Mumbai, A special court here on Tuesday rejected a plea moved by the Central Bureau of Investigation (<keyword id="19896633" type="General" weightage="20" keywordseo="cbi" source="keywords">CBI</keyword>) seeking a stay on the broadcast of a documentary series on <keyword id="20552870" type="General" weightage="20" keywordseo="indrani-mukerjea" source="keywords">Indrani Mukerjea</keyword>, a prime accused in the Sheena <keyword id="20659410" type="General" weightage="20" keywordseo="bora" source="keywords">Bora</keyword> murder case. CBI special judge S P Naik-Nimbalkar said the court does not have the "inherent power" to stop the broadcast, and asked the probe agency to approach an appropriate forum if advised. The judge held that the prosecution had not brought to his notice any legal provision for such directions. The docu-series, titled 'The <keyword id="20112549" type="General" weightage="20" keywordseo="indrani" source="keywords">Indrani</keyword> Mukerjea Story: The Buried Truth', delves into the disappearance of 25-year-old Bora and is scheduled to premiere on streaming platform Netflix on February 23. In its application filed through public prosecutor C J Nandode, the CBI had asked the court "to issue direction to accused and others concerned for staying/stopping the featuring of the accused persons and the persons connected with the case in the documentary by Netflix and its broadcasting on any platform till the conclusion of the ongoing trial". Bora was allegedly strangled to death in a car by Indrani, her then driver Shyamvar <keyword id="19931853" type="General" weightage="20" keywordseo="rai" source="keywords">Rai</keyword> and former husband Sanjeev Khanna in April 2012. Bora was Indrani's daughter from her previous relationship. Her body was burnt in a forest in the neighbouring Raigad district. The murder came to light in 2015, after Rai revealed about the killing following his arrest in another case. Indrani was arrested in August 2015, and granted bail in May 2022. The other accused in the case, Rai, Khanna and Peter Mukerjea, are also out on bail.

Court rejects CBI's plea to stop broadcast of docuseries on Indrani Mukerjea

Actor <keyword id="1623055" type="General" weightage="20" keywordseo="sooraj-pancholi" source="Orion">Sooraj Pancholi</keyword> shook off the controversy clouding his life and career on Friday with a special <keyword id="6354572" type="General" weightage="20" keywordseo="cbi" source="Orion">CBI</keyword> court acquitting him in the 2013 <keyword id="6356238" type="General" weightage="20" keywordseo="suicide" source="Orion">suicide</keyword> case of his girlfriend <keyword id="19566" type="General" weightage="20" keywordseo="jiah-khan" source="Orion">Jiah Khan</keyword>. Pancholi, 32, the son of actors <keyword id="966" type="General" weightage="20" keywordseo="aditya-pancholi" source="Orion">Aditya Pancholi</keyword> and Zarina Wahab, hasn't really been able to make a dent after his promising debut as the lead in the remake of "Hero" opposite Athiya Shetty in 2015. The film, which won him a Filmfare Award for best debut, was backed by Salman Khan and Subhash Ghai. It didn't do well and Pancholi's career has been moving in fits and starts since then. He has since worked in the little-known "Satellite Shankar" and "Time to Dance". Pancholi, who has also worked as assistant director on films such as Sanjay Leela Bhansali's "Guzaarish" and Salman Khan-starrer "Ek Tha Tiger", hit the headlines when he was accused of abetting Jiah Khan's suicide. He was charged on the basis of a six-page letter purportedly written by Khan, who was found hanging in her Juhu home on June 3, 2013. In an interview to PTI in 2015, Pancholi had said, "My name will always be associated with her and I have no guilt for that. I am happy that something at least stays with me. I am sad that she ended her life. But at least her name is with me and I have no problems with it." On Friday, Pancholi was there with his mother when the judge read out the verdict. Special CBI judge A S Sayyad called him to the witness box and asked his name. When the actor said Sooraj, the judge asked him to state his full name. The actor then replied, "Sooraj Aditya Pancholi." The judge then said, "Due to paucity of evidence, this court holds you (Sooraj) not guilty... acquitted." Sooraj nodded with his head down and stepped out of the witness box. He didn't speak to reporters. The three were produced before special judge S H Gwalani at the end of their earlier remand on Thursday. The CBI, represented by special public prosecutor A Limosin, did not seek their custody further. The court then sent all the three accused to judicial custody till January 10, 2023. The CBI had named the Kochhars and Dhoot, along with companies Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy Private Limited (SEPL), Videocon International Electronics Ltd (VIEL) and Videocon Industries Limited, as accused in its FIR registered in 2019 under Indian Penal Code sections related to criminal conspiracy and the Prevention of Corruption Act. The CBI has alleged that ICICI Bank had sanctioned credit facilities to the tune of Rs 3,250 crore to companies of the Videocon Group promoted by Dhoot in violation of the Banking Regulation Act, RBI guidelines, and credit policy of the bank. According to the CBI, a sanctioning committee headed by Chanda Kochhar in 2009 approved a term loan of Rs 300 crore to VIEL in contravention of the rules and policies of the bank by abusing her official position as a public servant. The day after the loan was disbursed, Dhoot transferred Rs 64 crore to NRL from VIEL through SEPL. Loan fraud case: Chanda Kochhar, Deepak Kochhar and Dhoot sent to judicial custody till Jan 10

The <keyword id="219589" type="POSITION" weightage="80" keywordseo="Special-CBI-Judge">special CBI judge</keyword> <keyword id="2055026" type="UNKNOWN" weightage="80" keywordseo="Bharat-Parashar">Bharat Parashar</keyword> has hogged the limelight after having summoned the former PM Manmohan Singh as an accused in the coal scam. 
 The Economic Times reports, the Patiala House courts additional sessions judge, later nominated by Supreme Court on recommendation of a sitting <keyword id="6355014" type="ORGANIZATION" weightage="80" keywordseo="Delhi-High-Court">Delhi High Court</keyword> judge, has taken to task various investigating agencies from time to time. Pressurizing the <keyword id="6354572" type="ORGANIZATION" weightage="80" keywordseo="CBI">CBI</keyword> for not sticking to the deadlines in the <keyword id="981763" type="UNKNOWN" weightage="80" keywordseo="Coalgate">Coalgate</keyword> scam and refusing to accept its closure reports, he has always been a taskmaster for the CBI. 
 He hit the headlines in the coal case first, when he asked the CBI point blank whether they had questioned the then PM, Manmohan Sngh, who held the coal portfolio during some of the coal block allocations, the ET has reported. All three are currently in judicial custody. Dhoot had challenged his arrest claiming it was illegal and sought immediate release from the case. His lawyer S S Ladda, along with advocate Viral Babar, argued that Dhoot was arrested only because the investigating officer came under pressure after the Kochhar couple's arrest. During the first remand hearing of the Kochhars their lawyer questioned why Dhoot had not been arrested yet, the <keyword id="6379256" type="General" weightage="50" keywordseo="videocon-group" source="Orion">Videocon group</keyword> founder's lawyer pointed out. The Kochhars were afraid that Dhoot might become an approver, advocate Ladda said. The Kocchars' lawyer made sure it was recorded in the remand order that Dhoot had not been arrested, which put pressure on the investigating officer leading to Dhoot's arrest, he claimed. Special Judge M R Purwar, however, didn't find merit in the arguments and rejected Dhoot's plea. The CBI had named Chanda Kochhar, Deepak Kochhar as well as Venugopal Dhoot along with Nupower Renewables (NRL) managed by Deepak Kochhar, Supreme Energy, Videocon International Electronics Ltd and <keyword id="744747" type="General" weightage="50" keywordseo="videocon-industries-limited" source="Orion">Videocon Industries Limited</keyword> as accused in the FIR registered in 2019 under Indian Penal Code sections related to criminal conspiracy and provisions of the <keyword id="6364753" type="General" weightage="50" keywordseo="prevention-of-corruption-act" source="Orion">Prevention of Corruption Act</keyword>. The CBI alleged that ICICI Bank sanctioned credit facilities to the tune of Rs 3,250 crore to the companies of Videocon Group in violation of the Banking Regulation Act, RBI guidelines and the credit policy of the bank. It further alleged that as a part of quid pro quo, Dhoot made an investment of Rs 64 crore in Nupower Renewables through Supreme Energy Pvt Ltd (SEPL), and transferred SEPL to Pinnacle Energy Trust managed by Deepak Kochhar through a circuitous route between 2010 and 2012. ICICI fraud: Special court rejects Dhoot's plea against arrest, Kochhars' demand for home food, bed

According to media reports, the Central Bureau of Investigation (<keyword id="6354572" type="ORGANIZATION" weightage="20" keywordseo="CBI">CBI</keyword>) has questioned former Prime Minister <keyword id="6359397" type="PERSON" weightage="20" keywordseo="Manmohan-Singh">Manmohan Singh</keyword> in a case related to the allocation of the <keyword id="1928982" type="UNKNOWN" weightage="20" keywordseo="Talabira-II-coal-block">Talabira II coal block</keyword> in Orissa to Hindalco in 2005. Manmohan Singh was in charge of the coal ministry at that time. 
 
Various media reports suggest that a team of CBI officers went to Singh’s residence and enquired him about two letters — dated May 7, 2005 and June 17, 2005 — that were sent to Singh by industrialist Kumar Mangalam Birla. In the letter, Birla had requested to allocate the coal block to Hindalco. 
 
Earlier, a special CBI court had refused to accept a closure report filed in the case. It had also asked the CBI to examine the role of the former Prime Minister. “I am of the considered opinion that before the matter is examined further as to what offence, if any, stands committed or by whom the same has been committed, it will be appropriate that the then minister of coal be first examined qua various aspects,” Special CBI Judge Bharat Parashar had said. 
 
The court had also noted that the letter written by Hindalco chief Birla “certainly raised eyebrows.” It further added that “The number of reminders which were sent by the PMO, as well as repeated telephonic requests seeking an early response from the coal ministry raises grave shadows of suspicion.” 
 
“There are certain circumstances which need to be elaborated and explained, especially regarding the manner and the circumstances under which the matter was taken up in the PMO or under what circumstances the recommendations of the 25th screening committee were set aside even though it already stood approved,” the court had said.

CBI Questions ex-PM Manmohan Singh

A special court hit out at the CBI in <keyword id="1703444" type="UNKNOWN" weightage="20" keywordseo="Jiah-Khan-suicide-case">Jiah Khan suicide case</keyword>, asking how did media get to know about parts of the chargesheet filed in the case. 
 
The court said this was "very serious" and asked the probe agency to be careful in future. 
 
Meanwhile, accused Sooraj Pancholi appeared before a Special Women's court which adjourned the matter till January 18. 
 
As he collected the copy of the chargesheet and left, Special Judge A S Shende adjourned the case observing, "How come the contents of the charge sheet is known to media even before I got to know about it." 
 
"CBI is the only source from where it got leaked. This is a very serious thing. Be careful about it in future," she warned. 
 
Meanwhile, outside the court, Jiah's mother Rabiya Khan told reporters that she was not satisfied with the charge sheet. 
 
"I am not happy with the charge sheet, there is much more to be revealed," she said. 
 
As per the chargesheet filed in a court here, it is alleged that on June 3, 2013, when Jiah was found hanging by her mother at her residence, she had left the house of Sooraj in the morning. Sooraj and Jiah had the been staying together for two days. 
 
According to CBI, Sooraj had hidden facts and fabricated information during questioning, the forensic analysis of his statements has indicated.

CBI gets rapped for leak of chargesheet details in Jiah Khan case

Three accused, who were arrested in connection with alleged corruption in supply of packaged drinking <keyword id="15300" type="ENTERTAINMENT" weightage="40" keywordseo="Water">water</keyword> in superfast trains, have now been sent to 14-day judicial custody by a Special <keyword id="6354572" type="ORGANIZATION" weightage="100" keywordseo="CBI">CBI</keyword> court today. 

	The accused were produced in the court after completion of their five-day CBI custody. 
 

	Special CBI judge Vinod Kumar remanded two senior rail officers -- Sandeep Silas and MS Chalia -- and a businessman -- Sharan Bihari Agrawal -- to judicial custody after CBI submitted that they were not required for further custodial interrogation.
 According to the probe agency, Silas and Chalia conspired with Agrawal and instead of taking <keyword id="62075" type="ORGANIZATION" weightage="100" keywordseo="Rail-Neer">Rail Neer</keyword>, they had allowed some private firms to supply water in trains which resulted in a loss of Rs 6.25 crore to the exchequer. 

	Searches were conducted in which about Rs 28 crore cash was recovered out of which around Rs four lakh was counterfeit, said CBI. 
 On Saturday, Silas, a 1984-batch Indian Railway Traffic Service(<keyword id="524330" type="ORGANIZATION" weightage="60" keywordseo="IRTS">IRTS</keyword>) officer, and Chalia of 1987 batch officer were taken into custody along with Agrawal, owner of R K Associates. The CBI has also registered case against seven private companies --- RK Associates Pvt Ltd, Satyam Caterers Pvt Ltd, Ambuj Hotel and <keyword id="6354553" type="COMPANY" weightage="40" keywordseo="real-estate">Real Estate</keyword>, PK Associates Pvt Ltd, Sunsine Pvt Ltd, Brandavan Food Product and Food World --- under the provisions of Prevention of Corruption Act.

Three accused sent to 14-day judicial custody in Rail Neer scam

NEW DELHI: Parliament on Wednesday passed the crucial <keyword id="6356353" type="UNKNOWN" weightage="100" keywordseo="lokpal">Lokpal</keyword> Bill with the <keyword id="6355187" type="ORGANIZATION" weightage="40" keywordseo="Lok-Sabha">Lok Sabha</keyword> adopting the measure as amended by the Rajya Sabha after a short discussion. Following are the salient features of the amended Lokpal Bill. 
 
1. Lokayuktas: The new bill mandates states to set up Lokayuktas within 365 days. States have the freedom to determine the nature and type of Lokayukta. 
 
The old bill said the law shall be applicable to states only if they give consent to its application. 
 
The old bill gave power to the central government to appoint state Lokayuktas while the new draft gives this power to the states. 
 
2. Constitution of Lokpal: The Lokpal will consist of a chairperson and a maximum of eight members, of which fifty percent shall be judicial members. Fifty percent members of Lokpal shall be from among SC, ST, OBCs, minorities and women. 
 The older version said the chairperson shall be the <keyword id="42759" type="POSITION" weightage="40" keywordseo="Chief-Justice">Chief Justice</keyword> of India or a present or former <keyword id="18182" type="POSITION" weightage="40" keywordseo="Judge">judge</keyword> of the <keyword id="6354977" type="ORGANIZATION" weightage="40" keywordseo="Supreme-Court">Supreme Court</keyword> or a non-judicial member with specified qualifications (chief justice or a judge of a high court). 
 
3. Selection of Lokpal: The selection committee will have <keyword id="71" type="POSITION" weightage="40" keywordseo="Prime-Minister">Prime Minister</keyword>, Lok Sabha Speaker, leader of the opposition in Lok Sabha and the Chief Justice of India. A fifth member of the selection committee for selection of Lokpal under the category of "eminent jurist" may be nominated by the <keyword id="2540" type="POSITION" weightage="40" keywordseo="President">President</keyword> on the basis of recommendation of the first four members of the selection committee. 
 
In the old bill, selection of the fifth person was left entirely to the President. 
 
4. Religious bodies and trust: The new bill includes societies and trusts that collect public money, receive <keyword id="6357455" type="EVENT" weightage="40" keywordseo="Funding">funding</keyword> from foreign sources, and have an income level above a certain threshold, it excludes bodies creating endowments for or performing religious or charitable functions. 
 
The old bill expanded definition of public servant by bringing societies and trusts which receive donations from the public (over a specified annual income) and, organisations which receive foreign donations (over Rs 10 lakh a year) within the purview of the Lokpal. 
 
5. Prosecution: In the new version, before taking a decision on filing a chargesheet in a case upon consideration of the investigation report, the Lokpal may authorise its own prosecution wing or the concerned investigating agency to initiate prosecution in special courts. 
 
Under the old bill, prosecution of the case could be done only by the prosecution wing of the Lokpal. 
 
6. Central Bureau of Investigation: For independence of the CBI, in the new bill a directorate of prosecution will be formed. Appointment of the director of prosecution will be on the recommendation of the <keyword id="403158" type="POSITION" weightage="40" keywordseo="Central-Vigilance-Commissioner">Central Vigilance Commissioner</keyword>. 
 
Transfer of officers of CBI investigating cases referred by Lokpal will be only with the approval of Lokpal who will also have superintendence over CBI in relation to Lokpal referred cases. 
 
7. Hearing: The new bill says a government servant will get a hearing before a decision is taken by the Lokpal. 
 
8. Prime Minister: The Prime Minister will be under the purview of the Lokpal with subject matter exclusions and specific process for handling complaints against the Prime Minister. 
 
9. Investigation: Inquiry has to be completed within 60 days and investigation to be completed within six months. Lokpal shall order an investigation only after hearing the public servant. 
 
Inquiry against the prime minister has to be held in-camera and approved by two-thirds of the full bench of the Lokpal. 
 
10. Penalty: False and frivolous complaints - imprisonment up to one year and a fine of up to Rs.1 lakh. Public servants - imprisonment up to seven years. Criminal misconduct and habitually abetting corruption - jail term up to 10 years.

<keyword id="44926" type="PERSON" weightage="100" keywordseo="A-Raja">A Raja</keyword> had accepted in his defence in the <keyword id="6395301" type="COMPANY" weightage="100" keywordseo="2G">2G</keyword> spectrum case that he had "actual dominion" over policy matters pertaining to allocation of 2G spectrum, CBI told a special court today Continuing the ongoing final arguments in the 2G spectrum allocation case in which Raja and 16 others are facing trial, special public prosecutor <keyword id="211437" type="PERSON" weightage="100" keywordseo="Anand-Grover">Anand Grover</keyword> said "actual dominion on policy matters vests with the <keyword id="44005" type="POSITION" weightage="100" keywordseo="Cabinet-Minister">cabinet minister</keyword>." "Minister was given the full dominion on deciding policy issues and it was said that <keyword id="116246" type="ORGANIZATION" weightage="100" keywordseo="Department-of-Telecommunications">Department of Telecommunications</keyword> (DoT) should act on any policy matter with prior approval of the minister," Grover told Special CBI Judge O P Saini while referring to a letter written by cabinet secretariat to DoT. 

	He also cited the statement given by Raja in court saying even he had "accepted" that the cabinet minister was the final authority on any policy matter. 
 

	Grover highlighted the objective of the New Telecom Policy (NTP) of 1999 and said it was envisaged by the Centre for the interest of the public at large and the interest of consumers in particular. 
 

	NTP 1999 was envisaged for enhanced competition in the sector which would have brought down services at affordable price, he said. 
 

	"Level-playing field and competition were the most important and crucial factor in NTP 1999," he said. 
 

	The arguments remained inconclusive and would continue on September 1. 
 

	Earlier, CBI had told the court that NTP 1999 sought to increase competitiveness and transparency in the sector. 
 

	It had said that NTP 1999 was brought in place of the telecom policy of 1994 to faciliate more competition and participation of private sector. 
 CBI had earlier alleged that Raja had "misled" the then Prime Minister <keyword id="6359397" type="PERSON" weightage="100" keywordseo="Manmohan-Singh">Manmohan Singh</keyword> on policy matters pertaining to 2G spectrum allocation in conspiracy with others to favour certain firms.
