The investigating agency further added that they have sufficient evidence to prove Senghar guilty. Unnao Case: India’s premier investigating agency finds ex-BJP MLA Kuldeep Singh Senghar guilty of rape

The Central Bureau of Investigation, on Wednesday filed a case against BJP MLA Kuldeep Singh Sengar and eight others on murder charges, alleging that the accident was planned, India Today reported. Sengar was accused of rape by the victim, a year back. The King George Medical University hospital said that the condition of the injured rape survivor is critical. Both the survivor and her lawyer are on ventilator. Both the aunts succumbed to injuries. At a hearing on Wednesday, the SC offered the rape survivor’s family to shift her to AIIMS in Delhi for treatment. Claiming to be a saint, Maharaj has 34 criminal cases against him for robbery, murder, forgery — including two accusing him of rape, reported news agency <a href="https://www.huffingtonpost.in/entry/sakshi-maharaj-unnao-bjp_in_5cc15940e4b0764d31dcb373">IANS</a> mentioning his election affidavit. Earlier this month, the self-proclaimed ‘saint’ reportedly said those who didn’t vote for him would be cursed. “A saint has come to your door. When a saint comes to beg and is not given what he asks for, he takes away all the happiness of the family and in turn curses the family...This I am not saying, but I am quoting from sacred scriptures. I am not asking for money or land. Those who do not vote for me will face divine displeasure,” the Tribune reported quoting him. Popularly known as ‘Anna,’ Samajwadi party candidate Arun Shankar Shukla has had oodles of land in Lucknow and neighbouring areas. In fact, he had been a prime suspect in a guesthouse scandal in mid-nineties, India Today <a href="https://www.indiatoday.in/election-news/story/corporate-power-takes-on-a-mafia-don-in-unnao-45661-2009-04-26">reported</a>. According to a <a href="https://indianexpress.com/article/india/india-others/top-100-hsbc-account-holders-with-indian-addresses/">leaked report</a> on money held in Swiss bank accounts, Congress candidate Annu Tondon had a staggering account value of $5,728,042 (nearly ₹400 million), as on July 2007. Crime and Politics intertwined Indian politics has had a strong intertwining with criminal charges on its potential candidates. According to the <a href="https://adrindia.org/content/lok-sabha-elections-2019-uttar-pradesh-phase-4-elections-2019-analysis-criminal-background">Association for Democratic Reforms</a>, which analysed <keyword id="456985" type="PERSON" weightage="20" keywordseo="Candidates-with-criminal-records">candidates with criminal records</keyword>, 210 candidates have been found with declared criminal cases. India’s largest constituency only has candidates with criminal past to choose from

Expelled BJP MLA <keyword id="6413701" type="PERSON" weightage="20" keywordseo="kuldeep-singh-sengar">Kuldeep Singh Sengar</keyword> has been disqualified from the membership of the Uttar Pradesh Vidhan Sabha, following his conviction in the rape case by a Delhi sessions' court in December. In a notification issued by the <keyword id="399958" type="COMPANY" weightage="20" keywordseo="UP-Vidhan-Sabha">UP Vidhan Sabha</keyword>, Sengar has been deemed disqualified with effect from December 20, 2019 and his Bangarmau seat in Unnao district has been declared vacant. <keyword id="6418920" type="PERSON" weightage="20" keywordseo="kuldeep-sengar">Kuldeep Sengar</keyword> is a four term MLA who was accused of rape by a girl from his Makhi village. The girl attempted self-immolation outside the chief minister's residence in April 2017 when the police did not take action on her complaint. The rape victim's father, who had been arrested by the police, died in custody two days later, after he was beaten up in the lock-up by Sengar's brother, <keyword id="6432581" type="PERSON" weightage="20" keywordseo="Atul-Sengar">Atul Sengar</keyword>. As public outrage erupted, Chief Minister <keyword id="43254" type="PERSON" weightage="20" keywordseo="Yogi-Adityanath">Yogi Adityanath</keyword> handed over the case to the CBI and Kuldeep Sengar, his brother Atul and others were arrested. In July 2019, the rape victim met with an serious accident in Rae Bareli. Her two female relatives died in the car crash while she and her lawyer were seriously injured. Both were airlifted to Delhi for treatment and the family alleged that Kuldeep Sengar had masterminded the accident. However, the CBI did not find any evidence of Sengar's involvement in the accident. Since the Supreme Court had ordered that all cases related to the rape case be heard in Delhi, where a sessions' court convicted Kuldeep Sengar in the rape case in December and awarded a life sentence.

Sengar loses UP Assembly membership after rape conviction

<ul><li>On Monday, during the <keyword id="120956" type="PERSON" weightage="20" keywordseo="Monsoon-Session">Monsoon Session</keyword> of <keyword id="6354721" type="ORGANIZATION" weightage="20" keywordseo="parliament">Parliament</keyword>, the Criminal Law (Amendment) Bill was passed.</li><li>Its implementation increases the maximum sentence for raping a girl under 12 years of age to a death penalty; for raping for a girl under 16 years of age to 20 years; and for raping a woman to 20 years. </li><li>While some people believe the situation is so extreme that the <keyword id="6384243" type="UNKNOWN" weightage="20" keywordseo="death-penalty">death penalty</keyword> is the only option, critics believe the law may do more harm than good. </li></ul>On Monday, the Parliament passed the Criminal Law (Amendment) Bill, replacing the Criminal Law (Amendment) Ordinance, <a href="http://www.prsindia.org/billtrack/the-criminal-law-amendment-bill-2018-5286/">increasing the minimum sentence</a> for raping a girl under 12 years to age to at least 20 years. Following which, the sentence can be increased the life imprisonment to a maximum of serving out the death penalty. The punishment for <keyword id="39493" type="ORGANIZATION" weightage="20" keywordseo="Rape">rape</keyword> has been a prominent topic of discussion since the Nirbhaya incident in 2012, and more recently in light of the Kathua and Unnao incidents. For the bill to apply, amendments have been made to the Indian Penal Code, the Criminal Procedure Code, Evidence Act and the Protection of Children from Sexual Offences Act (POCSO). Pros and cons When the ordinance was originally put in place strengthening the POCSO, the Bar Council of <keyword id="3658" type="COUNTRY" weightage="20" keywordseo="India">India</keyword> <a href="https://www.financialexpress.com/india-news/death-penalty-for-child-rape-bar-council-of-india-slams-centre-says-government-acted-in-haste/1144106/">reacted</a> by saying that such decision should not be taken in a hurry or without discussion. There are two <a href="https://timesofindia.indiatimes.com/city/bhopal/new-law-will-check-crime-experts-death-penalty-no-solution-activists/articleshow/63865086.cms">opposing</a> opinions on the matter. People in favour of the law claim that the situation in India has become so extreme that such a measure is unavoidable. On the other hand, the critics assert that increasing the punishment alone isn’t enough. They believe that provided the current laws are properly imposed and the system is made more efficient, there isn’t necessarily a requirement for the death penalty. In the larger picture, certain critics are worried that India is swimming against the trend where most countries are abolishing the death penalty. Jail time The increase in the severity of punishment when it comes to rape isn’t limited to the death penalty in the case of a minor. The minimum sentence for raping a girl under the age of 16 years has also been increased from 10 years to 20 years, which is extendable to include life imprisonment. Life imprisonment, in this case, implies that the convict will serve his or her jail term for the rest of their ‘natural life’. Also, in the case of raping or gang raping a girl under 16 years of age, there is no provision for anticipatory bail. In turn, the rape of a woman can now lead to 10 years of rigorous imprisonment, which is three years more than before. <div type="image" title="Copy of NCBC" msid="65342661" hostid="261"></div>

 Faster trials Justice isn’t justice until it is served. More than the increase in the sentences for rape, the bill also puts in place a measure to increase the speed with which rape cases are handled. First of all, the initial probe has to be completed within two months of the complaint being filed. After which there’s another deadline of two months in which the trial has to be concluded. There are another six months on the table for the disposal of appeals, after which matter should be settled. Whether or not such an amendment will have the desired effect on the level of rapes in the country is something that only time will determine. There are worries that the implementation of this law has been a ‘knee-jerk’ reaction from the government to satiate public outcry rather than bring about societal change. That being said, just this law, without programs to spread awareness and inform people of the consequences of rape, won’t do much good.
