Legal hassles seem to be the keynote of the season for Indian <keyword id="1521" type="CITY" weightage="100" keywordseo="Cricket">cricket</keyword> team captain <keyword id="10138" type="PERSON" weightage="100" keywordseo="Mahendra-Singh-Dhoni">Mahendra Singh Dhoni</keyword> who courted trouble with his <keyword id="2402647" type="UNKNOWN" weightage="100" keywordseo="Vishnu-Avatar">Vishnu avatar</keyword> cover image that Business Today magazine published over a year ago. Ever since, the skipper has been spending days of anxiety over the image. 
 
The image in question is said to have offended the sentiments of scores of Hindus who worship Lord Vishnu. He is their god while Mahendra Singh Dhoni is considered the demigod of cricket in a country that swears by its cricket frenzy. It is not often that one gets to see a deeply religious country being equally consumed by cricket fever. 
 
So how did the demigod who posed as god, turn into a villain? 
 
All cricket stars in this country bag endorsements worth much more than the moolah they make from the game. Mind you, they are not mere sportspersons. They embody the collective success of a nation that awaits its resurrection across various fronts. In a country like India where one finds so much of diversity, tolerance and also contradictions, heroes and zeroes are often compelled to swap places under strangest of circumstances. That Dhoni stood there like the raja (king) of big deals, endorsing several products and holding several consumer goods in his many hands (in his Vishnu avatar, he has many hands and even holds a shoe in one of them) did not go down too well with his fans and also with the Hindus. Cricket might be treated as a religion here; but this incident showed cricket can never take the place of a religion. Also, taking liberty with sentiments, no matter how popular one is, won’t please the masses. 
 
As soon as the magazine hit the stands, Hindu followers moved the court, saying that depicting a mere mortal as the god they revere is hurtful, mischievous and insulting. When the court admitted these cases, things turned a little serious for the magazine, as well as for Dhoni’s team of legal experts. 
 
Dhoni remained silent about this hullabaloo. A court in Anantapur in Andhra Pradesh issued a warrant against him, against a private complaint stating that Dhoni had hurt the religious sentiments of the Hindus. 
 
Actually, the protests connected to the incident were too widespread and immense. Although no violence followed this display of anger, the rage and resentment of people could not be ignored. 
 
That the complainants, Gopal Rao and Shyam, are rumoured to belong to a Hindu right wing organisation could be coincidental though, without connecting to the fact that there is a right wing government at the Centre. 
 
The police, who submitted a subsequent report stating that the cover page was a creation of clever artistry, using Dhoni’s face to depict his success, did not hold much water. The fact that the image was ‘animated’ had little to do with pacifying the frayed nerves and could not even ensure a legal margin for the accused to protect Dhoni later. However, the police recorded it and presented it to the court. 
 
What followed the controversy was something different. The court issued summons to MS Dhoni and to the said magazine. But when the representatives of the magazine appeared in the court with no representation from Dhoni’s side (he did not appear in person or sent a lawyer), the court didn’t take it too well and issued a warrant of appearance against the cricketer. Although the warrant was for appearance, it has somewhat upset the applecart of business, cricket and media.

Earlier, the number of injured people during the celebration was given as 238 but in a significant increase, the number increased to 245. Many 'Govindas' who are part of the many human pyramids formed during the celebrations of playing the dahi Handi are under treatment at various private hospitals, while several got discharged after treatment. The injured have been admitted to hospitals including the JJ Hospital, St. George Hospital, GT Hospital, Poddar Hospital, KEM Hospital, Nair Hospital, Sion Hospital, Rajawadi Hospital, Veer Savarkar Hospital, MT Agarwal Hospital, Kurla Bhabha Hospital, Shatabdi Govandi Hospital, Bandra Bhabha Hospital, Trauma Care Hospital, VN Desai Hospital, MW Desai Hospital, Cooper Hospital, BDBA Hospital and Leelavati Hospital. According to the latest reports, around 207 people have been discharged from various hospitals. Last year, during Dahi Handi celebrations, as many as 195 'Govindas' were injured in different incidents. The BMC reported that out of the 195 'Govindas', 18 were admitted to hospital while the remaining 177 were discharged. One of the major cultural activities, Dahi Handi is celebrated by filling an earthen pot with curd, butter, and other milk products. Subsequently, a group forms a human pyramid to reach the matka and break it. The tradition symbolises <keyword id="19906323" type="General" weightage="20" keywordseo="Lord-Krishna" source="keywords">Lord Krishna</keyword>'s playfulness and innocence, as well as his love for butter and curd. Dahi Handi celebrations commemorate Lord Krishna's act of eating Dahi hung at a height when he was a child. As per the Hindu calendar, Lord Krishna, an avatar of Lord Vishnu, was born on the eighth day of the month of Bhadra. The day mostly falls in August or September as per the Western calendar. The festival of Janmashtami is celebrated by offering prayers to Lord Krishna, with beautifully decorated swings, dance, and music performances along with the Dahi Handi competitions.

Origin of Govardhan Puja Govardhan Puja has its roots in the age of Dwapar during Krishnavatar. When little Krishna grew up in the village of Gokul, he initiated Govardhan Puja in order to pay tribute to the Govardhan hill, the small hillock of the village that provided nourishment to the cows of the village and some essentials for the village households. Govardhan Puja story During those days, the people in the village of Gokul performed elaborate pujas to please Indra, the king of gods. <ul><li>ASCI has launched the final guidelines for <keyword id="2540701" type="PERSON" weightage="20" keywordseo="Influencer-marketing">influencer marketing</keyword>.</li><li>It has also launched ASCI.Social, a digital platform that will be home to all information about guidelines and a community of influencers, marketers, agencies and consumers.</li></ul>The Advertising Standards Council of India (ASCI) today unveiled the final guidelines for influencer advertising on digital media. The draft guidelines initially were issued in February and feedback from all stakeholders – advertisers, agencies, influencers and consumers – was sought. To ensure a collaborative process and expert inputs, ASCI tied up with Big Bang Social, a leading marketplace for social storytelling, to get India’s leading digital influencers’ views on board. The guidelines will be applicable to commercial messages or advertisements published on or after June 14, 2021. The guidelines make it mandatory for influencers to label the promotional content they post. As digital media consumption becomes the norm, the distinction between content and promotional advertisements becomes critical. The marketing landscape is transforming, and influencer marketing has become mainstream. Therefore, consumers have a right to know what content has been paid for by brands and the guidelines intend to bring this transparency to influencer marketing. Since ‘Influence equals action’ is a reality now – consumers today not only buy products and services endorsed by influencers, but they also buy into the brand stories they create. Thus, these guidelines safeguard the interests of consumers, influencers, marketeers, and the advertising industry. When the draft guidelines were shared, they sparked vigorous conversations within the influencer community and among other stakeholders. We received feedback from more than 25 different stakeholders over two months, some of them included industry associations like IAMAI, IBHA, advertisers like PepsiCo, P&amp;G, Nestle, HUL, Tata, Star, we also received comments from voluntary consumer organizations. For this, ASCI has identified a French technology provider, Reech. With lines between content and advertisements becoming blurry, it is critical that consumers must be able to distinguish when something is being promoted with an intention to influence their opinion or behavior for an immediate or eventual commercial gain. Consumers may view such messages without realizing the commercial intent of these, and that becomes inherently misleading, and in violation of clause 1.4 (misleading by omission) and 1.5 (abuse trust of consumers or exploit their lack of experience or knowledge) GUIDELINES: <ol><li>Disclosure</li></ol>All advertisements published by social media influencers or their representatives, on such influencers’ accounts must carry a disclosure label that clearly identifies it as an advertisement. The following criteria must be used to determine if disclosure is required: <ol><li>Disclosure is required if there is any material connection between the advertiser and the influencer.</li><li>Material connection isn’t limited to monetary compensation. Disclosure is required if there is anything of value given to mention or talk about the Advertiser’s product or service. For example: If the Advertiser or its Agents gives free or discounted products or service or other perks and then the influencer mentions one of its products or services, a disclosure is needed even if they weren’t specifically asked to talk about that product or service.</li><li>Disclosures are required even if the evaluations are unbiased or fully originated by Influencer, so long as there is a material connection between Advertiser and Influencer.</li><li>If there is no material connection and the influencer is telling people about a product or service they bought and happen to like, that is not considered to be an advertisement and no disclosure is required on such posts.</li></ol>The disclosure must be upfront and prominent so that it is not missed by an average consumer <ol><li>It should be placed in a manner that is hard to miss. </li><li>Disclosures are likely to be missed if they appear only on an ABOUT ME or profile page, or bios, at the end of posts or videos, or anywhere that requires a person to click MORE. </li><li>Disclosure should not be buried in a group of hashtags or links.</li><li>Using a platform’s disclosure tool should be considered in addition to an influencer’s own disclosure.</li><li>If the advertisement is only a picture or video post without accompanying text (such as Instagram stories or Snapchat), the discloser label needs to be superimposed over the picture/video and it should be ensured that the average consumer is able to see it clearly. </li></ol>Videos<ol><li>For videos that last 15 seconds or lesser, the disclosure label must stay for a minimum of 3 seconds. </li><li>For videos longer than 15 seconds, but less than 2 minutes, the disclosure label should stay for 1/3rd the length of the video. </li><li>For videos which are 2 minutes or longer, the disclosure label must stay for the entire duration of the section in which the promoted brand or its features, benefits etc are mentioned. </li></ol>Live streams<ol><li>In live streams, the disclosure label should be announced at the beginning and the end of the broadcast. If the post continues to be visible after the live stream is over, appropriate disclosure must be added to the text/ caption.</li><li>In the case of audio media, the disclosure must be clearly announced at the beginning and at the end of the audio, and before and after every break that is taken in between.</li><li>The disclosure must be made in a manner that is well understood by an average consumer.</li></ol>Following is the list of disclosure labels permitted. This disclosure must be upfront and prominent.</li><li>Responsibility of disclosure of material connection and also of the content of Advertisement is upon the Advertiser for whose product or service the advertisement is, and also upon the Influencer. For clarity, where Advertiser has a material connection with the Influencer, Advertiser’s responsibility will be to ensure that the posted Influencer advertisement is in line with the ASCI code and its Guidelines. While the Influencer shall be responsible for making disclosures required under the Guidelines. The Advertiser, shall, where needed, call upon the Influencer to delete or edit an advertisement or the disclosure label to adhere to the ASCI Code and Guidelines.</li><li>Due Diligence: The influencers are advised to review and satisfy themselves that the advertiser is in a position to substantiate the claims made in the advertisement.</li></ol>
