 Prasant Kanojia was arrested from his home in West Vinod Nagar in New Delhi following a complaint alleging that he tried to “malign” <keyword id="43254" type="PERSON" weightage="20" keywordseo="Yogi-Adityanath">Yogi Adityanath</keyword>’s reputation. Kanojia, who is a freelance journalist, shared a video on his twitter account of a woman who said Yogi Adityanath sent him a marriage proposal. The noida-based news channel aired a story on the same woman. The Editor Guild pointed out the FIR against Vishweshwar Bhat, editor-in-chief of the Karnataka newspaper Vishwavani who published a story on Chief Minister HD Kumaraswamy’s son Nikhil reporting that he got into a drunken altercation with his grandfather, former prime minister HD Deve Gowda. The FIR in this case too is filed as a suo motu by the policy and not by the person directly affected by the story.

Indian Editors Guild wants defamation law decriminalised, after journalist arrests

New Delhi, The <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> on Thursday stayed the Centre's notification on setting up a fact-checking unit under the <keyword id="19910339" type="General" weightage="20" keywordseo="press-information-bureau" source="keywords">Press Information Bureau</keyword> (PIB) to identify fake news about the Union government. The <keyword id="20497070" type="General" weightage="20" keywordseo="fact-check-unit" source="keywords">Fact Check Unit</keyword> was notified on March 20 under Information Technology Rules, 2021, by the Ministry of Electronics and IT. A bench headed by Chief Justice D Y Chandrachud set aside the March 11 order of the Bombay High Court which had refused to grant interim stay on setting up the FCU under the amended IT Rules to identify fake and false content on social media about the Union government. "We are of the considered view that questions before the HC deal with core questions on Article 19(1)(a) of the constitution," the bench said. "We are of the view that notification dated March 20, 2024, after rejection of application of interim relief, needs to be stayed. The challenge to the validity of 3(1)(b)(5) involves serious constitutional question and the impact of the rule on free speech and expression would need to be analysed by the high court," the bench, also comprising Justices J B Pardiwala and Manoj Misra, said. Rule 3(1)(b)(v) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 The FCU will be the nodal agency to tackle or alert about all fake news or misinformation related to the <keyword id="19910020" type="General" weightage="20" keywordseo="central-government" source="keywords">central government</keyword>. The notification came days after the Bombay High Court declined to restrain the Centre from notifying the unit. The petition was filed by stand-up comedian Kunal Kamra and the Editors Guild of India. In April last year, the <keyword id="19959928" type="General" weightage="20" keywordseo="ministry-of-electronics-and-information-technology" source="keywords">Ministry of Electronics and Information Technology</keyword> (Meity) promulgated the 2023 Rules, which further amended the Information Technology Rules, 2021. Under the new rules, if the fact check unit comes across or is informed about any posts that are "fake", "false" or contain "misleading" facts pertaining to the business of the government, it would flag it to the social media intermediaries. The online intermediaries would then have to take down such content if they wanted to retain their "safe harbour" (legal immunity against third-party content).

Supreme Court stays centre's notification setting up PIB's Fact Check Unit

Mumbai, The <keyword id="48485" type="General" weightage="20" keywordseo="bombay-high-court" source="Orion">Bombay High Court</keyword> on Friday said before it considers the effects of amended Information Technology (IT) Rules on the fundamental rights of citizens, it needs to know the boundaries and limits of three words - 'fake, false and misleading'. It asked if opinions and editorial content on any policy of the government can also be held as misleading, and sought to know if it was permissible in law for a statute to have unbound and limitless discretionary authority. A division bench of Justices Gautam Patel and Neela Gokhale said this while hearing a bunch of petitions challenging the IT Rules that empower the Centre to identify fake, false and misleading information posted on social media against the government and its business. Stand-up comedian Kunal Kamra, the Editors Guild of India and the Association of Indian Magazines filed petitions in the high court against the rules terming them as arbitrary, unconstitutional and saying that they would have a "chilling effect" on the fundamental rights of citizens. "What are the limits and boundaries of these three words - fake, false and misleading? Before we get into the effect of the Rules on fundamental rights of citizens, as claimed by the petitioners, we need to know this. If these words were capable of limits and bounds then we need not go into the effect," the court said. The bench also sought to know what is construed as government business and what is not. The court said the Rules say action would be taken when some content/ information is fake, false and misleading and some authority, in this case the Fact Checking Unit (FCU) is assuming the power to unequivocally say that the content is false or not. "Having an FCU is fine but what we are concerned about is with the authority conferred on this FCU. What we find extremely and seriously problematic is these words - fake, false and misleading," Justice Patel said. The court questioned if this would also include opinions and editorial content. "I do not know or cannot make out what the boundaries of these words are. Is it permissible in law for a statute to have unbound and limitless discretionary authority like this? What are the limits and boundaries of these words," Justice Patel said. The bench noted that as per the Rules, the FCU would be determining whether a statement or content posted is true or not. "I have a problem with this. How can someone say with finality that this is false. What is the source of this power? At most the FCU can say whether the information is credible or not. Even a civil court cannot authoritatively pronounce what is true. At the most it can make the comment on probability," Justice Patel said. The bench questioned if the opinion of a person and editorial content fall in the Rules. "For example, criticism of government figures about the country's economy. The figures may come from government sources but the analysis of the same would be different. Does that make this false, fake, and misleading information?" the court asked. "One may find an editorial hard-hitting but does that make it false, fake or misleading," Justice Patel said. The bench said it would continue hearing the matter on July 13. The Union government had earlier assured the court that it would not notify the FCU till July 10. The bench on Friday said this statement shall stand extended till July 14. On April 6 this year, the Union government promulgated certain amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including a provision for a fact-checking unit to flag fake, false or misleading online content related to the government. The three petitions sought the court to declare the amended Rules unconstitutional and direct the government to restrain from acting against any individual under the Rules.

Two women journalists, arrested by Tripura police over their writings on the recent communal incidents which allegedly created a "sense of hatred between communities", were granted bail by a magistrate's court on Monday. Samriddhi Sakunia and Swarna Jha, journalists with <keyword id="12538105" type="General" weightage="20" keywordseo="hw-news-network" source="Orion">HW News Network</keyword>, were produced before the court of Chief Judicial Magistrate (CJM) of Gomati district Shubhra Nath, who granted them bail on bail bonds of Rs 7,500. They have been asked to mark their attendance at Kakrabon police station of the district on Tuesday before leaving the state. Presenting his arguments for bail, their advocate Pijush Biswas asserted there was no evidence that they spread communal hatred. "The charges made against the journalists are completely baseless. Police filed the case with mala fide intention, he insisted. Biswas said his clients will move the Supreme Court for quashing the case. An FIR was filed against the journalists at Fatikroy police station on Sunday on a complaint by a VHP supporter alleging that they had maligned the image of the Tripura government with their reporting, according to a statement issued by their employer. The duo was detained by Assam police in Karimganj district on Sunday, when they were on way to Silchar airport, at the request of Tripura police, and kept at a government-run shelter home for women. They were arrested by Tripura police on Monday morning and produced before the CJM's court in Gomati district. A senior Tripura police official had claimed the journalists planned to fly outside the state. Officials asked them to meet some police officers before leaving. The duo then started for Silchar in Assam without informing the authorities, prompting Tripura police to request their Assam counterparts to detain them. The official said the journalists had posted on social media that a mosque was burnt in Gomati district and a copy of the Quran was damaged. Police suspect that the videos uploaded by her (Sakunia) were doctored and police want to know if the videos are fake or true by interrogating them," he added. In a tweet on November 11, Sakunia had written, #Tripuraviolence Darga Bazaar: On 19th October at around 2:30 am, some unidentified people burnt down the mosque in Darga Bazaar area. People in the neighborhood are very upset with the fact that now they don't have any place nearby to go and pray. A press release issued by the office of Tripura police chief V S Yadav had claimed that Sakunia's posts were not true and promoted a sense of hatred between communities. In this social media post, she posted a video of her visit to the half burned prayer hall damaged by mischievous fire in the house of one Rahamat Ali of Hurijala, PS Kakraban on 11/11/2021 to claim that one holy Quran was burned in the incident occurred on the night of 19/10/2021 which refers to Kakraban PS Case No. 74/2021 U/S 436 IPC. "This is contrary to the findings so far revealed in course of investigation as presence of no such damaged books/documents was brought to the notice of investigating officer and fire service staff who extinguished the fire, the police statement said. The statement added that a team of lawyers, which visited the state earlier, had made a similar claim with a questionable photograph . It added that people with vested interests were trying to flare up communal tension in the state. Tripura police had registered a case against the four Supreme Court lawyers under the stringent anti-terror law-the Unlawful Activities (prevention) Act- and various sections of IPC for allegedly promoting communal disharmony with their social media posts. On November 6, it booked 102 social media account holders under the UAPA, besides criminal conspiracy and forgery charges, and served notices to the authorities of Twitter, Facebook and YouTube to freeze their accounts and inform it about their particulars. The actions of the police establishment drew criticism from various human rights and free speech advocacy groups. After the two journalists were detained in Assam, the Editors Guild of India had condemned police action against them and demanded their immediate release.
