The <keyword id="6360667" type="General" weightage="20" keywordseo="madras-high-court" source="Orion">Madras High Court</keyword> on Thursday stayed two sub-sections under <keyword id="10826959" type="General" weightage="20" keywordseo="IT-rules-2021" source="Orion">IT Rules 2021</keyword>'s Rule 9, which provide for a three-tier structure for addressing the grievances made in relation to publishers, under the Code of Ethics annexed to the rules. A bench of Chief Justice Sanjib Banerjee and Justice P.D. Audikesavulu passed the order on two petitions that were filed challenging the validity of the <keyword id="645424" type="General" weightage="20" keywordseo="it-rules" source="Orion">IT Rules</keyword>. Carnatic musician T.M. Krishna had filed a public interest litigation, while the Digital News Publishers Association, and journalist Mukund Padmanabhan had also filed a writ petition in the matter. "There is a substantial basis to the petitioners' assertion that there may be a violation of Article 19 (1)(a) (of the Constitution) in how the Rules may be coercively applied to intermediaries....," the court observed. Earlier, the same sub-section of Rule 9 had been stayed by the Bombay High Court on August 14. With the Supreme Court scheduled to take up transfer petitions next month, the Madras High Court posted further hearing of the case to October 27. Madras High Court stays 2 sub-sections of the new IT Rules

<keyword id="28423" type="General" weightage="80" keywordseo="vedanta" source="Orion">Vedanta</keyword> Ltd has decided to put its 4,00,000 ton per annum (tpa) <keyword id="437023" type="General" weightage="100" keywordseo="copper-smelter" source="Orion">copper smelter</keyword> plant and refining complex at <keyword id="6354388" type="General" weightage="80" keywordseo="tuticorin" source="Orion">Tuticorin</keyword> for sale. The copper smelter plant complex is known as <keyword id="1622540" type="General" weightage="50" keywordseo="sterlite-copper" source="Orion">Sterlite Copper</keyword>. The company along with Axis Capital has called for Expression of Interest (EoI) for its smelter complex (primary and secondary), sulphuric acid plant, copper refinery, continuous copper rod plant, phosphoric acid plant, effluent treatment plant, 160 MW captive power plant, reverse osmosis units, oxygen generation unit and residential complex with amenities. However, an environmental activist, who is against the Copper Smelter plant, wondered whether the company can sell the plant when a case is pending in the <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword>. The decision came as a surprise to many as the company was saying that it would reopen the plant. According to Vedanta, the plant produces about 40 per cent of the country's demand for copper and contributes about Rs 2,500 crore per annum to the exchequer and 12 per cent of Tuticorin Port's revenue. Curiously last March, Vedanta came out with an EoI about its decision to set up a 500,000 tpa copper smelter plant in a coastal region in India. The company has sought expression of interest from coastal states wishing to partner in the project that would have an investment potential of about Rs 10,000 crore through a newspaper advertisement. According to Vedanta, the proposed project would need about 1,000 acre in proximity to port along with logistics connectivity with conveyor/corridor of rail and road to handle five million tpa material movement on both in-bound and out-bound sides. The company said the project has a potential to provide direct and indirect employment to 10,000 people and will contribute about Rs 3,000 crore to the government treasury as taxes and others. Senior officials were not available to reply IANS query whether the company is exiting Tuticorin. Later in a statement, the company said India's copper requirements are set to grow exponentially in the coming years. Having ample supplies of copper is critical to ensuring successful implementation of new-gen technologies such as electric vehicles, rapid automated transport and clean energy, the company said. "We are, therefore, actively on the lookout for a suitable partner state to help take forward the vision of an Atmanirbhar Bharat and ensure that our nation enjoys unfettered access to copper, through a state-of-the-art copper manufacturing plant, the operational and environmental parameters of which are comparable to the best in the world," Vedanta said. According to Vedanta, the closure of Tuticorin copper smelter plant has had a ripple effect in terms of imports and livelihoods. "Post closure, India has become a net importer of copper for the first time in 18 years, with copper imports growing 3X while exports have plunged by 90 per cent. We are continuing to explore all legal avenues towards achieving a sustainable solution to the closure," the company had said. The <keyword id="20154" type="General" weightage="50" keywordseo="tamil-nadu" source="Orion">Tamil Nadu</keyword> government had ordered the copper smelter plant to be shut down in 2018 following a violent protest that led to the death of 13 persons in police firing. The 4,00,000 ton Sterlite Copper smelter plant that has been operating in Tuticorin for over 25 years with a cumulative investment of about Rs 3,000 crore. However, from the start, Sterlite Copper smelter plant has been facing protests by the local people alleging that it pollutes the environment. Originally, the plant was planned in Goa, but it faced severe opposition from the state's people. However, the AIADMK regime under J. Jayalalithaa gave a warm welcome to the project and allotted land at Tuticorin. Ever since then the plant was in the eye of a storm with MDMK leader Vaiko leading a protest against the project and later filing a case. The major political parties in Tamil Nadu -- AIADMK and DMK -- are against Vedanta's copper smelter plant in Tuticorin. The Supreme Court is hearing the case on an appeal filed by the company against the Madras High Court's refusal to reopen the Sterlite Copper smelter plant in Tuticorin. Reacting to the latest advertisement Fatima Babu, one of the persons who had filed a case against Sterlite Copper told IANS: "It has to be seen whether the company can sell the plant when a case is pending in the Supreme Court. There seems to be a hidden agenda in the advertisement as it makes several claims like state-of-the-art plant and others." "Our stand is clear. The copper smelter plant should not be in Tuticorin whether under the name Sterlite Copper owned by Vedanta or by any other owner," she said. She added that if Vedanta wants to set up a new copper smelter then it can do so by complying with the law anywhere else. Vedanta puts its copper smelter plant in Tuticorin on sale

<keyword id="6354742" type="General" weightage="20" keywordseo="Flipkart" source="Orion">Flipkart</keyword> co-founder <keyword id="225032" type="General" weightage="20" keywordseo="Sachin-Bansal" source="Orion">Sachin Bansal</keyword> has moved the Madras High Court challenging a show cause notice (SCN) dated July 1 this year issued by the Enforcement Directorate (ED), which held that he and another individual were personally responsible for the alleged violation of FDI policy involving a staggering amount of approximately ₹23,000 crore. Justice R Mahadevan, before whom the writ petition from Bansal came up for hearing on Friday, pulled up the authorities for the delay of 12 years in issuing the notice and adjourned the matter by three weeks, after directing the ED and its officials to file the counters. The petition sought to quash the notice as illegal and arbitrary, insofar as he is concerned. The interim prayer is to stay its operation. The SCN was issued on the basis of a complaint filed by the Deputy Director of Enforcement in Bengaluru, for instituting adjudication proceedings under Sec.16 of the Foreign Exchange Maintenance Act (FEMA) against the petitioner, another co-founder Binny Bansal of the e-commerce giant, Accel, Tiger Global, Subrata Mitra (nominee director of Accel) and Lee Fixel (nominee director of Tiger Global) on the alleged contravention of the various provisions of the FEMA. The notice was issued pursuant to an alleged non-compliance with a condition prescribed vide the Consolidated Foreign Direct Investment Policy of 2010 dated April 1, 2010 in respect of issuance of shares of certain Flipkart group companies to foreign investors during 2009-14. According to Bansal, he ceased to have any association with Flipkart and its group of companies, pursuant to his unanticipated exit following the acquisition of Flipkart by Wal-mart International Holding, Inc. on August 17, 2018. Among other things, he contended that issuance of the SCN was arbitrary, unreasonable and patently a perverse one, as it was issued after 12 years. The complaint followed an investigation by the Directorate of Enforcement in New Delhi, which commenced in 2012, i.e. 9 years ago. He had proactively participated and cooperated in the investigation undertaken by the ED. Given the substantial lapse of time following the inquiry, the petitioner has conducted himself under the bonafide belief that after due study of the materials obtained during the course of the probe, the ED had concluded that no action was warranted in the matter. And, he had effected bonafide transfers to third parties in the intervening period and had completely exited from the Flipkart group in August 2018. However, to the utter shock and dismay, the ED issued the notices, he contended. Specifically, there is no statutory period prescribed under FEMA within which the authorities concerned were required to file the complaint for initiating the adjudication proceedings. In the absence of any period of limitation under the statute, it has been settled by the <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> in various judgments that the Constitution requires every authority, including the ED, to exercise its power to file a complaint within a reasonable time, failing which the actions taken by the statutory authority will be amenable to the writ jurisdiction of constitutional courts, petitioner said.  TikTok was banned in the south Indian state of Tamil Nadu for ‘encouraging porn’ last week by the Madras High Court. The Indian high court’s <a href="https://www.businessinsider.in/tiktok-ban-in-india-for-hosting-porn/articleshow/68720430.cms">interim order</a> also included a request to the central government of India to advocate a ban nationwide. The Chinese video-based social networking app then <a href="https://www.businessinsider.in/tiktoks-appeal-against-ban-for-hosting-porn-in-indian-supreme-court/articleshow/68851962.cms">filed a petition</a> with India’s supreme court citing their concern that the ban on TikTok will “amount to curtailing the rights of the citizens of India.” They also expressed that they’re not responsible for third-party content on their platform and the Information Technology (Intermediaries Guidelines) Rules, 2011 gives TikTok conditional legal safeguards in that regard. TikTok even <a href="https://www.gadgetsnow.com/tech-news/tiktok-removes-over-6-million-videos-for-violating-community-guidelines-in-india/articleshow/68865656.cms">removed</a> 6 million videos from its service last week to address the problem of inappropriate content on the app. When the matter finally came up in front of the court on Monday, the Supreme Court <a href="https://www.livemint.com/technology/tech-news/supreme-court-refuses-to-stay-ban-on-tiktok-app-use-1555312603858.html">refused</a> to implement a stay against the Madras High Court’s ban. Abhishek Manu Singhvi, a senior advocate and law council for ByteDance, explained that the ban was causing irreparable damage to the company. He further contested that the Indian High Court in Madras had issued an interim order without giving TikTok the opportunity to defend itself. The matter will be heard on April 16 by the Madras High Court. And, the three-person Supreme Court bench headed by Chief Justice Ranjan Gogoi will hear the case on April 22 after observing the proceedings tomorrow. Madras High court just gave a rude wake up call to Tamil Nadu Chief Minister who is in denial of the state’s crippling water crisis

<a href="https://www.scmp.com/topics/india/">Indian</a> courts and political parties are calling for Chinese company ByteDance's most popular mobile app <a href="https://www.scmp.com/tech/apps-social/article/3001893/how-short-video-app-tiktok-became-first-chinese-made-app-take">TikTok</a> to be banned. On Tuesday, The Economic Times newspaper reported that India's Ministry of Electronics and Information Technology had asked Google and Apple to pull video social media platform <keyword id="6762469" type="UNKNOWN" weightage="20" keywordseo="TikTok">TikTok</keyword> from its mobile application stores. The South China Morning Post was unable to independently verify the report. The news follows an order of the <keyword id="6360667" type="UNKNOWN" weightage="20" keywordseo="madras-high-court">Madras High Court</keyword>, located in the southern state of Tamil Nadu, on April 3 that banned TikTok over concerns about children using the app being vulnerable to exploitation by sexual predators. TikTok is rated 12+ on the Apple app store and has a "teen maturity" rating on Google Play, but United States-based Common Sense Media, which reviews tech products for families, recommends that children be at least 16 years old to use the app. In February, the US Federal Trade Commission <a href="https://www.scmp.com/news/china/article/2187990/chinese-owned-video-sharing-tiktok-app-pay-us57-million-fine-settle">fined TikTok US$5.7 million</a>, the largest such sum in a child privacy case, for illegally collecting personal information from children under the age of 13. Meanwhile, the Delhi state unit of India's ruling Bharatiya Janata Party (BJP) complained to the country's Election Commission on March 29 that ByteDance, which it identified as a Chinese company, was "interfering in the Indian election process through its social media applications". The BJP cited Facebook's takedown of 11,000 advertisements from another of the company's apps - Helo - for violation of its rules concerning transparency in political spending. Helo's adverts featured doctored images of politicians accompanied by sensationalised text. In a statement, ByteDance said it was committed to respecting local laws and regulations and maintaining a safe and positive in-app experience for its users in India. ByteDance denied that its Helo platform has been sharing any political adverts, saying the company had promised India's Election Commission it would abide by the country's code of conduct. "We are not serving any paid political advertisements during this election period and are not proactively onboarding any political figures or parties on our platform." Out of all adverts generated from Helo since its launch last June, ads related to politics amounted to "less than 0.1 per cent", said the company. ByteDance is the world's largest internet start-up - valued at US$75 billion in its latest funding round, knocking US-based Uber, valued at US$72 billion, into second place. According to mobile app intelligence company Sensor Tower, 88.6 million of TikTok's 188 million new users in the first quarter of 2019 were from India - a more than eightfold year-on-year increase. By comparison, just 13.1 million new TikTok users over the same time period were based in the US. TikTok was also the third most downloaded app in the world during the first quarter of 2019. As of Tuesday, it was the second most popular free Android app in the Google Play store in India, while Helo was ranked 11th. ByteDance also offers short video product Vigo Video to Indian users. Helo, launched in June, is a social media platform created with Indian small towns and rural areas in mind - offering content in 14 languages. It is currently the subject of a legal case filed by the makers of ShareChat, which describes itself as the largest "Indian-language social media platform" and ranks seventh on Google Play store in India. "We believe Helo is a copycat app of ours," said Berges Y Malu, head of ShareChat's public policy team. ByteDance denies the allegation and the case is still being heard by the Delhi High Court. A representative for Helo said that the number of original adverts cited by the BJP in its complaint to the Election Commission that <a href="https://www.scmp.com/topics/facebook">Facebook</a> had found problematic amounted to 770, with translations across multiple languages increasing that number to 11,000. The app, which has brought entertainers, journalists and news organisations on board by providing them verified handles, has decided not to do the same for politicians and political entities. The representative said the idea was to promote entertainment-related content. Helo has not placed adverts featuring political content since the Indian electoral process began. "Out of all the ads that have been generated from Helo since we launched in June 2018, unique ads citing political mentions amount to less than 0.1 per cent. These ads were all generated prior to the declaration of general elections by the Election Commission of India and the enforcement of the Model Code of Conduct," said Helo in a statement. The first major call to ban TikTok in India was made in February by the Tamil Nadu government, citing obscenity as the reason. However, responses from politicians indicated that they were already annoyed at the political content being generated by the app's users, who had posted lip-synched videos to political speeches. "I will be the happiest if TikTok is banned. They mock someone like me most on that platform. The app may have been designed to make people happy, but it is often crossing the limits of decency," said Tamilisai Soundararajan, who heads the BJP - the party of Prime Minister <a href="https://www.scmp.com/topics/narendra-modi">Narendra Modi</a> - in Tamil Nadu state. After Tamil Nadu banned TikTok on April 3, the app's makers appealed to the Supreme Court of India, which refused to suspend the ban immediately but will hear the matter again on April 22. Meanwhile, the Madras High Court on Tuesday appointed an independent counsel to assist with the case as the app's lawyers appeared before it to appeal. The lawyers told the court that TikTok had removed 6 million videos based on a review of its Indian users; the court responded by saying that the ban will remain in place for now. In a statement, TikTok said it welcomed the decision of the Madras High Court to appoint an independent counsel. "We have faith in the Indian judicial system and we are optimistic about an outcome that would be well received by over 120 million monthly active users in India, who continue using TikTok to showcase their creativity and capture moments that matter in their everyday lives," it said. Indian politicians accuse China-made app Helo of election interference and call for TikTok to be banned

In December, India’s National Green Tribunal had allowed the reopening the plant, directing the Tamil Nadu Pollution Control Board to make it operational within <a href="https://scroll.in/latest/913653/top-news-icj-set-to-begin-hearings-in-kulbhushan-jadhav-case">three weeks</a>. In its judgment, Supreme Court said it Vedanta can now appeal the decision in the Madras High Court, saying that NGT does not have the jurisdiction to pass the order for its reopening. The Sterlite Copper plant came under the scanner last year, after violent protests broke out in Tamil Nadu’s Tuticorin against the plant’s reported adverse impact on pollution. The TNPCB had then ordered for the plant to be shut permanently, citing a provision of the <a href="https://indianexpress.com/article/india/sterlite-plant-tuticorin-vedanta-supreme-court-tamil-nadu-5588840/">Water Act, 1974</a>. In May 2018, in a police firing, 13 people were killed and now, the Supreme Court has ordered the CBI to conduct a fair and impartial investigation regarding the firing, according to ANI. India’s Supreme Court orders controversial copper smelter plant Sterlite to remain shut

While the entire world is mourning the death of <a href="http://www.businessinsider.in/searchresult.cms?query=APJ+Abdul+Kalam">APJ Abdul Kalam</a>, former Indian president, <a href="http://www.businessinsider.in/searchresult.cms?query=Madras+High+Court">Madras High Court</a> refused to close liquor shops in the state citing that it is an ‘essential commodity’. 
 As reported by Times of India, Madras HC, on Wednesday said that like fire, milk and police, liquor too is an essential commodity for around 30% people in the state, and thus, the state government can’t give orders to close the <keyword id="389603" type="COMPANY" weightage="20" keywordseo="Tamil-Nadu-State-Marketing-Corporation">Tamil Nadu State Marketing Corporation</keyword> (<keyword id="64072" type="ORGANIZATION" weightage="20" keywordseo="Tasmac">TASMAC</keyword>)-run retail<a href="http://www.businessinsider.in/searchresult.cms?query=liquor+"> liquor shops</a> on Thursday, during the <a href="http://www.businessinsider.in/Peoples-President-Dr-Kalam-laid-to-rest/articleshow/48276717.cms">funeral ceremony of former President APJ Abdul Kalam</a>. 
 
Justice C S Karnan, who has been fetching media attention for all the wrong reasons, has sparked another controversy yet again. The HC judge has said, "In five star hotels, liquor is served from 5am to 11pm. When people in five star hotels can drink, why not these people." 
The announcement came when advocate K Baalu of the Advocates Forum for Social Justice asked the court to order closure of all TASMAC shops in the state on Thursday when Kalam was scheduled to be laid to rest at Rameswaram in Ramanathapuram district. 
 
Baalu, referring to the state notification declaring a public holiday for all government and private establishments in Tamil Nadu under the provisions of the Negotiable Instruments Act on Thursday demanded a day’s leave for all the 28,000 TASMAC employees. 
 
The state council, however, had already declared a leave of two-day –July 29 and 30 - for all TASMAC employees and has informed the court about it. 
 
The judge, however, informed that he has great respect for Kalam and that he himself was leaving for Rameswaram immediately to take part in the funeral. 
 
He also said that the courts could not direct the government to close the shops across the state without hearing the top officials of the concerned department. 
 
"We have to appreciate the policy of the government in declaring holiday, and closing liquor shops for two days in Ramanathapuram district. But the court cannot interfere with the government's revenue," Justice Karnan further added.

Liquor ‘essential commodity’ for Chennai citizens, can’t close shops for Kalam’s funeral

Senior advocates Mukul Rohatgi, A.M Singhvi, and Shyam Divan, represented the gaming companies' associations, submitted before a bench of Justices S. Abdul Nazeer and V. Ramasubramanian that the issue was whether it was game of skill or chance or gambling. The Karnataka government contended that cybercrime has become a major issue and cited filing of 28,000 cases in the last three years, while emphasising the need for a law against online gaming to maintain public order. It further argued that people have died by suicide and the online gaming has ruined many families, therefore it was necessary to deal with its ill effects. The state government's plea said: "The Karnataka Police (Amendment) Act, 2021 made criminalised wagering, betting or risking money on the unknown result of an event." On February 14 this year, the high court struck down the government's ban and the legal provision which criminalised playing games of skill, including online games, and betting. The top court issued notice to online gaming industry body All India Gaming Federation and skill-based gaming firms. It directed to tag this matter with a similar matter, where the Tamil Nadu government has challenged the judgment by the Madras High Court. The Karnataka High Court had said that the Act was unconstitutional and there cannot be any ban on online games of skill. The state government contended before the apex court that the high court had grossly erred in not taking into account the material produced by it in connection with cases registered by the police authorities. SC admits Karnataka govt plea on online gaming

New Delhi, Feb 7 () The domestic production and exports of refined copper have declined since May 2018 due to the closure of copper smelter plant of Vedanta Ltd at Tuticorin in Tamil Nadu, Parliament was informed on Friday. Commerce and Industry Minister Piyush Goyal said that during April-November 2019, imports and exports of refined copper stood at 1,09,324 tonne (USD 684.02 million) and 18,300 tonnes (USD 106.35 million), respectively. "The domestic production and exports of refined copper have declined largely due to the closure, since May 2018, of the copper smelter plant of Vedanta Ltd at Tuticorin, Tamil Nadu, which has an annual production capacity of 4 lakh tonnes per annum," Goyal said in a written reply to the Rajya Sabha. He said Vedanta Ltd has filed a writ petition in February 2019 before the Madras High Court challenging the orders of the state government of Tamil Nadu and the Tamil Nadu Pollution Control Board, and the matter is sub-judice. In a separate reply, he said the Department for Promotion of Industry and Internal Trade (DPIIT) has recognised 27,916 start-ups, as on February 1 this year. "800 start-ups have been recognised in Rajasthan by the DPIIT as on February 1," he added. RR HRS
