New Delhi, Apr 23 () The police has opposed in the Delhi High Court the parole plea of Vishal Yadav, serving life term for the murder of Nitish Katara, saying there is no risk of coronavirus infection to him.Vishal sought parole on the ground that he could get infected by coronavirus or tuberculosis as he had earlier suffered from TB in view of overcrowding and poor sanitation facilities in the prison.In its status report placed before Justice V Kameswar Rao, Delhi Police has said that the prison records indicate the convict's medical condition to be stable and he is not suffering from TB.The report, filed through additional standing counsel (criminal) Rajesh Mahajan, also said that medical reports filed with the petition are of 2004, 2008, 2009 and 2010 and there is no material on record to show he is suffering from TB now.It further said that material filed with the petition indicating vulnerability of TB patients to coronavirus or COVID-19 relates to patients currently suffering from TB and not those who suffered from it in the past.Under the prison rules, grant of eight weeks 'emergency' parole during the coronavirus pandemic amounts to a remission of sentence, it said.However, in this case, the High Court while sending Vishal to jail in February 2015 had directed that he be not considered for any remission till he completes 25 years of actual imprisonment."Consequently, he would not be entitled to grant of emergency parole as it amounts to grant of remission," the report said.Another reason cited in the report for dismissing Vishal's plea was that he moved the court without first moving the competent authority for grant of parole in accordance with the rules.The status report also said that there was a threat to the life of the victim's mother -- Neelam Katara -- and witness -- Ajay Katara -- and, therefore, Vishal does not deserve to be released on paroleThe petition is listed for hearing on Friday.Vishal has contended in his plea that due to his prolonged TB infection, his immune system is weak and coupled with the poor sanitation facilities in prison, he would be vulnerable to coronavirus.On October 3, 2016, the Supreme Court had awarded 25-year jail term without any benefit of remission to Vikas Yadav and his cousin Vishal for their role in the sensational kidnapping and killing of Nitish Katara. New Delhi, Apr 20 () Vishal Yadav, serving life term for the murder of Nitish Katara, has moved the Delhi High Court seeking parole citing risk of COVID-19 or TB infection due to overcrowding and poor sanitation in the prison.Vishal claimed he suffered from tuberculosis (TB) earlier and if he gets infected again it could be fatal.His plea stated that due to his prolonged TB infection, his immune system is weak and coupled with the poor sanitation facilities in prison, he would be vulnerable to coronavirus.The matter came up for hearing before Justice V Kameswar Rao on Monday and he listed it for Wednesday so that the victim's mother, Neelam Katara, and a witness in the case - Ajay Katara - can be served with the petition, Delhi government additional standing counsel Rajesh Mahajan said.Mahajan also said that the state opposed the parole plea of Vishal during the brief hearing held via video conferencing.On October 3, 2016, the Supreme Court had awarded a 25-year jail term without any benefit of remission to Vikas Yadav and his cousin Vishal for their role in the sensational kidnapping and killing of Katara. Katara case: Vishal Yadav moves HC for 8-week parole citing COVID-19 risk in prison

New Delhi, Jun 9 () The Delhi High Court on Tuesday sought response of the AAP government on the parole plea of Vishal Yadav, who is serving life term for killing business executive Nitish Katara in 2002. Justice V K Rao issued notice to the Delhi government and Katara's mother Neelam Katara asking them to file their replies by the next date of hearing on June 11. Delhi government was represented by its additional standing counsel Rajesh Mahajan. Yadav has sought eight weeks emergency parole on the ground that he could get infected by COVID-19 or tuberculosis due to overcrowding and poor sanitation facilities in the prison. He had in April moved a similar plea which was disposed of on May 2 by the high court by asking the "competent authority", which under the prison rules is the Lt Governor, to treat the petition as a representation and take a decision within 15 days. On May 16, the competent authority rejected Yadav's plea for parole and against that order he has moved the high court. The competent authority had rejected the plea on the ground that he has been awarded 25 years imprisonment without any remission. Yadav has sought quashing of the May 16 order. He has contended that numbers of coronavirus cases was increasing at a high rate and there was a risk of infection to him inside the prison, especially since he was a tuberculosis (TB) patient in the past. He has also contended in his plea that due to his prolonged TB infection, his immune system is weak and coupled with the poor sanitation facilities in prison, he would be vulnerable to coronavirus. Katara case convict Vishal Yadav seeks parole citing COVID-19 infection risk: HC seeks govt stand

The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Monday modified the sentences of <keyword id="46447" type="PERSON" weightage="100" keywordseo="Nitish-Katara">Nitish Katara</keyword> murder case convicts <keyword id="46445" type="PERSON" weightage="20" keywordseo="Vikas-Yadav">Vikas Yadav</keyword> and his cousin <keyword id="46446" type="PERSON" weightage="20" keywordseo="Vishal-Yadav">Vishal Yadav</keyword> and reduced their jail terms to 25 years. 
 The <keyword id="6356229" type="ORGANIZATION" weightage="20" keywordseo="apex-court">Apex Court</keyword> sentenced another accused <keyword id="2180588" type="UNKNOWN" weightage="20" keywordseo="Sukhdev-Yadav">Sukhdev Yadav</keyword> alias Pehelwan to 20 years in prison. 
 
An Apex Court division bench headed by Justice Dipak Misra passed the order after hearing a detailed argument from both sides - the prosecution as well as the defence. 
 
The Apex Court had on August 17, 2015, upheld the conviction of Vikas, Vishal and Sukhdev, saying 'only criminals are crying for justice' in this country. 
 The three convicts were serving a life-term awarded by the lower court in May 2008 for abducting and killing <keyword id="6414390" type="PERSON" weightage="20" keywordseo="Katara">Katara</keyword>, a business executive and the son of a railway officer, on the night of February 16-17, 2002, as they opposed the victim's relationship with Bharti, Vikas' sister and the daughter of Uttar Pradesh politician D.P. Yadav. 
 The <keyword id="6355014" type="ORGANIZATION" weightage="20" keywordseo="Delhi-High-Court">Delhi High Court</keyword> had on April 2, 2014, upheld the verdict of the lower court in the case and described the offence as "honour killing" stemming from a "deeply-entrenched belief" in the caste system.

Nitish Katara murder case: SC reduces sentences of Yadav brothers to 25 years

<keyword id="536283" type="PERSON" weightage="100" keywordseo="Rahul-Yadav">Rahul Yadav</keyword> has decided to step down as CEO of <keyword id="1960231" type="UNKNOWN" weightage="100" keywordseo="Housing-com">Housing.com</keyword> for the second time in less than two months, and this time it seems it is not a bluff. His resignation will be accepted by the board of the real estate portal, two people directly aware of the development said. 
 
Yadav, 26, who has been involved in a string of controversies, will be asked to stay on at the company and oversee product development. 
"After discussions with the board, Rahul has decided to step down," said a source. "There will be a board meeting within two weeks where this will be announced. He has let individual board members know." 
 
Rahul Yadav denied all such claims though. Yadav, an IIT-Bombay dropout and co-founder of Housing, did not immediately reply to queries from ET. A representative for <keyword id="163404" type="COMPANY" weightage="60" keywordseo="Softbank">SoftBank</keyword>, the biggest investor in Housing, did not reply to an email sent on Thursday morning. 
 
Japan's SoftBank, and another investor Falcon Edge, had taken charge of operations at Housing after Yadav's confrontation with the board in late April and early May. In a letter announcing his resignation as CEO, Yadav questioned the intellectual prowess of the investors, who persuaded him to stay on but made him tender an apology. 
 
SoftBank's representative on the board, Jonathan Bullock, oversees all major decisions at the company. Yadav has courted one controversy after another, earning him a reputation as an enfant terrible of the Indian startup industry. He started a social media spat with <keyword id="122716" type="CITY" weightage="20" keywordseo="Sequoia-Capital">Sequoia Capital</keyword>'s managing director Shailendra Singh, and most recently posted a photo of InfosysBSE -0.40 % CEO <keyword id="6369763" type="PERSON" weightage="20" keywordseo="Vishal-Sikka">Vishal Sikka</keyword> sleeping at an airport lounge. The provocation was that Yadav apparently tried to wake up a sleeping Sikka, who brushed him off saying he was too tired to talk to him. 
 
 The board of Housing has been on the lookout for a potential successor to Yadav for some time. Recruitment agency <keyword id="2918431" type="UNKNOWN" weightage="20" keywordseo="Spencer-and-Stuart">Spencer and Stuart</keyword> has been leading the mandate for a new CEO. 
 
Housing was founded in 2012 by a dozen college-mates from IIT-Mumbai, of whom three have left the company. Housing, which competes with CommonFloor, 99Acres, and MagicBricks, owned by the publisher of this paper, has attracted more than $120 million (Rs 760 crore) in funding and is valued at over Rs 1,500 crore.

But the story that began with an ambitious youngster (read IIT dropout) founding a company that would make the established rivals sweat in competition and gradually attaining the status of corporate drama prince is something that needs serious analysis. 
 
The Economic Times in a news has asked ‘Had Rahul Yadav lost interest in Housing?’ 
 
Fond of controversy, Rahul may have lost actual interest in the business. "The guy is good. But he doesn't have the interests of his own company in mind, as he has now said that it is not interesting for him to solve the housing problem,” a venture capital investor told the ET. 
 
Even until a day earlier, Yadav was denying reports of his ouster or that online classifieds company Quikr was in talks to acquire Housing. 
 
The ET report further elaborates, Yadav has been openly contemptuous of rival organisations and people he perceives to have crossed his path. Things began to go haywire for him in March when he wrote an incendiary email to Sequoia India managing director Shailendra Singh, ostensibly because the venture capital firm poached an employee from Housing. 
 
Then came the most trolling phase in the life of Rahul. He resigned as CEO, questioning "intellectual capability” of the board members and investors. At a board meeting a few days later, he apologized and withdrew his resignation, but the stage had been sfor an unceremonious exit from the company he cofounded three years ago. 
 
 
According to the ET news report, Yadav announced a few days later in May that he was giving away his entire 4.57% stake to Housing employees, and challenged the founders of Ola and Zomato to follow suit. The following month, while returning from a trip to China, Yadav posted a photograph of Vishal Sikka sleeping at an airport lounge, complaining that the Infosys CEO had refused to answer his questions. 
 
Born to middle-class parents from Alwar in Rajasthan, Yadav's turning point came when he enrolled at IIT-Bombay in 2007, specialising in metallurgy. It was at the institute, a breeding ground for tech entrepreneurs - the founders of India's largest cab aggregator, Ola, are IIT-Bombay alumni - that Yadav caught the entrepreneurship bug. 
 
Having built Exambaba.com, an online question bank of old exam papers that IIT-Bombay asked to close, he dropped out of the institute in the final year. In 2012, he and 11 other batchmates cofounded Housing after they had a difficult time finding accommodation in Mumbai, home to some of the world's most expensive real estate. 
 
Yadav's ignonimous exit puts a lot of things in question. With the influx of capital, Housing has aggressively expanded and now employs more than 2,500 people, whose are now in a precarious place with investors keen to sell the company. 
 
But Yadav isn't without his share of supporters, people won over primarily because of his bold attitude. "... Please know that we are ardent admirers, and know that you are meant for greatness. Looking forward to hearing your next," Ajeet Khurana, the former CEO of IIT-Bombay's incubator, commented on Yadav's Facebook wall after he was fired, also stating that he was willing to invest in his next venture. 
 
Yadav had grand visions for Housing, which he outlined to ET after returning from his trip to China. This included going beyond Housing being a classifieds website for real estate and evolving into an ecosystem with an online community and helping design the "next generation of houses,” reads the news report by the financial daily.

"Even the woman in her statement to police did not mention about rape but talked about 'marpeet' (beating) only," he said. "For disturbing social harmony and create caste violence, some persons wrongly presented facts," the UP police officer said. "Police took immediate action in the case and now we will identify those who tried to disturb social harmony and create caste violence," the ADG added, stressing that people "distorted facts" in the media. The commission said it also came across a disturbing report on police officials cremating her body in the middle of the night without the permission and presence of her family members. It has been reported that the victim's body was cremated at 2:30 am by the police without the presence of any family member. "The victim's family had reportedly appealed to the District Magistrate for taking her body home for performing the last rites, however the police went ahead with the cremation while most of her family members were away," it said. "The commission has now written to Director General of Police, Uttar Pradesh seeking an explanation on the urgency to cremate the body of the victim in the middle of the night that too in the absence of her family. NCW has asked the administration to send a reply on the same at the earliest," it said. After Hathras, another gangrape victim dies in UP's Balrampur A 22-year-old Dalit woman died after allegedly being raped by two men in Uttar Pradesh's Balrampur district, succumbing to critical injuries on the same day as the teen from Hathras in the state who breathed her last in a Delhi hospital two weeks after she was gangraped. Both the women died on Tuesday and were cremated on Wednesday. The two men accused of assaulting the woman from Balrampur have been arrested, police said amid outrage over the death of the 19-year-old Dalit woman from Hathras. The Balrampur victim's mother told reporters on Wednesday night that the rapists broke her daughter's legs and back, a charge denied by the police. "My daughter had gone to take admission in a college on Tuesday. On her way back, three-four persons abducted her, took her to their room, gave her an injection and raped her. They later sent her back on an e-rickshaw, which dumped her outside our house. They broke her legs and back. She could not stand or talk," the woman said. Quoting the victim's family members, Balrampur Superintendent of Police (SP) Dev Ranjan Verma said the woman worked in a private firm and returned home on Tuesday in a serious condition. She looked dazed and had a cannula, medically known as Vigo and used for administering an injection or other fluids in the body, inserted in her hands. She was rushed to a nearby hospital but died on the way, the SP said. When the matter was reported to the police by the hospital, her parents alleged she was gangraped, he added. Acting on the family's complaint, police identified the accused as Shahid and Sahil and arrested them. About the mother's allegation that the woman's legs and back were broken, Verma said, "It was not confirmed in the post-mortem. We contradict this news." She was cremated on Wednesday after the post-mortem in the presence of her family members, the police said. The district magistrate and the SP, along with the mahant of the Devipatan temple, Mithilesh Nath Yogi, visited her home on Thursday morning, met the family members and condoled her death. "The family members were assured that the accused will be given a strict punishment in accordance with law. A letter sanctioning a financial assistance of Rs 6,18,450 was handed over to them by the mahant. The amount will be sent to the victim's mother's bank account by the afternoon," a statement issued here said. The mother has demanded a compensation of Rs 25 lakh and a government job for her son. "My daughter wanted to become a lawyer but she was killed. The same fate should await the culprits. We want justice. My son should be given a government job and we should get at least Rs 25 lakh as compensation," she said. Safdarjung Hospital releases autopsy The autopsy of the 19-year old victim of the Hathras gang rape reveals that she was tortured, strangled and suffered from a cervical spine injury. However, the final diagnoses does not mention rape. It reads, "Alleged post-strangulation with cervical spine injury with sepsis with cardiopulmonary arrest." Instead, ‘rape and strangulation’ have been noted under the ‘<a href="https://www.ndtv.com/india-news/hathras-gang-rape-autopsy-report-shows-victim-was-strangled-suffered-cervical-spine-injury-2303696">medical history</a>’ section. The report adds that the victim was given CPR and ‘despite all resuscitative efforts’ was declared dead at 8:55 am on Tuesday, September 27. Section 144 in Hathras, borders sealed The district administration in Hathras has imposed Section 144 in the area and has banned the entry of all 'outsiders' including media persons in Boolgarhi Village where a 19-year-old Dalit girl was gang-raped and later passed away. District Magistrate Praveen Lakshkar said that the Special Investigation Team (SIT), set up to probe the incident, has reached the village and is interacting with the family and other people to record their statements. "They do not want any disturbance and hence, all entry of outsiders has been stopped," he said. The District Magistrate further said that he had no information of Congress leaders Rahul Gandhi and Priyanka Vadra reaching Hathras to meet the bereaved family. NHRC issues notice to Yogi government on Hathras incident The National Human Rights Commission (NHRC) has taken suo motu cognizance of the Hathras incident of the rape and murder of a 19-year-old Dalit girl and has issued a notice to the Yogi Adityanath government. The Commission has directed the state government to provide adequate protection to the family of the deceased, keeping in view the gravity of the matter and also the aspect of the witness protection as there is apparent rift between two communities. This includes 36 men and 44 women. "Today around 11.30 pm, members of different parties - AIDWA, DSDU, AISA AIMSS - tried to reach UP Bhawan, SP Marg to stage a protest demanding harsh punishment for accused persons in Hathras gangrape case. We have detained 80 people in this connection," said a senior police officer. Police said that as the protestors have violated order u/s 144 CrPC in force and other laws regarding Covid-19, FIR u/s 188 IPC, 3 Epidemic Act &amp; 51(b) Disaster Management Act, PS Chanakyapuri has been registered against the protesters. Yogi announces ₹ 25 lakh aid for victim’s family Amid an uproar over the cremation of the body of a Dalit gang-rape victim early on Wednesday, Uttar Pradesh Chief Minister Yogi Adityanath spoke to the 19-year-old woman's father in Hathras district and offered his condolences. He also announced a compensation of ₹ 25 lakh to the bereaved family, apart from a job to one of its members. The family would also be given a house. The victim's father sought the harshest punishment for the four accused arrested for the crime reported on September 14. Additional Chief Secretary (Home) Avanish Awasthi said that the Chief Minister assured the woman's father of the most stringent action against the culprits and all possible help to the family. Yogi sets up SIT to probe Hathras incident The Yogi Adityanath government on Wednesday set up a Special investigation Team (SIT) to probe the Hathras incident. The SIT, according to official sources, will comprise home secretary Bhagwan Swaroop, DIG Chandra Prakash and IPS officer Poonam. The SIT will submit its report at the earliest. The Chief Minister, sources said, has decided to send the case to a fast track court in order to ensure justice to the victim. All four accused have already been arrested. PIL filed in Supreme Court seeking CBI probe in Hathras gang-rape and murder A PIL was filed in the Supreme Court on Wednesday seeking a CBI probe or SIT investigation under a sitting or former Supreme Court or High Court judge in the gruesome gang-rape and murder of a 19-year-old Dalit woman in Uttar Pradesh's Hathras district. The PIL has been filed by social activist Satyama Dubey and advocates Vishal Thakre and Rudra Pratap Yadav. The petitioners urged the apex court to pass appropriate order for a fair investigation - either by the CBI or the SIT under a sitting or retired judge of Supreme Court or High Court - and transfer the case to Delhi, as Uttar Pradesh authorities had failed to take certain actions against the accused. The plea said the victim was first raped and then brutally assaulted, and according to a medical report, her tongue was chopped and her neck and back bones broken by the accused, who belonged to an upper caste. The victim succumbed to her injuries at Safdarjung hospital in Delhi. The petitioner said on September 14, the accused persons raped and brutally assaulted the victim when she was in the fields to collect fodder for her cattle. It also said that the police have said the victim's cremation was being carried out as per the wishes of the family, which was not true, and the police personnel set fire to the body of the deceased, even as media persons were banned, as per the information received, said the plea. The Delhi Commission for Women (DCW) on Wednesday also wrote to Chief Justice of India (CJI) SA Bobde to urge the Supreme Court to take suo motu cognisance of the gruesome gang rape and murder of a Dalit woman in Uttar Pradesh's Hathras district. Hathras victim cremated, police denies coercion The 19-year-old Dalit woman from Hathra was cremated early Wednesday in her village amid tight security. "The police have forcibly taken the dead body, and my father along with them for cremation. When my father reached Hathras, he was immediately taken (to the crematorium) by the police," the victim's brother told the media. However, Hathras police have denied the charges and has issued a notice saying the coercion being talked about on social media is canard. It said: "The family cremated the body with due rituals under the supervision of police and administration." The victim, who was paralyzed after being allegedly dragged on the field by her attackers on September 14, died at the Safdarjung Hospital on Tuesday after battling for life for a fortnight. Her mortal remains reached the Boolgarhi village around midnight and the cremation was done at 3 a.m. There was tension as the victim's mortal remains reached the village and people tried to block the ambulance from moving ahead. Superintendent of Police (SP) Vikrant Veer denied any 'urgency' by the police in holding the cremation at night even though cremations do not normally take place after sunset. He added that the cremation was done by the family as usual after the body reached Boolgarhi village. The SP claimed that the situation is calm in the village, but heavy police force has been deployed. The woman was allegedly raped in a Hathras village by four men, who were later taken into custody. Initially she was rushed to the Jawaharlal Nehru Medical College and Hospital in Aligarh, but on Monday night had to be shifted to the Safdarjung Hospital in Delhi after her condition deteriorated.
