The Enforcement Directorate (ED) has sought revocation of debt-ridden <keyword id="14678" type="PERSON" weightage="40" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>’s diplomatic passport over non-cooperation in a <keyword id="6355008" type="UNKNOWN" weightage="40" keywordseo="money-laundering">money laundering</keyword> probe. 
 The ED had asked Mallya to appear before the law enforcement agency by April 9 in Rs 900 crore <keyword id="6357560" type="CITY" weightage="40" keywordseo="IDBI-Bank">IDBI bank</keyword> loan fraud case. 
 
It has written to the Ministry of External Affairs to take action under the Passport Act, 1967 and ask the Regional Passport Office (RPO) here to revoke the diplomatic passport of the beleaguered businessman as he has turned out to be "un-cooperative" with its investigators probing a criminal case under the Prevention of Money Laundering Act (PMLA) at its zonal office in Mumbai. 
 
Apparently, Mallya left India on March 2 on a diplomatic passport issued to him by virtue of him being a sitting Rajya Sabha Member of Parliament. 
 
Under the Passport Act, when a person is issued a diplomatic passport, their regular international travel document gets deposited and when a revocation is sought for the former is sought, the latter too gets cancelled. 
 
They said once the ED request is okayed, the MEA will inform UK authorities about the same and seek for his deportation to India. 
 
Mallya had thrice failed to appear before the ED IO in Mumbai in connection with the Rs 900 crore IDBI loan fraud case which the central probe agency is investigating under PMLA. 
 
Once Mallya's Passport is revoked, ED still is left with the option to approach a competent court and get issued a non-bailable warrant against him and also ask the Interpol to issue a Red Corner Notice (RCN) against him and apprehend him anywhere across the globe. 
 
Mallya, who is facing legal proceedings for alleged default of loans worth over Rs 9,000 crore from various banks, was also directed by the Supreme Court to disclose all assets owned by him and his family in India and abroad by April 21.

ED says Vijay Mallya is un-cooperative, seeks revocation of his diplomatic passport

Former Indian liquor baron <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>, who <a href="http://www.businessinsider.in/Vijay-Mallya-out-of-India-while-banks-seek-stay-order/articleshow/51323634.cms">fled India in March </a>and owes billions of dollars to Indian banks, has said that he is in a "forced exile" and would not return to India right now, because here, things are been thrown at him "fast and furious". 
 
Mallya, whose passport has been cancelled by the Indian government, said that he wants a "reasonable" settlement with creditor banks for the now defunct Kingfisher Airlines, but by taking his passport or arresting him, they won’t get any money. 
 
"I definitely would like to return to India. Right now, things are flying at me fast and furious. My passport has been revoked. I don't know what the government is going to do next," he told the Financial Times. 
 
The 60-year old says that he continues to be an Indian patriot, who is "proud to fly the Indian flag", but he feels safe in the UK and has no plans to leave that country amidst the outcries against him. 
 
"It is important to understand the environment in India today. The electronic media is playing a huge role not just in moulding public opinion, but in <a href="http://www.businessinsider.in/Vijay-Mallya-foreign-assets/articleshow/51994174.cms">inflaming the government</a> to a very large extent," he said in a four-hour interview in Mayfair, Central London. 
 
It was yesterday that the Indian government had formally asked the UK to <a href="http://www.businessinsider.in/Indian-wants-Vijay-Mallya-deported/articleshow/52027466.cms">deport Mallya</a>, who also has <a href="http://www.businessinsider.in/Four-more-NBWs-against-Mallya/articleshow/51412039.cms">several NBWs </a>against him. 
 
Mallya added that he was "absolutely not guilty of any of these preposterous charges of diverting funds from Kingfisher, buying <a href="http://www.businessinsider.in/Vijay-Mallyas-Airbus-to-be-auctioned/articleshow/51406790.cms">properties </a>or stuff like that".

He added that the government can appoint the world's best forensic auditor, but even he won’t find anything wrong in the accounts of Kingfisher as far as bank loans utilization is concerned. 
 
When asked who he thinks is behind his woes, he said, "I wish I knew," and "All I can say is the manner in which my passport was first suspended and then revoked was done in an extraordinary haste." 
 
"First, notice of suspension came on a public holiday last week... I replied. And my reply was not considered and the passport was revoked on Saturday," he concluded.

Cancelling my passport won’t get you back your money, cries Mallya

<a href="http://www.businessinsider.in/searchresult.cms?query=Vijay+Mallya&amp;sortorder=effectivedate">Vijay Mallya</a>, the head of <a href="http://www.businessinsider.in/searchresult.cms?query=Kingfisher+Airlines&amp;sortorder=effectivedate">Kingfisher Airlines</a> suffered a major blow today when his passport was suspended by the government. It has threatened to even revoke it. 
 Mallya’s diplomatic passport, was suspended by the <keyword id="193522" type="ORGANIZATION" weightage="60" keywordseo="External-Affairs-Ministry">External Affairs Ministry</keyword> on the recommendation of the ED. He has been in Britain for over a month and has refused to appear before the agency. 
 "On the advice of the Enforcement Directorate, the Passport Issuing Authority in the MEA has today suspend the validity of <keyword id="14678" type="PERSON" weightage="80" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>'s diplomatic passport with immediate effect for a period of 4 weeks, under Section 10 A of the Passports Act, 1967. 
 
"<a href="http://www.businessinsider.in/searchresult.cms?query=Vijay+Mallya&amp;sortorder=effectivedate">Mallya</a> has been asked to respond within one week as to why his passport should not be impounded or revoked under section 10(3)(c) of the Passports Act, 1967. If he fails to respond within the stipulated time, it will be assumed that he has no response to offer and the MEA will go ahead with the revocation," MEA Spokesperson Vikas Swarup said.

Mallya's Passport, may revoke it

<ul><li>The Ministry of Home Affairs has empowered the <keyword id="107956" type="ORGANIZATION" weightage="20" keywordseo="Serious-Fraud-Investigation-Office">Serious Fraud Investigation Office</keyword> (SFIO) to request the issuance of look-out-circulars (<keyword id="6355098" type="UNKNOWN" weightage="20" keywordseo="LoC">LOC</keyword>) against people who are suspected of defaulting on large loans. </li><li>Last week, the same power was also granted to the CEOs of India’s public-sector banks, which have largely been the major casualties of these frauds and loan defaults. </li><li>Prior to these changes, the ability to request for LOCs was mainly extended to police authorities, the CBI, Enforcement Directorate, the home and external affairs ministries as well as regional passport offices and customs and tax officials. </li></ul>In the wake of a series of high profile banking scams and loan defaults this year, the most notable of which is <a href="https://www.businessinsider.in/here-are-the-main-findings-from-punjab-national-banks-internal-investigation-into-the-2-billion-nirav-modi-scam/articleshow/64681851.cms">the Nirav Modi case</a>, the Indian government is trying to make it easier to prevent fraudsters from escaping the country and taking up residence elsewhere. To this effect, the Ministry of Home Affairs has empowered the Serious Fraud Investigation Office (SFIO), which is housed under the corporate affairs ministry, to request the issuance of <a href="https://indianexpress.com/article/india/centre-gives-sfio-powers-to-stop-defaulters-from-fleeing-the-country-5468015/">look-out-circulars </a>(LOC) against people who are suspected of defaulting on large loans. Last week, the same power was also granted to the<a href="https://www.livemint.com/Politics/lAjlD5SnzGYkS87SyKxVJI/Govt-authorises-public-sector-bank-CEOs-to-request-for-look.html"> CEOs of India’s public-sector banks</a>, which have largely been the major casualties of these frauds and loan defaults. However, as these public-sector banks aren’t official investigation agencies, the LOCs requested by them can be challenged in court. That is not the case with the SFIO. Prior to these changes, the ability to request for LOCs was mainly extended to police authorities, the CBI, Enforcement Directorate, the home and external affairs ministries as well as regional passport offices and customs and tax officials. A major reason why wilful defaulters like <keyword id="14678" type="PERSON" weightage="20" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>, <keyword id="571991" type="COMPANY" weightage="20" keywordseo="Nirav-Modi">Nirav Modi</keyword> and Mehul Choksi were able to flee India for safer havens was because the agencies or entities that caught wind of their crimes did not have the authority to prevent them from fleeing and had to follow protocols and notify higher powers with said authority. By the time formal channels of communication were activated, it was too late. This is reportedly what happened in the case of Vijay Mallya, who fled India in March 2016. The CBI actually <a href="https://www.hindustantimes.com/india/cbi-ignored-immigration-alert-on-mallya-leaving-india-on-march-2/story-hW83mkAc6qVe14VyFVOIFJ.html">watered-down the LOC</a> it had filed against the liquor baron in October 2015 from “detain” to “inform” after citing a lack of evidence and Mallya’s supposed intention to cooperate, which eventually allowed him to leave the country. The CBI had actually taken over the case from the SFIO, which had been looking into the diversion of funds at Mallya’s companies in September 2015. By broadening the number of stakeholders that can ask for the arrest of a <keyword id="2168141" type="PERSON" weightage="20" keywordseo="Wilful-defaulter">wilful defaulter</keyword>, the move could decrease the chances of this happening again in the future, especially in instances where investigations by the police and CBI are hamstrung by “conflicts of interest” or they don’t follow through with arrests. A few months ago, the central government also passed the <a href="https://www.businessinsider.in/india-takes-its-first-big-step-towards-avoiding-future-nirav-modi-vijay-mallya-like-scams/articleshow/65069668.cms">Fugitive Economic Offenders Act</a>. The law allows the Enforcement Directorate to seize the domestic as well as foreign assets of “economic offenders” who have left the country so their creditors may recover their dues. The crimes involve amounts of ₹1 billion or more. India’s corporate fraud investigation agency and the CEOs of state-owned banks can now directly prevent scamsters from leaving the country

India’s liquor baron <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword> has been in a good <a href="http://www.businessinsider.in/Govt-Rejects-Vijay-Mallya-As-Kingfisher-Airlines-Director/articleshow/45345410.cms">few controversies</a> in the recent past, and being <a href="http://www.businessinsider.in/PNB-not-the-only-bank-to-declare-me-a-defaulter-will-do-what-I-have-to-do-Mallya/articleshow/51054600.cms">declared as a wilful defaulter by Punjab National Bank</a> and <a href="http://www.businessinsider.in/United-Bank-Of-India-First-Bank-To-Declare-KFA-And-Vijay-Mallya-As-Wilful-Defaulter/articleshow/41419364.cms">United Bank of India</a> might just be one of them.

Not only an arrest, SBI also wants his passport to be impounded and a complete disclosure of his personal assets. The move has come after Mallya struck a $75-million deal with Diageo to exit United Spirits and relocate to the UK. 
 
The CBI has charged on lenders for not taking timely action against the defaulter, which helped the company "divert funds and destroy evidence". 
 "Despite our repeated requests, the banks did not file a complaint with the CBI. We had to register the case on our own." Regretting that only "one among the 17 lenders" had declared Kingfisher a "wilful defaulter", CBI Director <keyword id="235651" type="PERSON" weightage="100" keywordseo="Anil-Sinha">Anil Sinha</keyword> said.

SBI wants Vijay Mallya arrested

The Indian government has formally asked the United Kingdom to deport <a href="http://www.ndtv.com/topic/Vijay-Mallya">Vijay Mallya</a>, the former Indian liquor baron who owes state-run banks over Rs 9000 crores of unpaid loans, but <a href="http://www.businessinsider.in/A-little-too-late-Mallya-flew-out-of-India-before-banks-could-take-a-stay-order-against-him/articleshow/51323634.cms">fled to London</a> on March 2nd. 
 
The 60-year old <a href="http://www.businessinsider.in/Vijay-Mallyas-personal-Airbus-jet-to-be-auctioned-to-recover-governments-dues/articleshow/51406790.cms">businessman</a> inherited a fortune from his father at the age of 28, and took it to new heights with his vision and successful brands like Kingfisher beer. As per reports, he would also be expelled from his <a href="http://www.businessinsider.in/Vijay-Mallya-asked-for-Rs-20000/articleshow/51943521.cms">post of a Member of Parliament</a> next week, after the government cancelled his passport a few days back. 
 "As of today, the ministry has written to the High Commission of the UK in Delhi requesting the deportation of Sri <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>," Foreign Ministry spokesman Vikas Swarup said, adding that the British authorities are yet to respond.

India formally asks UK to deport Vijay Mallya

<ul><li>At the Commonwealth Summit last month, UK Prime Minister <keyword id="368666" type="PERSON" weightage="20" keywordseo="Theresa-May">Theresa May</keyword> is said to have questioned her India counterpart <keyword id="6354477" type="PERSON" weightage="20" keywordseo="Narendra-Modi">Narendra Modi</keyword> about the state of India’s <keyword id="100683" type="PERSON" weightage="20" keywordseo="Jails">jails</keyword>. </li><li>The question was in reference to the Indian government’s plan to extradite liquor baron <keyword id="14678" type="PERSON" weightage="20" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>. </li><li>Mallya is contesting the <keyword id="82903" type="ORGANIZATION" weightage="20" keywordseo="extradition">extradition</keyword> on the grounds that India’s prisons are overcrowded and unhygienic. </li></ul>Barring the obvious legal and diplomatic complications, the Indian government’s quest to extradite liquor baron Vijay Mallya from the UK has faced another roadblock. Since December 2017, Mallya’s legal team have been arguing against his extradition by citing <a href="https://timesofindia.indiatimes.com/india/indian-jails-over-crowded-with-poor-hygiene-mallyas-defence/articleshow/62074358.cms">the poor conditions of India’s jails</a>. The topic of the state of India’s jails came to the fore again this week, as reports surfaced that Theresa May, the Prime Minister of the UK, questioned her Indian counterpart Narendra Modi about the same when he visited the UK last month for the Commonwealth Summit. According <a href="https://economictimes.indiatimes.com/news/politics-and-nation/vijay-mallya-extradition-india-slams-uk-for-raising-concerns-over-state-of-indian-jails/articleshow/64362960.cms">to Sushma Swaraj,</a> India’s minister of external affairs, Modi reportedly responded by saying that these jails were the same ones where Jawaharlal Nehru and Mahatma Gandhi were held. The subtext was clear. As the struggle for India’s independence gained momentum in the early 20th century, the British had no qualms about imprisoning a number of national leaders and freedom fighters in the very same jails. Why then, should they protest against the imprisonment of a businessman who is wanted for money laundering and defrauding India’s banks of billions of rupees? A final judgement on Mallya’s extradition is expected to come <a href="https://www.hindustantimes.com/india-news/vijay-mallya-s-extradition-hearing-in-uk-court-to-test-india-s-paperwork/story-wWtRIcMjPyV8psbt7vvIBN.html">on July 11th</a>. A favourable ruling for India is contingent on providing a sufficient amount of evidence and paperwork that there is no threat to Mallya’s life in India and that a “prima facie” case, or a case with sufficient proof to merit a trial, exists in the country. The UK’s Crown Prosecution service, a public prosecutor, is representing India’s interests and is said to have handed a 2000-page dossier from the Indian government to the courts in this regard. As part of the case, the Indian government has also furnished information about the conditions of the prison cell in Mumbai’s Arthur Road jail where Mallya will be detained.

The long list of assets owned by <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>, who has been in news constantly since the past few days for <a href="http://www.businessinsider.in/A-little-too-late-Mallya-flew-out-of-India-before-banks-could-take-a-stay-order-against-him/articleshow/51323634.cms" target="_BLANK￿￿￿￿">fleeing away from the country</a> even though he owes state-run banks some 9000 crore rupees, has not been able to avoid the Indian government’s hawk eyes. 
 
Apparently, the government is all set to auction off Vijay Mallya's assets, which include his personal Airbus ACJ 319, so that his service tax dues of Rs 812 crore can be recovered. 
 
Mallya’s other assets that are about to be auctioned include five smaller ATRs and three helicopters belonging to Mallya's <a href="http://www.businessinsider.in/Govt-Rejects-Vijay-Mallya-As-Kingfisher-Airlines-Director/articleshow/45345410.cms" target="_BLANK￿￿￿￿">Kingfisher Airlines</a>.

"We are going ahead with the auction," a senior Central Board of Excise &amp; Customs (CBEC) official told ET. 
 
Even though the tax department wanted to arrest Mallya last year, it was rebuffed by a Mumbai metropolitan magistrate on the execution of a personal recognisance bond of Rs 50 lakh. Ecen then, the tax department had argued that Mallya could leave the country and had asked the court to ask him to surrender his passport, but that didn’t happen and as a result, <a href="http://www.businessinsider.in/Vijay-Mallyas-journey-from-a-businessman-to-a-fraudster/articleshow/51328653.cms" target="_BLANK￿￿￿￿">Mallya has fled the country</a>.

Vijay Mallya's personal Airbus jet to be auctioned to recover government’s dues

The Supreme Court of India has said that banks that owe more than a billion dollars to <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword> have all the rights to access details of the assets that he owns outside India. 
 
The former liquor baron of India, who fled India before banks could get a restriction order against him, had stated that since the loans that he has taken were not based on his overseas properties and investments, banks have no right seeking any information about them. 
 
As of now, the Indian government has cancelled his passport, with an arrest warrant being issued by a Mumbai court since he didn’t turn up for three meetings held with investigators in Mumbai.

SC says Vijay Mallya will have to declare all his assets to the Banks, including that of his wife’s and children’s

Indian government has tried several methods to bring loan defaulter <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword> back to India, but to no avail. This forced the <keyword id="6357808" type="ORGANIZATION" weightage="100" keywordseo="Enforcement-Directorate">Enforcement Directorate</keyword> to think of a 21-year-old treaty, called <keyword id="507869" type="ORGANIZATION" weightage="100" keywordseo="Mutual-Legal-Assistance-Treaty">Mutual Legal Assistance Treaty</keyword> (<keyword id="513083" type="UNKNOWN" weightage="100" keywordseo="MLAT">MLAT</keyword>) to bring him back. 
 
As per an ET report, ED has written to Ministry of External Affairs (MEA), asking for MLAT to be invoked, hoping that the treaty can be used to bring Mallya back. 
 
It was only a few days back that CBI has registered a fresh case against Mallya for allegedly cheating several Indian banks of Rs 6,027 crore. 
 
The 1995 MLAT allows countries to seek "transfer of persons, including persons in custody, for the purpose of assisting in investigations or giving evidence in proceedings". 
 
Here is why India is forced to use MLAT to bring Mallya back: 
 
a) Mallya cannot be deported under UK laws because under the 1971 Immigration Act, UK does not require an individual to hold a valid passport in order to remain in the country. That means, Mallya can legally stay in Britain if his passport was valid when he entered the country. He left India on March 2 and the Indian government revoked his passport only after that, which means his passport was valid when he entered the UK. 
 
b) Extradition is possible only if Mallya is recognised as a criminal by both countries. 
 
c) Mallya can challenge India's extradition move in UK courts.

MLAT, the 21-year-old treaty that could bring Vijay Mallya back to India

Over 13 banks including the <a href="http://www.businessinsider.in/searchresult.cms?query=State+Bank+of+India">State Bank of India</a> approached the <a href="http://www.businessinsider.in/searchresult.cms?query=Supreme+Court">Supreme Court</a> on Tuesday to prevent <a href="http://www.businessinsider.in/searchresult.cms?query=Vijay+Mallya">Vijay Mallya</a>, once called India’s <a href="http://www.businessinsider.in/searchresult.cms?query=Richard+Branson">Richard Branson</a>, from fleeing the country.

Troubles have only mounted for <a href="http://www.businessinsider.in/searchresult.cms?query=VIJAY+MALLYA&amp;sortorder=effectivedate">debt-laden Vijay Mallya</a>. The latest on this is that Mallya, who is a Rajya Sabha member, is likely to be expelled from the parliament too. But, his expulsion will not be the first one as 14 MPs have already been expelled from the House before.

The list of MPs expelled from the parliament includes former <a href="http://www.businessinsider.in/searchresult.cms?query=indira+gandhi&amp;sortorder=effectivedate">Prime Minister Indira Gandhi</a>, <a href="http://www.businessinsider.in/searchresult.cms?query=subramanian+swamy&amp;sortorder=effectivedate">Subramanian Swamy</a> and HG Mudgal. Mallya will be the 15th one on the list. 
 
HG Mudgal, who was a Lok Sabha member in 1951, was the first one to be expelled from the Lok Sabha over accepting money for favours in Parliament.

After hacking Twitter accounts of Rahul Gandhi and Vijay Mallya, hacker group Legion is now going to target parliament’s website. 
 
The hacker group, in an encrypted interview, told a tech news website: “Next is a dump of sansad-.nic.in emails. Which is - quite big. It includes a lot of _BIG FISH_.” 
 The <keyword id="1334314" type="UNKNOWN" weightage="20" keywordseo="Parliament-website">parliament website</keyword> has email services to government employees. Besides, in an interview with Washington Post, a Legion member claimed to have access to servers of Apollo chain of hospitals, etc. 
 
"We... ourselves have confidential data pertaining to NPCI /IDRBT (hub servers, and even have the encryption keys/ certificates used by some banks in India," Legion said. 
 
In interviews to Washington Post and Factor-Daily.com, they spoke about weak data security practices. The hacker who spoke with the Post described the group as a "bunch of computer g33kz addicted to crime and drugz". 
 
In an interview to Washington Post, Legion said their objective was to put "as much classified information out in the public domain as possible". 
 
In another interview to Factordaily-.com, a Legion member responded to a question about possibly targeting BJP, saying: "We will own them too, when the time is right." 
 
Recently, Legion hacked accounts of Vijay Mallya, Rahul Gandhi, and senior NDTV journalists Ravish Kumar and Barkha Dutt. They published 277 files purported to be documents pertaining to Vijay Mallya's personal and financial dealings. These included credit card bills and scanned copies of his passports. In the case of Dutt, they released a "partial" dump of her emails, 1.2 GB in size. When they breached Gandhi's Twitter account, they threatened to release data on Congress as well.
