Under the new tariff regime which was painstakingly implemented by players in February this year, consumers could pay-per-channel, making way for more transparency in the final bill they were paying. However, this pro-consumer move resulted in confusion amongst users and even television blackouts. As a result, the number of consumer complaints shot up. TRAI had to issue a <a href="https://www.businessinsider.in/new-trai-rules-and-show-cause-notice-to-airtel/articleshow/67877793.cms">showcause</a> notice to Airtel when old channels were disconnected and new channels selected by consumers, failed to activate. Not cheap at all Consumers also complained of having to pay higher prices than before. In order to deal with the confusion, TRAI also extended the time for selection of channels for viewers under the new subscription model. The revised date for consumers stood at March 31. Earlier, all free-to-air channels were available forRs 130, and consumers needed to pay more to watch additionalchannels. Under new tariffs, consumers will pay Rs 130 asNetwork Capacity Fee charges, but will be entitled to 200channels.

Bombay High Court wants to delay new cheaper TV tariffs

The new norms that kicked in from February 1 intended to give the viewers to pay only for the channels they want to watch, and the regulator hoped that this would bring the cost down for the consumers. Indian TV viewers get more time to pick the channels they want to watch

New Delhi, Dec 9 () Sector regulator Trai on Monday released a pre-consultation paper on unbundling of different elements of telecom like infrastructure, network, services and application layers through differential licensing.
 The move came after the Telecom Department sought the regulator's recommendation on the issue.
 The concept of unbundling of layers through differential licensing is enshrined in the new telecom policy, the 'National Digital Communications Policy (NDCP), 2018', Trai noted.
 "National Digital Communications Policy (NDCP), 2018, under its 'Propel India' mission, envisages one of the strategies as 'reforming the licensing and regulatory regime to catalyse investments and innovations and promote ease of doing business'," the Telecom Regulatory Authority of India (Trai) said in a statement.
 Enabling unbundling of different layers (that is, infrastructure, network, services and application layer) through differential licensing is one of the action plans for fulfilling the strategy, Trai pointed out.
 "Through the said letter dated May 8, 2019, Department of Telecom (DoT) has...requested TRAI to furnish recommendations on enabling unbundling of different layers through differential licensing...," it said.
 As per the current licensing regime, infrastructure, network and service layers are not segregated and are part of Unified Licence.
 Market watchers said that segregation or carving out specific elements, say of network through differential licensing, would enable telcos to reduce their costs by enabling them to outsource certain parts to independent licence holders.
 Specifically, Trai has asked the stakeholders about the possible benefits and anticipated problems in having an unbundled licensing regime, and the measures that can be taken to overcome the hurdles.
 "In case it is decided to unbundle the different layers of licensing...what should be the different layers and their scope? What changes would be required in licensing regime to enable such a framework?," Trai has asked.
 It has also sought suggestions on whether there should be a new regime of licensing on which the existing licensees can migrate within a specified time frame or a parallel incentivised licensing regime for unbundled layers of licence.
 For those not in favour of unbundling of different layers of the licence, Trai has asked what changes should be made in the existing licensing regime to promote sharing to increase utilisation of the existing resources, and catalyse investments and innovation in the sector.
 It has also asked stakeholders for their views on various other reforms or changes that are required in the existing licensing regime.

Trai seeks industry's views on unbundled licensing regime in telecom

New Delhi, Feb 18 () The Telecom Regulatory Authority of India (Trai) on Tuesday proposed to do away with a fix rate of 50 paise for each SMS sent beyond a daily limit of 100 messages per SIM. In its tariff order in November 2012, Trai had notified a minimum rate of 50 paise to curb menace of pesky messages. "With the introduction of TCCCPR (Telecom Commercial Communications Customer Preference Regulations) 2018, it is felt that regulation of tariff for SMS may not be required. "Accordingly, the draft Telecommunication Tariff (65th Amendment) Order, 2020 proposes withdrawal of regulatory provisions relating to tariff for SMS introduced by the Telecommunication Tariff (54th Amendment) Order," Trai said in draft Telecommunication Tariff (65th Amendment) Order, 2020. The regulator has fixed March 3 as the deadline for stakeholder comments on the draft and March 17 for counter comments. PRS HRS

Trai proposes to withdraw 50 paise charge on SMS beyond daily limit of 100

New Delhi, Feb 12 () Telecom regulator Trai on Wednesday strongly defended its recommendations on pricing of spectrum, including 5G airwaves, saying its views had been finalised based on industry feedback, and it is for the individual stakeholders to decide whether to participate in the auction or not.Trai's views assume significance as Bharti Airtel, earlier this month, made it clear that it will not buy 5G spectrum in the upcoming auction if its base price is fixed at Rs 492 crore per megahertz as recommended by the telecom regulator. Minister of State for telecom and IT Sanjay Dhotre had informed Rajya Sabha last week that a Draft Cabinet Note has been prepared for the auction of the spectrum, and that the document is under consideration within the Department. "I don't react on decisions that individual companies take. Trai has recommended the reserve pricing after taking into account the feedback and comments from various stakeholders and has given that to the government. "The government has also apparently accepted those reserve prices and it is for the government to decide on the timing of the auction," Telecom Regulatory Authority of India (Trai) Chairman RS Sharma said.He was speaking on the sidelines of a joint workshop on 'Digital Radio Vision for India' organised by Xperi Corporation and India Cellular and Electronics Association (ICEA)."...of course while the government will decide the time of the auction, it is for the stakeholders to decide whether they want to participate in the auction or not. TRAI's new AI spam filters will provide relief from spam calls and messages

New Delhi, Feb 12 () The Competition Commission has dismissed a complaint against Vodafone Idea, Reliance Jio Infocomm, Airtel and Sify Technologies which alleged that they were charging higher rates for overseas inbound calls as compared to the ceiling fixed by telecom regulator Trai. The order came on a complaint filed by Canada-based Teleclub (Alberta Ltd), which is an international telecom carrier. The complainant alleged that the Indian telecom operators together decided to charge standard rate of 0.0053 USD for inbound calls terminating on their network in India, instead of the rates fixed by Trai. As per IUC Regulations, 2018, the telecom regulator prescribes international termination charges (ITC) of Rs 0.30 per minute for international incoming calls to wireline and wireless networks, it said. It added that the telecom operators further increased the rate of inbound calls to 0.0115 USD per minute after another meeting in February 2018. Besides, they allegedly harassed the firm by choking its ports used for sending traffic. Subsequently, the Competition Commission of India (CCI) sought the opinion of the Telecom Regulatory Authority of India (Trai) on the matter. CCI, from the submission of Trai, noted that as per Interconnection Usage Charges (IUC) Regulations, the regulator has prescribed the ITC for international incoming calls but international settlement charge (ISC) is not regulated under the norms and has to be decided based on mutual negotiations between the Indian long distance operators and foreign service providers. The complainant has "mistaken International Termination Charges i.e. ITC as International Settlement Charge i.e. ISC", CCI noted. CCI, while disposing of the complaint, said "the Commission has prima facie not found any evidence to indicate that OPs have fixed the rates through any concerted action amongst themselves, so as to warrant an investigation." CCI dismisses complaint of unfair biz practices against Voda Idea, Jio, Airtel

New Delhi, Dec 12 () Telecom sector regulator Trai on Thursday dropped broad hints that it may be open to the idea of setting a minimum tariff for calls and data to ensure viability of the sector.
Telecom Regulatory Authority of India (Trai) had, in past, vehemently opposed any intervention by the regulator in setting either cap or floor tariffs, and the U-turn in its thought process came a day after Bharti Airtel head Sunil Mittal reportedly pressed Telecom Secretary for setting a floor or minimum rate for data.
Speaking at the AVIA India Video 360 event here, Trai Chairman R S Sharma said telecom tariffs have been under forebearance for the last 16 years that have been working fine, and it now looking at renewed industry demand for fixing a floor price.
Free voice calls and dirt cheap data by billionaire Mukesh Ambani's Jio has wrecked havoc on the industry, which squeezed finances to match them.
"It is only recently that the telecom companies have together written to us that regulate us, so it's for the first time," he said. "In the past, in 2012, I remember they had opposed tooth and nail the Trai's proposal to regulate tariffs. They said tariffs must be left under forebearance."
Stating that the regulator is focussed on three overarching principles of consumer protection, fair competition and growth of the industry, he said Trai had, in the past, allowed telecom companies to decide tariffs and stepped in only when operators sought intervention from the regulator.
"But if there are certain market failures, if there are certain abberations, if one of the objectives, for example consumer protection, is not being met with, then obviously we will have to think of ways to ensure that these objectives are met with," he said.
Sharma said the telcos in 2017 had given a proposal, asking the regulator to fix a floor price, which Trai had observed to be a "bad idea".
The proposal surfaced again after the October 24 ruling of the Supreme Court that upheld the government position on including non-telecom revenues in calculating statutory dues. After the ruling, Bharti Airtel, Vodafone Idea and other telecom operators have to pay Rs 1.47 lakh crore in past dues.
Mittal met Telecom Secretary Anshu Prakash on Wednesday after which he reportedly said setting a floor for tariffs was important. The telecom czar said tariff needs to go up and industry needs to become viable.
Sharma said in 2017, the telcos were consulted and "all of them came to the conclusion that floor price is a bad idea, so regulatory intervention is not required".
"And again they have said in a couple of weeks back, so we will have to consider what to do," he said. "But what I am saying is that ideally we would not like to put any regulation, if the market is functioning in an efficient and fair manner, that is our broad principle. Looking at industry demand to fix floor price: Trai

New Delhi, Dec 26 () The Department of Telecom will soon seek sector regulator Trai's recommendations on pricing and other modalities for coveted 5G bands of 24.75-27.25 GHz, and wants to put this new spectrum up for auction sometime next year, sources said.
 This new 5G chunk is separate from the Rs 5.22 lakh crore spectrum sale plan approved by the Digital Communications Commission on December 20, under which 8,300 MHz of airwaves across 22 circles are set to be put on block in March-April 2020.
 The Department of Telecom (DoT) sources said that the government will soon approach Telecom Regulatory Authority of India (Trai) for its recommendations on 'millimeter wave bands' of 24.75-27.25 GHz, coveted bands for 5G.
 DoT plans to approach the regulator in January for views on these additional 5G bands, sources stated.
 Although DoT wants these bands to be put for sale earlier in the year, there are specific timelines involved in Trai reference and responses, they said.
 That said, DoT wants to put this additional spectrum belonging to new 5G bands for auction sometime during 2020, they noted.
 It may be recalled that industry body Cellular Operators' Association of India (COAI) has been urging the government to seek Trai's views on 26 GHz band.
 "We request an early referral from DoT to Trai to make a recommendation for including the 26 GHz band for the planned spectrum auction in conjunction with other bands as this is imperative and will have a significant bearing on realising the deployment of 5G in India," COAI Director General, Rajan Mathews had said in a year end note recently. DoT to seek Trai's views on new 5G spectrum; wants sale of additional bands in 2020

<keyword id="198636" type="PERSON" weightage="100" keywordseo="Vijay-Shekhar-Sharma">Vijay Shekhar Sharma</keyword>, the founder of Noida-based ecommerce company <keyword id="6357120" type="UNKNOWN" weightage="100" keywordseo="PayTM">Paytm</keyword> has urged <keyword id="6356988" type="PERSON" weightage="100" keywordseo="TRAI">TRAI</keyword> to not allow apps on closed communication networks or intranets. He says that doing so would prevent the misuse of a clause in the new rule barring discriminatory pricing of data services. 
 
"If a kind of content is available on the Internet, it can't be made available to a closed network at a differential price - that's the clarity we want," he told ET. 
 
Sharma has asked TRAI to be specific in its definition of "closed communication electronic network (CECN)," which can prove to be a loophole in the regulator's recent order that bans discriminatory pricing, exempting data services offered over such intranets. 
 
As of now, a closed communication network is the one that can be created without being directly connecting to the Internet. 
 Those who advocate net neutrality and free Internet are concerned that <keyword id="6383126" type="CITY" weightage="100" keywordseo="Telcos">telcos</keyword> can use this loophole to offer data services at differential rates. 
 
TRAI chairman RS Sharma is of the view that the regulation clearly says that all content that is available on the Internet falls under the new regulation, but if a content that isn't on the Web, then that content won’t be governed by the rule. 
 
Telecom companies have also asked for clarity on the clause that exempts data services offered over closed networks, so that they can be sure of no nuisances in the future.

Vijay Shekhar Sharma urges TRAI to stop apps from being allowed on closed networks

New Delhi, Jan 16 () Telcos will need to deposit unclaimed consumer money - like excess charges and security deposit, which could not be refunded -- towards 'telecom consumers education and protection fund' after a stipulated period, Trai clarified on Thursday.
"The authority observed that there is a need to bring clarity among service providers in depositing money which they are unable to refund to the consumers," Telecom Regulatory Authority of India (Trai) said.
The regulator said it was therefore felt that an amendment in the related regulations should be undertaken to remove any kind of ambiguity and facilitate deposit of any unclaimed money of the consumer.
The Telecommunication Consumers Education and Protection Fund Regulations of 2007 offers a basic framework for depositing unclaimed money of consumers by service providers, maintenance of the fund and other aspects.
The income from the fund is utilised for programmes and activities relating to consumer education and protection.
As things stand today, any excess charges revealed in the billing audit should be refunded to consumers. However, if a service provider is not able to refund the amount despite its attempt within the time period permitted by the regulations, it has to deposit the unclaimed/unrefunded amount to the fund.
Accordingly, service providers have been depositing such unclaimed amounts to the fund.
However, Trai had noticed that certain inconsistency on the grounds on which money is being deposited by operators.
"Interactions held with service providers and analysis of the amount deposited, have revealed that while some service providers are depositing money only on account of excess billing revealed in the audit, some other service providers are depositing unclaimed money such as security deposits and plan charges of failed activations which they are unable to refund to the consumers because of non-traceability of the consumers," Trai said while notifying the amendments to the said rules.
After considering the comments of the stakeholders, the regulator has now notified the fifth amendment to the regulations.
"With this amendment service provider will deposit any unclaimed consumer money of any form such as excess charges, security deposit, plan charges of failed activations, or any amount belonging to a consumer, which service providers are unable to refund to consumers, to the fund after providing time of twelve months or period of limitation specified under law whichever is later," the regulator said. Starting next month, consumers will be able to customize channels as per their choice, and pay per use. Cable TV companies in India have been asked to adhere to these regulations latest by 31 January. With the deadline approaching, the app is aimed to help viewers of cable TVs or DTH select the channels they want rather than automatically be enrolled in monthly packages that include channels people don’t want to watch. Giving viewers the choice to select their preferred channels could make their monthly bills cheaper. Calculating bills The app can be accessed through TRAI’s <a href="https://channel.trai.gov.in/">official website</a>. It will simplify information on channels and their Maximum Retail Price (MRP), and will help calculate rentals. Just like online shopping platforms, the web-based service contains filters to choose from — including price, service provider and language among others — which can help in price comparison. The application will then show up channels to select from and calculate the bill for the selected ones. It’s yet to be seen whether this revives the fortunes for cable TV channels as they compete with increasing number of digital content and video streaming services. The relaxed pricing scheme is likely to fetch more viewers for cable TVs and broadcast media, at least in the short term.
