The Securities and Exchange Commission has charged "<keyword id="372054" type="ENTERTAINMENT" weightage="60" keywordseo="Wall-Street-2">Wall Street 2</keyword>" actor Anastasios "Tommy" Belesis, who is the CEO of brokerage firm <keyword id="215723" type="COMPANY" weightage="60" keywordseo="John-Thomas-Financial">John Thomas Financial</keyword>, with fraud, <a href="http://www.sec.gov/news/press/2013/2013-46.htm">according to a release.</a>
Belesis was the managing director to Shia LeBouf's character in Oliver Stone's "Wall Street: Money Never Sleeps."
A hedge fund manager named George Jarkesy has also been charged, according to the <keyword id="6362470" type="ORGANIZATION" weightage="60" keywordseo="SEC">SEC</keyword>.

An investigation by the SEC’s Enforcement Division found that George R. Jarkesy Jr., worked closely with <keyword id="375568" type="PERSON" weightage="60" keywordseo="Thomas-Belesis">Thomas Belesis</keyword> to launch two hedge funds that raised $30 million from investors. Jarkesy and his firm John Thomas Capital Management (since renamed Patriot28 LLC) inflated valuations of the funds’ assets, causing the value of investors’ shares to be overstated and his management and incentive fees to be increased. Jarkesy, a frequent media commentator and radio talk show host, also lied to investors about the identity of the funds’ auditor and prime broker. Meanwhile, although they shared the same “John Thomas” brand name, Jarkesy’s firm and Belesis’ firm John Thomas Financial were portrayed as wholly independent. Jarkesy led investors to believe that as manager of the funds, he was solely responsible for all investment decisions. However, Belesis sometimes supplanted Jarkesy as the decision maker and directed some investments from the hedge funds into a company in which his firm was heavily invested. Belesis also bullied Jarkesy into showering excessive fees on John Thomas Financial even in instances where the firm had done virtually nothing to earn them.
“Jarkesy disregarded the basic standards to which all fund managers are held,” said Andrew M. Calamari, Director of the SEC’s New York Regional Office. “Not only did he falsify valuations and deceive investors about the value of their holdings, but he bent over backwards to enrich Belesis at the funds’ expense. Belesis in turn exploited the supposed independence of the funds to surreptitiously pull the strings on key decisions.”
According to the SEC’s order instituting administrative proceedings against Jarkesy, Belesis, and their firms, Jarkesy launched the two hedge funds in 2007 and 2009, and they were called John Thomas Bridge and Opportunity Fund LP I and John Thomas Bridge and Opportunity Fund LP II. The funds invested in three asset classes: bridge loans to start-up companies, equity investments principally in microcap companies, and life settlement policies. Jarkesy mispriced certain holdings to increase the net asset values of the funds, which were the basis for calculating the management and incentive fees that Jarkesy deducted from the funds for himself. Jarkesy also falsely claimed that prominent service providers such as KPMG and Deutsche Bank worked with the funds.
According to the SEC’s order, Jarkesy used fund assets to hire multiple stock promoters in 2010 and 2011 to create an artificial and unsustainable spike in the price of two microcap stocks in which the funds were heavily invested. As a result of these efforts, the funds recorded temporary gains in the value of the microcap stocks that Jarkesy used to mask the write-down of other more illiquid holdings of the funds.
According to the SEC’s order, Jarkesy violated his fiduciary duties to the funds in multiple instances by providing excessive compensation to Belesis and John Thomas Financial. This only incited further demands by Belesis. For example, in February 2009, Belesis angrily complained via e-mail that Jarkesy was not steering enough money to John Thomas Financial, and Jarkesy responded that “we will always try to get you as much as possible, Everytime [sic] without exception!” On another occasion, Jarkesy reassured Belesis that “[n]obody gets access to Tommy until they make us money!!!!!”
The SEC’s order charges that Jarkesy and John Thomas Capital Management violated and aided and abetted violations of Section 17(a) of the Securities Act and Section 10(b) of the Securities Exchange Act and Rule 10b-5, and violated Sections 206(1), 206(2) and 206(4) of the Investment Advisers Act and Rule 206(4)-8. The SEC’s order further charges that Belesis and John Thomas Financial aided and abetted and caused Jarkesy’s and John Thomas Capital Management’s violations of Sections 206(1), 206(2) and 206(4) of the Advisers Act and Rule 206(4)-8. The administrative proceedings will determine what, if any, remedial action is appropriate in the public interest against Jarkesy, John Thomas Capital Management, Belesis, and John Thomas Financial including disgorgement and financial penalties.
The SEC’s investigation was conducted by Igor Rozenblit, Kathy Murdocco, and Michael Osnato in the New York Regional Office. The SEC’s litigation will be led by Todd Brody. The SEC appreciates the assistance of the Financial Industry Regulatory Authority (FINRA).

'Wall Street 2' Actor Thomas Belesis Charged With Fraud By The SEC

Anastasios "Tommy" Belesis's brokerage firm <keyword id="215723" type="COMPANY" weightage="60" keywordseo="John-Thomas-Financial">John Thomas Financial</keyword> has drawn regulatory scrutiny and could face disciplinary action from <keyword id="164129" type="ORGANIZATION" weightage="60" keywordseo="FINRA">FINRA</keyword>, <a href="http://www.bloomberg.com/news/2013-02-25/red-bull-fed-brokers-stand-as-john-thomas-draws-scrutiny.html">Bloomberg News' Zeke Faux reports.</a>
<a href="http://brokercheck.finra.org/Support/ReportViewer.aspx?SearchGroup=Individual&amp;FirmKey=-1&amp;BrokerKey=2707354">FINRA records show</a> that Belesis received a Wells Notice from the self-regulatory organization in January.
<a href="http://brokercheck.finra.org/Support/ReportViewer.aspx?SearchGroup=Individual&amp;FirmKey=-1&amp;BrokerKey=2707354">FINRA claims</a> that Belesis' JTF "willfully or recklessly sold a substantial portion of a firm proprietary position while failing to execute customer orders to sell shares of the same stock, at prices that would have satisfied the unexecuted customer orders" and "used manipulative, deceptive and/or fraudulent means to artificially inflate the price of the stock," among other allegations.

Anyway, here's what <a href="http://www.bloomberg.com/news/2013-02-25/red-bull-fed-brokers-stand-as-john-thomas-draws-scrutiny.html">Bloomberg News' sources</a> said it's like to work at Belesis' John Thomas: 
John Thomas’s 40,000-square-foot offices on the 23rd floor of 14 Wall St., the pyramid-topped former headquarters of Bankers Trust, are decorated with a statue of a bull, big-screen televisions and a vending machine stocked solely with Red Bull. Some <keyword id="45476" type="PERSON" weightage="60" keywordseo="Brokers">brokers</keyword> rub the statue for luck as they walk in at 7:30 a.m., then practice their sales pitches with one another while speakers blast music from the “Rocky” movies.
Everyone wears suits. Brokers who show up with stubble are sent to the bathroom, where a bow-tied attendant dispenses razors, cologne and candy.
Belesis, bald and muscular, sometimes seeks to inspire his predominantly male staff with speeches about how they’re entering a “war zone” before the calling starts in earnest. He walks the floor, patting people on the back and calling them “buddy.” Some days, executives from small publicly traded firms pitch their stocks to the brokers.
Working from printed lists or index cards, junior brokers dial again and again as they hunt for potential customers. The senior brokers shout and talk about weight lifting, cars and watches. The junior brokers, who are told to make about 500 calls a day, don’t have computers and are required to stand. Their bosses tell them that standing makes them sound more animated, and their pitches more compelling to customers.
JTF insists that it does not have a boiler-room atmosphere.

Alternative fund manager Daniel Thibeault is facing civil charges from the SEC a month after he was arrested on charges of securities fraud, reports Mason Braswell.
The SEC's complaint "echoes many of the same allegations made by the Federal Bureau of Investigation in the criminal case and accuses Mr. Thibeault of siphoning off some $16 million in assets from the GL Beyond Income fund, of which he was portfolio manager," reports Braswell.
"Thibeault began a scheme to use the fund's money to support his faltering financial advisory businesses," the SEC said.

"Federal Street has been involved in socially responsible investing for more than 20 years; it is part of everyone's job," the chief investment officer of Federal Street said. "Molly will work with the rest of the research team to handle SRI because of the increased interest from clients."

John Thomas Financial CEO And 'Wall Street 2' Actor Tommy Belesis Has Been Barred From The Industry

Just last month, the <a href="http://www.businessinsider.com/sec-sues-belesis-fopr-alleged-fraud-2013-3">Securities and Exchange Commission sued Belesis</a> and a Houston radio host for allegedly defrauding investors. It was a different case, though.

Washington, D.C. — The Financial Industry Regulatory Authority (FINRA) announced today that it has filed a complaint against John Thomas Financial (JTF), of New York, NY, and its Chief Executive Officer, Anastasios "Tommy" Belesis, charging fraud in connection with the sale of America West Resources, Inc. (AWSR) common stock, intimidation of registered representatives, trading ahead, failing to provide best execution for customer orders and various other violations. The complaint also names Michele Misiti, Branch Office Manager; John Ward, trader; Joseph Castellano, Chief Compliance Officer; and Ronald Vincent Cantalupo, Regional Managing Director.
JTF and many of its customers owned AWSR stock as a result of participation in the company's private financings. According to the complaint, on Feb. 23, 2012, the price of AWSR common stock, which at the time was thinly traded on the OTC Bulletin Board, spiked higher, by over approximately 600 percent, opening at 28 cents per share, peaking at $1.80 per share and eventually closing the day at $1.29 per share. On the same day, JTF sold 855,000 shares, the majority of its proprietary position in AWSR, reaping proceeds of more than $1 million.
The complaint alleges that while JTF sold its shares at the height of the price spike, the firm received at least 15 customer orders to sell more than one million shares, yet only entered one of these orders for execution on Feb. 23, 2012. Instead, JTF and Belesis prevented the orders from being executed on the same day they were received and some customer orders were executed the following day or days after at prices grossly inferior to those obtained by the firm while other customer orders were not entered or executed at all. AWSR is now in bankruptcy and the customers' investments are virtually worthless.
In addition, the complaint alleges that JTF and Belesis, through Misiti and Castellano, lied to the firm's registered representatives and customers about the reasons the customer shares could not be sold on Feb. 23, 2012, including that there was a problem with the clearing firm's trading systems, there was insufficient volume on that day to fill the orders, and the shares could not be sold because they were restricted under the Securities Act of 1933.
FINRA further alleges that to conceal that the firm received the orders during the February 23 price spike but failed to execute them, JTF and Belesis, through Misiti, "lost" order tickets for customer orders received on Feb. 23, 2012, and replaced six of those tickets with falsified tickets dated Feb. 24, 2012. Belesis and Misiti also made misrepresentations to FINRA concerning Belesis' role in the misconduct.
Also, the complaint charges JTF, Belesis, Castellano and Cantalupo with violating FINRA's anti-intimidation rule by physically threatening (including threatening to have them "run over"), harassing and assaulting registered representatives who have disagreed with Belesis' business practices, and threatening to ruin the registered representatives' financial careers by improperly marking their industry records.

The gold rout continues and gold prices have fallen to $1,352 an ounce. Jim Rogers said the sell-off was being driven by falling gold demand in India, chartists, Cyprus and Bitcoins.

Finra has accused Anastasios Tommy Belesis, CEO of at John Thomas Financial, and four other employees of fraud and intimidation. Finra alleges that John Thomas Financial (JTF) sold shares of America West Resources, Inc. (AWSR) "at the height of the price spike."
