreement with Johnson &amp; Johnson to produce the latter's vaccine at its vaccine production facilities and sell them both in India and export across various global markets. Indian Immunologicals, a human and animal vaccines maker, too is developing a vaccine for COVID. Hyderabad-based pahrma major Dr Reddy's Laboratories is conducting clinical trials of Russian COVID-19 vaccine, Sputnik V. Russian Direct Investment Fund (RDIF), Russia's sovereign wealth fund, has collaborated with Dr Reddy's to conduct clinical trials and distribute the vaccine in India. Hyderabad was under spotlight with the recent visits by Prime Minister Narendra Modi and ambassadors of more than 60 countries to the facilities of Bharat Biotech and Biological E in Genome Valley Telangana's industry minister K. T. Rama Rao believes that Hyderabad has cemented its position as the vaccine capital of the world. He pointed out that Hyderabad is already manufacturing more than two billion doses of vaccines every year, which is one-third of the global vaccine output. The city, with its strong ecosystem, has played a critical role in making India not only self-sufficient in the medicine manufacture but also turned it into the pharmacy capital of the world. It accounts for 40 per cent of the total Indian bulk drugs and 50 per cent of the bulk drug exports. Industry leaders believe that Hyderabad will be an integral part of the global efforts to vaccinate the world against COVID. Even if no vaccine is developed in the city, the city will still have a big role to play in global vaccination efforts with the sheer vaccine manufacturing capacity it houses. Hyderabad has the largest US FDA approved vaccine facilities. They have the capacity to manufacture millions of doses with world-class standards. "India's vaccine sector will play a critical role in developing and producing vaccine at scale for distribution across the world. Hyderabad's importance in the global vaccine landscape is only growing," K.T. Rama Rao said. Telangana government has assured the companies that it will play the enabling role in global vaccination efforts against COVID-19. The Hyderabad airport announced few days ago that has developed necessary infrastructure to handle the exports. As per the industry insights, most of India's vaccine export will be to Africa, Latin America and Asian destinations. Hyderabad is already home to more than 800 life sciences companies and the sector employs over 1,20,000 pharmaceutical professionals. It is said to be the only city in the country to house more than 20 incubation centres focused only on life sciences and health-tech. More than 200 start-ups are also working on innovative solutions in healthcare. Genome Valley is India's first organised cluster for life sciences R&amp;D activities spread across 600 square kilometers. However, according to close sources, the high-end model will not be manufactured in the country, reports GizmoChina. As per the reports, the tech giant is reportedly reducing its reliance on China for product manufacturing. "The new iPhone 14 lineup introduces ground-breaking new technologies and important safety capabilities. We're excited to be manufacturing iPhone 14 in India," the company said last month. Foxconn is assembling the new iPhone 14 at its Sriperumbudur facility near Chennai. At this pace, industry analysts predict that next year, Apple might manufacture iPhone 15 in India at the same time in China. Reddy reportedly said the district planned to arrest workers caught on CCTV. The weekend violence caught the attention of C T Ravi, BJP National General Secretary I/C of the region, who called for an investigation by state officials. "It is unfortunate that Wistron manufacturing plant was violently attacked by agitating workers near Kolara. At a time when many companies are shifting base from China to India, such attacks give a bad name for the State," he said on Twitter.Wistron opened the plant earlier this year, hiring about 5,000 new employees, according to a June report in <a href="https://www.deccanherald.com/business/wistron-to-start-iphone-production-at-narasapura-soon-to-hire-5000-workers-867611.html.">The Deccon Herald</a>. The new iPhone SE still carries that same look and design as from the iPhone models few years back and many upgraders have moved to XR or 11 in past two years with their new design and full screen experience. "I should certainly find volumes immediately when it is launched since this will be the most affordable new iPhone and cheapest way to enter Apple ecosystem," Singh added. The Cupertino-based iPhone maker has seen a dramatic shift in its fortunes in India since mid-2019, with increased 'Make in India' manufacturing giving the impetus required for iPhones. According to Hanish Bhatia, Senior Analyst, Devices &amp; Ecosystem at Counterpoint Research, Apple's latest A13 bionic chipset, IP67 rating and wireless charging feature are some of the key highlights of the new device. "The aspirational value of the Apple brand remains high in India, but traditionally consumers tend to lean towards buying a device with higher specifications. The new iPhone SE shall further consolidate Apple's position in the premium segment," said Bhatia. Although lockdown, along with other factors, will impact some sections of the Indian economy, the social distancing period is also likely to create some demand vacuum which may lead to stronger demand for a short period in the coming days. "Consumers will be excited to get hands-on experience of the new device," Bhatia added. The move is seen as a very strategic one to gain foothold in important emerging markets like India, which is a very value-conscious market. "This price point is very aggressive from Apple, considering that Apple found success in India in 2019 in this segment. Also, with the expected aggressive marketing and demand generation initiatives expected by the brands and platforms, once the lockdown is lifted, should really help Apple to gain foothold in the mid premium segment of the market, where the competition is intensifying," elaborated Singh from IDC. Apple is also continuously ramping up its manufacturing capabilities through its partners in India. Apple supplier Wistron assembled low-end iPhone SE (now discontinued) and is now assembling iPhone 6S and iPhone 7 at its Bengaluru facility. The highest-selling iPhone XR is being manufactured at Apple supplier Foxconn's facility in Sriperumbudur, Chennai. "Some of the best-selling Apple iPhone models are already manufactured in India. Also, we can now expect global OEMs to be more aggressive on their contingency planning while diversifying their supply chain and reducing the overall dependency on China. Reuters is first to report the size of the investment and the kind of phones to be assembled.Apple spokeswoman Trudy Muller declined to comment. It is also unclear whether the production will be confined to assembly or include any component production in India.<h2>Looking beyond China</h2>For Apple, widening assembly beyond China is critical to mitigate the risks of the Sino-U.S. trade war.Foxconn, the world's biggest electronics contract manufacturer, is considering setting up a factory in Vietnam, Vietnamese state media reported this month. IBM has been granted the most patents this year, having won 3,059 at the end of May.
